City Mayor James Gordon, Jr. which refers to the submitted Safe Closure and Rehabilitation Plan (SCRP) for the 18.5 hectares disposal facility located in Barangay New Cabalan, Olongapo City of which approximately 4-5 hectares are actively operated as controlled disposal site by the City Government. Consistent with the provisions of Republic Act 9275 or the Clean Water Act of 2004 (RA 9275), we are required to establish monitoring wells and conduct groundwater sampling at strategic areas to be identified in coordination with the Mines and Geosciences Bureau, Region 3 and this Office immediately. The frequency of the succeeding conduct of groundwater sampling would be determined later after the results of laboratory analyses.

Mr. Cabanayan is informing the City Mayor that based on the site evaluation conducted by the EMB Task Force RA 9003, they found it suitable for upgrading into a Sanitary Landfill for LGU use alone or cluster of LGUs. And as such, we may start with the preparation of the documents needed to secure ECC prior to the development of the SLF while implementing the physical closure component listed in this letter and in order to meet with the time frame of total closure of the active disposal site by the end of April 2008. 28. Committee report, minutes of the meeting submitted by Kgd. Gina Perez, Chair, Committee on Organizational Development and Personnel Matters regarding the proposal to create a Dental Division under the City Health Department. (For information)

29. Memorandum from City Administrator Ferdie M. Magrata to all Department Heads and Heads of Offices in the City regarding the Advisory 08 – 001, advised all concerned government agencies that effective 01 February 2008, the submission of Certified Copy of Appointment Approved/Attested by the Civil Service Commission is required prior to the creation of new member record. This means that unless the appointment has been duly approved by the Civil Service Commission, the GSIS shall not extend membership and/or insurance coverage to the concerned employees. So, as not to prejudice our concerned employees with undue deductions without the benefit of GSIS membership coverage, we are instructed to direct Payroll Section to refrain from deducting GSIS premiums from the respective payroll until the approval of their appointments by Civil Service Commission. Committee Reports

Under the Committee on Telecommunication and IT, Councilor Piano reported that he was given instruction by the City Mayor to conduct a survey and a study regarding the installation of PABX and telephone lines within the City Government, including the Gordon College and James L. Gordon Hospital. He advised all Council Members and Department Heads, to inform if there is a need for him retaining the lines or its additional with NDD for their offices. He will submit his recommendation to the City Mayor.

On another report, Councilor Piano provided the body with an update on the accident which happened at Hanjin shipyard being the one who Chairs the Committee on Labor. He said that an explosion occurred at the shipyard that took the lives of two workers and injured three others. He related the full account of the incident as reported to him by workers who witnessed the incident. Because of this unfortunate event, it is recommended to the company to enhance more the shipyard’s safety training on its job site. However, the company has extended financial assistance to the family of one of the victims. While the family of the other victim is still negotiating with the administration of Hanjin for proper compensation benefits. Lastly, Councilor Piano made some announcement for possible hiring of employees in the different companies inside SBMA.

Under the Committee on Livelihood, Councilor Dabu reported that the Barangay Consultation Livelihood Program was conducted in the cooperation with the Livelihood Cooperative Development Office (LCDO) and Barangay Sta Rita. She made note that Kgd. Elsa Vensilao as Chairman on Trade and Employment, who spearheaded the participation of thousands of their constituents, who took advantage of availing this free livelihood and skills training for various trades. She said that the Resolution they passed urging all barangays to allocate funds for this kind of livelihood program is paying-off..

On another matter, concerning the Committee on Markets, Councilor Dabu informed the body that the Local Price Coordinating Council conducted an inspection of all three markets in the city, to monitor the state of cleanliness and the proper display of price tags and maintaining the Timbangan ng Bayan, in consonance with RA 7581. This is to provide protection to consumers by establishing prices of basic commodities and prescribing measures against undue price increases.

Under the Committee on Organizational Development and Personnel Matters, Councilor Perez reported the outcome of the committee hearing regarding the proposal to create a Dental Health Division under the City Health Department, attended by concerned representatives from the City Health, James L. Hospital, Personnel Dept., Budget Office and from the City Council. From the discussion, it was revealed that Dr. Tamayo, as Head of the City Health, was not consulted about the –proposed creation of a Dental Division under his department. On the side of the James L. Hospital, there was no objection, as it will not affect the operation of the hospital’s dental services. It was recommended by the Budget Office that a Dental Service Section should be put in place instead of creating a division. For this, Dr. Vigo was requested to submit his recommendation about the proposal in one week’s time as well as an approval from the Personnel Head. The committee chair reminded everyone that the organizational chart and standard procedures should be strictly followed and assured that once all pertinent documents are completed, this proposal will be included in the next session.

