A RESOLUTION ADOPTING THE COMMENT TO THE APPLICATION (WITH MANIFESTATION) OF THE OLONGAPO CITY LEGAL OFFICER AS REGARDS THE APPLICATION OF PILIPINO TELEPHONE CORPORATION (PILTEL) AND PHILIPPINE LONG DISTANCE TELEPHONE COMPANY (PLDT) WITH THE NATIONAL TELECOMMUNICATIONS COMMISSION IN NTC CASE NO. 2007-186


WHEREAS, Pilipino Telephone Corporation (PILTEL) and Philippine Long Distance Telephone Company (PLDT) entered into a LEC ASSETS SALE AND PURCHASE AGREEMENT wherein PILTEL agreed to sell, assign and transfer to PLDT its LEC Assets which PLDT agreed to purchase and acquire last 04 December 2007;

WHEREAS, the Pilipino Telephone Corporation (PILTEL) and Philippine Long Distance Telephone Company (PLDT) filed a joint application with National Telecommunications Commission seeking approval and authority for the sale and transfer of the Local Exchange Carrier (LEC) facilities, assets, properties and services from PILTEL to PLDT;

WHEREAS, the Pilipino Telephone Corporation (PILTEL) and Philippine Long Distance Telephone Company (PLDT) filed a joint application with National Telecommunications Commission seeking approval and authority for the transfer to applicant PLDT of applicant PILTEL’s existing and effective Certificate of Public Convenience and Necessity (CPCNs) and Provisional Authority (Pas), and for applicant PLDT to continue operating applicant PILTEL’s CPCNs and PAs to provide LEC Service in areas covered by applicant PILTELs CPCNs/PAs;

WHEREAS, the Olongapo City Legal Officer filed a COMMENT TO THE APPLICATION (WITH MANIFESTATION) before the National Telecommunications Commission as Olongapo City will be affected by the said transfer applied for;

WHEREAS, the aforementioned COMMENT provides that the applied transfer ought to be with prior approval of the Congress of the Philippines as stated in Section 11 of RA 7293;

WHEREAS, it is further manifested that the both PILTEL and PLDT ought to comply with Olongapo City Tax Ordinance as empowered by Local Government Code;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled to adopt, as it hereby adopts the comment to the application (with manifestation) of the Olongapo City Legal Officer as regards the application of Pilipino Telephone Corporation (PILTEL) and Philippine Long Distance Telephone Company (PLDT) with the National Telecommunications Commission in NTC Case No. 2007-186.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copy of the Comment to the Application (with Manifestation) be attached to this Resolution.

Let copies of this Resolution be furnished to the National Telecommunications Commission, Pilipino Telephone Corporation (PILTEL) and Philippine Long Distance Telephone Company (PLDT) for their information and guidance.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY EAST TAPINAC, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2008

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay East Tapinac, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolutions No. 38, Series of 2007 and Barangay Ordinance No. 02, Series of 2007 of Barangay East Tapinac dated December 7, 2007 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Section 287 of Local Government Code of 1991.

That the 5% Calamity Fund in the amount of P 214,645.45 is deficient by Thirteen Thousand Nine Hundred Thirteen and 10/100 Pesos (P13,913.10) Computed as follows:

Total Estimated Revenue net of Aids P 4,571,171.03
From cities
5 % thereof 228,558.55
Amount appropriated 214,645.45

Deficit P 13,913.10

Not withstanding the above deficiency in appropriation, which should be included in the first supplemental budget of the Barangay.

The excess in the appropriation for 10% SK fund in the amount of Three Thousand Six Hundred Seventy Six and 49/100 (P3,676.49) should be reverted back to the Unappropriated Balance under the General Fund of the Barangay; computed as follows:

From cities
10% thereof 463,279.31
Amount Appropriated 466,955.80

Excess P 3,676.49

Pursuant to Local Budget Circular No. 63 of the Department of Budget and Management (DBM) dated 22 October 1996, barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; The honorarium rates of said barangay officials may be adjusted in accordance with Local Budget Circular No. 86 of the Department of Budget & Management dated 18 July 2007; However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:

SG-14 For Punong Barangay
SG-10 For the Sanggunianng Barangay Members,
Barangay Secretary and Barangay Treasurer.

The excess in the appropriation for 2% Discretionary Fund in the amount of One Thousand Four Hundred Seventy Three and 79/100 (P 1,473.79) should be reverted back to the Unappropriated Balance under the General Fund of the Barangay; Computed as follows:

Total Share in Real Property Tax for P 732,749.36

2% thereof 14,654.99
Amount Appropriated 16,128.78

Excess P 1,473.79

That the amount of “Power Bills’ appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sanggunian Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability, may be properly liquidated/settled:

That appropriation in the amount of Four Million Six Hundred Thirty-two Thousand Seven Hundred Ninety-three Pesos and Twelve Centavos (PhP 4,632,793.12) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

Let Barangay East Tapinac Resolution No. 38, Series of 2007 and Barangay Ordinance No. 02, Series of 2007, endorsement from City Budget Office and other pertinent documents related hereto form part of this resolution.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY NEW ILALIM, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2008

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay New Ilalim, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolution No. 01, Series of 2008 and Barangay Ordinance No. 1, Series of 2008 of Barangay New Ilalim dated January 15, 2008 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation.That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management (DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999.

