12. Letter from Councilor Marey Beth D. Marzan addressed to yours truly, Secretary of the Council, regarding the copy of the decision of the Sandiganbayan and may I read the whole letter:

September 3, 2007

Ms. Elflida Salmon,
Council Secretary

Dear Ms. Salmon,

Seven years has past when this horrific Criminal Case No. 26174 for violation of Sec. 3 (e) of Republic Act 3019 graft and corrupt practices was first filed against one of Olongapo City Most Trusted Public Servant (27 years in service and counting) by some people who are up to fame and power. It cost severe moral damage to the accused not to include the hassle and financial glitch that she went thru in the process. But indeed the truth will prevail.

And so, the long wait is over. Truly God is so powerful… Attached here a copy of the final decision of the Sandiganbayan stating that Hon. Cynthia G. Cajudo is acquitted from such criminal violation.

Therefore, now is the time to reinforce trust, cooperation, and the clean political reputation which was temporarily tarnished thereby causing perplexity to the people of Olongapo that she served most of her life.

With this copy of the decision of the Sandiganbayan be forwarded to the Council documents custodian for future reference and proper custody. Furthermore the Secretariat should cause the circulation of the attached documents to our local newspaper. And please allow this letter to be read during Sangguniang Panlungsod Session.

13. Letter from the Philippine Dental Association, Olongapo City Dental Society asking a short message from the Vice Mayor that would be included in their souvenir program. This is relation to the Olongapo City Dental Society’s hosting the 30th PDA Central Luzon Regional Dental Conference on November 2007 at the Olongapo City Convention Center.

14. Invitation letter from Dr. Richard S. Custodio, First VitaPlus Product Consultant, UP – Philippine General Hospital Chapter addressed to the Vice Mayor to be a special guest in the grand opening of the FIRST VITAPLUS AND PRODUCT CENTER on September 9, 2007.

15. Communication from Mr. Magrata addressed to all Members of this Council informing that the officials from Asian Urban Information Center of Kobe (AUICK) will have their monitoring visit in the City of Olongapo on 13 – 14 September, 2007 and there are three representatives coming. In line with the monitoring, a consultation meeting will be held between the city officials and AUICK representatives on 13 September 2007, 9:00 a.m. to be held at the FMA Hall. Ms. Miriam Siscar – Blat of the UNFPA, together with selected City Department Heads will be attending and Mr. Magrata is requesting that the Members of this body to attend and participate in the consultation meeting.

16. Copy of a letter from Mr. Mario Carreon, Chairman, District Convention 2007 of Subic 32nd Kiwanis Philippine Luzon District Convention on September 6 – 9, Legenda Hotel, SBMA, Olongapo City. The theme is “MAKE IT HAPPEN…” and the response to Kiwanis International’s theme “ONE CAN MAKE A DIFFERENCE”. On September 6, 2007 at 9 o’ clock in the morning, a motorcade within the SBMA to the Mayor's Office with foreign dignitaries and the Philippine Luzon District’s Board of Trustees will come to see the Mayor for a courtesy call. They are also inviting Mayor James Gordon, Jr. in the Opening Ceremonies to welcome the delegates, guests and friends at 7:00 p.m. of the same day.

17. Committee report on Cooperative Technical and Management Training submitted by Councilor Dabu.


Committee Reports

Councilor Perez first reported on the Tourism Awareness Seminar and Strategic Planning conducted on August 30, 2007 at the Olongapo City Convention Center Function Room. It was attended by 80 tourism stakeholders. The invited speakers were Dir. Ronnie P. Tiotuico of DOT Region III and Mr. Nilo Agustin. The two discussed the following for the morning session: The Tourism Situationer, which gave an update of the International and Local Tourism; the Planning of Eco-Tourism Products; and Overview of Tourism in Central Luzon.

In the open forum, right after the discussion, issues raised were the increasing number of side-walk vendors which were already affecting the market of the mall and public market tenants. The huge amount of garbage in our rivers and the role of the hotels and restaurants in local tourism were also raised.

The Councilor, likewise, reported the activities done in the afternoon where the participants were grouped into three: the Planning group, the Marketing group and the Standard/Accreditation group. Led by the guest speaker, Mr. Agustin, the activity sought the products that the city can be known for in three periods for immediate, short term and long term. After relaying to the body what the seminar was about, she thanked all those who attended who made the endeavor a success.

