A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO AND SIGN A LEASE CONTRACT WITH THE BUREAU OF INTERNAL REVENUE (BIR) FOR THE RENEWAL OF LEASE ON THE PORTION OF JAMES L. GORDON AVENUE MARKET AND MALL IN A MANNER CONSISTENT WITH LAW

WHEREAS, the Bureau of Internal Revenue for a long period of time already leased a portion of the second floor of the James L. Gordon Avenue Market and Mall, specifically a portion with an area of approximately 393 square meters and an additional area of seventy eight (28) square meters as an extension office (for total of 471 square meters);

WHEREAS, the BIR, as represented by its officer in charge manifested its intention to continue its lease of the said premises covering this year 2012 until December 31, 2012, subject to the payment of an agreed rental rate of Sixty One Thousand One Hundred Ten Pesos and 89/100 (PhP61,110.89) for the 393 square meters and an additional amount of Twelve Thousand One Hundred Twenty Eight and 97/100 (PhP12,128.87) for the extension room of 78 square meters, more or less;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the honorable City Mayor James Gordon, Jr. to enter into and sign a Lease Contract with the Bureau of Internal Revenue (BIR) for the renewal of lease on the portion of James L. Gordon Avenue Market and Mall in a manner consistent with law.

A RESOLUTION RATIFYING THE LEASE CONTRACT BETWEEN THE CITY AND THE BUREAU OF INTERNAL REVENUE (BIR) FOR THE YEAR 2011 ON A PORTION OF THE JAMES L. GORDON AVENUE MARKET AND MALL IN A MANNER CONSISTENT WITH LAW

WHEREAS, the Bureau of Internal Revenue leased a portion of the second floor of the James L. Gordon Avenue Market and Mall with an area of approximately 393 square meters for the year 2011;

WHEREAS, the BIR, as represented by its officer in charge manifested its intention to continue its lease of the said premises covering this year 2012 until December 31, 2012, subject to the payment of an agreed rental rate of Sixty One Thousand One Hundred Ten Pesos and 89/100 (PhP61,110.89) for the 393 square meters;

WHEREAS, there is a need to ratify the year 2011 lease contract to facilitate orderly renewal of the same with the Bureau of Internal Revenue in accordance with legal protocol;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to ratify as it hereby ratifies the Lease Contract between the City and the Bureau of Internal Revenue (BIR) for the year 2011 on a portion of the James L. Gordon Avenue Market and Mall in a manner consistent with law.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, J. TO ENTER, EXECUTE AND SIGN THE AFFILIATION AGREEMENT WITH LYCEUM OF SUBIC BAY, INC. (COLLEGE) IN A MANNER CONSISTENT WITH LAW

WHEREAS, the Lyceum of Subic Bay, Inc. is an educational institution with students enrolled in medical courses who are required to undergo on-the-job training or internship requirements of actual immersion to medical service;

WHEREAS, the James L. Gordon Memorial Hospital is a tertiary medical facility which, as assessed by Lyceum of Subic Bay, Inc. is equipped with the necessary facilities that would assist in the development and training of its students to become competent and prepared for a future career in medical service;

NOW, THEREFORE, on joint motion of City Councilors Eyrma Yvette Marzan-Estrella and Edna Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod present.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter, execute, and sign the affiliation agreement with Lyceum of Subic Bay, Inc. (College) in a manner consistent with law.

A RESOLUTION DECLARING THE ANNUAL BUDGET OF BARANGAY GORDON HEIGHTS FOR THE FISCAL YEAR 2012 IN THE AMOUNT OF ELEVEN MILLION THREE HUNDRED TWENTY NINE THOUSAND NINETY TWO PESOS AND 05/100 (PHP11, 329,092.05) OPERATIVE IN ITS ENTIRETY

