RESOLUTION NO. 84
(Series of 2009)

A RESOLUTION AUTHORIZING MR. RAMON DASIG BALAGTAS, ADMINISTRATIVE OFFICER V, PUBLIC UTILITIES DEPARTMENT, TO REPRESENT THE CITY GOVERNMENT OF OLONGAPO PUBLIC UTILITIES DEPARTMENT IN THE PROSECUTION OF CRIMINAL CASES

WHEREAS, a number of cases of suspects were caught and apprehended by the Public Utilities Department involved in Blatant Violation of Republic Act. No. 7832 otherwise known as the “Electricity Anti- Pilferage Act”;

WHEREAS, under Republic Act No. 7160 (The Local Government Code Of 1991), the City is vested with corporate powers including the power to sue and be sued;

WHEREAS, with Olongapo losing millions of pesos to this kind of illegal act, the city deems it best to prosecute the offenders in court; with the recommendation of its Legal Department;

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo, with the unanimous accord of the Members of Sangguniang Panlungsod present.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes Mr. Ramon Dasig Balagtas, Administrative V, Public Utilities Department, to represent the City Government of Olongapo Public Utilities Department in the Prosecution of criminal cases before the City Prosecutor’s Office and the Trial Courts, and to appear before the same.

RESOLVED FURTHER, AS IT HEREBY FURTHER RESOLVED, that Mr. Ramon Dasig Balagtas is hereby given full power and authority to do and perform all acts and things whatsoever requisite and necessary to be done in and about the premises as fully to all intents and purpose for and in the name of the City.

RESOLVED, FINALLY, AS IT IS HEREBY FINALLY RESOLVED, that it shall be the obligation of Mr. Balagtas to furnish the Hon. Mayor and the City Legal Office with updates and pertinent reports relative thereto on a regular basis

RESOLUTION NO. 83

A RESOLUTION SUPPORTING THE PASSAGE OF SENATE BILL NO. 2317 OTHERWISE KNOWN AS “AN ACT PROHIBITING CHILD PORNOGRAPHY, IMPOSING PENALTIES FOR THE COMMISSION THEREOF AND FOR OTHER PURPOSES

WHEREAS, child pornography in the Philippines is a little known issue owing to its clandestine operations but the magnitude of its impact on children’s exploitation can be harrowing;

WHEREAS, the Optional Protocol to the UN Convention on the Rights of the Child (UN CRC) on the Sale of Children, Child Prostitution and Child Pornography, defines child pornography as “..any representation, by whatever means, of a child engaged in real or simulated explicit sexual activities or any representation of the sexual parts of a child for primarily sexual purposes.” The Philippines being a State Party to both the UN CRC and aforesaid Optional Protocol is duty-bound to undertake all necessary measures to protect children from such life-threatening risk and degradation;

WHEREAS, pornographic exploitation of children is growing at an extremely alarming rate given the backdrop of poverty, sex trade and sex tourism, trafficking, and especially with evolving advanced technology and globalization. Recorded cases in the Philippines show children ages 12 to 17 are common prey. However, some reports involve victims even younger than age five;

WHEREAS, prostituted children, usually girls, become readily accessible subjects of pornographers. With the number of child sex workers placed between 40,000-100,000 (IBC Country Profile in the Philippines, undated) one can only be appalled at the enormity of exploitation these children suffer;

WHEREAS, large scale sex rings of pedophiles rake in profits from the violation of children captured in video and sold in a lucrative business of pirated VCDs and DVDs. Young girls and boys are made to do unimaginable things in cybersex dens. Mobile phones and digital cameras, like the internet, facilitate speedy production, possession and distribution of pornographic photos and videos;

WHEREAS, poverty acts as a major push factor for children being caught in the web of child pornography especially those belonging to low income and extremely disadvantaged families. Street children particularly those plying the red light districts or notorious beach fronts are highly at risk;

