Call to Order

The City Vice-Mayor and Presiding Officer Cynthia G. Cajudo called the session to order at 3:45 in the afternoon.

Roll Call

With nine (9) members and the Presiding Officer present, a quorum was declared. However, Councilors Gina Perez arrived during the Reading and Approval of the Day’s Agenda and Carlito A. Baloy during Committee Reports.

Reading and Adoption of Minutes

With no questions nor objections the body adopted the minutes of its regular session held last July 4, 2007, on motion of Councilor Marey Beth D. Marzan.

Before the approval of the agenda, the Presiding Officer clarified to the Council Secretary if copies of the drafts in the items on second reading, specifically items nos. 7, 8, 9 and 10 were already provided because she has no copy. The Council Secretary replied neither she has the copy of the drafts.The chair also asked if the Council Members have their copy and they answered negative. Councilor delos Reyes said he intends to table Draft Resolution No. 11.

Finally, on motion of Councilor Rodel Cerezo, the body approved the agenda for the day’s session except for items 7, 8, 9 and 10.

Communications Read:

1. Resolution No. 443, Office of the Sangguniang Panlungsod of Zamboanga. In behalf of their people, the council totally supported the intended Malacañang initiative to grant executive clemency to Senators-Elect Antonio F. Trillanes and Gregorio B. Honasan, for the best interest of the country. They were to transmit the resolution to Her Excellency President Gloria Macapagal-Arroyo and furnish copies to all Sangguniang Panlungsod, Panlalawigan and Bayan throughout the Philippines and to Honorable Senators Trillanes and Honasan. Councilor delos Reyes clarified that the findings and recommendations were formally submitted to the Sangguniang Panlungsod in compliance with the rules of barangay cases and the decision was rendered within 30 days. But, after learning that the findings submitted were not signed by the Chairman, Councilor delos Reyes and Vice Chairman Councilor Marzan, the Presiding Officer decided to return it to the Committee for their proper signatures.

9. Letter from Rexy G. Cruz, City Executive Regulator, Subic Bay Regulatory Board addressed to Ms. Edna G. Canlas, General Manager, Subicwater and Sewerage Co. Inc., wherein the City Mayor called their attention regarding the numerous excavations going on in the City which inconvenienced the public who were complaining. The problem was discussed by Subicwater and Engineering Department last July 12, 2007. According to Executive Regulator Rexy Cruz it was observed that there was no change particularly at Arthur Street. In fact the works seems to have slowed down. (For information and guidance)

10. Letter from Samuel L. Matias leader of TUBIG, Olongapo City, addressed to Hon. JC. delos Reyes, Chairman, Committee on Laws, asking why Councilor Lipumano was not given committee chairmanship and was not even a member of any committee. 11. 18. Committee report of Councilor Ellen Dabu on the monitoring of banned Chinese products, and the celebration of the National Disability Prevention and Rehabilitation Week last July 17-23, 2007 by the Social Welfare and Development Office.

Committee Reports

Councilor Gie Baloy rendered a joint committee report being the Chairman, Committee on Local Price Coordinating Council and Councilor Ellen Dabu, as Chairman, Committee on Markets and Slaughterhouse, pertaining to Councilor Gie Baloy’s request to the Department of Trade and Industry and the City Health Office, to investigate the proliferation of medicinal, herbal and banned food products imported from China. According to the Council, these were openly sold in drugstores, supermarkets, specialty shops, malls and sidewalks in the city, even without the requisite approval from the BFAD.

Based on the monitoring report submitted by Ms. Leonila Baluyut, Provincial Caretaker of the DTI in Zambales a monitoring was conducted by the City Local Price Coordinating Council composed of the DTI, City Health, Treasurer’s Office and the City Agriculture Office to identify the sale of banned Chinese products such as White Rabbit, Creamy and Milk Candy, Bairong Grape Biscuits and Yongkang Grape Biscuits.

