RESOLUTION NO. 231

A RESOLUTION OF CONDOLENCES TO THE BEREAVED FAMILY
OF SCOUTER MAXIMO GUERRERO VENZON, LT AND RECOGNIZING HIS INVALUABLE CONTRIBUTIONS TO THE CITY OF OLONGAPO


WHEREAS, Scouter Maximo G. Venzon, LT, one of the prime movers of the Scouting in the City, joined his Creator last December 7, 2006, while attending a jamboree at Clarkfield, Pampanga;

WHEREAS, an educator and master initiator of various leadership trainings in the High School Department of the Columban College, Mr. Venzon had motivated his students to hone multiple skills and instilled in them the values of perseverance, discipline and teamwork – a lifestyle he himself exemplified;

WHEREAS, Max, as he is fondly called, was the beacon and spirit behind the Builders’ Organization, a movement that provides programs and trainings that bring out the leadership potentials of young men and women through the principles of Scouting. The said program enriched countless individuals now creating niches in various career horizons. The pathfinder program as he envisioned it to be, none of the Builders strayed from the fundamentals of rightful living;

WHEREAS, strict and resolute inside the classroom, Mr. Venzon will always be remembered as a great cook who can feed hundreds of students with a minimum budget in camp outs, a trustworthy friend of his co-teachers and a generous brother;

WHEREAS, Scouter Max remained loyal to his mother institution and mother council as attested by his 34 years of service as Columban Scout Coordinator, Olongapo City Private Schools Scout Coordinator, Council Training Commissioner and Chairman of Council Advancement and Activities (1971-2006) and Central Luzon Regional Program Commissioner.

WHEREAS, for many years, Olongapo had claimed awards for the National Search in the Ten Outstanding Boy Scouts of the Philippines. Most of them under the direct tutolege of Mr. Venzon;

WHEREAS, Mr. Venzon died in the line of service and left a legacy of programs and trainings implemented by schools. But most of all, he had written solid and encouraging principles to live by in the hearts of many scouters whom he touched;

NOW, THEREFORE, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to condole, as it hereby condoles the bereaved family of Scouter Maximo Guerrero Venzon, LT and recognizing his invaluable contributions to the City of Olongapo.

Let a copy of this Resolution be furnished the bereaved family of Scouter Maximo Guerrero Venzon, LT, for their information and record.

A RESOLUTION RATIFYING THE MEMORANDUM OF AGREEMENT ENTERED INTO BY AND BETWEEN THE BALIKATAN LADIES OF OLONGAPO MOVEMENT (BLOOM) MULTI-PURPOSE COOPERATIVE, INC. REPRESENTED BY ITS CHAIRPERSON SARAH DELA CRUZ AND THE CITY GOVERNMENT OF OLONGAPO REPRESENTED BY THE CITY MAYOR JAMES GORDON, JR.


WHEREAS, the City Mayor was authorized to enter into a Memorandum of Agreement (MOA) with the Balikatan Ladies of Olongapo Movement (BLOOM) Emission Testing Center thru Resolution No. 207, Series of 2006;

WHEREAS, the Sangguniang Panlungsod Members deem it proper to ratify the Memorandum of Agreement;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to ratify, as it hereby ratifies the Memorandum Of Agreement Entered Into By And Between The Balikatan Ladies Of Olongapo Movement (BLOOM) Multi-Purpose Cooperative, Inc. Represented By Its Chairperson Sarah Dela Cruz And The City Government Of Olongapo Represented By The City Mayor James Gordon, Jr.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a signed copy of the Memorandum of Agreement be made as an integral part of this Resolution.

A RESOLUTION AUTHORIZING THE CITY MAYOR TO ENTER INTO AN AGREEMENT FOR THE HOSPITAL COMPUTERIZATION PROJECT, PABX UPGRADE, CONSTRUCTION OF OUT-PATIENT DEPARTMENT BUILDING AND REHABILITATION OF VARIOUS HOSPITAL UNITS PURSUANT TO THE DEVELOPMENT BANK OF THE PHILIPPINES LOAN AGREEMENT


WHEREAS, Olongapo City realizes that growth is a continuous process and is constantly seeking ways to improve the delivery of basic services. It is now undergoing expansion projects on health services to make it more accessible to its constituents;

WHEREAS, improvement of its facilities will help boost productivity and adopt effective management of the hospital;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the City Mayor to enter into an Agreement for the hospital computerization project, PABX upgrade, construction of out-patient department building and rehabilitation of various hospital units pursuant to the Development Bank of the Philippines loan agreement.

