A RESOLUTION AUTHORIZING THE CITY LEGAL OFFICER ATTY. BERNARDINE S. GANTAN TO REPRESENT THE CITY GOVERNMENT OF OLONGAPO BEFORE THE MUNICIPAL TRIAL COURT, THE REGIONAL TRIAL COURT, THE COURT OF APPEALS, THE SUPREME COURT OF THE PHILIPPINES, AND QUASI-JUDICIAL BODIES, PERTINENT TO CASES INVOLVING THE CITY GOVERNMENT OF OLONGAPO.

WHEREAS, under Article 481 of Republic Act No. 7160 in relation to article 117 (2) (k) iii of its implementing Rules, the City Legal Officer shall provide the necessary legal services to ensure that best interests and welfare of the government is protected and enforced;

WHEREAS, by reason of the formal documentary requirements in courts of all levels and quasi-judicial bodies, a City Council resolution authorizing the City Legal Officer to represent the City in its legal cases and concerns should be presented or submitted to the court, body or tribunal concerned;

WHEREAS, the City Legal Officer shall appear or represent the City Government Employees in cases involving their respective offices and official capacity;

WHEREAS, the City is involved in court cases before courts of different levels, and may be involved in legal concerns with quasi-judicial bodies;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED by the Members of the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes, the City Legal Officer Atty. Bernardine S. Gantan to represent the City Government of Olongapo before the Municipal Trial Court, the Regional Trial Court, the Court of Appeals, the Supreme Court of the Philippines, and Quasi-judicial Bodies, pertinent to the cases involving City Government of Olongapo.

A RESOLUTION DECLARING THE ANNUAL BUDGET OF BARANGAY PAG-ASA FOR THE FISCAL YEAR 2011 OPERATIVE IN ITS ENTIRETY

In the interest of the public service and on motion of City Councilor Gina Gulanes-Perez with unanimous accord of the Members of the Sannguniang Panglungsod present:

RESOLVED, AS IT IS HEREBY RESOLVE, by the Sannguniang Panlungsod in session assembled, to declare as it hereby declares the Annual Budget of Barangay Pag-Asa for the Fiscal Year 2011 operative in its entirety considering that the said budget as contained in Appropriation Ordinance No. 01 Series of 2011 of Barangay Pag-Asa, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations. PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the OIC, City Budget Office in her letter dated May 2, 2011 are strictly complied with;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED that Appropriation Ordinance No. 01, Series of 2011 of Barangay Pag-Asa dated January 5, 2011 and letter from Ms. Marey Beth D. Marzan, OIC-City Budget Office dated May 2, 2011 shall be made as integral parts of this Resolution.

A RESOLUTION CONGRATULATING ABSOLUTE SERVICE, INC. AS RECIPIENT OF A SPECIAL AWARD IN THE 2011 EMPLOYERS CONFEDERATION OF THE PHILIPPINES (ECOP) KAPATID NATIONAL AWARDS.

WHEREAS, ECOP’s Kapatiran sa Industriya or KAPATID Awards is a biennial national event which recognizes companies that exemplify best workplace policies and programs highlighted by industrial peace and harmony, and characterized by quality and productivity, social accountability, and strategic visioning and partnering;

WHEREAS, companies which have been bestowed with the Grand KAPATID Award are known to have strong partnership between management and workers, the society, and continue to thrive as a top-level establishment in their respective sectors;

WHEREAS, Absolute services, Inc., a duly registered company based in Subic Bay Freeport Zone employing 112 employees was among the 13 companies and the only medium-size company nominated for the coveted award and was eventually chosen as the Grand Kapatid Special Awardee for 2011;

WHEREAS, prestigious multinational companies with the likes of Nestle Philippines, Toyota Motor Phils., SM, Bridgestone Precision, IBM Philippines, Dole Philippines, Amkor Technology, AGC Flat Glass Phils. Inc., HEDCOR, ADD Research Paints and Chemicals, Inc., RCM Manufacturing, Inc. and Tagum Agricultural Development Company, Inc. where among the nominees for the coveted award;

