A RESOLUTION AUTHORIZING ACTING CITY MAYOR HONORABLE CYNTHIA G. CAJUDO TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE PHILIPPINE OVERSEAS EMPLOYMENT ADMINISTRATION (POEA) REPRESENTED BY ITS ADMINISTRATOR ATTY. ROSALINDA DIMAPILIS-BALDOZ FOR THE ANTI-ILLEGAL RECRUITMENT PROGRAM

WHEREAS, Philippine Oversees Employment Administration (POEA), is a government agency tasked to promote, develop overseas employment program, protect the rights of migrant workers and regulate private sector participation in recruitment and overseas placement;

WHEREAS, Olongapo City’s thrust is to ensure local and overseas employment and protect Overseas Filipino Workers against illegal recruiters;

WHEREAS, POEA launched an Anti-Illegal Recruitment (AIR) information campaign that enable the Olongapo City thru its Public Employment Service Office (PESO) to participate in the aggressive AIR campaign in the city;

WHEREAS, the city government finds the agreement beneficial to the people of Olongapo;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes Acting City Mayor Honorable Cynthia G. Cajudo to enter into a Memorandum of Understanding with the Philippine Overseas Employment Administration represented by its Administrator Atty. Rosalinda Dimapilis-Baldoz for the Anti-Illegal Recruitment Program.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) BETWEEN THE CITY GOVERNMENT OF OLONGAPO AND THE SUBIC BAY WORKERS/VOLUNTEERS MULTI-PURPOSE COOPERATIVE, INC. (SBWVMPCI) REPRESENTED BY ITS OFFICER-IN-CHARGE NIÑALYN M. RODRIGUEZ FOR JANITORIAL AND GROUND MAINTENANCE SERVICES FROM APRIL 01, 2008
TO NOVEMBER 30, 2008


WHEREAS, Section 35 of the Local Government Code of 1991 states that “Local government units may enter into joint ventures and such other cooperative arrangements… to engage in the delivery of certain basic services…”;

WHEREAS, SBWVMPCI is duly organized and authorized by law and ordinance, to perform janitorial and ground maintenance services;

WHEREAS, SBWVMPCI participated in a public bidding for janitorial and maintenance services and was awarded the contract in accordance with Section 441 (d) of the Government Accounting and Auditing Manual, Section 369 of the Local Government Code and Section 10, Rule IV of the Implementing Rules and Regulations of Republic Act No. 9184, otherwise known as the Government Procurement Reform Act;

WHEREAS, the City of Olongapo needs to avail of such service for the maintenance and cleanliness of its facilities, mainly: Olongapo City Hall, Olongapo City Hall Annex Building, Gordon College, Olongapo City Mall, Olongapo City Museum, James L. Gordon Memorial Hospital and Olongapo City Convention Center;

NOW, THEREFORE, on motion of Councilor Angelito W. Baloy with the majority decision of the Members of the Sangguniang Panlungsod present,


RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter into a Memorandum of Agreement (MOA) between the City Government of Olongapo and the Subic Bay Workers/Volunteers Multi-purpose Cooperative, Inc. (SBWVMPCI) represented by its Officer-In-Charge Niñalyn M. Rodriguez for janitorial and ground maintenance services from April 01, 2008 to November 30, 2008.

A RESOLUTION APPROVING THE REQUEST OF BARANGAY PAG-ASA TO OPERATE A MINI FAIR WITHIN THEIR JURISDICTION SUBJECT TO THE PRESCRIBED GUIDELINES OF THE SANGGUNIANG PANLUNGSOD

WHEREAS, carnivals and mini fairs established in conjunction with fiestas are good income generating means to fund projects for good causes;

WHEREAS, Barangay Pag-asa requested through Barangay Resolution No. 52, Series of 2008, permission to operate a mini fair in the said Barangay in order to raise funds for various barangay projects;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Pag-asa with the condition that the preparation and operation of a mini fair shall be in accordance with the provisions of Ordinance No. 49, Series of 2005 and upon compliance with the recommendations set by the same;

NOW , THEREFORE, on motion of Councilor Angelito W. Baloy with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the request of Barangay Pag-asa to operate a Mini Fair within their jurisdiction subject to the prescribed guidelines of the Sangguniang Panlungsod.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the Sangguniang Panlungsod recommendations regarding the request and that item nos.1 to 4 shall form part of this Resolution.

RECOMMENDATION REGARDING THE REQUEST OF BARANGAY PAG-ASA FOR PUTTING UP OF MINI FAIR AS PART OF THEIR FUND-RAISING CAMPAIGN


It is hereby recommended that Barangay Pag-asa’s request to operate a mini fair as part of their fund-raising activity be approved subject to the following conditions:

1. Specify the specific purpose of such fund-raising activity as stated in Section 391 Paragraph 11 of R.A. 7160 “… Provided that in appropriation thereof, specific purpose for which such fund-raising activity has been held shall be first satisfied …”

2. Require the barangay to submit the exact location of the mini fair.

3. Mini Fair operator must secure business permit from the City and should comply with the safety regulations of the Office of the City Mayor.

4. Require the barangay to secure a copy of Ordinance No. 49 Series of 2005 and comply with the conditions mandated.

5. Copies of item nos. 1 to 4 should form part of the request.