In the interest of public service and on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare as it hereby declares the Annual Budget of Barangay Gordon Heights for FY 2012 in the amount of Eleven Million Three Hundred Twenty Nine Thousand Ninety Two Pesos and 05/100 (PhP11, 329,092.05) operative in its entirety considering that the said budget as contained in Appropriation Ordinance No. 05, Series of 2011 of Barangay Gordon Heights, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government code of 1991 and its Implementing Rules and Regulations. PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in her letter dated March 29, 2012 are strictly complied with;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Appropriation Ordinance No. 05, 2011 of Barangay Gordon Heights dated September 30, 2011 and a letter from Ms. Marey Beth D. Marzan, City Budget Officer dated March 29, 2012 be made as integral parts of this Resolution,

A RESOLUTION CONGRATULATING SK CHAIRMAN ALFONSO RIBADA III OF BARANGAY NEW CABALAN FOR BEING AWARDED AS ONE OF THE OUTSTANDING SANGGUNIANG KABATAAN OF CENTRAL LUZON LAST APRIL 11, 2012 AT THE SUBIC BAY TRAVELERS HOTEL AND EVENT CENTER

WHEREAS, the Sangguniang Kabataan os celebrating its twenty years of genuine SK leadership and braving the challenges of unending youth empowerment, dedication and commitment to good governance;

WHEREAS, the Sangguniang Kabataan of Central Luzon conducted a search for The Outstanding Sangguniang Kabataan Award (TOSKA) which will recognize the hardwork, dedication and passion of each SK official in their respective communities;

WHEREAS, all SK officials of Central Luzon are encouraged to submit their accomplishment reports to the Central Luzon Office for scrutiny and even get the chance to be recognizes as one of the TOSKA awardees;

WHEREAS, SK Chairman Alfonso Ribada III conducted three Katipunan ng mga Kabataan and Sangguniang Kabataan assemblies, passed three ordinances and 61 SK resolutions and accomplished seven significant projects;

WHEREAS, SK Chairman Alfonso Ribada III of Barangay New Cabalan was awarded as one of the outstanding Sangguniang Kabataan of Central Luzon which was a part of the 2nd Central Luzon Youth Summit held last April 10-12, 2012 at the Subic Bay Travelers Hotel and Event Center;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

TO ENTER, EXECUTE & SIGN A MEMORANDUM OF AGREEMENT WITH THE DEPARTMENT OF EDUCATION OF OLONGAPO CITY REPRESENTED BY THE SCHOOLS DIVISION SUPERINTENDENT JESSIE D. FERRER, CESO VI FOR THE ESTABLISHMENT OF UPPER SIBUL II ELEMENTARY SCHOOL IN A MANNER CONSISTENT WITH PERTINENT LAWS

WHEREAS, the Sangguniang Barangay of East Bajac-Bajac, Olongapo City approved Barangay Resolution No. 28, Series of 2009 for the establishment of Upper Sibul II Elementary School;

WHEREAS, the establishment of Upper Sibul II Elementary School will lessen the influx of enrollment at the thickly populated public elementary schools in the city proper;

WHEREAS, this is deemed necessary for the constituents of the barangay who belong to the low income families to have the opportunity to send their children to high school;

WHEREAS, the creation of the Upper Sibul II Elementary School would be beneficial to the residents and nearby constituents of the area as well as to accommodate the growing educational needs and minimize congestion in the city schools;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungosd in session assembled, to authorized, as it is hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter, execute & sign a Memorandum of Agreement with the Department of Education of Olongapo City represented by the Schools Division Superintendent Jessie D. Ferrer, CESO VI for the establishment of Upper Sibul II Elementary School in a manner consistent with pertinent laws.

A RESOLUTION DECLARING THE ANNUAL BUDGET OF BARANGAY BARRETTO FOR FY 2012 IN THE AMOUNT OF ELEVEN MILLION EIGHT HUNDRED FIFTY THOUSAND ONE HUNDRED SIXTY THREE PESOS AND 71/100 (PHP 11, 850,163.71) OPERATIVE IN ITS ENTIRETY

In the interest of public service and on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungosd in session assembled, to declare, as it hereby declares the Annual Budget of Barangay Barretto for FY 2012 in the amount of Eleven Million Eight Hundred Fifty Thousand One Hundred Sixty Three Pesos & 71/100 (P11, 850,163.71) operative in its entirety;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copy of Barangay Barretto Appropriation Ordinance No. 1, Series of 2012 dated January 17, 2012 and a letter from Ms. Marey Beth D. Marzan, City Budget Officer dated May 3, 2012 be made as integral parts of this Resolution.

