A RESOLUTION REJECTING ANY MARKET STUDY FROM FINASIA LAND AND REALTY CORPORATION OR ANY OTHER ENTITY THAT SEEKS TO OUST GENUINE STAKEHOLDERS AT THE EAST BAJAC-BAJAC PUBLIC MARKET AND REAFFIRMING THE CITY’S COMMITMENT TO GENERAL WELFARE

WHEREAS, on 15 April 2009, the Sangguniang Panlungsod approved Resolution No. 50, Series of 2009, which primarily sought to redevelop the East Bajac Bajac Public Market (“EBB Market”) for the primary benefit of the people whose livelihood is based and conducted therein;

WHEREAS, on 27 May 2009, the Sangguniang Panlungsod approved Resolution No. 70, Series of 2009, for the purpose of maximizing the livelihood-and-job generating potential of the East Bajac Bajac Public Market (“EBB Market”), but placing emphasis on the need to ensure, to the fullest extent viable, a real and meaningful participation from its authentic stakeholders such as genuine stallholders, salesmen and retailers who must be protected;

WHEREAS, in light of the misinformation perpetuated by unscrupulous non-stakeholders or those who seek to sow disunity in the community, and whose negative disinformation is aimed at stunting the City’s well-meaning initiatives, the Sangguniang Panlungsod deems this measure indispensable to affirm its profound commitment to its constituents;

NOW, THEREFORE, on motion of City Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reject as it is hereby rejects any market study from Finasia Land and Realty Corporation or any other entity that seeks to oust genuine stakeholders at the East Bajac Bajac Public Market and reaffirming the city’s commitment to general welfare.

RESOLUTION NO. 25

A RESOLUTION COMMENDING THE GORDON COLLEGE AND THE EXAMINEES WHO PASSED IN THE RECENT NURSING LICENSURE EXAMINATION (NLE) FOR THEIR SUCCESSFUL PERFORMANCE GIVEN BY THE PROFESSIONAL REGULATORY COMMISSION HELD LAST NOVEMBER 29-30, 2009.

WHEREAS, Forty-four (44) Gordon College examinees successfully passed the Nursing Licensure Examination given by the Professional Regulatory Commission last November 29-30, 2009;

WHEREAS, the City’s leadership is proud for such accomplishment since it is committed in encouraging the youth to excel in their own chosen career;

WHEREAS, the City Government of Olongapo outlines its endeavors to help, support, and motivate the youth for their academic excellence and facilitate their holistic development;

WHEREAS, Gordon College also topped the list of educational institutions that garnered the highest passing rate for their examinees, an attestation of its competitiveness and excellent quality of education that it provides;

WHEREAS, the said students reaped honors not only for themselves, but as well as for their families and ultimately for the city. Thus, this body recognizes their achievements with great pride and high esteem;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to commend, as it hereby commends Gordon College and the examinees who passed in the recent Nursing Licensure Examination (NLE) for their successful performance given by the Professional Regulatory Commission held last November 29-30, 2009.

Let copy of this resolution be furnished the Gordon College for their information and record.

A RESOLUTION RATIFYING THE AUTHORITY OF THE HON. CITY MAYOR JAMES GORDON, JR. TO FILE A PETITION FOR REVIEW ON CERTIORARI WITH THE SUPREME COURT AS THE CITY’S REPRESENTATIVE RELATIVE TO THE CASE OF CITY GOVERNMENT OF OLONGAPO VS. TERESITA MEREDITH DOCKETED AS G.R. NO. 189560 AND TO PERFORM ALL ACTS INDISPENSABLE IN RELATION THERETO

WHEREAS, the City seeks to protect its legal interests over, among others, the accreted portions at the Half-Moon Beach area (“Property”);

WHEREAS, to effectively protect the City’s legal interests over the said property, the City through the City Legal Office filed a Petition for Review on Certiorari with the Supreme Court lodged as City Government of Olongapo vs. Teresita Meredith and docketed as G.R. No. 189560;

WHEREAS, in a resolution dated 02 December 2009, the Supreme Court effectively directed the City to submit a resolution bearing on the authority of the Hon. City Mayor to file a case or initiate action such as the Petition for Certiorari and to take necessary legal action to protect the City’s public interests over the Property ;

NOW, THEREFORE, on motion of City Councilor Aquilino Y. Cortez, Jr., with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to ratify, as it is hereby ratifies the authority of the Hon. City Mayor James Gordon, Jr. to File a Petition for Review on Certiorari with the Supreme Court as the City’s Representative Relative to the Case of City Government of Olongapo Vs. Teresita Meredith Docketed as G.R. No. 189560 and to Perform All Acts Indispensable in Relation Thereto.
