RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 44
(Series of 2009)

AN ORDINANCE APPROVING AND APPROPRIATING THE AMOUNT OF ELEVEN MILLION TWO HUNDRED SEVENTY FOUR THOUSAND PESOS (PHP11,274,000.00) AS SUPPLEMENTAL BUDGET FOR CALENDAR YEAR 2009

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The Supplemental Budget of the City of Olongapo for Calendar Year 2009 in the amount of Eleven Million Two Hundred Seventy Four Thousand Pesos (PhP11,274,000.00) is hereby approved.

The budget documents consisting of the following are incorporated herein and made integral part of this Ordinance:

1. LBP Form No. 9 – Statement of Funding Sources (SB No. 4)
2. LBP Form No. 10 – Statement of Supplemental Appropriation

SECTION 2. SOURCES OF FUNDS. The sources of funds for the Supplemental Budget in the total amount of Twenty Four Million Four Hundred Sixty Four Thousand Four Hundred Eleven Pesos (PhP24,464,411.00) shall be taken from the unappropriated balance of the General Fund.

SECTION 3. USE OF FUNDS. The amount of Eleven Million Two Hundred Seventy Four Thousand Pesos (PhP11,274,000.00) is hereby appropriated for the Supplemental Budget of the City of Olongapo, as follows:

Summary of Appropriations (see attached LBP Form No. 10 – Statement of Supplemental Appropriation for details)

SECTION 4. SEPARABILITY CLAUSE. If, for any reason, any section or provision of this Ordinance is declared invalid or unconstitutional, other sections or provisions thereof which are not affected thereby shall continue to be in full force and effect.

SECTION 5. EFFECTIVITY. The provisions of this Ordinance shall take effect upon its approval.

WHEREAS, Olongapo celebrated the 50th anniversary of its turn over from the American Government to the Philippine Government last December 7, 2009;

WHEREAS, the Sangguniang Panlungsod passed Resolution No. 168, Series of 2009; authorizing Mayor James Gordon. Jr. to enter into a Memorandum of Understanding (MOU) with the Philippine Postal Corporation for the printing and issuance of Commemorative Stamps depicting the 50th Anniversary;

WHEREAS, the said stamps, which is a collectors item is ready for sale and the proceeds of which will cover the expenses incurred and shall be earmarked for the establishment of Olongapo Center for Historical Studies or any other related purposes;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 43
(Series of 2009)

AN ORDINANCE PRESCRIBING FEES FOR THE OLONGAPO CITY 50TH ANNIVERSARY COMMEMORATIVE STAMP AND CREATING A SPECIAL ACCOUNT THEREOF

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Below herewith are the rates for Olongapo City 50th Anniversary Commemorative Stamp:

1) Package A – Includes a six-page Commemorative Folder showing a collage of Olongapo City, Message from Mayor James “Bong” Gordon, Jr., the City’s 10-Point Agenda, a brief history of the City and the lists of Awards and Recognitions earned by the City through the years. As the highlight of this package, it contains eight (8) pieces commemorative stamps and:

Official First Day Cover and two (2) cancelled commemorative stamps on it.

Selling Cost – P600.00/piece or P1, 500.00 for 3 pieces

2) Package B – Includes eight (8) commemorative stamps on a parchment paper bearing the Official Seal of both the US and the Philippines with printed text of the 50th Anniversary of the turn-over.

Selling Cost – P150.00

3) Package C – Includes an Official First Day Cover depicting the “Most Competitive City” award of Olongapo with two (2) cancelled commemorative stamps on it.

Selling Cost – P100.00

SECTION 2. A special account shall be created for this purpose.

SECTION 3. The special account shall be subject to the usual accounting and auditing rules and regulation.

SECTION 4. This Ordinance shall take effect upon its approval.

WHEREAS, the City of Olongapo has long been campaigning for the apprehension of Colorum tricycles, jeep, and van vehicles and as such conducted two public hearings to iron out the issues, specifically on the traffic citation ticket presently used by the City;

WHEREAS, the existing traffic citation ticket issued by the office of the Olongapo Traffic Management & Public Safety to traffic violators does not include the following City Ordinances;
City Ordinance No. 106, Series of 2000, Section 10a, An Ordinance Amending Section 10 Of Ordinance No. 9, Series Of 1995, In Relation To Section 5(6) Of The Same, Otherwise Known As “An Ordinance Further Amending Certain Sections Of Ordinance No. 3, Series Of 1983 Otherwise Known As The Jeepney Ordinance Of 1983, “And Amending Section 11 Of Ordinance No. 4, Series Of 1983, In Relation To Section 9 Of The Same, Otherwise Known As “An Ordinance Regulating And Monitoring The Operation Of For Hire Public Utility Motorized Tricycles In The City Of Olongapo And For Other Purposes”

SECTION 10 – Penal Provisions.
a. Violation of any provisions of this Ordinance shall be punished. Provided further, that any violation of the provisions of this Ordinance, which includes the non-wearing of proper and current Identification Card (ID) by the driver shall result in the impounding of the jeepney unit at the designated City Government Impounding Area, which shall be released only when the requirement of the provisions of pertinent Ordinances on impounding has been issued.


City Ordinance No. 83, Series of 2000, “An Ordinance Prohibiting The Operation Of “Colorum” Public Utility Transportation Vans Or Service Utility Vehicles (Suv’s) Plying And/Or Passing Through The Olongapo City Route Without First Securing A Franchise From LTFRB And A Favorable Indorsement/Approval From The City Government Of Olongapo And In Effect Amending Section 1 Of Ordinance No. 19, Series Of 2000 Known As The “Ordinance Prescribing Rates Or Fees For The Impounding Of Colorum, Stalled Or Illegally Parked Vehicles And For Other Purposes”

City Ordinance No. 69, Series of 2005, “An Ordinance Amending Ordinance No. 95, Series Of 2002”

SECTION 1.
a. It is unlawful for any individual/person to adopt the required body colors of a legitimate public utility vehicle for privately owned vehicle/tricycle;

b. All privately owned vehicles even not using the same color as in Section 1 of this Ordinance used for public utility without acquiring a franchise is considered a colorum vehicle. These vehicles are also subject to the penalties hereunder set forth.

WHEREAS, the said three City Ordinances will equip the officers of the OTMPS on apprehending drivers with the said specific violations;

WHEREAS, the Sangguniang Panlungsod deems it best to update the violations stated therein in the TCT;

NOW, THEREFORE, on motion of City Councilor Aquilino Y. Cortez, Jr. with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 42
(Series of 2009)

AN ORDINANCE UPDATING THE TRAFFIC VIOLATIONS LISTED IN THE TRAFFIC CITATION TICKET (TCT) ISSUED BY THE OFFICE OF THE TRAFFIC MANAGEMENT & PUBLIC SAFETY (OTMPS) TO TRAFFIC VIOLATORS

BE IT ORDAINED, BY THE SANGGUNIANG PANOUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The updated list of violations be reflected on the TCT to be issued by the OTMPS to traffic violations and such TCT shall form as integral part of this Ordinance.

SECTION 2. This Ordinance shall take effect after 15 days of posting in 3 conspicuous areas within the City.