That the 5% Calamity Fund shall be utilized solely for relief, rehabilitation, reconstruction, contingencies and other works or services in connection with calamities and which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determined and declared by the Sangguniang Barangay concerned.

Pursuant to Local Budget Circular No. 63 of the Department of Budget and Management (DBM) dated 22 October 1996, barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; The honorarium rates of said barangay officials may be adjusted in accordance with Local Budget Circular No. 86 of the Department of Budget & Management dated 18 July 2007; However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:
SG-14 For Punong Barangay
SG-10 For the Sanggunianng Barangay Members,
Barangay Secretary and Barangay Treasurer.

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed pursuant to the Local Budget Circular No. 63 of the Department of Budget Management dated 22 October 1999”.

Barangay Tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument subject to appropriation ordinance and limitations for Personal Services provided the total amount shall not exceed the minimum salary rate for salary grade 1.

That the amount appropriated for Traveling Expenses and Training & Seminar Expenses shall be disbursed in accordance with Executive Order No. 248 dated 29 May 1995 as amended by Executive Nos. 248-A and 298 dated 14 August 1995 and 23 March 2004 respectively.

That the amount of “Power Bills’ appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sanggunian Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability, may be properly liquidated/settled:

That appropriation in the amount of One Million Four Hundred Forty Seven Thousand Five Hundred Seven Pesos and Thirty-three Centavos (PhP1,447,507.33) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

Let Barangay New Ilalim Resolution No. 01, Series of 2008 and Barangay Ordinance No. 1, Series of 2008, endorsement from City Budget Office and other pertinent documents related hereto form part of this resolution.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY ASINAN, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2008

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Asinan, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolutions No. 020 and 021, Series of 2007 of Barangay Asinan dated November 30, 2007 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That the account Terminal Leave/Monetization of Leave Credits shall be included under Personal Services instead of Maintenance and Other Operating Expenses (MOOE).

That appropriation in the amount of Two Million Six Hundred Forty Three Thousand Five Hundred Eighty-One Pesos and Twenty-five Centavos (PhP2,643,581.25) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY KALAKLAN, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2008

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Kalaklan, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolution No. 03, Series of 2007 and Barangay Ordinance No. 01, Series of 2007 of Barangay Kalaklan dated December 28, 2007 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation.

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management

(DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999.That the 5% Calamity Fund shall be utilized solely for relief, rehabilitation, reconstruction, contingencies and other works or services in connection with calamities and which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determined and declared by the Sangguniang Barangay concerned.

Pursuant to Local Budget Circular No. 63 of the Department of Budget and Management (DBM) dated 22 October 1996, barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; The honorarium rates of said barangay officials may be adjusted in accordance with Local Budget Circular No. 86 of the Department of Budget & Management dated 18 July 2007; However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:
SG-14 For Punong Barangay
SG-10 For the Sanggunianng Barangay Members,
Barangay Secretary and Barangay Treasurer.

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed pursuant to the Local Budget Circular No. 63 of the Department of Budget Management dated 22 October 1999”.

Barangay Tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument provided the total amount shall not exceed the minimum salary rate for salary grade 1.

That the amount appropriated for Training & Seminar Expenses shall be disbursed in accordance with National Budget Circular No. 486 dated 26 March 2003.

That the excess in the appropriation for discretionary fund in the amount of Three Thousand Five Hundred Eighty Six Pesos and Sixty-two centavos (P3,586.62) as required under section 324 (d) of Local Government Code of 1991 shall be reverted to the unappropriated Balance under the General fund of the Barangay.

AN ORDINANCE IMPLEMENTING THE SCHEDULE OF LOCATIONAL CLEARANCE FEES

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The schedule of Locational Clearance fees provided under HULRB Resolution No. 760, Series of 2004 shall be adopted and made an integral part of this Ordinance.

SECTION 2. This Ordinance shall take effect after its posting at conspicuous places in the City for at least three (3) consecutive weeks, posted in the city website and published in a local newspaper.

SECTION 3. The aforesaid schedule of shall be appended in the existing Revenue Code of the City.

SECTION 4. Let copies of this Ordinance be furnished the Office of the City Treasurer, Business Permit Division, City Planning and Development Office and all other concerned for their information and record.