WHEREAS, Olongapo City recognizes the invaluable help of various non-governmental organizations and quasi-public corporations for the development and preservation of our environment and natural resources;

WHEREAS, the National Transmission Corporation is a foremost advocate of corporate social responsibility and environmental stewardship for the parallel development of both the company and the country;

WHEREAS, Olongapo City believes that a comprehensive approach ought to be utilized in the development and preservation of the environment;

WHEREAS, National Transmission Corporation recognizes that one of the more effective ways for environmental development is women empowerment;

WHEREAS, the City Government of Olongapo and National Transmission Corporation aim to develop and enhance the production capability of women through livelihood training.

CENTER, 3RD REGIONAL COMMUNITY DEFENSE GROUP, ARMY RESERVED COMMAND AS MANDATED BY RA 7077 OTHERWISE KNOWN AS THE CITIZENS ARMED FORCES ACT REPRESENTED BY ITS COMMANDING OFFICER CAPT. ROBERTO B. SARMIENTO, (INF) PA

WHEREAS, the 306th Community Defense Center, 3rd Regional Community Defense Group, Army Reserve Command, is a unit of the Philippine Army whose mission is to develop, organize, train, equip, administer and provide highly competent and mobile reserve force as an integral component of the total army in defense of the state and to participate in socio-economic development effort and community service during peace time including disaster relief operation, environmental protection and other training as mandated under RA 7077 otherwise known as the Citizens Armed Forces Act;

WHEREAS, Olongapo City welcomes cooperation and collaboration with socio-civic organizations, non-government organizations and cooperatives, and the national Government Agencies to foster growth and ensure the delivery of basic services, particularly in the maintenance of peace and order;

WHEREAS, the 306th Community Defense Center signifies its intention to support and assist the city in the maintenance of peace and order particularly the areas surrounding the Gordon College and its premises, and offers its expertise and experience to train freshmen students willing to take-up NSTP, ROTC program;

NOW, THEREFORE, on motion of Councilor John Carlos G. delos Reyes, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLUTION NO. 225

A RESOLUTION RESPECTFULLY REQUESTING THE HON. SECRETARY ANGELO T. REYES OF THE DEPARTMENT OF ENVIRONMENT & NATURAL RESOURCES TO ORDER THE DISMANTLING OF ALL ILLEGAL FISH CAGES IN SUBIC BAY PURSUANT TO ENVIRONMENTAL MANAGEMENT BOARD ORDER DATED AUGUST 29, 2006 AND TO LEGALLY PROCEED AGAINST PRIVATE AND
PUBLIC INDIVIDUALS RESPONSIBLE FOR THE SAME.


WHEREAS, the Chairman of the Committee on Environment of the Sangguniang Panlungsod of Olongapo City was informed and furnished with copies of official documents regarding the operations of fishcages by various corporations and private individuals within the municipal waters at Brgy. Cawag, Subic, Zambales that covers an area of twenty-two (22) hectares of Subic Bay;

WHEREAS, the documents submitted show that the operators of fish cages were found to be operating without the necessary Environmental Compliance Certificate (ECC) from the Department of Environment & Natural Resources which is in violation of Section 4 of Presidential Decree No. 1586 and that the area where the fish cages are currently operating is not a demarcated area identified by the Bureau of Fisheries and Aquatic Resources which is in violation of Section 22 of Republic Act. No. 8550 (The Philippine Fisheries Code of 1998);

WHEREAS, the Philippine Fisheries Code of 1998 specifically provides under Section 53 – “Grant of Privileges for Operations of Fish Pens, Cages, Corrals/Traps and Similar Structures – No new concessions, licenses, permits, leases and similar privileges for the establishment or operation of fish pens, fish cages, fish corrals/traps and other similar structures in municipal areas shall be granted except to municipal fisherfolk and their organizations”;

WHEREAS, an ORDER dated August 29, 2006 has been issued by the Department of Environment and Natural Resources for Violation of Sec. 4 of P.D. 1586 against Neo-Mega Seahorse Aqua Farms, Inc. which states:

“This refers to your non-compliance to sec. 4 of the Philippine Environmental Impact Statement (EIS) system law (PD 1586) for the continuous operation of fishcages along the coastal waters of Cawag, Subic, Zambales without an ECC from the office and failure to observe proper aquaculture practices resulting to the alleged occurrence of fishkills in the area.

