Uniform truck ban, isusulong

DAHIL sa matinding problema sa trapiko na idinudulot ng malalaking truck sa Metro Manila, nais ni Sen. Miriam Defensor Santiago na magkarooon ng batas na tatawaging “uniform truck ban”.

Sa Senate Bill 1518 na inihain ni Santiago, sinabi nito mismong ang mga Metro mayors at si DTI Sec. Peter Favila na ang nakapuna na ang iba’t ibang truck ban hours na ipinaiiral ng mga local government units sa Kalakhang Maynila ang nagdudulot ng matinding trapiko at pagsisikip ng mga lansangan.

enforced by local government units was causing delays that translated to high logistics costs, particularly among local exporters,” sabi ni Santiago sa kanyang panu-kala.

Committee Reports

Councilor Gie Baloy reported about the Quarterly Meeting of the Provincial Tourism Investment Promotion Officers of Zambales last September 13, 2007, held at the Provincial Tourism Office of Iba. It was organized by the DTI headed by Provincial Caretaker Ms. Leonila Baluyut and was attended by representatives from Olongapo, Castillejos, San Marcelino, San Felipe, Cabangan, Botolan, Iba, Palauig and Masinloc.

Included in the agenda were the following: the work plan for a new Zambales; the implementation of the Investment Code; industry updates such as the Information and Communications Technology Fair; the execution of the Internal Monitoring System and the inception of a streamlined work process for security business permit.

Councilor delos Reyes, Chair of the Committee on Complaints and Investigations put it on record that he drafted two motions for reconsideration. He requested the Council Members who have not yet affixed their signatures to either sign or if there were objections, to put it into writing to be able to justify the long delay in the release of the decision. On the other hand, the Turalba vs. Brgy. Capt. Carlito Baloy Administration case still needs to be decided upon.

For the report regarding the Committee on Public Utilities, Councilor delos Reyes informed the body that he was able to secure a copy of a resolution of the Subic Bay Water Regulatory Board, courtesy of Mr. Ben Miranda. The said resolution denied the petition of Subic Water for a water rate increase for this year. He hoped that this will not be subjected to the filing of a reconsideration, where the board will approve just the same.

For the pending ratification of the resolution on the MOA regarding the establishment of a Police Crime Laboratory in the City, the Councilor told the body that he was informed by Mrs. Arlene Dascil a Forensic Chemist and by SPO3 Miguel Acosta that the Crime Laboratory is lacking of the needed equipments and facilities such as a SOCO van, a freezer etc. He suggested for the Office of the City Mayor to review the agreements they signed.

Councilor Cortez first gave a report on the meeting with SBMA Officials led by Engr. Mar Sanque and Sanitary Landfill Project Technical Working Committee Members which he, Councilor Gie Baloy and Mr. Dante Ramos of ESMO attended. It was about the city’s proposal to host SBMA’s garbage.

There are two options in the proposal prepared by the City ESMO. The first option provides that Olongapo will collect the garbage from SBMA residents and locators where Olongapo can either collect the fee directly from the residents/locators or SBMA shall remit the fees to Olongapo. The second option provides that Olongapo will host the garbage from SBMA’s dumpsite.

According to the Councilor, the city will form its Technical Working Committee to study the financial aspect of the city’s proposal to host and collect SBMA’s garbage. The SBMA will prepare a list of its heavy equipments and its maintenance, operation cost and depreciated value for the purpose of either donation or to be part of the agreement with the city. SBMA will likewise submit their garbage collection cash flow. They asked Mr. Ramos of the long term plan for the Sanitary Landfill in compliance with RA 9003.

As an update, to the Sanitary Landfill, Councilor Cortez said that Mr. Dolly Cabezo, RA 9003 Task Force Team Leader of EMB DENR, Region III reiterated that Olongapo needs to submit a Gantt Chart providing the time table and checklist for compliance with RA 9003. It is required prior to the issuance of a certificate stating that the city’s landfill will not closed. The ESMO explained that the Gantt Chart will be based on the city’s schedule of implementation. Phase I is the containerization of garbage and sanitary transportation which forms part of the DBP loan amounting to PhP177 Million. This phase includes the PhP7 Million Engineering of the Sanitary Landfill. Ms. Cabezo mentioned that the other LGUs are closely monitoring Olongapo’s compliance to RA 9003. She also offered to provide technical assistance to the city.

Councilor Cortez on behalf of Councilor delos Reyes who chairs the Committee on Transportation, informed the body that the meeting of all J-01 and J-11 jeepneys to be attended by the City Mayor is scheduled the next day.

Councilor Cerezo reported before the body about the group of students who competed in the Milo National Little Olympics at Lingayen, Pangasinan. The students coming from OCNHS and St. Joseph’s College garnered 14 gold medals from the competition and temporarily ranked first, awaiting the results of the other events to be played in the Taekwando Competition, inorder to determine whether we can clinch the overall championship.

Councilor Marzan extended her invitation to all members to attend the Committee hearing to discuss the matter regarding the request of PUD for appropriation in the purchase of items under Capital Outlay. The meeting was set on Monday at 9:00 a.m.