For the second report, Councilor Perez informed the body that the Clean Up Drive is scheduled on September 22 while the Tourism Summit is set in September 25.

Regarding the Philippine Councilors League-Olongapo, the Councilor requested all the Council Members that they may already submit their PCL Membership forms duly filed-out on or before September 6, 2007, Thursday, so that they can be submitted to the Head Office on Friday. She reminded the body that her office provided each of the Councilor a copy the following documents: the PCL Membership Application Form and Personal Data Sheet; the PCL ID Information Sheet; Memorandum Circular No. 2007 – 78 and 79; PCL Policy No. 98-15 for the election guidelines; and the PCL Constitution and By-Laws.

Lastly, Councilor Perez informed the body that the memorandum requesting the participation of the Councilors in the student consultation set on Sept. 13 from 9:00 am-12:00 nn at the Olongapo City Convention Center in celebration of the PCL week was moved to September 20, same time and venue. This was due to the DILG invitation to attend the General Orientation Program in September 12-14 at Clarkfield, Pampanga.

The Presiding Officer said that the Council regular session was reset on Tuesday in lieu of the mentioned DILG seminar at Clark.

Councilor Ellen Dabu, Chairman of the Committee on Livelihood reported her Committee’s undertakings.

First, the Councilor said that the Barangay Livelihood Consultation Program was held on September 3, 2007 at Barangay East Bajac-Bajac. Present were the Barangay Capt., Brgy Councilmen and Barangay East Bajac-Bajac residents. The creation of a small cooperative to help in the livelihood projects of the barangay was discussed. She added that the “Samahan ng Kababaihan of Barangay East Bajac-Bajac which she organized will conduct a Pre-Membership Education Seminar.

Second, the Councilor enumerated the plans and actions for 2007 of the Olongapo City Cooperative Development Council for which she is the Chairman. Activities for the Technical and Management Training for small and new cooperatives include:

a. Leadership / Trainers Training
b. Practical Cooperative Accounting and Bookkeeping.
c. Capability Team – Building for the Cooperative
d. Training / Workshop or saving mobilization and capital build up.
e. Training / Workshop of Pre – Membership Education Seminar.
f. Cooperative Market Training
g. Cooperative Risk Management Training
h. Conference / Workshop on the Strengthening of Cooperative Banks.

Councilor Dabu explained that the Olongapo City Cooperative Development Council shall serve as a referral body which shall endorse interested cooperatives to credible offices, institutions or agencies that offer cooperative technical and management trainings free of charge or low fees. It will also initiate an assistance to federate non-agri/non-transport multi-purpose cooperative by providing information to assist and facilitate research, business and sourcing endeavors of various cooperatives.

Lastly, Councilor Dabu mentioned that on Sept. 7, 2007, she, together with the Brgy. Capt of Brgy. Pag-asa, Asinan and East Bajac-Bajac will meet with the management of Subic Bay Industrial Park and with Administrator Arreza regarding the scrap items that the Subic Bay Industrial Park factories may donate for the livelihood projects.

Councilor Marzan, for her Committee gave an explanation to the letter/inquiry of Brgy Kagawad Lydia Demorse dated Aug. 15 referred to her by the Presiding Officer.

According to her, the question on hand is whether the stated part of Resolution No. 7, 2007 of Brgy Barretto regarding the “securing of permit and license by whoever will be awarded the right to operate, is in conflict with Section 391, Paragraph II of the Local Government Code which states the barangay powers, duties and functions. Councilor Marzan said that the permit referred to in the said barangay resolution pertains to section 3 of City Ordinance No. 49, Series of 2005 which states that the owners/operators of carnivals or mini-fairs must secure business permit from the City.

In Section 391, Paragraph 11, it was stated that the Sangguniang Barangay, as a legislative body, may hold fund-raising activities without securing permit. The Councilor further explained that what was mentioned in Resolution No. 7, Series of 2007 of Brgy. Barretto was the business permit/license to operate to be secured by the private entity awarded to operate the mini-fair, which is different from the permit to hold a fund-raising activity in Paragraph 11, Section 391 of the Local Government Code. Thus, she concluded that the said barangay resolution is not in conflict with the provisions of the Local Government Code, and it conforms with the provisions of City Ordinance No. 49, Series of 2005.