WHEREAS, Absolute Service, Inc., was also a recipient of the Best Employer Award given by the Social Security Service (SSS) for not only sustaining and surpassing the superior service and high quality work but also providing job opportunities to all regardless of age, sexual orientation, and physical capacity;

WHEREAS, no less than the President of the Republic, His Excellency Benigno Aquino, III handed over the award to Professor Danilo J. Piano, ASI- Philippines President during a ceremony held at the Marriott Hotel, Manila;

NOW, THEREFORE, on motion of Councilor James G. Delos Reyes, with the unanimous accord of the Members of the Sangguniang Panglungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panglungsod in session assembled to congratulate, as it hereby congratulates Absolute Service, Inc. as Recipient of a Special Award in the 2011 Employers Confederation of the Philippines (ECOP) KAPATID National Awards.

A RESOLUTION EXTENDING OUR WARMEST CONGRATULATIONS TO ATTY. DEO AMOR DAVID FOR BEING ADJUDGED AS THE MOST OUTSTANDING CHAPTER PRESIDENT, CATEGORY B OF THE INTEGRATED BAR OF THE PHILIPPINES

WHEREAS, Atty. Deo Amor David is a native of Municipality of Castillejos, Province of Zambales and one of the promising legal practitioners not only within our sphere but goes beyond its border;

WHEREAS, he has been characterized by his legal brethren within the legal circle as a hardworking lawyer practicing with humility. Inevitably, this trademark did not escape the eyes of his fellow brothers in profession, thus on February 2009 he was elected as the Chapter President of the Integrated Bar of the Philippines Olongapo-Zambales Chapter;

WHEREAS, immediately upon assumption into office, Atty. Deo Amor David introduced several innovations in his chapter, reliving camaraderie and fellowship among legal circle with its regular “Kapihan sa IBP” through constant communications with trial judges, prosecutors and court officials and employees for the efficient and effective administration of justice, assignment of IBP Legal Aid Lawyers in every branch of the courts, conducting regular legal aid clinic, distribution of school supplies and relief goods to indigent families and holding regular sport programs;

WHEREAS, his leadership has moved the IBP - Olongapo-Zambales Chapter to greater heights which gained strong and active participation by its members in all its activities and projects;

WHEREAS, at the helm of his governance as Chapter President of Integrated Bar of the Philippines Olongapo-Zambales Chapter, Atty. Deo Amor David was able to secure the right to host the 13th National Convention of Lawyers on April 7 to 10, 2011 to be held at Subic Bay Freeport Zone;

WHEREAS, the untiring efforts of Atty. Deo Amor David leading the chapter to broaden its horizon did not escape the attention of the awarding body of the Integrated Bar of the Philippines, National chapter for which reason, he was adjudged as an OUTSTANDING CHAPTER PRESIDENT Category B during the recently concluded 13th National Convention of Lawyers on April 7 to 10, 2011 at Subic Bay Freeport Zone.

NOW, THEREFORE, on motion of the City Councilor Noel Yabut Atienza, with the unanimous accord of Members of the Sanggunian Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by Sangguniang Panlungsod in session assembled, to extend, as it hereby extends our warmest congratulation to Atty. Deo Amor David for being adjudged as the Most Outstanding Chapter President, Category B of the Integrated Bar of the Philippines.

