A RESOLUTION ADOPTING THE GORDON COLLEGE BOARD OF TRUSTEES RESOLUTION NO. 6, SERIES OF 2015 ENTITLED: “A RESOLUTION RECOMMENDING THE CHANGE OF SIGNATORY OF THE LAND BANK ACCOUNT OF GORDON COLLEGE FROM MR. MARCELINO D. ANDAWI TO  DR. IMELDA DP. SORIANO, OFFICER-IN-CHARGE OF GORDON COLLEGE AND MS. LIZA L. LIM, OFFICER-IN-CHARGE OF CITY TREASURER’S OFFICE

WHEREAS, the Gordon College has an existing dormant bank account at Land Bank, Olongapo City Branch and the Board of Trustees approved by virtue of Board of Trustees Resolution No. 25, Series of 2014 the closure of the said account;

WHEREAS, before the proper closure of the said dormant bank account, there’s a need to change the signatory from Mr. Marcelino D. Andawi, former City Treasurer, to Dr. Imelda DP. Soriano, Officer-in-Charge of Gordon College, and Ms. Liza L. Lim, Officer-in-Charge of the City Treasurer’s Office;

WHEREAS, the Sangguniang Panlungsod deems it proper that Resolution No. 6, Series of 2015 approved on March 27, 2015 is necessary for adoption pursuant to City Resolution No. 70, Series of 2012;

NOW, THEREFORE, on motion of City Councilor Benjamin G. Cajudo II, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to adopt, as it hereby adopts the Gordon College Board Of Trustees Resolution No. 6, Series Of 2015 Entitled “A Resolution Recommending The Change Of Signatory Of The Land Bank Account Of Gordon College From Mr. Marcelino D. Andawi To Dr. Imelda DP. Soriano, Officer-In-Charge Of Gordon College And Ms. Liza L. Lim, Officer-In-Charge Of City Treasurer’s Office”

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copy of the Gordon College Board of Trustees Resolution No. 6, Series of 2015 be made as integral parts of this Resolution.

WHEREAS, on May 06, 2015, the father of Honorable Councilor Aquilino Y. Cortez, Jr., Mr. Aquilino O. Ocampo Cortez, Sr. peacefully joined his creator at the age of 76. Without doubt, this date marks a lowest point in the life of City Councilor Aquilino Y. Cortez, Jr. and his family wherein the company of relatives, friends and colleagues and the consoling words and sincere expression of sympathies from others who are condoling with them are their only refuge;

WHEREAS, Mr. Aquilino O. Cortez, Sr. may have lived his life to the fullest and died at a relatively old age which for many is both a blessing and cause to celebrate life. But despite all the comforting thoughts, his loss is surely painful to his beloved family;

WHEREAS, in their grief, may this Resolution of sympathies and condolences may somehow ease the sorrow of the family and help them to immediately come to terms with the reality of losing someone so dear;

A RESOLUTION DECLARING THE ANNUAL BUDGET OF BARANGAY MABAYUAN  FOR THE FISCAL YEAR 2015  IN THE AMOUNT SEVEN MILLION NINETY NINE THOUSAND EIGHT HUNDRED SIXTY SIX PESOS & 57/100 (PHP7,099,866.57) OPERATIVE IN ITS ENTIRETY

            In the interest of public service and on motion of  City Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

            RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang  Panlungsod in session assembled, to declare, as it hereby declares the Annual Budget of Barangay Mabayuan  for the Fiscal Year 2015 in the amount Seven Million Ninety Nine Thousand Eight Hundred Sixty Six Pesos & 57/100 (PhP7,099,866.57) of  operative in its entirety considering that the said budget as contained in Barangay Appropriation Ordinance No. 02, Series of 2015 of  Barangay Mabayuan, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations.  PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in her letter dated April 28, 2015 are strictly complied with;

            RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Barangay Appropriation Ordinance No. 02, Series of 2015 of  Barangay Mabayuan dated January 09, 2015 and the letter from Ms. Joy Fernandez-Cahilig, City Budget Officer dated  April 28, 2015 be made as integral parts of this Resolution.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR ROLEN C. PAULINO TO ENTER INTO AND SIGN THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY GOVERNMENT OF OLONGAPO, THE DEPARTMENT OF EDUCATION, AND THE SM PRIME HOLDINGS, INC. , REGARDING THE RELOCATION OF GORDON COLLEGE AND THE CONSTRUCTION OF A THREE-STOREY 18-CLASSROOM SCHOOL BUILDING, AND ACCEPT THE SAME, SUBJECT TO APPLICABLE LAWS, RULES, AND REGULATION

 WHEREAS, the City Government Of Olongapo, with its principal address at the City Hall Complex, Rizal Avenue, West Bajac-Bajac, Olongapo City, is represented herein by its City Mayor Rolen C. Paulino hereinafter  referred to as CGO;

              WHEREAS, the Department Of Education, with its principal address at the City School Division Office, Olongapo City Elementary School, Rizal Avenue, West Bajac-Bajac, Olongapo City, is represented by the City School Superintendent Jessie Ferrer, hereinafter referred  to as DepEd;

              WHEREAS, the SM PRIME HOLDINGS, INC., with its principal address at the Mall of Asia Arena, Annex Building Coral Way Corner J.W. Diokno Boulevard, Mall of Asia Complex, Barangay 76 Zone 10 CBP 1-A, Pasay City, is represented by its President, Hans Sy, hereinafter referred to as SM;

            WHEREAS,  the CGO is the owner of a property located in Barangay East Tapinac, Olongapo City, known as Lot No. 12, TS-308, with an area of  30,397 square meters by virtue of Presidential Proclamation No. 936;

            WHEREAS, the DepEd is the occupant of the portion of the lot known as Lot No. 12, TS-308, which is currently being used as site of the East Tapinac Elementary School;

            WHEREAS, the existing site of the city-owned and city-run Gordon College is covered by the lease agreement between the CGO and SM as such, Gordon College will be relocated on a portion of Lot No. 12, TS-308;

             WHEREAS, in the proposed relocation site of Gordon College, there are existing improvements, particularly the Grandstand and DepEd Buildings A and B;

            WHEREAS, since the proposed relocation site of Gordon College will affect DepEd Buildings A and B, with a total of 12 classrooms, the CGO proposes to build a new, three(3) storey building in lieu of the school buildings that will be affected;

            WHEREAS, as part of the additional condition/commitment of SM to the CGO, SM will fund and build a three-storey, 18-classroom school building in exchange for the DepEd Buildings A and B which will be affected by the construction of the new Gordon College Building;

            WHEREAS, the DepEd and the CGO will not shoulder any cost for the construction of the three-storey, 18-classroom school building, and that the said construction shall comply  with the standard design and requirements as mandated by the DPWH for the construction of schools;

            WHEREAS, upon completion of the construction of the three-storey, 18-classroom school building, there should be an acceptance on the part of DepEd and warranties in case the building will be damaged within a specified period as mandated by the law;

            WHEREAS, to carry out such undertaking, a Memorandum of Agreement (MOA) signed by the parties is deemed necessary;

            NOW, THEREFORE, on motion of City Councilors Noel Y. Atienza and Benjamin G. Cajudo II,  with the majority decision of the Members of the Sangguniang Panlungsod present,

            RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes Honorable City Mayor Rolen C. Paulino to enter into and sign theMemorandum of  Agreement (MOA) between the City Government of Olongapo, the Department of Education, and the SM Prime Holdings, Inc., with their respective representatives, Olongapo City Mayor Rolen C. Paulino, DepEd City Schools Superintendent Jessie Ferrer, and SM President Hans Sy, on the relocation of Gordon College and construction of a three-storey 18-classroom school building in lieu of DepEd Buildings A and B, and accepts the same, subject to applicable laws, rules and regulations.
