WHEREAS,
on March 17, 2008, the Office of the Sangguniang Panlungsod has passed
Ordinance No. 12, Series of 2008 entitled “An Ordinance Amending Ordinance No.
04, Series of 2008 otherwise known as the “The Cockfighting Ordinance of
Olongapo City” specifically Subsection 5a of Section 5 - Imposition of Fees and
Subsection 9.2. of Section 9- Administrative Provisions”
WHEREAS, on February 6, 2008, the Office of the
Sangguniang Panlungsod also passed Ordinance No. 04, Series of 2008 entitled
“An Ordinance Amending Ordinance No. 101 and Ordinance No. 106, Both Series of
1978 Providing for the Establishment, Operation and Maintenance of Cockfighting
and the Regulation of Cockfighting and Commercial Breeding of Gamecocks”
otherwise known as “The Cockfighting Ordinance of Olongapo City”;
WHEREAS, cockfighting has been a popular,
traditional and customary form of recreation and entertainment among Filipinos
during legal holidays, local fiestas, agricultural, commercial and industrial
fairs and still one of the major tourist attractions in the Philippines;
WHEREAS, in the aforesaid Ordinance, the city
imposes, aside from the usual annual license fee, a Franchising Fee in the
hefty amount of P600,000.00, P1,500,000.00 and P2,500,000.00 for one(1) year,
three (3) years and five (5) years, respectively;
WHEREAS,
no franchise had ever been granted to possible applicants for the operation of
a Cockpit due to the prohibitive franchising fee being imposed by the city,
hence, the presence of illegal cockfighting in the city;
WHEREAS,
in other cities and municipalities, no franchise fee had ever been imposed in
the operation of a cockpit.
NOW THEREFORE, on motion of City Councilor Alreuela M. Bundang-Ortiz, with the unanimous
accord of the Members of the Sangguniang Panlungsod present,
RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in
session assembled, to enact the following Ordinance:

AN ORDINANCE AMENDING ORDINANCE NO. 12,
SERIES OF 2008 ENTITLED “AN ORDINANCE AMENDING ORDINANCE NO. 04, SERIES OF 2008
OTHERWISE KNOWN AS THE “THE COCKFIGHTING ORDINANCE OF OLONGAPO CITY” AND
ORDINANCE NO. 04, SERIES OF 2008 ENTITLED “AN ORDINANCE AMENDING ORDINANCE NO.
101 AND ORDINANCE NO. 106, BOTH SERIES OF 1978 PROVIDING FOR THE ESTABLISHMENT
, OPERATION AND MAINTENANCE OF
COCKFIGHTING AND THE REGULATION OF COCKFIGHTING AND COMMERCIAL BREEDING
OF
GAMECOCKS
BE IT ORDAINED, BY THE
SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:
SECTION 1. Subsection 5a of Ordinance No. 12, Series of 2008 shall be amended as follows:
5a. FRANCHISING FEE
For ten (10)
years----------------------------P1,500,000.00
Payable
in the amount of P100,000.00 a year for five years and P200,000.00
a year for
the next succeeding years
SECTION 2. Subsection 9.2 of Ordinance No. 12,
Series of 2008 shall be amended as follows:
9.2. The site
of construction of cockpits shall be constructed and operated within the
appropriate areas as prescribed in the City Zoning Ordinance. The cockpit shall
be established, maintained and/or operated within reasonable distance from
hospitals, school buildings, churches or other public buildings or properties,
existing commercial and residential areas and a radius of ten (10) meters from
its entry point from the National Highway. Cockpits may also be established
within and/or as an adjunct of resorts, sports and/o recreational project sites
duly recognized and registered with the Philippine Tourism Authority, subject
to the construction of cockpits shall be made by the City Engineering in
accordance with the National Building Code and other applicable laws.
SECTION 3. Subsection 9.3 of Ordinance No. 4,
Series of 2008 shall be amended as follows:
9.3. Licensing
of Cockpits – Upon prior application made, the Sangguniang Panlungsod is duly
authorized to issue a license for the establishment, operation and maintenance
of cockpits for a period of ten (10) years.
SECTION 3. Repealing clause. Ordinances, Executive
Orders and other local legislation inconsistent with this Ordinance are hereby
modified or repealed accordingly.
SECTION 4. This Ordinance shall take effect after
its posting at three (3) conspicuous places in the City of Olongapo.