As such you are hereby ordered to voluntarily dismantle all fishcages within seven days upon receipt of this ORDER and cease and desist from project operations until and ECC is secured from this Office and futher water quality studies of Subic Bay are undertaken with concerned agencies pursuant to the provisions of PD 1568 and the Philippine Clean Water Act (RA 9275), otherwise this Office shall take the necessary legal actions to fully implement the law.

You are likewise ordered to pay the penalty in the amount of Php50,000.00 pursuant to sec. 9 of PD 1568.

So ordered 29, August, 2006.”;


WHEREAS, the order in coordination with local government through the Office of the Municipal Mayor, Hon. Jeffrey D. Khonghun was served to the above named respondents. However, despite the abovestated Order and after four months, respondents have remained contumacious, stubborn and continue their illegal operations;

WHEREAS, the continued operation of these fish cages within Subic Bay will not only cause massive fish kill as reported in page A-16 of June 23, 2006 issue of the Philippine Daily Inquirer but they will also cause great damage to the tourism potential of the bay;

WHEREAS, these illegal economic activities are adverse to the City’s eco-tourism and environmental policies as it shares and is a stakeholder in the riches and bounty of Subic Bay;

NOW, THEREFORE, on motion of Councilor John Carlos G. de los Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to respectfully request, as it hereby respectfully requests the Hon. Secretary Angelo T. Reyes of the Department of Environment & Natural Resources to order the dismantling of all illegal fish cages in Subic Bay pursuant to Environmental Management Board Order dated August 29, 2006 and to legally proceed against private and public individuals responsible for the same.

RESOLVED FURTHER, AS IT IS FURTHER RESOLVED, that copies of this Resolution be furnished the Office of the Municipal Mayor of Subic, Zambales, the Office of the City Mayor of Olongapo City, the Office of the Administrator of the Subic Bay Metropolitan Authority, the Office of the Provincial Governor of Zambales and the Office of the Secretary of the Department of Environment & Natural Resources for their information and proper action.

WHEREAS, Olongapo City is one of the Local Government units pursuing the process of Land Administration and Land Management reform under the Land Administration and Management Program (LAMP);

WHEREAS, it is the objective of the city government to determine its needs to achieve and improve its own delivery of Land Administration and Management Service such as Land Mapping and Collection of revenues;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the City Mayor to enter into a Memorandum of Agreement with the winning bidder of the GIS, Land Mapping and other revenue generating activities;

A RESOLUTION OF CONDOLENCES TO THE BEREAVED FAMILY OF SCOUTER MAXIMO GUERRERO VENZON, LT AND RECOGNIZING HIS INVALUABLE CONTRIBUTIONS TO THE CITY OF OLONGAPO


WHEREAS, Scouter Maximo G. Venzon, LT, one of the prime movers of the Scouting in the City, joined his Creator last December 7, 2006, while attending a jamboree at Clarkfield, Pampanga;

WHEREAS, an educator and master initiator of various leadership trainings in the High School Department of the Columban College, Mr. Venzon had motivated his students to hone multiple skills and instilled in them the values of perseverance, discipline and teamwork – a lifestyle he himself exemplified;

WHEREAS, Max, as he is fondly called, was the beacon and spirit behind the Builders’ Organization, a movement that provides programs and trainings that bring out the leadership potentials of young men and women through the principles of Scouting. The said program enriched countless individuals now creating niches in various career horizons. The pathfinder program as he envisioned it to be, none of the Builders strayed from the fundamentals of rightful living;

WHEREAS, strict and resolute inside the classroom, Mr. Venzon will always be remembered as a great cook who can feed hundreds of students with a minimum budget in camp outs, a trustworthy friend of his co-teachers and a generous brother;

WHEREAS, Scouter Max remained loyal to his mother institution and mother council as attested by his 34 years of service as Columban Scout Coordinator, Olongapo City Private Schools Scout Coordinator, Council Training Commissioner and Chairman of Council Advancement and Activities (1971-2006) and Central Luzon Regional Program Commissioner.

WHEREAS, for many years, Olongapo had claimed awards for the National Search in the Ten Outstanding Boy Scouts of the Philippines. Most of them under the direct tutolege of Mr. Venzon;

WHEREAS, Mr. Venzon died in the line of service and left a legacy of programs and trainings implemented by schools. But most of all, he had written solid and encouraging principles to live by in the hearts of many scouters whom he touched;

NOW, THEREFORE, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to condole, as it hereby condoles the bereaved family of Scouter Maximo Guerrero Venzon, LT and recognizing his invaluable contributions to the City of Olongapo.