The next topic was not a committee report but a suggestion given by Councilor Piano regarding the offer of the publisher of Ozisero for the Council to avail of its subscription. He suggested that the Council subscribe for each Councilor, totaling 12, and another for routing to the staff and for filing of local news.

The Presiding Officer was amenable to it but recommended to determine if there is a budget for it and then afterwards, they may pass a resolution.

There being no other committee report, the Presiding Officer apprised the body of her activities. First, she said that she was invited by the PMMA (Philippine Merchant Marine Academy) to represent the city to their program to honor Governor Amor Deloso. She added that she was fortunate to have attended the said program because she was able to greet the governor for his birthday which is the following day.

Second, the Presiding Officer mentioned that she was able to watch the Silent Drill.

Third, she was able to see the so called “Simulator” and she got to experience how it works. High technology computers from Germany set with computer programs are installed in a big building like a program on how ships are being run, how it actually feels when you are in it can be experienced in the “Simulator”. She told the body that they may ask the host to invite them again if they are interested.

Lastly, the Presiding Officer said that, that afternoon she greeted the Mayor and delegation of the Province of Leyte, City of Baybay.

Third Reading:

1. On motion of Councilor Marzan “An Ordinance Withdrawing Portions (As Described In The Attached Site Development Plan) Of The Left And Right Wing Side Of The Volunteers Park From Public Use And Declaring Them As Patrimonial Property Of The City”, was approved on its third reading.

Second Reading:

1. Draft Resolution No. 2007 – R-53 - A Resolution Adopting Gordon College, Board Of Trustees (BOT) Resolution Nos. 27,28,29,30 & 31 Series Of 2007, was deferred on motion of Councilor Marzan.


2. Draft Resolution No. 2007 – R-54 – A Resolution Converting Transcon Area As Multi-Purpose Complex. Sponsored by Councilor Edwin J. Piano. The proponent moved for an amendment on the title to read, “A Resolution Converting Transcon Area Into A Multi-Purpose Complex, which was approved by the body. On motion of Councilor Piano the said Resolution was approved unanimously on second and final reading.

3. Draft Ordinance No. 2007 – O-22 – An Ordinance Providing For The Olongapo City 2007 Revenue Code, Councilor Piano manifested to amend the title to “An Ordinance Repealing The Olongapo City 2002 Revenue Code and Providing for the Olongapo City 2007 Revenue Code and approved by the body. Since this measure will have to undergo public hearings, Draft Ordinance No. 2007-O-22 was deferred, on motion of Councilor Piano.

4. On motion of Councilor Dabu, Draft Resolution No. 2007 – R-55 – A Resolution Urging The Barangay Councils Of The Different Barangays In Olongapo City To Allocate Funds From Their Budgets Solely For The Implementation Of Livelihood Program, was approved unanimously on its second and final reading.

5. Draft Resolution No. 2007 – R-56 – A Resolution Encouraging All Sectors, Public And Private, Academic Institutions, Non-Governmental Organizations (NGOs), Professional Organizations, Police Force And All Barangays To Participate In The Citywide Clean-Up On September 22, 2007 In Line With The Celebration Of World Tourism Day 2007, was approved unanimously on its second and final reading.

6. Draft Ordinance No. 2007 – O-19 – An Ordinance Providing For Annual Physical And Dental Check-Up Of Olongapo City Government Employees, was deferred on motion of Councilor Piano.

7. Draft Resolution No. 2007 – R-51 – A Resolution Authorizing The City Mayor James Gordon, Jr. To Enter Into Memorandum Of Agreement With BSP-James L. Gordon Council Represented By Dr. Ligaya B. Monato, For The Perpetual Use Of A Parcel Of Land Located At The South-West End Of Tapinac Elementary School, For James L. Gordon Council-BSP Headquarters. The sponsor Councilor Edwin J. Piano proposed to remove the word “Perpetual” in the title and to specify in the text of the resolution that the land use shall be 15 years. With no other observation on the amendments, the motion was approved. However, on motion of Councilor Piano, the said resolution was deferred for review of the Legal Department.