A RESOLUTION EXTENDING OUR WARMEST CONGRATULATIONS TO THE OFFICERS AND MEMBERS OF THE INTEGRATED BAR OF THE PHILIPPINES OLONGAPO-ZAMBALES CHAPTER FOR THE SUCCESSFUL HOSTING OF THE 13TH NATIONAL CONVENTION OF LAWYERS HELD LAST APRIL 27-10, 2011 AT THE SUBIC BAY EXHIBITION AND CONVENTION CENTER, SUBIC BAY FREEPORT ZONE

WHEREAS, the Integrated Bar of the Philippines Olongapo-Zambales Capter has been awarded the right to host the 13th National Convention of Lawyers on April 7 to 10, 2011;

WHEREAS, with strong determination and courage, the Integrated Bar of the Philippines Olongapo-Zambales Chapter has taken the challenge and organized one of the best ever conversations held in the history of Integrated Bar of the Philippines;

WHEREAS, with a limited resources, the Integrated Bar of the Philippines Olongapo-Zambales Chapter has tremendously worked overtime to come up with an organized and memorable convention to be held at the heart of economic bastion of the Philippines, Subic Bay Freeport Zone;

WHEREAS, true indeed, the IBP – Olongapo-Zambales Chapter through the hardwork and perseverance of its officers and members, garnered another milestone in its fold for having achieved in attendance, with no less than the Vice-President of the Philippines, Hon. Jejomar C. Binay who led the array of convention speakers who discussed about the integrity and credibility of a lawyer;

WHEREAS, the Integrated Bar of the Philippines Olongapo-Zambales Chapter in collaboration with its National Officers has come up with a complete 36 units of Mandatory Continuing Legal Education (MCLE) for the delegates covering accredited topics in laws and procedures with excellent line up of resource speakers;

WHEREAS, after the culmination of the four-day convention, delegates from all over the Philippines were delighted with benefits and happiness brought by the convention knowing fully well that their time and efforts in attending the said convention have added to their personal growth;

WHEREAS, by reason of the successful hosting of the 13th National Convention of Lawyer from April 07 to 10, 2011 by the Integrated Bar of the Philippines Olongapo-Zambales Chapter has a beneficial effect on the economic and tourism aspect not only with the Subic Bay Freeport Zone but likewise with the City of Olongapo;

NOW, THEREFORE on motion of City Councilor Noel Yabut Atienza, with the unanimous accord of the Members of the Sanggunian Panlungsod present;

AN ORDINANCE TEMPORARILY CLOSING MABINI STREET FROM RIZAL CORNER CAYETANO STREET OF BARANGAY NEW CABALAN, OLONGAPO CITY TO TRAFFIC FROM 5:00 PM TO 1:00 PM DAILY STARTING MAY 11 TO 21, 2011 AS VENUE FOR THEIR NIGHT BAZAAR IN CONNECTION TO THEIR FIESTA 2011, SUBJECT TO PERTINENT LAWS

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The Mabini Street from Rizal Street corner Cayetano Street, Barangay New Cabalan, Olongapo City is declared temporarily closed from 5:00p.m to 1:00p.m daily from May 11 to 21, 2011.

SECTION 2. The above-mentioned temporary closure is in line with the Night Bazaar Project of Barangay New Cabalan on their Fiesta 2011.

SECTION 3. This Ordinance shall take effect upon its approval

AN ORDINANCE AMENDING ORDINANCE NO. 25 SERIES OF 1995 (RE: PAYMENT OF PER DIEMS FOR MEMBERS OF THE PEOPLE’S LAW ENFORCEMENT BOARD)

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Section 1 of Ordinance No. 25, Series of 1995 is hereby amended to read as follows:

“Section 1. Pursuant to the provisions of Section 61, Republic Act No. 8551otherwise known as the “Department of the Interior Act of 1990”, as implemented by Section 7, Rule III of NAPOLCOM memorandum Circular No. 91-002, the Chairman and Members of the People’s Law Enforcement Board (PLEB) of Olongapo City are hereby provided with per diems for each actual attendance at a hearing of the Board in accordance with the following rates, to wit:

Chairman------Php 1,500.00 per hearing
Secretary------Php 750.00 per hearing
Other Members----Php 750.00 per hearing

Provided, that the number of hearings which shall be credited for the payment of the per diems hereinabove fixed shall not exceed four every month.