This led to the inspection of establishments in the City of Olongapo and Subic Bay Freeport Zone. In the list, were six duty free shops in SBFZ, three stalls in James L. Gordon Public Market and five supermarkets in the city.

The outcome of the investigation revealed the following:

A. Rexie’s and Miriam’s Store in SBFZ, five (5) repacked plastics and six (6) packs of White Rabbit Creamy and Milk Candy were confiscated.

B. At Royal Duty free Shop also in SBFZ, the management was readily advised by their supplier to remove all White Rabbit Creamy and Milk Candy from their shelves long before the said product was banned.


C. All the monitored establishments were not found selling Bairong and Yong Kang Grape Biscuits.

The Councilor was still awaiting from the City Health Office, the report on the sale of china made herbal and medicinal products which were without BFAD approval.

Councilor Gina Perez reported the activities conducted concerning the Committee on Tourism. On the status of the proposed Olongapo City Investment Code, a committee hearing was called last July 20 to discuss the proposed ordinance. It was attended by the representatives from the Offices of the Budget, City Planning, Business Permit, DILG, Personnel as well as Councilors Gie Baloy and Jong Cortez. The discussion focused on the composition of the Investment Board Investment Center and Investment Incentives transpired. She invited her colleagues to attend the next scheduled hearing on July 31 at 9:00 a.m.

Councilor Perez also reported the meeting which was held in July 25 with the barangay Committee on Tourism. Discussions covered the following status of each Barangay’s Tourism Programs, the upcoming tourism activities which will include Awareness Seminar, Strategic Planning and Summit, and the anticipated tourism events in the city like the Ulo ng Apo Festival, Subik Subik Festival and the Ad Congress by November. In line with these events, an inspection and accreditation of various establishments were conducted by the Committee.

Also, in her report, the Councilor brought up the complaints of Barangay Barretto businessmen particularly their request to the City Mayor for assistance on the provisions of Portalets to be installed in tricycle terminals, and the designation of tourist police in the Barrretto business area.

Councilor Dabu reported about the seminar held by the Olongapo City Local Price Coordinating Council regarding Republic Act 7581. She explained that the Act provides protection to consumers by stabilizing the prices of basic necessities and prime commodities and prevention on undue price increases. She further explained that the seminar also concerns measures to improve and develop an efficient transport and distribution system, stabilize prices at reasonable level, as well as to institute appropriate penalties for illegal price manipulation.

After which she presented the work plan of the council for 2007-2008.

For her second report, she informed the body that the Social Welfare and Development Office celebrated the National Disability Prevention and Rehabilitation Week last July 17-23, 2007 with the theme “Kapag May Access, May Success”. One of the events was the Livelihood Day which was participated in by hundred of disabled persons who took part in various livelihood activities such as banana and camote chips, crispy and spicy dilis making. This was held at Old Cabalan.

Councilor delos Reyes brought out the matter concerning the issue on the proposed Coal-Fired Power Plant in Redondo Bay. Councilor delos Reyes mentioned that according to Councilors Perez and Cortez, it seemed like they were already informed about the concrete plan to build the said Coal-Fired Power Plant when they attended a meeting with SBMA. Councilor delos Reyes then reminded his colleagues about the Resolution that was approved last January 24. It was a resolution inviting Ms. Amethya Dela Llana. Manager of Ecology, SBMA and test consultants to conduct a formal briefing before the City Council and enlighten the members about the status of the proposed 150 mega-watt Coal Fired Thermal Power Plant at Brgy. Agusuhin, Subic, Zambales.

In order to give emphasis to the said resolution, Councilor delos Reyes read a paragraph under the Local Government Code, particularly Section 26 which states, “It shall be the duty of every national agency or government-owned or controlled corporation authorizing or involved in the planning and implementation of any project or program that may cause pollution, climatic change, depletion of non-renewable resources, loss of cropland, rangeland, or forest cover, and extinction of animal or plant species, to consult with the local government units, non-governmental organizations, and other sectors concerned and explain the goals and objectives of the project or program, its impact upon the people and the community in terms of environmental or ecological balance, and the measures that will be undertaken to prevent or minimize the adverse effects thereof.”