8. On motion of Councilor Dabu, Draft Ordinance No. 2007 – O-20 – An Ordinance Creating The Cooperative Development Council, Pursuant To Article 2 Of The Cooperative Code Of The Philippines And Executive Order No. 95, Series Of 1993, And Adopting The Guidelines Thereof For Its Formation Under The Aegis Of The Cooperative Development Authority, was approved unanimously on its second and final reading.

9. Draft Ordinance No. 2007 – O-21 - An Ordinance Appropriating The Amount Of One Million Seven Hundred Fifty Seven Thousand Eight Hundred Eighty Pesos (PhP1,757,880.00) For The Improvement Of PUD Computerized System To Be Taken From The Unappropriated Balance Of The General Fund (2007 IRA Adjustment), was approved by majority vote with eight (8) members in favor, one (1) opposed and one (1) out during votation, on its second and final reading, upon motion of Councilor Edwin Piano.

A RESOLUTION EXPRESSING SORROW OVER THE PASSING AWAY OF FORMER COUNCILOR, ARCHITECT JESSE A. MACKAY AND CONDOLING WITH HIS BEREAVED FAMILY


WHEREAS, Architect Jesse A. Mackay, former Councilor of Olongapo from 1961-1963, peacefully joined his Creator on September 3, 2007 at the age of 78;

WHEREAS, the late Architect Mackay, invested the best years of his life not only as a public servant and master architect, but as an educator enriching the groves of the academe with his teaching prowess, skillful review and wealth of experiences. As the former Vice-President of the Council of Heads and Deans of Architectural Schools in the country, Scribe of the College of Fellows, United Architects of the Philippines, and a classroom professor, many of the prolific architects and engineers of our time went through his direct tutelage, critical consultation and liege review;

WHEREAS, the former councilor served as Technical Assistant on Townsite Development and Public Utilities of Olongapo, as a municipality then, co-founded the Chamber of Real Estates and Builders Associations, Incorporated (CREBA), Olongapo City Chapter and Chairman of the Task Force on Housing and City Development Council, from which the City derived and referred its numerous infrastructure developments;

WHEREAS, fondly called “Jess”, Mr. Mackay was a Boy Scouts Chairman, a Methodist Lay Leader, a Mason, a Lion, a DeMolay Adviser, a PTA President and City Fiesta Chairman and earned the confidence of many organizations because of his leadership capabilities and made him garner numerous awards and citations here and abroad. These attested not only of his civic and fraternal involvements but his commitments to their causes as well;


WHEREAS, he did not only design and build sturdy homes and edifices that withstood the devastating forces of nature, but he also laid down the strongest foundation for his family to stand to. He inculcated in his children trust in biblical principles, involvement in socio-civic organizations, love for music and arts, focus to the unequivocal returns of good education and personal aptness which constitute the bedrock and essence of the father that he was;

WHEREAS, the advance of age did not stop him from learning and upgrading his God-given craft. He honed them as a mentor sharpening his tools for the benefit of his students;

WHEREAS, the City Government and the people of Olongapo pay its last respects to Architect Mackay, recognizing his outstanding contributions etched in the City’s history of development and join the Mackay Family in this moment of grief;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to express, as it hereby expresses sorrow over the passing away of former Councilor, Architect Jesse A. Mackay and condoling with his bereaved family.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY PAG-ASA, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2007

On motion of Councilor Edwin J. Piano, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Pag-asa , City of Olongapo for the Calendar Year 2007 considering that the budget as contained in Barangay Resolution No. 40 , Series of 2006 and Barangay Ordinance No. 01, Series of 2006 of Barangay Pag-asa dated 25 November 2006 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:


In the event the Calendar Year 2007 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as un-utilized appropriation.

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Development Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management (DBM) dated 13 March 2000, implementing Executive Order No. 189 dated 21 December 1999.


That the 5% Calamity Funds shall be utilized solely for relief, rehabilitation, reconstruction and other works and services in connection with calamities and which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determine and declared by the Sangguniang Barangay concerned.

Pursuant to Local Budget Circular No. 63 of the Department of Budget and Management (DBM) dated 22 October 1996, barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; The honorarium rates of said barangay officials may be adjusted in accordance with Local Budget Circular No. 86 of the Department of Budget & Management dated 18 July 2007; However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belong:

SG-14 For the Punong Barangays
SG-10 For the Sanggunianng Barangay Members, Barangay Secretary and Barangay Treasurer.