A RESOLUTION EXPRESSING OPPOSITIONS TO THE PLAN OF THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO COVERT SUBIC BAY INTERNATIONAL AIRPORT (SBIA) INTO A COMMERCIAL ZONE, INSTEAD, SUPPORTING SBIA’S RETENTION AND FULL UTILIZATION

WHEREAS, the Naval Air Station Cubi Point now known as Subic Bay International Airport (SBIA), was constructed October 2, 1951 and befits all the requirements of the National Historical Commission of the Philippines (NHCP) as a Historical site, symbolizing the lasting friendship and cooperation between the people of the Philippines in general, the Olongapo constituents in particular, and the American People;

WHEREAS, the Subic Bay International Airport (SBIA), which lies strategically at the center of the Asia-Pacific heartland, serves as a secondary and main diversion airport for Ninoy Aquino International Airport (NAIA);

WHEREAS, while NAIA is now over-its-capacity limit and Clark International Airport (CIA) is expected to duffer the same fate as the Manila airports in the next five to ten years, the SBIA is capable of international and domestic flight operations which complements the general aviation requirements of Luzon;

WHEREAS, SBIA, an irreplaceable asset that entails a construction costs worth billions of dollars, can serve as an International General Aviation Hub and can be a backup for Hong Kong, Singapore and Malaysia airports which have reached either its full or nearly full capacity in terms of Aircraft Management, Interior and Painting Facilities and Maintenance and Repair facilities;

WHEREAS, an article by Aviation Industry Newspaper (AIN), published by Aviation Industry 6,000 plus participants in China and 100,000 in the US and Europe, says that Subic Bay is an excellent “alternative to Hong Kong hassles” thereby creating new aviation careers for the Philippines with jobs providing long-term growth and high income potential;

WHEREAS, the Subic Bay Metropolitan Authority has expressed its plan to demolish and destroy SBIA and convert the billion-dollar asset into a commercial zone for future leasable areas for the development of what they termed as an “Integrated Family-Oriented Tourist Destination”;

WHEREAS, the City Government believes that we retain the runway vis-à-vis the plan commercialization of SBMA;

WHEREAS, while the City Government of Olongapo supports the business expansion at the Subic Bay Freeport Zone, it, however, found its proposed plan untenable due to the following reasons:

1)      The planned conversion is ill-advised as it forfeits the use of an international airport and demolish a billion-dollar investment which can be utilized for the benefits of both local and national interest;

2)      Converting and demolishing billions-worth of infrastructure to make way for a 200-hectare leasable area for prospective investors is economically and financially unsound, especially if a 3,000-hectare area at the Redondo Peninsula is available for expansion and development;

3)      The proposal of SBMA to cram in one contiguous area all kinds of projects of various categories is technically and environmentally unsound; and

4)      It shall diminish the viability of the Philippines, in general and Subic Bay, in particular as a Cooperative Security Location (CSL) especially in terms of aerial operations and logistical requirements of allied countries.

WHEREAS, the planned expansion of the SBMA can be established at Redondo Peninsula which has been described in the official portals of the Department of Tourism (www.visitmyphilippines.com) as scenic 3,800-hectare area earmarked for the development of subdivisions, golf courses, resort hotels and restaurants. Part of Redondo Peninsula is being reserved for the Green Beach One Project for both tourism and industrial based developments which may include an eco-village development, a resort, marina and entertainment complex are some of the possible tourism-based projects suitable in the area and ship-building facility, container port, specialized industrial park and institutional research center are some of the industrial-based developments;

WHEREAS, with both the airport and seaport intact, the capability of Subic Bay as Cooperative Security Location (CSL) shall be greatly enhanced and the national government, the Subic Bay Freeport Zone, the City of Olongapo and outlying LGUs shall benefit from the lease-rentals of the two facilities;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby express opposition to the plan of the Subic Bay Metropolitan Authority (SBMA) to convert Subic Bay International Airport (SBIA) into a commercial zone, instead, supporting SBIA’s retention and full utilization.
