A RESOLUTION COMMENDING BARANGAY CHAIRMAN RAFALE SANTULAN, JR. AND THE BARANGAY COUNCIL OF WEST BAJAC-BAJAC, THIS CITY FOR THEIR SIGNIFICANT CONTRIBUTIONS AS PART OF THE CRISIS COMMITTEE, THAT LED TO THE ARREST OF THE SUSPECT IN THE HOSTAGE TAKING INCIDENT LAST APRIL 3, 2012 IN OLONGAPO CITY

WHEREAS, last April 3, 2012, the Olongapo Police Station 1 received a spot report regarding the hostage taking incident at Arthur Street, West Bajac-Bajac, Olongapo City involving Francisco Gonzales Mamolo, the hostage taker and the victim, a female minor;

WHEREAS, before the police response, eyewitnesses reported that Barangay Chairman Rafael Santulan, Jr. of West Bajac-Bajac was already there at the scene rendering initial negotiations with the suspect and coordinated with the police and higher authorities;

WHEREAS, it was through his initiative that the report was disseminated and was acted upon by Station 1 Commander, PSINSP Vicente L. Gabarda, secured the scene and informed higher authorities, together with the TEU Chief, PCINSP Cesar B. Cabling set up the initial negotiation with the suspect;

WHEREAS, the Office of the City Director was informed and together with DCDO and the Chief of CIB, immediately proceeded to the area for assessment and supervision. A crisis committee was immediately formed, where Barangay Captain Santulan, Jr. and members of the West Bajac-Bajac Barangay Council, were also part of, to effectively handle the situation;

WHEREAS, the SWAT Team led by PSUPT Luisito C. Bolivar was also deployed at the strategic location to assist the police secure the area;

WHEREAS, Captain Santulan, Jr. and his councilmen, were among those who braved the imminent harm and placed their lives at stake as they came nearer to the site. But after 10 hours, the negotiation failed and the Crisis Committee implemented the final option to take assault to rescue and save the victim’s young life;

WHEREAS, the display of remarkable courage and readiness in this life-threatening rescue operation was witnessed by many, much more documented and televised in the entire country;

WHEREAS, these dauntless acts, attest that Olongapo is a city where barangay leaders are primed to face the enormous challenges head on despite the perils of duty;

WHEREAS, such bravery indeed uplifts the morale of all Olongapeños and those who uphold the rights of women and children, wherever they may be, to be rooted up and growing committed to the call;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present; 

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungosd in session assembled, to commend, as it hereby commends, as it hereby commends Barangay Chairman Rafael Santulan, Jr. and the Barangay Council of West Bajac-Bajac, this City for his significant contributions as part of the Crisis Committee, that led to the arrest of the suspect in the hostage taking incident last April 3, 2012 in Olongapo City.

A RESOLUTION AUTHORIZING THE OLONGAPO CITY’S PARTICIPATION AND COMPLIANCE WITH THE REGISTRATION REQUIREMENTS AND FOR TRANSACTIONS WITH DIRECT WHOLESALE ELECTRICITY SPOT MARKET PARTICIPANTS IN THE WHOLESALE ELECTRICITY SPOT MARKET (WESM) AS INDIRECT PARTICIPANT, AND AUTHORIZING THE HON. CITY MAYOR JAMES GORDON, JR. TO SIGN THE NECESSARY APPLICATION AND MARKET PARTICIPATION AGREEMENTS AND ALLIED INSTRUMENTS, IN A MANNER CONSISTENT WITH LAW

WHEREAS, it is vital that the city participate in the electricity market to ensure that there would be sufficient provisions or supply for the electricity requirements of the community consistent with Republic Act No. 9136 or the Electric Power Industry Reform (EPIRA) Law and its allied legislation;

WHEREAS, as per 25 April 2012 communication sent by the Philippine Electricity Market Corporation, the city is required to pass legislation embodying the local government unit’s authority to register and participate in the Philippine Wholesale Electricity Spot Market, and sign pertinent instruments herein-mentioned;

WHEREAS, there is an urgency to pass the required legislation on or before May 14, 2012 as May 15, 2012 is the final deadline for registration and application, otherwise, the city may be sanctioned with the eventual disconnection of its electric supply as provided under the Department of Energy Circular No. DC2010-05-0006, and which precipitate an electricity crisis;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present; 

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungosd in session assembled, to authorize, as it hereby authorizes the Olongapo City’s participation and compliance with the registration requirements and for transactions with Direct Wholesale Electricity Spot Market (WESM) as an indirect participant, and authorizing the Hon. City Mayor James Gordon, Jr. to sign the necessary application and market participation and allied instruments in a manner consistent with law.

NOW, THEREFORE, with the majority decision of the Members of the Sangguniang Panlungsod present;

A RESOLUTION AUTHORIZING THE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO THE RENEWAL OF A JOINT POLE USE AGREEMENT WITH THE SMART COMMUNICATIONS, INC.

WHEREAS, Smart Communications, Inc. a leading telecommunication service provider through their official contractor SLL International cables Specialist Corporation requested the city for the use of the 249 PUD poles for their telecom cables;

WHEREAS, there is a previous Memorandum of Agreement between the City Government and the Smart Communications signed last 1995 and the said MOA has expired last 2000. After assessment, it is deemed necessary to renew the said agreement with all the back pay and other fees applicable;

WHEREAS, committee meetings were held last May 25 and June 4, 2012 and the Smart Communications, through its authorized representatives, agreed to pay the rental fees of Two Hundred Fifty Pesos per pole per year as provided by the Olongapo Revenue Code, from the time of expiration of the previous MOA in 2000 up to the end year of the new MOA;

WHEREAS, other fees, taxes and charges due to the city shall be settled by the Smart Communications separately;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the majority decision of the Members of the Sangguniang Panlungsod present; 

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungosd in session assembled, to authorize as it hereby authorizes the City Mayor James Gordon, Jr. to enter into the renewal of a Joint Pole Use Agreement with the Smart Communications, Inc.

Marzan, City Budget Officer dated May 28, 2012 be made as integral parts of this Resolution.
