A RESOLUTION AUTHORIZING THE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT/DEED OF ASSIGNMENT WITH PSALM IN THE AMOUNT OF FIVE HUNDRED MILLION PESOS (PHP500,000,000.00) FROM THE PROCEEDS OF THE  PUBLIC UTILITIES DEPARTMENT’S ASSET SALE

WHEREAS, City Resolution No.18, Series of 2013 reiterating City Resolution No. 60, Series of 2010 provides that a portion of the proceeds from the PUD asset sale is allocated to the NAPOCOR now PSALM, the amount of which is however not stipulated;

WHEREAS, Olongapo Electric Distribution Company, Inc. has already secured its franchise and there is a need to assign the proceeds of the PUD asset sale in consonance with the aforesaid city resolutions;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano co-sponsored by City Councilors Rodel S. Cerezo, Eyrma Yvette Marzan-Estrella, Elena C. Dabu, and Edna A. Elane, with the  majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes, the City Mayor James Gordon, Jr. to enter, execute and sign the  Memorandum of Agreement/Deed of Assignment with in the amount of  Five Hundred Million Pesos (PhP500,000,000.00)  to be taken from the proceeds of the Public Utilities Department’s Asset Sale in favor of PSALM represented by Mr. Emmanuel Ledesma, in a manner consistent with law.

A RESOLUTION AUTHORIZING ENGR. VICTOR S. BERNABE, DEPARTMENT HEAD, GENERAL  SERVICES  OFFICE,  TO  REPRESENT  THE GENERAL  SERVICES  OFFICE  AND/OR THE CITY GOVERNMENT IN ALL CIVIL AND CRIMINAL CASES FILED IN THE MUNICIPAL AND REGIONAL TRIAL COURTS, COURT OF APPEALS AND SUPREME COURT

WHEREAS, Section 15 of Republic Act 7160, otherwise known as the Local Government Code avow local government units as corporate entities endowed with corporate powers to sue and be sued;

WHEREAS, the General Services Office is a department of the City of Olongapo   mandated  among others, to take custody and be accountable for all  properties, real or personal, owned by the City Government;

WHEREAS, there is a considerable number of theft, damage to property and malicious mischief cases involving city government properties under the custody of the General Services Office;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, co-sponsored by City Councilors Rodel S. Cerezo, Eyrma Yvette Marzan-Estrella, Elena C. Dabu, and Edna A. Elane, with the  majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes, Engr. Victor S. Bernabe, Department Head, General Services Office, to represent the General Services Office and/or the City Government in all civil and criminal cases filed in the Municipal and Regional Trial Courts, Court of Appeals and Supreme Court.

A RESOLUTION EXTENDING COMMENDATION TO CITY COUNCILOR GINA GULANES-PEREZ FOR EMERGING AS THE REGIONAL WINNER AND NATIONAL FINALIST IN THE SEARCH FOR THE OUTSTANDING COUNCILOR OF THE PHILIPPINES (TOCP)

WHEREAS, in 2004, Gina Gulanes-Perez, a young and idealistic educator and popular media practitioner successfully ran as an Independent Candidate to win a seat in the Olongapo City Council during the 2004 Local Election;

WHEREAS, with her unyielding determination, youthful dynamism, remarkable work ethics and incomparable insight, deeply rooted from her unbridled commitment to public service, City Councilor Perez championed numerous key legislations that clearly benefitted the city’s local industry;

WHEREAS, due to her exceptional legislative record and an unblemished reputation as a true warrior of good governance, she received the highest number of votes en route to her successful reelection to a second term in the City Council during the 2007 Local Election, and was entrusted with the stewardship of various high profile committees that generated substantial revenues to fund the centerpiece of the city’s public service programs;

WHEREAS, City Councilor Perez, in her official capacity as a distinguished and seasoned legislator, actively and commendably promoted and represented the City of Olongapo in the entire Philippines, while serving as the City Chapter President of the Philippine Councilors League (PCL);

WHEREAS, City Councilor Perez, demonstrating the same level of commitment and excellence in service, successfully communicated the mission of the PCL and ultimately gained the trust and respect of her colleagues and was subsequently elected as PCL Island Public Relations Officers (PRO) in 2008;

WHEREAS, buoyed by her increasing popularity and dedication to the PCL advocacy and having served as Interim National Public Relations Officer (PRO) in 2010, City Councilor Perez was overwhelmingly elected as National PRO during the National Convention in March 2011 at SMX Convention Center, Pasay City;

WHEREAS, City Councilor Gina Gulanes-Perez, during her last term in the City Council, received numerous endorsements from various sectors and groups in line with her nomination for The Outstanding Councilors of the Philippines (TOCP) Award, given for outstanding leadership and excellent contributions to local legislation, governance and the nation at large and sponsored by the Junior Chamber International (JCI) in coordination with the Philippine Councilors League (PCL) and the Office of Senator Edgardo J. Angara;

WHEREAS, with her Legacy of Legislative Excellence, Exceptional Leadership, Irrefutable Integrity and Dynamic Record in Public Service, Gina Gulanes-Perez was recognized and declared as the Regional Winner and National Finalist in the search for The Outstanding Councilor Of The Philippines (TOCP) on March 7, 2013 at the SMX Convention Center, Pasay City, Philippines;

WHEREAS, City Councilor Perez has brought pride and honor to the City of Olongapo and continues to inspire the next generation of public servants by virtue of the positive reforms she implemented and the sense of idealism and optimism she inspired in restoring the people’s trust and faith in government;

NOW, THEREFORE, on the motion of  City Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

A RESOLUTION EARNESTLY INVITING THE PHILIPPINE COUNCILORS LEAGUE FOR THE CONDUCT OF ITS 2ND QUARTERLY NATIONAL EXECUTIVE OFFICERS AND NATIONAL BOARD MEETING AND 2ND 2013 SERIES OF CONTINUING LOCAL LEGISLATIVE EDUCATION PROGRAM IN OLONGAPO CITY

WHEREAS, the Philippine Councilors League (PCL) has been conducting its regular quarterly national assembly in different eminent places which present the wonders of nature and more importantly best practices that each local government unit may boast of to share with the delegates;

WHEREAS, the PCL’s national assembly in the City of Olongapo with its neighboring partner, Subic Bay Economic Zone last November 24-26, 2010 had conquered the needs and requirements of the said event. An astonishing success of almost 2000 delegates from all corners of the country flocked in to the area which boosted the local tourism economy;

WHEREAS, the PCL’s upcoming national event in June 2013, the city once again yearns to invite the league to enjoy its extensive array of hotels, restaurants, resorts, theme parks, along with the amazing nature itself: the blue waters of Subic Bay, green tropical forest and lush mountains;

WHEREAS, each city official of the Philippine Councilors League will beyond doubt learn many relevant knowledge from the City Government of Olongapo and Subic Bay Metropolitan Authority as these government units bring forward many awards and best practices which can be utilized for bench marking programs;

WHEREAS, the City of Olongapo welcomes all the officers and members of the league and offers a seminar package of great significance to newly elected and incumbent councilors from all over the country,  in addition to an exciting tour package which has effectively combined learning and fun;

NOW, THEREFORE, with the unanimous accord of Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to earnestly invite, as it hereby earnestly invites the Philippine Councilors League for the conduct of its 2nd Quarterly National Executive Officers and National Board Meeting and 2nd 2013 Series of Continuing Local Legislative Education Program in Olongapo City.