Reyes, OIC, Tourism Office for the Vice Mayor requesting her presence and that of the City Councilors to welcome the Association of Barangay Captains of the City of Lamitan, Basilan Province, ARMM on March 1 – 4… on March 3, 2008, that is Monday at 7:30 A.M. because they’re asking to conduct a briefing on the different plans and programs of the City and also requesting for possible Sister Cityhood with Olongapo.

Committee Reports

Councilor delos Reyes reported before the body about the number of letters sent to Administrator Arreza which remained unanswered up to this time. This is concerning the operation of a coal power plant at Subic Freeport Zone supposed to have been inaugurated last week but was postponed. It had reached this point, he said, that our request to be briefed about their plans regarding its operation has not yet been given due course at least to explain what is going to happen. Since, Olongapo will be affected if anything will happen, he intend to write a follow-up letter to Administrator Arreza regarding this matter.

Concerning his Committee on Traffic and Transportation, he attended a committee hearing which discussed the problem on “Kotong” in the streets where the offenders are the traffic enforcers believed to receive PhP70 to PhP20 from jeepney drivers. It is considered as a form of corruption in the streets that he is trying hard to curb by suggesting measures to stop these illegal acts, like traffic enforcers riding on jeepneys without paying which is considered inappropriate. The transport group should also help the City Mayor in formulating rules that should govern traffic and transportation system before it gets worse. Such discussion had transpired during the said committee hearing.

In another matter, Councilor delos Reyes informed the body that as part of his investigation on the propriety of government employees who have businesses that are in conflict with their position, he said that, he is in the process of gathering evidences to be used for the filing of charges against the said individuals. He is also about to finish the last stages of the fact finding before bringing the case to the proper courts.

Councilor Piano reported on the barangay budget hearing for Brgy. East Tapinac, West Tapinac, Sta. Rita and Kalaklan. It was attended by their respective officials. A digital copy of barangay budgets was provided to each City Councilor.

Under the Committee on Telecommunications, he imparted to his colleagues about the request of Subictel to continue providing the City Council an internet connection which Subictel has been providing for free for the past months. In the agreement, we, the Council will start paying the internet connection this year at PhP9,000, he continued our request to reduce the charges to PhP3,000 but they granted our request for PhP5,000 per month, which is within our budget allocation. This includes 20 internet connections serving almost all City Councilors and Vice Mayor’s Office.

Another matter reported by Councilor Piano was the Community Based Flood Early Warning System Conference which he attended, conducted by PAGASA Flood Forecasting Branch. There were 27 provinces who were selected to benefit from this project and Olongapo is the only city that was on the list. The project will run beginning 2006 up to 2011. The executing agency is the Office of Civil Defense together with Philvocs, DOST, the LGUs and Telecommunication groups. The participation of Skills Training Center is to fabricate steel cages for security of equipments to be installed to prevent these from thieves or vandals as previously experienced by PAGASA.

Also, the visit of the Commander of US Naval Forces, Admiral James Kelly who paid a courtesy call to the City Officials was also mentioned in the report.

Councilor Dabu’s committee report pertained to the celebration of Women’s month for the month of March. Various activities has been scheduled. A kick-off parade will be participated in by the different groups of women and a mass offering on March 7. Other activities will include mobile birth registration, job fair, medical dental mission, pap smear, ligation and breast examination. Also invited to grace the affair is Congresswoman Etta Rosales.

Regarding the campaign against illegal sidewalk vendors, the Task Force Virgo conducted a saturation drive spearheaded by the Vendors Management Action Team together with the elements of SBMA police, Traffic Management and Public Safety, the PNP, Engineering, ESMO, CSWD, Rescue Team, City Health, Public Affairs, Treasury Departments with the assistance from the Barangay Officials and Tanods of EBB, WBB and Asinan. Several stalls were demolished particularly in the areas of 6th St. at Asinan, RM Drive and Gordon Avenue. Illegal vendors occupying the sidewalks were driven away and muslim vendors selling pornographic CD were confiscated. This is also in response to Councilor Cortez’s letter complaint to the City Mayor which the task force has acted upon to solve the problem.

While in the area of the public market, 3 kiosks purportedly managed by 3 members of the PNP were also demolished including two stalls.

Councilor Cerezo reported about the seminar on City Disaster Coordinating Council attended by 17 Barangay Captains and Members of Barangay Disaster Coordinating Council. Another seminar on Barangay Tanods Enhancement Training was held at WBB and East Tapinac, he said.

Barangay officials also attended the seminar on barangay legislation at Tagaytay City. Councilor Cerezo was privileged to speak on Internal Rules and Procedures, the Order of Business and the making of resolutions and ordinances.