He informed the body that he intends to write the management of SBMA, a letter stating that mandatory consultations, under the Local Government Code, is under the terms and conditions of the Council of which the Members are the representatives of the people of Olongapo, and not dictated by SBMA.

He explained that as Chairman of the Committee on Laws and Human Rights protection and Vice-Chairman of Environment, he expressed his apprehension that if the SBMA will continue to pursue this project without consulting the Council, it may have an adverse effect as to the relationship between the City and SBMA is concerned. He added that as a matter of fact, SBMA conducted a meeting regarding this in Subic that day.

The Presiding Officer queried whether the letter of invitation to Ms. Dela Llana was properly coursed through. The Council Secretary answered that it was received by the Office of Ms. Dela Llana. Councilor delos Reyes added that before he relinquished his Chairmanship of the Committee on Environment to Councilor Cortez, he wrote a follow-up letter dated July 2 to Administrator Arreza, which remains unanswered to date.

The Chair requested Councilor Jong Cortez, being the new Chairman of the Committee on Environment, the task of making a follow-up to that request, which the Councilor gladly accepted. He also informed the body that in one of the SUBRA meetings he attended together with Atty. Dilag, they were able to have the chance to tell Mr. George Lorenzana and the others who were in the meeting that they are invited to come if a public hearing will be held in Olongapo to be conducted by SBMA and the proponents of the project.

Councilor delos Reyes commented that this issue was already published in the news paper in June 29, thus, it appears that the project was all systems go.

According to Councilor Cortez, there were reports that people of SBDMC have started conducting soil testing in the area and SBMA has already advised the fisher folks to avoid that area. He also informed the Chair that he was able to attend the meeting of the SUBRA upon the request of the City Mayor.

The discussion caused a great concern for all the members because of the lack of knowledge on their part about the Coal Power Plant Project, considering that Olongapo City can be directly affected by any effects that may result from its operation. Councilor Cortez explained that the said power plant is just adjacent to Hanjin Shipyard. Hanjin is at Sitio Agusuhin, Brgy Cawag, Subic, Zambales, so technically, the project will fall under the jurisdiction of Subic, Zambales. However, said area was also claimed by SBMA since it was a military reservation.

The Presiding Officer expressed her concern that they really need to be briefed or be given an orientation on what the project was all about so she asked Councilor Cortez to follow-up the letter issued by Councilor delos Reyes to SBMA.

For the next committee report, Councilor Marzan informed the body about the result of their review on the annual budget of Brgy East Tapinac which is already on second reading. It was reviewed together with Vice-Mayor Cajudo except Councilors Buenafe and Lipumano. After the deliberation, it was found out to be in accordance with the guidelines and prescriptions for the passage of a barangay budget.

Also under second reading, regarding ordinance withdrawing portions of the Volunteers Park, the Councilor, together with Councilor Gie Baloy, wrote a letter to Brgy. Capt. Apalit and Mayor Gordon for the posting of the notice of public hearing set on August 10, 9:30 a.m. at the Session Hall. She mentioned about the letter of Councilor Perez also concerning the matter which will also be given consideration. She, likewise, said that they were reviewing national laws like the NIPAS Act that might also affect the proposed Ordinance.

With regards to the appropriations for the Convention Center and Early Childhood Care Development, she informed the body that the Certification of the Availability of Funds was already secured from the City Treasurer.

Before proceeding to the discussion of the Calendar of Business, the Chair recognized the presence of Councilors Gina Perez, Carlito Baloy and Robine Rose Buenafe.


