A RESOLUTION INTERPOSING STRONG OBJECTION TO THE 12.5% TARIFF INCREASE PROPOSED BY SUBICWATER AND SEWERAGE INCORPORATED


WHEREAS, the City graciously faces the torrents of difficulties bought by a prolonged economic dilemma and as such explores every possibility to brace the lives of its people from its lingering ill-effects;

WHEREAS, with Subicwater and Sewerage Company, Incorporated, proposing a 12.5% tariff increase in water rates, Olongapo City deems that this move is outright oppressive since the consuming public had already agonized from the reneged service developments such as the sewerage system promised by Subicwater years back;

WHEREAS, Subicwater’s petition for a rate increase for 2007 had been ruled upon by the adjudicator to be zero percent (0%);

WHEREAS, there are still many areas in Olongapo City that still await the services of Subicwater and are wanting in this basic need;

WHEREAS, with the people consistently rolling out their discontent and vehement objection for undue and unjust increases, this initiative from the Subicwater is an insult to their injured and disdainful plight;

WHEREAS, the City of Olongapo hereby reiterates its stance that Subicwater’s rate increase is untimely, unjustified and unwarranted and that its management must heed the public outcry against its implementation;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to interpose, as it hereby interposes strong objection to the 12.5% tariff increase proposed by Subicwater and Sewerage, Incorporated.

A RESOLUTION AUTHORIZING THE CITY MAYOR JAMES GORDON, JR.TO ENTER A MEMORANDUM OF UNDERSTANDING (MOU) FOR AND IN BEHALF OF THE CITY GOVERNMENT OF OLONGAPO AND
SUBIC BAY METROPOLITAN AUTHORITY (SBMA) REPRESENTED BY ITS DEPUTY ADMINISTRATOR FOR TOURISM DEVELOPMENT MR. RAUL F. MERCADO FOR THE SIBIT-SIBIT FESTIVAL 2007

WHEREAS, the City Mayor was authorized to accept donation from the Subic Bay Metropolitan Authority (SBMA) through Resolution No. 47, Series of 2007 for the upcoming Sibit-Sibit Fetival 2007;

WHEREAS, Olongapo City government deemed it necessary to enter into a Memorandum of Understanding (MOU) with Subic Bay Metropolitan Authority (SBMA) to strengthen its partnership for tourism development;

NOW, THEREFORE, on motion of Councilor Gina G. Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor James Gordon, Jr. to enter a Memorandum of Understanding (MOU) for and in behalf of the City Government of Olongapo and Subic Bay Metropolitan Authority (SBMA) represented by its Deputy Administrator for Tourism Development Mr. Raul F. Mercado for the Sibit Sibit Festival 2007.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY WEST BAJAC BAJAC, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2007


On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay West Bajac Bajac, City of Olongapo for the Calendar Year 2007 considering that the budget as contained in Barangay Resolution No. 1 , Series of 2007 of Barangay West Bajac Bajac, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of May 30, 2007 and for Barangay West Bajac Bajac to comply with the said recommendations on the matter which form an integral part of this Resolution, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

A RESOLUTION AFFIRMING THE SHAREHOLDINGS OF OLONGAPO CITY AT SUBICWATER AND SEWERAGE, INC. WITHOUT PREJUDICE TO THE PENDING SUPREME COURT CASE PERTAINING TO SUBICWATER

WHEREAS, the Olongapo City Government and Subicwater, Inc. are touted as global partners in the delivery of clean, potable and quality water to residents of Olongapo City and Subic Bay Freeport;

WHEREAS, Subicwater and Sewerage Co., Inc. is the exclusive water distributor in Olongapo and Subic Bay Freeport;

WHEREAS, the Olongapo City Government which owned the Olongapo City Water District forged a Joint Venture Agreement with Subicwater, Inc.;

WHEREAS, the aforementioned Agreement recognized the considerations of the City Government of Olongapo thereby making it as shareholder and a creditor in Subicwater and Sewerage, Co. Inc.;

WHEREAS, Olongapo City is therefore entitled to the dividends declared by Subicwater and Sewerage, Co. Inc.

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to affirm, as it hereby affirms the shareholdings of Olongapo City Government at Subicwater and Sewerage, Inc. without prejudice to the pending Supreme Court case pertaining to Subicwater.


Let copies of this Resolution be furnished to the Chairman and President of Subicwater and Sewerage, Co., Inc. Chairman and Administrator of Subic Bay Metropolitan Authority and Members of Subicwater Regulatory Board for their information and guidance.
