SC strips 16 cities of status

Sixteen Cities will Revert Back to being municipalities as the Supreme Court has ruled that the laws that converted them into cities last year were unconstitutional.

Voting 7 to 5 with two abstentions, the high court said the laws that gave city hood to 16 municipalities violated the Local Government Code.

The 16 cities that will revert back to towns are Baybay, Leyte; Bogo, Carcar and Naga in Cebu; Borongan, Eastern Samar; catbalogan, Samar; Tandag, Surigao del Sur; Tayabas, Quezon; Lamitan, Basilan; Tabuk, Kalinga; Bayugan, Agusan dek Sur; Batac, Ilocos Norte; Mati, Davao Oriental; Guihulngan, Negros Oriental; Cabadbaran, Agusan del Norte; and El Salvador, Misamis Oriental.

In a decision penned by Associate Justice Antonio Carpio, the high court said the laws that created the cities could not claim to be exempted from Republic Act 9009.

RA 9009, which took effect in June 2001, or six years before the city hood laws were passed, amended Section 450 of the Local Government Code to increase the annual income requirement for converting a municipality into a city from P20 million to P100 million.

“The Constitution is clear. The creation of local government units must follow the criteria established in the Local Government Code and not in any other law,” the ruling said.

Because President Macapagal-Arroyo did not sign the individual bills that elevated the 16 towns into cities, these lapsed into law between March and July 2007.

The Supreme Court upheld the petition of the League of Cities of the Philippines which argued that the “wholesale conversion” of municipalities into cities will reduce the share of existing cities in the Internal Revenue Allotment, since there would be more of them sharing the same amount of IRA set aside for all cities.

Associate Justice Dange Tinga, a former Taguig congressman, and Associate Justice Antonio Nachura, a former Western Samar congressman, took no part in the decision.

A RESOLUTION EXPRESSING APPRECIATION, COMMENDATION AND GRATITUDE TO THE FREE EYE DIAGNOSTIC SERVICES AND EYE LENSES EXTENDED BY THE THIRD WORLD EYE CARE SOCIETY OF CANADA TO THE PEOPLE OF OLONGAPO

WHEREAS, the Third World Eye Care Society of Canada (TWECS of Canada), a 100% volunteer-based charity composed of eye professionals and individuals conducting mission around the globe, visited Olongapo City on November 10 to 20, 2008 to render free cataract operations, eye diagnostic services, eye lenses and medicines for indigents of Olongapo City and outlying municipalities of Zambales and Bataan;

WHEREAS, armed with the mission “never lose sight of people in need,” optometrist Dr. Marina Roma- March, the Founder and President of TWECS, traveled with her an 18-member team composed of optometrists, eye surgeons and volunteers to provide prescription lenses and eye examinations to some 5,500 patients from Olongapo City and its outskirts;

WHEREAS, the gift of clear vision was also provided to some 16 patients through cataract operations;

WHEREAS, the organization brought a new level of awareness to the health care needs of the Olongapo constituency by focusing on the restoration of clearer eyesight, an effort extended by communities from Canada and other countries;

WHEREAS, the TWECS of Canada infused nourishing hope to those people whose clear sights were restored and left a positive difference in the hearts of the Olongapo community by their wholehearted service and random acts of kindness, for which the City is exceedingly grateful for;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod in session assembled, present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby expresses appreciation, commendation and gratitude to the free eye diagnostic services and eye lenses extended by the Third World Eye Care Society of Canada to the people of Olongapo.

Let a copy of this Resolution be furnished Dr. Marina Roma-March, the Founder and President of the Third World Eye Care Society of Canada for their information and record.

A RESOLUTION CONFIRMING THE APPOINTMENT OF ENGINEER ROBERTO E. ALVAREZ AS ACTING CITY GOVERNMENT DEPARTMENT HEAD II (CITY ENGINEER) SG-26

WHEREAS, the City Mayor hereby appoints Engineer Roberto E. Alvarez as Acting City Department Head II (City Engineer) SG-26;

WHEREAS, Section 454(d) of Republic Act 7160 otherwise known as the Local Government Code of 1991, provides that heads of departments shall be appointed by the City Mayor with the concurrence of the majority of all members of the Sangguniang Panlungsod;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to confirm, as it hereby confirms, the temporary appointment of ENGINEER ROBERTO E. ALVAREZ as Acting City Government Department Head II (City Engineer) SG-26 which effects the appropriation in the amount of Three Hundred Twenty Seven Thousand Pesos (PhP327,000.00) in the item City Government Head II under the account “Salaries” of the Engineering Department.

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT :

SECTION 1. First Street (1st St.), fronting St. Columban Church corner Magsaysay Drive to corner of Fendler Street is declared temporary closed from 6:00 a.m. to 4:00 p.m. of November 20, 2008.

SECTION 2. The above-mentioned temporary closure is in line with the St. Columban Church Healing Eucharist to be Presided by Rev. Fr. Joey Faller.

SECTION 3. Re – routing of vehicles to be outlined by the Office of the Traffic Management and Public Safety is necessary during the said closure.

SECTION 4. This Ordinance shall take effect upon its approval.