Calendar of Business

Second Reading:

1. Draft Resolution No. 2007 – R-20 – A Resolution Approving The Annual Budget Of Barangay East Tapinac, City Of Olongapo For The Calendar Year 2007, was approved unanimously on second and final reading, on motion of Marey Beth D. Marzam on behalf of Councilor Piano.

2. On motion of Councilor Marzan in behalf of Councilor Gie Baloy, Draft Ordinance No. 2007 – O-02 – An Ordinance Withdrawing Portions (As Described In The Attached Site Development Plan ) Of The Left And Right Wing Side Of The Volunteers Park From Public Use And Declaring Them As Patrimonial Property Of The City was tabled pending completion of the technical and legal requirements, and to be lifted as soon as everything is completed.

3. Draft Ordinance No. 2007 – O-03 - An Ordinance Appropriating The Amount Of Thirty Nine Thousand Five Hundred Pesos ( PhP39,500.00) To The Item Other Machineries And Equipment Under The Capital Outlay Of Olongapo City Convention Center From The Special Account – Olongapo City Convention Center was approved unanimously on second and final reading, on motion of Councilor Marzan.

4. For the next item. Councilor Marzan discussed to the body the content of the draft ordinance. Attached in the draft was the approved ECCD Program with its corresponding work and financial plan. The Councilor said that in the appropriation part, there is a need to appropriate PhP1,000,000.00 for the year and the years thereafter which shall be included in the city’s annual budget. The PhP1,000,000.00 funding needed for this year can be appropriated because certification of the Availability of Funds was already secured. The Councilor further explained that the National Office, in return, will give the City PhP5,000,000.00 intended for the city’s children. A trust account for the said undertaking shall also be created.

Before the discussion of the Draft Ordinance on the Early Childhood Care Development (ECCD) Investment Plan and Providing Funds Thereof, the Chair recognized the presence of Ms. Gene Eclarino, City Social Welfare Officer and Ms. Nova together with a visitor from Zambales.

Councilor Lipumano-Garcia queried if the said program will only be given to three barangays. Councilor Marzan referred the question to the CSWD.

Ms. Gene Eclarino, the CSWDO Head, explained that based on the standards given to them by the National Council for the Welfare of Children, there were only three (3) barangays identified to be the pilot areas for this ECCD Program. These are Brgys. Sta. Rita, Gordon Heights and New Cabalan. From the surveys conducted, these three barangays has the most number of children. The basic services to be given include health services, education and parenting capability. Children in the crucial age, 0-6 years, will be the priority of the program. Furthermore, Ms. Eclarino said that it will be a pilot program.

The Presiding Officer asked if the city had any previous similar programs. Ms. Eclarino confirmed, there is, but the ECCD program will further enhance the previous programs due for the budget to be given by the National Council.

With no other observations made, Draft Ordinance No. 2007 – O-04 An Ordinance Adopting The 2007-2009 Early Childhood Care Development (ECCD) Investment Plan And Providing Funds Thereof was approved unanimously on second and final reading, on motion of Councilor Marey Beth D. Marzan.

5. Draft Resolution No. 2007 – R-21 – A Resolution Authorizing The City Mayor To Open A Special Account In The Designated Government Bank For The Purpose Of The ECCD Expansion Program, was approved unanimously on second and final reading, on motion of Councilor Marey Beth D. Marzan.

6. Draft Resolution No. 2007 – R-22 – A Resolution Ratifying The Memorandum Of Understanding (MOU) Entered Into By City Mayor James Gordon, Jr. For And In Behalf Of The City Government Of Olongapo And Subic Bay Metropolitan Authority (SBMA), Represented By Its Administrator And CEO Armand Arreza For The Sibit-Sibit Festival 2007, was approved unanimously on second and final reading, on motion of Councilor Gina G. Perez.

7. Draft Resolution No. 2007 – R-08 – A Resolution Authorizing The Experimental Re-Routing Of Public Utility Jeepneys Particulary PUJ-J-10 (Tabacuhan Yellow With Blue) And PUJ-J-04 (Mabayuan Green) was tabled on motion of Councilor delos Reyes pending questions that need to be answered and to confer with traffic authorities on certain matters.

