A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO REPRESENT THE CITY OF OLONGAPO TO ENTER INTO A MEMORANDUM OF AGREEMENT BETWEEN THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS FOR THE IMPLEMENTATION OF THE SPECIAL LOCAL ROAD FUND (SLRF) UNDER REPUBLIC ACT 8794 OR THE MVUC LAW

WHEREAS, Pursuant to Republic Act No. 8794, the Motor Vehicle User’s Charge Law (MVUC Law), under Section 1 which declares that “it is the policy of the State to provide for and ensure the adequate maintenance of national and provincial roads through sufficient funding for the purpose”;

WHEREAS, Section 7 of the said Act, which states that all monies collected under this Act shall be earmarked solely and used exclusively (1) for road maintenance and improvement of road drainage, (2) for the installation of adequate and efficient traffic lights and road safety devices, and (3) for air pollution control”. It further provides that 5% of all monies collected shall be deposited in the National Treasury under the Special Local Road Fund (SLRF), which shall be apportioned to provincial and city governments in accordance with the vehicle population and size of the road network under their respective jurisdiction, and shall be used exclusively for maintenance of local roads, traffic management and road safety devices. It also directs that the Special Fund, the Special Local Road Fund and Special Road Safety Fund shall be under the DPWH;

WHEREAS, pursuant to Sections 3 and 5 of Executive Order No. 124, dated 30 January 1987, the DPWH shall decentralize its responsibilities to the fullest extent possible; and, may delegate to any agency it determines to have adequate technical capability, any of its powers and functions. Consistent with its policy of decentralization, the DPWH shall assist the LGUs in developing the latter’s capabilities by allowing them greater participation in the local road maintenance and safety provisions;

WHEREAS, it is necessary that a Memorandum of Agreement should be entered into for the purpose of delineating responsibilities regarding the implementation of policies, standards and procedures at the LGU level in accordance with the pertinent provisions of the SLRF under MVUC Law and its IRR;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino co-sponsored by Councilors Edwin J. Piano, and Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it is hereby authorizes the Honorable City Mayor James Gordon, Jr. To Represent The City Of Olongapo To Enter Into A Memorandum Of Agreement Between The Department Of Public Works And Highways For The Implementation Of The Special Local Road Fund (SLRF) Under Republic Act 8794 Or The MVUC Law.

WHEREAS, the Lyceum Of Subic Bay examinees successfully passed the licensure examination for Customs Brokers given by the Professional Regulatory Commission last October 28-29, 2008;

WHEREAS, the City Government Of Olongapo is encouraging the youth to excel in their own field of endeavors;

WHEREAS, due to the long Christmas holiday and the delay of remittances from abroad due to global financial crisis, many real property taxpayers in the city were not able to avail of the twenty percent (20%) discount on advance payment of Real Property Taxes (RPTs) as provided under Section 2B.12 of the Olongapo City 2007 Revenue Code;

WHEREAS, the City Treasurer in coordination with the City Assessor and the City Finance Committee recommended the extension of the said program to taxpayers who will pay their Real Property Taxes (RPTs) in full for tax year 2009 on or before February 15, 2008;

SECTION 1. The position of Information System Analyst I Salary Grade 12 is hereby created in line with the staffing adjustments/movements of the Gordon College.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter-request of the Honorable City Mayor James Gordon Jr., dated 04 September 2008 and from Ms. Arlida M. Pame dated 11 August 2008 shall be made as integral parts of this Ordinance.

SECTION 4. This Ordinance shall take effect upon its approval.