On another report, she informed the body about the memo she received from the City Mayor, Office of the Traffic Management and Public Safety, Civil Security and Safety Unit. This is with regard to the enhancement of the effectiveness of the implementation of security measures within the city hall, which include observing the non-entry of employees after 0ffice hours without proper authorization from the department heads, proper inspections, logging on record book all incidents, entry and transfer of government properties without proper documents and the like. The copy of the memorandum was furnished to the Committee on Peace and Order.

Councilor delos Reyes reported his participation in a Press Conference held in Manila regarding the complaint filed before the Advertising Board on the proliferation of condom ads aired on national televisions particularly Frenzy and Trust Condom ads. He criticized the condom ads citing its flagrant disregard to the moral values of the Filipinos, since it promotes promiscuity and destroys the institution of marriage making sex as available even outside the marital relationship. He singled-out the City Health Office and the health centers in Olongapo which he described as the distribution center for condoms which are readily available like candies, as well as the legislations made promoting the programs on Reproductive Health Code and the Contraceptive Self Reliance Ordinance.

He vowed, that, as City Councilor, he will fight against allowing this liberal culture of promoting on TV and radios the advertisement of condoms. According to him, the best course of action is to study them because there are social implications implementing these laws.

Before moving on to the Second Reading, the Chair informed the body that, as part of the security of the office, the locks of the door to the Sanggunian office has been changed. Only two persons were authorized to keep the keys, the janitor and Greg Ramos. If anybody needs a duplicate, they have to make a request and be accountable for anything that will happen.

However, he manifested that the said draft resolutions be separated into 3 resolutions.

5. Draft Ordinance No. 2008 – O-01 – “An Ordinance Amending Ordinance No. 101 And Ordinance No. 106 Both Series Of 1978 Providing For The Establishment, Operation And Maintenance Of Cockfighting And The Regulation Of Cockfighting And Commercial Breeding Of Gamecocks”, was deferred by the body for modifications, on motion of Councilor Angelito W. Baloy.

On motion of Councilor Piano, and on his manifestation that that the said draft resolution be separated into 5 Resolutions, Draft Resolution No. 2008 – R-004 – “A Resolution Congratulating Emmanuel Jonson, Carlo Laborce, Albert Layug, Rosalie Montemayor And Emily Pagal For Winning In The 2007 Ten Outstanding Freeport Workers Of The Year Awards”, was deferred by the body.

7. Councilor Piano moved to open for discussion Draft Resolution No. 2008 – R-006 – “A Resolution Authorizing The City Mayor Honorable James Gordon, Jr. To Enter Into A Memorandum Of Agreement With Globe Telecom/Innove Communications, Inc. For Joint Pole/Lease Rental Agreement”. As a background, Councilor Piano explained that Innove Communication is a subsidiary of Globe Telecom who is applying for a permit with the city to allow the construction and installation of aerial cable: poles, guy support and telecom cabinets through their official contractor MG EXEO Networks. These cabinets will be installed in Barangays Barretto, EBB, WBB, Gordon Heights and Pag-asa. They are in full coordination with the local government to secure clearances for the smooth execution of their projects. Globe Telecom is known for its world class telecommunication system.

He mentioned about the 150 pieces of concrete poles which will to be donated to the city and stressed that or they will add more. It is for this reason that they would like to execute a MOA authorizing the City Mayor to negotiate and enter into an agreement. He also read the contents of its provisions.


Councilor Gie Baloy wanted to know from the proponent if they are only talking with the contractor MG EXEO Network. According to the proponent, they are not only talking with the contractor because in their previous hearings the main representatives of Globe were also present.

Councilor Aquino commented that they don’t still have a copy of the said MOA in order to have a chance to study it further. He also suggested that they should deal directly with Globe rather than with the contractor who will just leave after they finished the project.

The proponent explained, that they are not entering into a MOA with EXEO, but with Globe Telecom, whom they are dealing with directly. EXEO’s only role is to facilitate the clearance with the local government on behalf of Globe.