Other items on the agenda were not discussed particularly items 7, 8, 9 and 10.


Other Matters

A. The Chair announced the receipt of a Red Alert Notice coming from the National Transmission Corporation dated July 23, 2007 which alerts the public of the impending power cut-offs on a daily basis. She encouraged that being in the government, we should set an example by implementing some measures to decrease the power consumption in the city government. She suggested that on the part of the Sanggunian air conditioning units must be turned-on at 9:00 a.m. and turned-off at 4:00 p.m.

B. Councilor delos Reyes, for his part being the Chairman of the Committee on Public Utilities, strongly recommended the filing of cases against those who will be caught directly and indirectly committing illegal connections. He suggested that this should be initiated by the management of the PUD.

There must be a massive information campaign in order to let the people know the importance of conserving energy . Councilor Perez said this is where she could help being a media practitioner.

D. In line with the celebration of the occasion of its 93rd year Anniversary of the Iglesia ni Cristo. Draft Resolution No. 2007 – R-28 – A Resolution Extending Warmest Greetings And Congratulations To The Iglesia Ni Cristo (INC) On The Occasion Of Its 93rd Year Anniversary, was considered an urgent matter and was approved on its first, second and final reading. The resolution will be presented to Iglesia ni Cristo on July 28, 2007.

WHEREAS, Republic Act No. 8980, an Act Promulgating a Comprehensive Policy and a National System for Early Childhood Care and Development, otherwise known as the ECCD Act, signed into law on December 5, 2000 declares the policy of the State to institutionalize a National System for Early Childhood Care and Development (ECCD) within a period of five (5) years that involves multi-sectoral and interagency collaboration at all levels of government;

WHEREAS, the same law stipulates the responsibilities of the Local Government Units (LGU) specifically Section 7 (b)(4) which specifies that LGU is required to provide counterpart funds for the training and continuing education of ECCD service providers, and to support the operations of Provincial, City/ Municipal and Barangay ECCD Coordinating Committees;

WHEREAS, Olongapo City as one of the beneficiaries of the Early Childhood Care and Development (ECCD) expansion program accordingly allocated corresponding funds for the CWC/NECCDC;

WHEREAS, recognizing the need of a comprehensive, integrative and sustainable system to promote the rights, needs and protection of children, the City Government represented by City Mayor Hon. James Gordon, Jr, has signed a Memorandum of Agreement (MOA) with the Council for the Welfare of Children (CWC/NECCDCC) and the Regional Sub Committee for the Welfare of Children (RSCWC) to address these concerns;

WHEREAS, the said MOA, indicates, as enumerated by Article V (3.3.1-3.3.14) the responsibilities of the Local Government Units, in addition to the functions identified in the ECCD Act and the Local Government Code;

WHEREAS, the said MOA has identified that the total cost of counterpart fund by the City Government of Olongapo for the projects/ programs/ activities to implement the ECCD program to be Three Million Pesos (Php3,000,000.00) in accordance with the financial arrangements, in conjunction with the CWC/NECCDCC as specified in Article IV (4.4) of the said Agreement;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 22

AN ORDINANCE ADOPTING THE 2007-2009 EARLY CHILDHOOD CARE DEVELOPMENT (ECCD) INVESTMENT PLAN AND PROVIDING FUNDS THEREOF

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Short Title. This Ordinance shall be known as the “ECCD INVESTMENT PLAN.”

SECTION 2. Definition Of Terms. Unless the context otherwise requires, the term/s defined in the ECCD Law and of this Ordinance shall have the following meanings:

Investment Plan – a three (3) year plan of the City Government for the ECCD program approved by the City Council with corresponding Annual Work and Financial Plan (AWFP).

