WHEREAS, the Philippine Constitution in its declaration of Principles and State Policies mandates that the state shall promote social justice in all phases of national development;

WHEREAS, as declared in Section two (2) of Chapter one (1) the Magna Carta for Disabled Persons, to wit; disabled persons are part of the Philippine society, thus the state shall give full support to the improvement of their total well-being and their integration into the mainstream of the society;

WHEREAS, the City Government of Olongapo believes that these laws should be given teeth and Persons With Disabilities (PWDs) should be provided with assistance to help them become productive members of the community;

WHEREAS, the Olongapo City Persons With Disabilities numbering around four hundred and forty two (442) are desirous to reestablish the permanent office of Persons with Disabilities Affairs (OPDA), for the purpose of providing each member a place to work with, venue for meetings and an area to maintain its records and documents;

WHEREAS, the thrusts on rehabilitation of disabled persons, the concern of the Government in order to foster their capacity to attain more meaningful, productive and satisfying life shall be given a larger focus when they have an office of their own;

WHEREAS, the establishment of this office will become a contributor to the welfare of persons with disabilities, as this will enhance their social functioning as well as promote equal treatment among them;

WHEREAS, further, in order to continuously sustain and carry out the tasks of documenting, monitoring, evaluating, data gathering, assessing, planning and its advocacy, the need for reestablishing an Office for PWDs is imperative so that its members and officers will be able to work well;

NOW, THEREFORE, on motion of Councilor Elena C. Dabu, with the unanimous accord of the Sangguniang Panlungsod Members present;

Section 1. This Ordinance shall be known as “An Ordinance Creating the Office of Persons with Disabilities Affairs”

Section 2. The said Office shall be located at____________________________.

Section 3. Repealing Clause. All existing ordinances, which are inconsistent with this Ordinance, are hereby deemed repealed and/or amended accordingly.

Section 4. Separability Clause. If any of the provisions or parts of this Ordinance is declared unconstitutional or invalid, the other provisions or parts hereof shall continue to be in full force and effect.

Section 5. This ordinance shall take effect upon its approval.

A RESOLUTION CONFERRING THE “ULO NG APO CAREER ACHIEVEMENT AWARD OF EXCELLENCE” TO MR. ABRAHAM T. ABIERTAS, RECIPIENT OF THE NATIONAL GAWAD KALASAG INDIVIDUAL HEROES AWARD IN THE NATIONAL CATEGORY OF “HEROIC ACT DURING EMERGENCY RESPONSE AND RESCUE OPERATIONS”


WHEREAS, Olongapo City hails the gallant spirit and commitment of one of its thin red liners in the aspect of disaster management and rescue operations, Olongapo City Fire-Rescue Team Member Abraham T. Abiertas, recipient of the 2006 National Gawad Kalasag Individual Heroes Award;

WHEREAS, on August 6, 2005 in the midst of a heavy downpour, 14-year old Romulo Alfonso, who was swept away by the raging current while swimming at the Sta. Rita River, was frantically reported to Hotline 117 of the Philippine National Police;

WHEREAS, knowing the danger entailed in the said situation, the Olongapo City – Rescue Team composed of Joel DL Himalin, Bonifacio De mesa, Allan Jahnke and Abraham Abiertas were dispatched immediately to the scene;

WHEREAS, Abraham Abiertas, known to his friends as “Abe” defied the dangers of the raging current and volunteered to perform the “one-man” life saving technique;

WHEREAS, Abe, equipped only with a life vest, a life ring, a prayer in his heart and trust for his teammates who were holding the end of the rope tied to his waist, decisively plunged into the water and swam towards Romulo;

WHEREAS, the raging waters swept Abe and Romulo for about 500 meters away where the boy was first seen. Beyond this, Abe’s commitment to the call of duty, armed him to cross over such huge challenge and just did a breathtaking, successful rescue operation witnessed by a cheering crowd;

WHEREAS, this death-defying yet life-saving feat earned him the respect and recognition of his peers, the entire department and the City leadership. His dedication, perseverance and unselfish efforts in saving lives and properties led him to be recommended to the prestigious Individual Heroes Award under the Gawad Kalasag of the National Disaster Coordinating Council which he triumphantly garnered on July 28, 2006;

WHEREAS, he did not only earn the respect of his fellowmen but had proven that the members of the Olongapo Fire-Rescue Team are indeed equipped, dependable, imbibed with sturdy values and worthy of emulation;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod, present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to confer, as it hereby confers the “Ulo Ng Apo Career Achievement Award Of Excellence” to Mr. Abraham T. Abiertas, recipient of the National Gawad Kalasag Individual Heroes Award in the national category of “Heroic Act During Emergency Response And Rescue Operations.”

