A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A LETTER OF UNDERSTANDING BETWEEN THE OLONGAPO CITY GOVERNMENT AND BARANGAY BARRETTO REPRESENTED BY ITS PUNONG BARANGAY HONORABLE CARLITO A. BALOY FOR THE ESTABLISHMENT OF A HEALTH FACILITY PROVIDING BASIC EMERGENCY MATERNAL OBSTETRIC CARE (BEMOC) IN BARANGAY BARRETTO

WHEREAS, Republic Act 7160 otherwise known as the Local Government Code of 1991 enables the Sangguniang Barangay to provide for the construction and maintenance of barangay facilities and other public works chargeable to the general fund of the barangay or such other fund actually available for the purpose;

WHEREAS, the Barangay Council of Barretto passed a Resolution authorizing Honorable Carlito A. Baloy, as Punong Barangay, to enter into a Letter of Understanding with Honorable City Mayor James Gordon, Jr. which shall serve as a record of agreement between Barangay Barretto and the City of Olongapo as to the obligations of both parties concerning the establishment of a health facility providing Basic Emergency Maternal Obstetric Care (BEMOC);

WHEREAS, the establishment of such facility as an additional health-related service shall not only benefit nearby residents but shall also aid significantly in the decongestion of the James L. Gordon Memorial Hospital;

WHEREAS, the City Council duly recognizes the extensive merits of the health facility and the need for an agreement;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano on behalf of Councilor Angelito W. Baloy, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon., Jr. to enter into a Letter of Understanding between the Olongapo City Government and Barangay Barretto represented by its Punong Barangay Honorable Carlito A. Baloy for the establishment of a Health Facility providing Basic Emergency Maternal Obstetric Care (BEMOC) in Barangay Barretto.

A RESOLUTION APPROVING THE REQUEST OF BARANGAY NEW KALALAKE TO OPERATE A MINI FAIR WITHIN THEIR JURISDICTION SUBJECT TO THE PRESCRIBED GUIDELINES OF THE SANGGUNIANG PANLUNGSOD

WHEREAS, carnivals and mini fairs established in conjunction with fiestas are good income generating means to fund projects for good causes;

WHEREAS, Barangay New Kalalake requested through Barangay Resolution No. 16, Series of 2008, permission to operate a mini fair in the said Barangay in order to raise funds for various barangay projects;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay New Kalalake with the condition that the preparation and operation of a mini fair shall be in accordance with the provisions of Ordinance No. 49, Series of 2005 and upon compliance with the recommendations set by the same;

NOW, THEREFORE, on motion of Councilor Gina G. Perez on behalf of Councilor Angelito W. Baloy, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the request of Barangay New Kalalake to operate a Mini Fair within their jurisdiction subject to the prescribed guidelines of the Sangguniang Panlungsod.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the Sangguniang Panlungsod recommendations regarding the request and that item nos.1 to 4 shall form part of this Resolution.

A RESOLUTION RATIFYING THE MEMORANDUM OF AGREEMENT ENTERED INTO BY AND BETWEEN THE 306TH COMMUNITY DEFENSE CENTER, 3RD REGIONAL COMMUNITY DEFENSE GROUP, ARMY RESERVE COMMAND, REPRESENTED BY ITS COMMANDING OFFICER LIEUTENANT COLONEL (LTC) MAXIMIANO GOMEZ AND THE CITY GOVERNMENT OF OLONGAPO, FOR AND IN BEHALF OF THE GORDON COLLEGE, REPRESENTED BY THE CITY MAYOR HON. JAMES GORDON, JR. WITH REGARDS
TO NSTP-ROTC PROGRAM


WHEREAS, the City believes in the capacity of the National Service Training Program-Reserved Officers Training Core (NSTP-ROTC) in promoting and integrating values education, transformational leadership, spirit of patriotism and nationalism. A sustainable social mobilization for youth development, NSTP-ROTC fosters community building that strengthens national security;

WHEREAS, having such training administered by the 306th Community Defense Center, 3rd Regional Community Defense Group, Army Reserve Command to the freshmen students of the Gordon College who are willing to enroll in the NSTP-ROTC program, the City is confident that the aforesaid positive values will be best imparted to the said students;

WHEREAS, the ratification of the Memorandum of Agreement between the City and the 306th Community Defense Center, 3rd Regional Community Defense Group, Army Reserve Command will pave way for the smooth implementation of the same at the Gordon College;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to, ratify as it hereby ratifies the Memorandum of Agreement entered into by and between the 306th Community Defense Center, 3rd Regional Community Defense Group, Army Reserve Command, represented by its Commanding Officer Lieutenant Colonel (LTC) Maximiano Gomez and the City Government of Olongapo, for and in behalf of the Gordon College, represented by the City Mayor Hon. James Gordon, Jr. with regards to NSTP-ROTC Program.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the said signed Memorandum of Agreement be an integral part of this Resolution.

In the interest of the public service and on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 48
(Series of 2008)

AN ORDINANCE REVERTING THE AMOUNT OF ONE HUNDRED THOUSAND PESOS (PhP100,000.00) FROM THE ADVERTISING EXPENSES - MAINTENANCE AND OTHER OPERATING EXPENSES ITEM TO THE OFFICE EQUIPMENT - CAPITAL OUTLAY OF THE GENERAL FUND.

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED THAT:

SECTION 1. The amount of One Hundred Thousand Pesos (PhP100,000.00) is hereby reverted from the item Advertising Expenses - Maintenance and Other Operating Expenses (MOOE) to the Office Equipment-Capital Outlay of the General Fund.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. This Ordinance shall take effect upon its approval.
