AN ORDINANCE TEMPORARILY CLOSING A PORTION OF FILTRATION ROAD CORNER CAMIA STREET AND SAMPAGUITA ROADS OF BARANGAY STA. RITA, THIS CITY TO TRAFFIC FROM 9:00 A.M. TO 12:00 MIDNIGHT ON OCTOBER 31, 2008 FOR THE 25TH YEAR SACERDOTAL ANNIVERSARY OF REV. FR. NELSON. C. VENCILAO

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. A portion of Filtration Road corner Camia Street and Sampaguita Road, Barangay Sta. Rita, Olongapo City be closed temporarily from 9:00 a.m. to 12 midnight on October 31, 2008.

SECTION 2. The above-mentioned temporary closure is in line with the holding of the 25th Year Sacerdotal Anniversary of Rev. Fr. Nelson C. Vencilao.

SECTION 3. Re-routing of vehicles to be outlined by the Office of the Traffic Management and Public Safety with the BPSO of Barangay Sta. Rita is necessary during the said closure.

SECTION 4. This Ordinance shall take effect upon its approval.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) BY AND BETWEEN JAMES L. GORDON MEMORIAL HOSPITAL AND MONDRIAAN AURA COLLEGE REPRESENTED BY ITS PRESIDENT EDGAR G. GENIZA FOR THE TRAINING OF ITS PSYCHOLOGY AND CAREGIVER STUDENTS IN FULFILLMENT OF THEIR COURSE REQUIREMENTS

WHEREAS, the City of Olongapo has consistently played a major part in worthwhile affiliations for the benefit of the City and its populace;

WHEREAS, Mondriaan Aura College, represented by its president, Edgar G. Geniza, proposes for its Psychology and Caregiver students to undergo actual training at the City through the James L. Gordon Memorial Hospital in fulfillment of their course requirements;

WHEREAS, Mondriaan Aura College further accedes to disburse to the City an Affiliation Fee based on Administrative Order No. 5-A, Series of 1996 of the Department of Health;

WHEREAS, cognizant of the benefits of the proposal, this august body considers it favorable to bestow authority to the Local Chief Executive to participate in such undertaking;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon Jr. to enter into a Memorandum of Agreement (MOA) by and between James L . A RESOLUTION AUTHORIZING THE CITY MAYOR, HONORABLE JAMES GORDON, JR. TO NEGOTIATE AND ENTER INTO A MEMORANDUM OF AGREEMENT FOR AND IN BEHALF OF THE CITY GOVERNMENT OF OLONGAPO WITH MR. JOHN MICHAEL IAN S. SALAS AND MS. ARNELYN MAY A. ABDON REGARDING CONSULTANCY SERVICES IN CONNECTION WITH THE AUICK-OLONGAPO CITY’S SOCIO ECONOMIC INFORMATION SYSTEM

WHEREAS, the AUICK, United Nations Population Fund (UNFPA) and the City Government of Olongapo entered into a collaborative work for the implementation of a project which aims to establish a system for the City that is capable of generating updated information on demographic, economic, social, cultural and physical attributes of its locality and population;

WHEREAS, the consultants, Mr. John Michael Ian S. Salas and Ms. Arnelyn May A. Abdon, were deemed to have full capacity to provide the technical expertise and guidance needed to undertake the project;

WHEREAS, the Sangguniang Panlungsod recognizes that it is in the best interest of the Olongapo constituents that such an agreement be entered into with the consultants to pave way for the establishment of the Olongapo City’s socio-economic information system;

NOW, THEREFORE, on motion of Councilor Aquilino Y. Cortez, Jr., with the unanimous accord of the Members of the Sangguniang Panlungsod present,

A RESOLUTION APPROVING AND RATIFYING THE LOAN AGREEMENT, THE CONTINUING DEEDS OF ASSIGNMENT WITH HOLD-OUT AND OTHER DOCUMENTS RELATED THERETO SIGNED AND EXECUTED BETWEEN THE CITY OF OLONGAPO (LGU), AND THE DEVELOPMENT BANK OF THE PHILIPPINES (DBP) WITH ALL THE TERMS AND CONDITIONS THEREOF.

WHEREAS, as duly authorized by the City Council of Olongapo (the “Sanggunian”), Hon. James J. Gordon, Jr. City Mayor of Olongapo and Marcelino D. Andawi, City Treasurer have entered into a Loan Agreement with the DEVELOPMENT BANK OF THE PHILIPPINES (DBP) in the principal amount of TWENTY FOUR MILLION NINE HUNDRED SIXTY NINE THOUSAND ONE HUNDRED FORTY PESOS (PhP24,969,140.00), hereinafter referred to as the “DBP Loan”, to finance General Funding requirements of the LGU and executed as security therefore, the Loan Agreement dated October 21, 2008, the Continuing Deed of Assignment on the applicable portion of the LGU’s Internal Revenue Allotment (IRA) with hold-out provision equivalent to three (3) monthly regular interest under the Loan Agreement and other related documents; and the Continuing Deed of Assignment with Hold-out of the LGU’s Unreleased Share of IRA differential for CY 2001 and 2004, based on the Notice of Payment Schedule (NPS) duly issued by the Department of Budget and Management (DBM), local taxes and other revenues of the City duly allocated for debt servicing.

WHEREAS, the aforesaid Loan Agreement, Continuing Deeds of Assignment with Hold-out and other related documents are now before the Sanggunian for its perusal, study, ratification and approval;

WHEREAS, the terms and conditions contained in the above loan document are fair, just, legal and in order.

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to ratify, confirm, approve and render effective and of full force and effect the Loan under the terms and conditions of the Loan Agreement and the covering collateral and other document/s executed in relation thereto.