Calendar of Business

Second Reading:

1. Councilor Marzan moved to open for discussion Draft Ordinance No. 2007 – O-27 – “An Ordinance Creating A Special Account – Gordon College IT Under The General Fund For The Gordon College”, Explaining the background why this ordinance is being introduced. According to the proponent, it was decided by the Board of Trustees of Gordon College to establish a Special Program for the Department of Computer Science where they are going to offer short term courses every summer. Certain portions of the tuition fees and laboratory fees being paid by students will be placed under Special Account of the Gordon College under IT. This will become the source of funds aside from the total collections of Gordon College to be used for whatever program they will undertake. She explained further that it should be the Sanggunian who should approve this ordinance, because the Board of Trustees has no power to approve the creation of a Special Account. In response to Councilor Lipumano’s question, Mrs. Pame explained that they are short term courses with ten hours per course offered during summer. She also explained to Councilor Dabu that the actual fees for the ten hour completion of one module are what the students are paying for.

Finally, on motion of Councilor Marzan, Draft Ordinance No. 27 was unanimously approved by the body on its second and final reading.

2. 8. Councilor Cortez moved to open for discussion, Draft Resolution No. 2007 – R-64 - “A Resolution Implementing An Experimental Truck Ban Within The Major Thoroughfares And Streets Of Olongapo City”. The proponent clarified that this resolution will not infringe on any national laws or existing laws because there are roads where the city cannot prohibit passage of vehicles. But the city can only regulate the hours fixed for banning entry of trucks from 7:00 a.m. to 9: 00 a.m. and 11:00 a.m. to 2:00 p.m., 4:00 p.m. -8:00 p.m. Also, taken into consideration was the time of business operation that will be affected as well as the hours when students and workers go to school and place of work.

Proper signages will be installed on strategic places to warn truck drivers from entering the city within the specified hours. It will also enforce a total truck ban for dump trucks hauling white sand from Zambales on the use of city roads since the road may deteriorate fast with the number of trucks passing Rizal Avenue. The proponent also mentioned, the plan of SBMA to renovate the Kalaklan bridge leading to SBMA which will take 1-2 years.

Councilor Piano suggested to include in the guidelines some exemptions on this truck ban such as the firetrucks and government trucks, so as not to delay government projects.

Draft Resolution R-64 was approved unanimously by the body on second and final readings, on motion of Councilor Cortez.

The above listed resolutions under item No. 9 of the second reading were approved unanimously on second and final readings, on motion of Councilor Piano, co-sponsored by Councilors Carlito Baloy and Rodel Cerezo.

10. On motion of Councilor Piano, Draft Resolution No. 2007 – R-70 – “A Resolution Confirming The Renewal Of Appointment Of Atty. Angelito R. Orozco As City Government Department Head II (City Legal Officer) SG-26 Under City Legal Office”, was unanimously approved on second and final readings.

Other Matters

Taking the opportunity of having Atty. Angelito Orozco in the session, Councilor delos Reyes made a follow-up on the status of the letter sent to his office regarding the request for legal advise to be given to a certain Barangay Official. In response, Atty. Orozco said he will check the matter with his staff.

Councilor Piano on the other hand wanted to know from Atty. Orozco if the Legal Office can issue a demand letter in favor of PUD and Hospital to some individuals with unpaid accounts. According to Atty. Orozco, if it was referred formally and officially to his office, it will be acted upon.

Councilor Cerezo extended the invitation to all members to the Awarding Ceremony of the YMCA National Marathon on September 30 at 7:00 a.m. at the Tapinac Oval.

The Presiding Officer announced an invitation from the Philippine Councilors League to attend the PCL Continuing Local Legislative Education Program on October 15-17 at Davao City. It was decided by the body to move the date of the scheduled session because the activity falls on a Wednesday. She also announced the important topics to be discussed. They are interested to listen on the topic about Human Security Act and Davao’s best practices, particularly its Investment Center and Landfill.

WHEREAS, Article IV of Ordinance No. 36, Series of 2004 provides the courses offered at the city-owned and operated Gordon College;

WHEREAS, the said ordinance addresses the needs of the community especially the indigent ones, whose services from social workers are indispensable;

WHEREAS, the demand for social workers has increased primarily due to the fact that our government is now sincerely paying attention to the needs of our indigent people, who are aptly in need of the services of the government;

WHEREAS, it is but time for the Gordon College to introduce a new course that will be equally helpful for the people of the Olongapo and to the Gordon College as well;

SECTION 1. A special account for the Gordon College is hereby created to be generated from the Information Technology (IT) short courses, to be kept in the City Treasury.

SECTION 2. Charges and fees. All charges and fees derived from the enrollees of the short-term courses on computer technology during the summer period of Gordon College shall accrue to the special account hereto established.

SECTION 3. Disbursement. The special account shall be used solely for the improvement/maintenance of computer equipment of Gordon College and shall be credited as a trust liability.

SECTION 4. The Resolution of the Gordon College Board of Trustees shall be made an integral part of this ordinance.

SECTION 5. This Ordinance shall take effect upon its approval.