The Chair brought-out other observations in addition to authorizing the City Mayor to enter into a MOA. One of which is to have its counterpart who representing the Globe Telecom to present a Board Resolution that he duly authorized to sign on behalf of the company. She also wanted to determine the amount they should be paying in rentals after 15 years in exchange to the poles that they are going to donate. It appears from the proponent’s computation, a 20-footer concrete pole costs P35,000 to be paid by Globe at P250 per year, 459 pieces of which are to be donated to be used by the city where they can just connect. The Chair wanted these details to be considered in the presentation of the terms of the city government if an assessment should be made to decide it will be advantageous to accept the donation or just charge them instead.

In the absence of a copy of the MOA for each Councilor, the proponent opted to move for deferment of the approval of Draft Resolution No. 2008-R-006 since there are matters that need clarifications.

8. For the reason that the sponsor, Councilor John Carlos G. delos Reyes is still compiling information Draft Resolution No. 2008 – R-007 - “A Resolution Requesting The Hon. Barangay Chairmen Of Olongapo City To Abate Pilferage And Theft Of Electric Power By Reporting Illegal Connections And Tappings Within Their Barangays”, was deferred by the body.

9. On motion of Councilor delos Reyes, Draft Resolution No. 2008 – R-008 – “A Resolution Adopting The Two (2)-Year Investment Plan Of The Public Utilities Department”, was deferred by the body. The proponent is still drafting the resolution.

10. Draft Resolution No. 2008 R- 009 – “A Resolution Authorizing The City Mayor Hon. James Gordon, Jr. To Enter Into An Affiliation Agreement Between James L. Gordon Memorial Hospital (JLGMH) And Central Luzon College Of Science & Technology, Represented By Its President, Dr. Renato P. Legaspi”, was deferred by the body, on motion of Councilor John Carlos G. Delos Reyes

11. Draft Ordinance No. 2008 O-04 – “An Ordinance Prescribing For The Mandatory Posting Of Notice And Information Regarding Child Protection On Establishments Whose Operation Of Business Is Prejudicial To The Development And Welfare Of Minors”, was deferred by the body, on motion of Councilor Angelito W. Baloy.

Councilor Cortez moved to open for discussion Draft Resolution No. 2008 –R -010 – “A Resolution Approving The Application For Preliminary Approval And Development Permit Of Fiesta Communities Olongapo Containing An Area Of 36,342 Square Meters With 370 Saleable Lots Located At Barangay New Cabalan, City Of Olongapo”. Also invited in the session were representatives of Hausland Development and former Councilor Bebeth Marzan, who will help in the discussion. According to Ms. Marzan, Fiesta Homes has applied for development permit to improve certain areas in New Cabalan for the construction of a socialized housing. The application was submitted two years ago and have already complied with the requirements under BP 220. On Councilor JC’s inquiry, Ms. Marzan explained that, a development permit is issued by the local government for the development of a subdivision. This is the first time that such development permit will be issued by the city to regulate this kind of housing development. However, the former Councilor was not sure if the same was also issued before to Alta Vista and Alacor. According to Mr. Ed Manuel, representatives of Hausland, to answer Councilor Gie Baloy’s question, the said property was bought by the developer and was fully paid and were able to secure 3 titles for the land. It was also requested from Mr. Manuel by Councilor Piano to furnish the Council all copies of the clearances, titles, receipts and the plans to be used by the members for further scrutiny. While Councilor delos Reyes requested a Special Power of Attorney to be presented, the Chair expects a better visual presentation of the whole plan for better appreciation of the same, which Councilor Cortez also agreed for the benefit of all the new members of the Council and the 150 government employees who signified their intention to get a property.

In order to give the developer more time to prepare its presentation next session, Councilor Cortez moved to defer the approval of the resolution.


Other Matters

A. Councilor Lipumano-Garcia took the opportunity to inquire on the status of the resolution she sponsored and eventually sponsored unanimously and approved by the Council last November 21, 2007. This is the resolution conveying gratitude to IBM Philippines “Big Blue”, for their donation of Kidsmart Computer and Educational Software to the Olongapo City Elementary School, which was indorsed to the City Mayor for his signature. But up to this time, it was not clear to her on whether it was approved or not. Citing certain provisions of the Revised Internal Rules in the approval or disapproval of the executive in all resolutions submitted to his office, she expressed disappointment on what appears to her as an indifference to her proposal, considering that it is a simple gesture of gratitude and appreciation to the internationally known corporation who donated something useful for students of one of our elementary school. Despite inaction of the Mayor to her resolution, it is deemed approved. She requested that the resolution be prepared so that it can be presented as soon as possible.

The Chair instructed the Council Secretary to make a follow-up and to probably invite the recipients for proper presentation of the resolution together with the Mayor.