SECTION 3. Adoption of ECCD Investment Plan. This Ordinance adopts the 2007-2009 Early Childhood Care Development (ECCD) Investment Plan incorporated herein and shall be made an integral part hereof;

SECTION 4. Appropriations. The amount of Eight Million Pesos shall be appropriated in the investment plan. Five Million shall come from the National Government through the Council for the Welfare of Children (CWC/NECCDCC) and the Regional Sub Committee for the Welfare of Children (RSCWC) and the remaining Three Million from the City Fund. One Million Pesos (Php1,000,000.00) is hereby appropriated for the year 2007 from the unappropriated balance to be earmarked in a Trust Account – ECCD, effective upon the approval of this Ordinance. The remaining Two Million (P2,000,000.00) shall be integrated in the Budget of the City effective 2008 to 2009, where in One Million Pesos for each year shall be allocated in the said trust account.

SECTION 5. Trust Account (ECCD). A trust account shall be created for the purpose of this undertaking. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 6. Separability Clause. If any provision of this Ordinance is declared unconstitutional, the same shall not affect the validity and effectivity of the other provisions thereof.

SECTION 7. This Ordinance shall take effect upon its approval.

A RESOLUTION AUTHORIZING THE CITY MAYOR TO OPEN A SPECIAL ACCOUNT IN THE DESIGNATED GOVERNMENT BANK FOR THE PURPOSE OF THE ECCD EXPANSION PROGRAM

WHEREAS, Resolution No. 138, Series of 2006 authorized the Hon. City Mayor James Gordon, Jr. to enter into a Memorandum of Agreement (MOA) in behalf of the Olongapo City Council for the Welfare of Children with the Regional Sub-Committee for the Welfare of Children (RSCWC) in relation to the Early Childhood Care and Development (ECCD) Program Implementation in the City;

WHEREAS, Article III (3.3.4) of the said Memorandum of Agreement stipulates that the City Government of Olongapo, represented by Hon. City Mayor James Gordon, Jr., is required to maintain a Special Trust Account solely for the funds received from CWC/NECCDCC intended for ECCD programs;

WHEREAS, Olongapo City is one of the beneficiaries of the Early Childhood Care and Development (ECCD) expansion program, thus, will be allocated the corresponding fund by the CWC/NECCDC and as such, required to open a Special Trust Account;

WHEREAS, being the proud beneficiary, the City Government of Olongapo City, best represented by the City Mayor, Hon. RESOLUTION NO. 81

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY EAST TAPINAC, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2007

On motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay East Tapinac, City of Olongapo for the Calendar Year 2007 considering that the budget as contained in Barangay Resolution No. 51, Series of 2007 of Barangay East Tapinac, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

The disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Development Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Section 287 of Local Government Code of 1991.

The appropriation for 5% Calamity Fund in the amount of Php117, 949.10 is deficient by Sixty Six Thousand Seven Hundred Twenty Five and 25/100 Pesos (66,725.25). Computed as follows:

Not withstanding the above deficiency in appropriation, which should be included in the first supplemental budget of the barangay.

Pursuant to Local Budget Circular No. 63 of the Department of Budget & Management dated 22 October 1996, “barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitation on personal services, the honorarium rates of said barangay officials may be adjusted”. However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:

SG-14 - For the Punong Barangay
SG-10 - For the Sanggunianng Barangay Members, Barangay Secretary and Barangay Treasurer.

The excess in the appropriation for 2% Discretionary Fund in the Amount of Seven Thousand One Hundred Sixty One and 32/100 (P7,161.32) should be reverted back to the Unappropriated Balance under the General Fund of the barangay computed as follows:

Total Share in Real Property Tax for P 806,439.32

2% thereof 16,128.78
Amount Appropriated 23,290.10
Excess P 7,161.32

That the amount of POWER BILLS appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sanggunian Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability may be properly liquidated/settled.

That appropriations herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

And finally, the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied. PROVIDED, that the City Accountant is enjoined to observe the above conditions.