He was also able to attend together with the City Mayor and some of the City Councilors, the Central Luzon Regional Athletic Association (CLRAA) at Palayan City, Nueva Ecija. Participants from Olongapo City were able to bag 21 gold, 16 silver and 15 bronze medals for a total of 52 medals and ranked no. 5 in the over all rating. He already requested the PE Supervisor to provide the council with the listing of all winners who garnered medals for their cash incentives as per resolution passed for the said matter.

4. Draft Ordinance No. 2008 O-06 – “An Ordinance Establishing The Dental Health Section Under The City Health Department,” was deferred on motion of Councilor John Carlos G. delos Reyes.

5. On motion of Councilor delos Reyes, Draft Ordinance No. 2008 O-12 – “An Ordinance Creating The Transportation Office Of The City Of Olongapo Under The Supervision Of The Vice Mayor,” was deferred by the body.

6. Draft Resolution No. 2008 R-027 – “A Resolution Encouraging All Educational Institutions To Adopt City Parks,” was deferred, on motion of Councilor John Carlos G. delos Reyes.

7. On motion of Councilor Piano, Draft Resolution No. 2008 R-028 – “A Resolution Approving The Annual Budget Of Barangay Sta. Rita, City Of Olongapo For The Calendar Year 2008,” was approved unanimously on its second and final readings.

8. Draft Resolution No. 2008 R-029 – “A Resolution Approving The Annual Budget Of Barangay Kalaklan, City Of Olongapo For The Calendar Year 2008,” was unanimously approved on its second and final readings, on motion of Councilor Edwin J. Piano.

9. Draft Resolution No. 2008 R-030 – “A Resolution Approving The Annual Budget Of Barangay Asinan, City Of Olongapo For The Calendar Year 2008,” was approved unanimously on its second and final readings, on motion of Councilor Edwin J. Piano.

Other Matters

Councilor Piano moved to approve a resolution adopting the comment to the application with manifestation of the City Legal Officer as regards to the application of PILTEL and PLDT with the NTC. The proponent explained the urgency due to the reason that the NTC will be having a hearing this Friday. The hearing officer informed the Legal Officer to submit any comment from the City until Friday which will be the last hearing to be conducted. Since, there are some matters that need to be clarified, the city will submit its comment to be put on record of the NTC and PLDT.

Explaining the importance of the resolution, when asked by Councilor Lipumano-Garcia, the proponent reminded the body that PILTEL has the franchise to operate the telephone system in Olongapo City. Since PLDT has already bought PILTEL, they are requesting the national TC that the Certificate of Public Conveyance and the Local Exchange Care facilities be transferred under their company’s name to be able to continue their operation of the telephone system. Otherwise, they need to apply for a congressional franchise of their own. With no other comment, “A Resolution Adopting The Comment To The Application (With Manifestation) Of The Olongapo City Legal Officer As Regards The Application Of Pilipino Telephone Corporation (PILTEL) And Philippine Long Distance Telephone Company (PLDT) With The National Telecommunications Commission In NTC Case No. 2007-186,” was approved unanimously on second and final reading, on motion of Councilor Edwin J. A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY STA. RITA, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2008

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Sta. Rita, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolution No. 18, Series of 2007 and Barangay Ordinance 01, 2007 of Barangay Sta. Rita dated December 28, 2007 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount
as unutilized appropriation.

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No . 70 of the Department of Budget and Management (DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999.

That the 5% Calamity Fund shall be utilized solely for relief, rehabilitation, reconstruction, contingencies and other works or services in connection with calamities and which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determined and declared by the Sangguniang Barangay concerned.

Pursuant to Local Budget Circular No. 63 of the Department of Budget and Management (DBM) dated 22 October 1996, barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; The honorarium rates of said barangay officials may be adjusted in accordance with Local Budget Circular No. 86 of the Department of Budget & Management dated 18 July 2007; However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:

SG-14 For Punong Barangay
SG-10 For the Sangguniang Barangay Members, Barangay
Secretary and Barangay Treasurer.

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed pursuant to the Local Budget Circular No. 63 of the Department of Budget Management dated 22 October 1999”.

Barangay Tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument subject to appropriation ordinance and limitations for Personal Services provided the total amount shall not exceed the minimum salary rate for salary grade 1.

That the amount appropriated for Traveling Expenses and Training & Seminar Expenses shall be disbursed in accordance with Executive Order No. 248 dated 29 May 1995 as amended by Executive Order Nos. 248-A and 298 dated 14 August 1995 and 23 March 2004, respectively.

That the amount of “Power Bills’ appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sanggunian Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability, may be properly liquidated/settled:

That appropriation in the amount of Ten Million Five Hundred Forty Three Thousand Three Hundred Forty-three Pesos and Eleven Centavos (PhP10,543,343.11) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

Let Barangay Sta. Rita Resolution No. 18, Series of 2007, endorsement from City Budget Office and other pertinent documents related hereto form part of this resolution.