WHEREAS, child pornography serves as a permanent testament to the sexual abuse of a child. It places the child in a hideous cycle of victimization and to far-reaching negative psychological effects;

WHEREAS, the rampant problem in child pornography renders Republic Act 7610 insufficient and inefficient to protect and guard the children from such a terrible crime;

WHEREAS, the stand of Senate Bill No. 2317, known as the “Anti-Child Pornography Act of 2009,” prepared jointly by the Committees on Youth, Women and Family Relations and Justice and Human Rights with Senators Madrigal, Escudero, Zubiri, Lapid, Revilla, Legarda and Gordon as authors thereof, is to strengthen the measures against pornography, involving children by defining the crime in a larger scope and imposing severe penalties;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to support, as it hereby supports the passage of Senate Bill No. 2317 otherwise known as, “An act prohibiting child pornography, imposing penalties for the commission thereof and for other purposes.

A RESOLUTION APPROVING THE APPLICATION OF DIGITEL TELECOMMUNICATIONS, INC. (SUN CELLULAR) FOR THE INSTALLATION AND OPERATION OF CELLSITE/GSM ANTENNA AT BARANGAY EAST TAPINAC, OLONGAPO CITY

WHEREAS, Digitel Mobile Philippines, Inc. (DIGITEL) a corporation duly organized and existing under Philippine Laws, with principal office located at 40th Floor, Robinsons Equitable Tower ADB Avenue corner Poveda Street Ortigas Center, Pasig City thru their official Site Acquisition Contractor Partners in Managing Macro Advance Technologies, Inc. (PMMAT) applied for a permit to allow the construction, installation and operation of a 9-meter BI-POD Digitel Cellular Antenna located at ARPN AB-00003-03101, 1190 Rizal Avenue, East Tapinac, Olongapo City;

WHEREAS, with Digitel’s well-known capability of providing world-class telecommunication system that produces seamless cellular coverage and accessibility, residents and subscribers of Digitel Telecom / Sun Cellular in the City and adjoining areas will be assured of uninterrupted link to personal and business communications;

WHEREAS, the Olongapo Telecom and IT Board was created under City Ordinance No. 24, Series of 2004 and Executive Order No. 84-A, Series of 2005 where its duties and functions to implement Guidelines, Rules and Regulations are defined under Sangguniang Panlungsod Resolution No. 13, Series of 2005;

WHEREAS, PMMAT had presented to the Olongapo Telecom and IT Board the necessary documents that warrant the approval of the Board for them to proceed with their application and had accomplished other pertinent requirements for the approval of the same;

WHEREAS, Barangay East Tapinac, after public consultation and submission of signed neighbors’ consent, passed Resolution 7, Series of 2009, giving clearance to the said project and placed on record that no objection had been noted for the said construction;

WHEREAS, DIGITEL acknowledges its obligation to settle real property taxes of its existing assets in Olongapo City and assured that its contractor have local Mayor's Permit prior to the start of construction;

WHEREAS, additional implements being installed into the tower, such as but not limited to antenna, satellite or parabolic disc or any device used to transmit or receive for purpose of voice or data especially those that are from other service provider and thus, will be doing so for a fee is not covered by this resolution and therefore, must have prior permission from the city;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod
in session assembled, to approve as it hereby approves the application of Digitel Telecommunications, Inc. (Sun Cellular) for the installation and operation of Cellsite/GSM antenna at Barangay East Tapinac,Olongapo City;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Barangay East Tapinac Resolution No. 7, Series of 2009 and a copy of the signed neighbors’ consent as well as other pertinent documents such as declaration of Real Properties shall be made as integral parts of this Resolution.

Let copies of this Resolution be furnished the Partners in Managing Macro Advance Technologies, Inc., Digitel Telecommunications, Inc. (DIGITEL), Olongapo City Telecom and IT Board, Barangay East Tapinac and the National Telecommunications Commission for their information and record.