A RESOLUTION ADOPTING THE EXPERIMENTAL IMPLEMENTATION OF THE TRUCK BAN WITHIN THE MAJOR THOROUGHFARES AND STREETS OF OLONGAPO CITY

WHEREAS, the City of Olongapo is experiencing a growing traffic problem along its major thoroughfares and streets as a result of the heightened economic activity in Olongapo City, the Subic Bay Freeport Zone and the province of Zambales;

WHEREAS, cargo trucks, heavy vehicles, fuel tankers, cement bulk carriers, long-bed trailers, container vans and other type of heavy and long vehicles pass, travel, enter and traverse Rizal Avenue and Magsaysay Drive even during rush hours thereby adding to traffic congestion owing to the size and weight of these vehicles;

WHEREAS, this type of vehicles also poses danger to the general public especially loaded fuel and liquid tankers that carry flammable, volatile and combustible materials as they pass through highly concentrated area like the Olongapo Public Market, Olongapo City Hall and the Olongapo City Elementary School;

WHEREAS, this type of vehicles considering their weight, size and heavy load contributes to the gradual deterioration of our roads, bridges and streets;

WHEREAS, this type of vehicles should enter and use the Subic Freeport Expressway and SBMA Kalaklan Bridge during day time if they are going to Manila and Zambales thus avoiding the confined roads and streets of Olongapo City, thereby reducing traffic congestion;

WHEREAS, the attached recommendation of the Office of the Traffic Management and Public Safety shall be the coverage of this experimental truck ban;


NOW, THEREFORE, on motion of Councilor Aquilino Y. Cortez, Jr. with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to adopt, as it hereby adopts the experimental implementation of the truck ban within the major thoroughfares and streets of Olongapo City to commence after two (2) weeks of posting this Resolution and its attachments in conspicuous places and public information drive up and to remain in effect until November 30, 2007.

A RESOLUTION RATIFYING THE MEMORANDUM OF AGREEMENT ENTERED INTO BY AND BETWEEN THE PHILIPPINE NATIONAL POLICE CRIME LABORATORY (PNPCL) REPRESENTED BY POLICE CHIEF SUPT. ARTURO G. CACDAC, JR. AND THE CITY GOVERNMENT OF OLONGAPO REPRESENTED BY CITY MAYOR JAMES GORDON,JR.

WHEREAS, the City believes that the Police Force needs to be equipped with the best technology and forensic services in line with their investigative works, which are highly significant in the prompt solution and containment of crimes;

WHEREAS, the Sangguniang Panlungsod deems it imperative that the Philippine National Police Crime Laboratory (PNPCL) in the City of Olongapo can provide the technical support, scientific analysis, examination and findings of evidences needed by examiners in line with the investigations conducted for crime solution;

WHEREAS, an agreement forged between the Olongapo City Government and the PNPCL for the implementation as well as the assurance that such technical and forensic support are delivered is indeed of necessity;

NOW, THEREFORE, on motion of Councilor John Carlos G. Delos Reyes, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED by the Members of the Sangguniang Panlungsod in session assembled to ratify, as it hereby ratifies the Memorandum of Agreement entered into by and between the Philippine National Police Crime Laboratory (PNPCL) represented by Police Chief Supt. RESOLUTION NO. 135
(Series of 2007)

A RESOLUTION AUTHORIZING THE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO MEMORANDUM OF AGREEMENT WITH BSP-JAMES L. GORDON COUNCIL REPRESENTED BY DR. LIGAYA B. MONATO, FOR THE USE OF A PARCEL OF LAND LOCATED AT THE SOUTH-WEST END OF EAST TAPINAC ELEMENTARY SCHOOL, FOR JAMES L. GORDON COUNCIL-BSP HEADQUARTERS

WHEREAS, Sangguniang Panlungsod passed Resolution No. 183, Series of 2006, approving the proposed Boy Scouts of the Philippines (BSP)-James L. Gordon Council Building as one of the priority projects of the City for the calendar year 2006;

WHEREAS, BSP-James L. Gordon Council passed Resolution No. 07, Series of 2007 requesting Senator Richard J. Gordon to support the BSP-James L. Gordon Council Headquarter project and Resolution No. 03, Series of 2007 designating Dr. Ligaya B. Monato as signatory to the proposed Memorandum of Agreement for the use of the subject parcel of land;

WHEREAS, a Memorandum of Agreement for the use of the said parcel of land is necessary for the project to commence;

WHEREAS, the Sangguniang Panlungsod during in its 9th regular session deliberations agreed to grant the Boy Scouts of the Philippines, for an initial period of fifteen years and renewable thereafter, the use of a parcel of land with an area consisting of approximately 408 square meters located at the South-West-end of East Tapinac Elementary School, bounded by East Tapinac Oval Track Grandstand at SOUTH, Bacon St. at the WEST, East Tapinac Oval Track at EAST, and East Tapinac Elementary School building at NORTH;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano and with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor James Gordon, Jr. to enter into Memorandum of Agreement with BSP-James L. Gordon Council represented by Dr. Ligaya B. Monato, for the use of a parcel of land located at the South-West end of Tapinac Elementary School, for James L. Gordon Council-BSP Headquarters.