For this purpose, the City is hereby authorized as it is hereby authorizes, the following:

1. To maintain with DBP its existing Debt Servicing Account (DSA) where the Unreleased Internal Revenue Allotment CY 2001 and 2004, based on the Notice of payment Schedule (NPS) duly issued by the Department of Budget and Management (DBM) and the applicable portion of the LGU’s IRA shall be deposited subject to continuing assignment with hold-out of the Unreleased Share of IRA differential for CY 2001 and 2004, based on the Notice of payment Schedule (NPS) duly issued by the Department of Budget and Management (DBM), Realty Taxes, other taxes and revenues; and of the applicable portion of the LGU’s IRA with hold-out provision equivalent to three (3) monthly regular interest under the Loan Agreement and other related documents, in favor of DBP and for the City Mayor to execute the covering Continuing Deeds of Assignment with Hold-out;

2. To maintain its 20% allowed Debt Service Ceiling under Section 324(b) of the Local Government Code of the Philippines;

3. The Continuing Assignment with Hold-out of the LGU’s Unreleased Share of IRA differential for CY 2001 and 2004, based on the Notice of Payment Schedule (NPS) duly issued by the Department of Budget and Management (DBM), local taxes and other revenues of the City duly allocated for debt servicing.

4. The Continuing Assigment on the applicable portion of the LGU’s Internal Revenue Allotment (IRA) with hold-out provision equivalent to three (3) monthly regular interest under the Loan Agreement and other related documents.

RESOLVED, that the Sanggunian undertakes, as it hereby undertakes to appropriate in the LGU’s annual budget for the years 2008 to 2015 an amount sufficient to pay its loan from DBP including interest thereon and other charges.

RESOLVED, that this Resolution shall remain valid and effective until the Loan with DBP has fully settled and paid.

RESOLVED FINALLY, that copies of this Resolution be furnished the Office of the City Mayor, City Treasurer’s Office, the Auditor’s Office and the concerned Development Council, and DBP.

A RESOLUTION AUTHORIZING THE CITY MAYOR AND THE CITY TREASURER TO REPRESENT THE CITY OF OLONGAPO TO ENTER INTO A CONTRACT OF LOAN WITH THE DEVELOPMENT BANK OF THE PHILIPPINES (DBP) IN THE PRINCIPAL AMOUNT OF TWENTY FOUR MILLION NINE HUNDRED SIXTY NINE THOUSAND ONE HUNDRED FORTY PESOS (PhP24,969.140.00) FOR THE CITY’S DEVELOPMENT PROGRAMS AND TO SIGN THE LOAN AGREEMENT, DEED OF ASSIGNMENT, THE PROMISORY NOTE

WHEREAS, this in effect supersedes Resolution No. 98, Series of 2008.

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize the City Mayor and the City Treasurer of the City of Olongapo to enter into, negotiate and obtain a loan in the principal amount of Twenty Four Million Nine Hundred Sixty Nine Thousand One Hundred Forty Pesos only (PhP24,969.140.00) from DBP in behalf of the City of Olongapo for the City’s Development Program, a priority project of the City.

RESOLVED, that the City Mayor and the City Treasurer whose names and signatures appear hereunder be authorized, as they are hereby authorized, to negotiate and conclude such loan, to sign, execute and deliver loan and collateral agreements, promissory notes and such other pertinent papers, instruments, and documents and to do all acts and things necessary, proper and convenient under the premises for and in behalf of the City:

RESOLVED, to authorize as it hereby authorizes the City to do, undertake, execute and perform the following acts:

1. The continuing assignment of the City’s applicable portion of the Internal Revenue Allotment (IRA), Realty Taxes and other taxes and other revenues, in favor of DBP;

2. The issuance of an authorization/instruction letter to the Department of Budget and management (the “DBM”) to remit all or a portion of the City’s share of the IRA directly to DBP for deposit to the City’s deposit account threat;

3. The undertaking not to cause transfer of the remittance of IRA or any portion thereof by the DBM from DBP to any other bank without the DBP’s prior written consent until the loan and other charges shall have been fully paid;

4. The designation of DBP as its principal depository bank and the opening and maintenance of a deposit account (the “Deposit Account”) with DBP where the City’s share in IRA or a portion thereof shall be deposited during the term of the loan and payments of its obligation shall be debited;

5. The assignment of the appropriate portion of the City’s other revenues with undertaking to remit the same to DBP in case the IRA, realty tax collections, project revenues are insufficient to service the loan amortization;

6. The undertaking of the City to include in its annual budget the required amortization to service its loan obligations with DBP.

RESOLVED, that this Resolution once approved and executed shall be valid and effective until the loan with DBP has been fully settled and paid.

RESOLVED FINALLY, that copies of this Resolution be furnished the Office of the City Mayor, the City Treasurer’s Office, the Auditor’s Office, the concerned Development Council and DBP.

A RESOLUTION DECLARING EVERY OCTOBER OF THE YEAR AS OLONGAPO CITY COOPERATIVE MONTH

WHEREAS, Section 458, 3 (vii) of Republic Act 7160 also known as The Local Government Code of 1991 strongly supports the preference of cooperative to engage in business;

WHEREAS, Cooperative Development Authority (CDA) was mandated by the Executive Order No. 95 as lead government agency in the promotion, development and regulation of cooperatives nationwide;

WHEREAS, in compliance with CDA Memorandum Circular No. 2007-08, Olongapo City Cooperative Council (CCDC) was organized September 18, 2008;

WHEREAS, one of the mandates of City Cooperative Development Council includes promotion and observance of cooperative awareness in the city at all times;

NOW, THEREFORE, on motion of Councilor Elena C. Dabu with the unanimous accord of the Members of the Sangguniang Panlungsod present,