WHEREAS, the country’s top seed tennis player, Patrick John Tierro merits the admiration of the international tennis arena as he cruised smoothly for his 7 wins - 3 losses in the singles, 4 wins - 0 loss in the doubles and 11 wins – 3 losses in the appearances on the prestigious Davies Cup Tennis Tournament;

WHEREAS, one of our illustrious athletes who made the Philippines conquer the international tennis frontier, Tierro’s inhausted discipline, sportsmanship values and contagious winning spirit will serve as an inspiration to the young populace of the City to invest their time in worthwhile activities and make a positive difference in the lives of their peers;

A RESOLUTION CONFERRING THE “ULO NG APO CAREER ACHIEVEMENT AWARD OF EXCELLENCE” TO MR. REGIE PABLO, FOR CONQUERING THE SUMMIT OF MOUNT EVEREST ON MAY 17, 2007, MAKING HIM THE 7TH FILIPINO TO ATTAIN SUCH FEAT

WHEREAS, the City memorializes the remarkable climb of Regidor “Regie” Pablo to the peak of Mount Everest on May 17, 2007;

WHEREAS, Regie Pablo gallantly trekked the longest route to the summit, the China route, believed to be the oldest journey to the apex, severely challenged his endurance, physique and spirit. This feat placed him as the seventh Filipino to reach the summit, but the First Filipino to dare and reach Mt. Everest through the said extended route;

WHEREAS, his never-say-die attitude and resilience taught him to take the tough journey ahead as well as the near-death descent without sustaining an injury, for which he was indeed so blessed of;

WHEREAS, his strength to finish it to the top amidst the great battle over the forces of nature and human frailty is a character worth emulating by the people of Olongapo;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod, present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to confer, as it hereby confers the “Ulo Ng Apo Career Achievement Award Of Excellence” to Mr. Regie Pablo, for conquering the summit of Mount Everest on May 17, 2007, making him the 7th Filipino to attain such feat.

A RESOLUTION PROVIDING FOR THE IMPLEMENTATION OF THE CONTAINERIZATION, COLLECTION AND TRANSPORT OF THE CITY’S SOLID WASTE IN ACCORDANCE WITH R.A. 9003

WHEREAS, Republic Act 9003, otherwise known as the Ecological Act of the Philippines, mandates every local government unit to immediately undertake the upgrading of the City’s Solid Waste Management System and in particular, the implementation of the containerization, collection and transport of solid waste;

WHEREAS, the approval of such undertaking shall not only make the City conform to the provisions of R.A. 9003 which required compliance as early as Year 2006 but shall also ensure the health of the City’s environment and its people;

WHEREAS, this resolution corresponds to the provisions stated in Ordinance No. 33, Series of 2007 otherwise known as the Olongapo City Ecological Solid Waste Management Plan for 2007-2011, which was unanimously approved by this august body.

NOW, THEREFORE, on joint motion of Councilors Aquilino Y. Cortez, Jr. and Angelito W. Baloy, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to provide, as it hereby provides for the implementation of the containerization, collection and transport of the City’s solid waste in accordance with R.A. 9003.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize as it hereby authorizes the winning bidder to import the following items needed for the implementation of the said project as stated in Ordinance No. 33, Series of 2007.

RESOLVED FINALLY, AS IT IS HEREBY FINALLY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes Honorable City Mayor James Gordon, Jr. to open a Letter of Credit with the Development Bank of the Philippines (DBP) for the immediate commencement of the project.

WHEREAS, Mr. Willie Miller called as “The Thriller” of the Philippine Basketball Association (PBA) had proven himself as one of the elite players in the professional league, tucked the Most Valuable Player Award for the second time and led his team, the Alaska Aces to the PBA Championships;

WHEREAS, Miller, a power point guard who hails from Olongapo City was one of the consistent take-charge guys of his team, a player for the National Collegiate Athletic Association representing Colegio de San Juan de Letran, the Philippine Basketball League (PBL) and the Metropolitan Basketball Association (MBA), was drafted before among the 57 equally competent players for the Batang Red Bull Team and then as a mid-season recruit by the Aces in a trade with Talk N Text;

WHEREAS, bubbling with youthful enthusiasm and personable demeanor, Willie Miller now serves as a source of inspiration for the young members of the populace and has brought pride and honor to the leadership and people of Olongapo known for their discipline, determination and excellence;

A RESOLUTION REQUESTING THE SANGGUNIANG PANLALAWIGAN OF ZAMBALES TO DECLARE VOID THE ORDINANCE COLLECTING THREE HUNDRED PESO-WORK PERMIT TO NON-RESIDENTS OF SUBIC, WORKING AT HANJIN SHIPYARD

WHEREAS, the Municipality of Subic, Zambales passed Municipal Ordinance No. 1, Series of 2008, requiring all non-Subic resident workers to secure Work Permit at a cost of Three Hundred Pesos;

WHEREAS, consequently, Hanjin Heavy Industries and Construction issued a memorandum to all workers requiring them to secure work permit in compliance to the said ordinance;

WHEREAS, Hanjin workers who are bonafide residents of Olongapo sought the assistance of Mayor James Gordon, Jr. through a letter dated May 11, 2008 to intervene on their behalf since the cost for the required permit will serve as additional burden to the already heartrending plight of the workers, in this difficult time that the prices of basic commodities had soared up;

WHEREAS, the workers further stressed in their letter that their workplace (Hanjin) is under the locational jurisdiction and governance of the Subic Bay Metropolitan Authority and as such they should have been exempted from the requirements provided by the said ordinance unless the SBMA Administration said so;

NOW, THEREFORE, with the unanimous accord of the Members of the Sanggunian Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to request, as it hereby requests the Sangguniang Panlalawigan of Zambales to declare void the Ordinance collecting Three Hundred Peso-Work Permit to non-residents of Subic, working at Hanjin Shipyard.