In the event that barangay funds will not be sufficient to implement maximum honorarium/salary rates as prescribed, increase in the same shall be made proportionately and uniform to all positions in the barangay concerned as provided in herein sample matrix:

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed pursuant to the Local Budget Circular No. 63 of the Department of Budget Management dated 22 October 1999.

And finally, the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied. PROVIDED, that the City Accountant is enjoined to observe the above conditions.

WHEREAS, as one of the projects of the tourism in Olongapo, in line with the celebration of the World Tourism Day, the citywide clean-up is a social activity that would benefit both the tourism industry and the environment through local campaign of World Tourism and cleanliness drive;

WHEREAS, all sectors, public and private, including academic institutions, non-governmental organizations (NGOs), professional organizations, police force and all barangays, are encouraged to participate to this monumental activity being the Tourism Industry Stakeholders;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of Sangguniang Panlungsod present;

A RESOLUTION URGING THE BARANGAY COUNCILS OF DIFFERENT BARANGAYS IN OLONGAPO CITY TO ALLOCATE FUNDS FROM THEIR BUDGETS SOLELY FOR THE IMPLEMENTATION OF LIVELIHOOD PROGRAMS

WHEREAS, the City recognizes the power of livelihood programs and business opportunities together in pump-priming the flow of economic wealth in the City;

WHEREAS, the integration of livelihood and business implemented at the barangay level will not only uplift the economic condition of financially-marginalized Olongapo residents but will energize the spirit of cooperation within the barangay;

WHEREAS, the allocation of funds from the barangay budget solely for this purpose is deemed to be complementary to the efforts of the City in equipping the barangay units arm their people with livelihood skill, entrepreneurial spirit and self-reliance;

WHEREAS, by virtue of Ordinance No. 50, Series of 2005, the City established the City Livelihood and Cooperative Office and had approved recently the creation of a cooperative development council to assist the executive branch in bringing this thrust down to the barangay level, to support and provide services towards the wider opportunities of livelihood development, an endeavor the barangay should not miss;

NOW, THEREFORE, on motion of Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present :

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges the Barangay Councils of different barangays in Olongapo City to allocate funds from their budgets solely for the implementation of livelihood programs.

WHEREAS, the City government acquired the subject parcel of land containing an area of Six Thousand Five Hundred Twenty Four Square Meter (6,524 sq.m.) located at Barangay Old Cabalan, Olongapo City thru a Deed of Conditional Sale with National Development Company executed on December 20, 2002;

WHEREAS, the right of ownership and possession of the said properties was acquired by National Development Company by virtue of Deed of Assignment executed with Transport Contractors, Inc. (TRANSCON) dated 27 December 1984;

WHEREAS, the said parcel of land (TRANSCON) was intended to be used as Engineering Equipment Motorpool site, however there are sufficient idle space that can be utilized for other valuable purposes;

WHEREAS, the subject parcel of land may be better utilized for the physical, mental and emotional development of Olongapeños engaged or interested in different sports, hobbies, athletics, games and activities such as, but not limited to, boxing, karate, calisthenics, mixed martial arts and the like;

WHEREAS, aside from being a venue for Olongapenos to display their wares and the development of such, the said parcel of land may be utilized as a revenue-generating property of the City Government;

WHEREAS, infrastructure, buildings, business ventures (public or private in nature) that will be put-up in the area still requires city council’s approval;

WHEREAS in case buildings and structures will be put up in the said area, cost estimates, designs and appropriations will be subject to approval of the Sangguniang Panlungsod;

NOW THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;


RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to convert as it hereby converts, TRANSCON area into a Multi-Purpose Complex.

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Million Seven Hundred Fifty Seven Thousand Eight Hundred Eighty Pesos (Php1, 757,880) is hereby appropriated from the Unappropriated Balance of the General Fund (IRA adjustment) not otherwise appropriated and the same is hereby made available for the improvement of PUD Computerized System.

SECTION 2. This Ordinance shall be subject to the usual procurement, accounting and auditing rules and regulations.

AN ORDINANCE CREATING THE COOPERATIVE DEVELOPMENT COUNCIL (CDC) PURSUANT TO ARTICLE 2 OF THE COOPERATIVE CODE OF THE PHILIPPINES AND EXECUTIVE ORDER NO. 95, SERIES OF 1993, AND ADOPTING THE GUIDELINES THEREOF FOR ITS INFORMATION UNDER THE AEGIS OF THE COOPERATIVE DEVELOPMENT AUTHORITY

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. There is hereby created the Olongapo City Cooperative Development Councilor which shall spearheaded the vision and mission of the Cooperative Code of the Philippines pursuant to Article 2 of the same and Executive Order No 95, Series of 1993.

SECTION 2. The said council also adopts the guidelines of its formation under the aegis of the Cooperative Development Authority hereto attached as an integral part of this ordinance.

SECTION 3. The council shall submit an annual report each year to the Sangguniang Panlungsod and to the Office of the City Mayor for evaluation.

SECTION 4. The Ordinance shall take effect upon its approval.

COA asks 6 Manila dads to return allowances

‘No legal basis for getting P1.6M each’

MANILA, Philippines – Six Manila councilors have yet to return nearly P10 million to the city government’s coffers despite the Commission on Audit’s finding that there was “no legal basis” for them to receive a “monetary reward” for serving for three consecutive terms.

The six were identified as incumbent Councilors Luciano “Lou” Veloso, Jocelyn Dawis-Asuncion, Marlon Lacson and Monina “Pipay” Silva who received the money on behalf of her late husband, former Councilor Hilarion “Pipoy” Silva. The other two were former councilors Abraham Cabochan and Julio Logarta Jr. All six served in the city council for three consecutive terms from 1995 to 2004.

Based on documents obtained by the Inquirer, the six each received over P1.6 million (out of a total amount of P3 million each) as “initial payment” after they qualified for the Exemplary Public Service Award (Epsa) in 2005.

The Epsa was created by the Manila City Council through Ordinance No. 8040, enacted on Dec. 7, 2000, which authorized “the conferment of an exemplary public service award on elective local officials of Manila who have been elected for three consecutive terms in the same position.”

The ordinance, whose principal author was Lacson, covered the mayor, vice mayor and councilors and stipulated that qualified officials would receive “a plaque of appreciation, retirement and gratuity pay remuneration equivalent to the actual time served in the position.”

After the release of the money, however, then supervising city auditor Gabriel Espina said a “verification of the (above) payment showed that the grant of (a) monetary reward to former elective officials in the form of retirement and gratuity pay was approved and authorized by the city council without legal basis.”

Espina’s comment was in an audit observation memorandum (AOM) he issued in 2005, a copy of which was received by the Inquirer.

According to him, the remuneration was “not among the compensation and benefits due to elective local officials enumerated under … the Local Government Code of 1991.”

Eduardo de Gracia, a human resources management officer at City Hall, told the Inquirer that a city councilor is entitled to the following benefits every month: P23,422 in basic salary plus P10,000 representation allowance; P1,500 additional compensation and P500 personal emergency relief allowance. He added that city councilors do not receive retirement benefits.

Based on Espina’s AOM, the COA legal and adjudication office, through COA Director IV Elizabeth Zosa, issued a notice of disallowance on May 24, 2006 ordering the six councilors to return the P1.6 million each of them had received.

Zosa said that the giving out of a monetary reward “likewise contravenes Article 170 of Republic Act 7160, which provides that no elective or appointive local official shall receive additional, double or indirect compensation unless specifically authorized by law.”

Despite her order, a certification made by city accountant Ma. Lourdes Manlulu last week said that none of the six councilors has complied with the COA directive. Instead, they filed at the City Auditor’s Office “a motion to lift the notice of disallowance.”

Zosa added that several other city officials were also liable for the disbursement of the money.

They included former Mayor Lito Atienza for approving the ordinance creating the Epsa, former vice mayor and city council presiding officer Danilo Lacuna who approved the transaction, city council secretary Rodolfo Lapid who certified that the expenses were lawful and necessary, city accountant Gloria Quilantang who attested to the completeness and propriety of supporting documents and city budget officer Alicia Moscya.

In an interview with the Inquirer, Veloso confirmed he had received the money, although he defended the Epsa.

“There’s nothing wrong with it. My talent fee is even bigger than the amount I received,” Veloso, who is also an actor, said. “It is a big help to us councilors. Because of our meager salaries, most of us end up spending our own money to help people who come to us,” he added.
