RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

AN ORDINANCE APPROPRIATING THE AMOUNT OF THREE MILLION ONE HUNDRED SEVENTY ONE THOUSAND ONE HUNDRED SIX PESOS (PhP3,171,106.00) FOR THE REHABILITATION OF ERODED ROAD SHOULDER ALONG LONG ROAD BARANGAY GORDON HEIGHTS, THIS CITY CAUSED BY “TYPHOON HELEN” LAST JULY 16, 2008 CHARGEABLE UNDER THE 5% CALAMITY FUND OF THE OFFICE OF THE CITY MAYOR UNDER GENERAL FUND

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED THAT:

SECTION 1. The amount of Three Million One Hundred Seventy One Thousand One Hundred Six Pesos (PhP3,171,106.00) for the rehabilitation of eroded road shoulder along Long Road Barangay Gordon Heights caused by “Typhoon Helen” last July 16, 2008 is hereby appropriated chargeable under the 5% Calamity Fund of the Office of the City Mayor under General Fund.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter-request of the Honorable City Mayor James Gordon Jr., dated 08 September 2008 with Certification signed by the City Treasurer Marcelino Andawi and City Budget Officer Johnny B. Choa shall form part of this Ordinance.

SECTION 4. This ordinance shall take effect upon its approval.

A RESOLUTION REQUESTING FREEPORT SERVICES CORPORATION (FSC) AND SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO LEASE A PORTION OF FSC GROUNDS TO BE UTILIZED AS VENUE FOR THE 2008 CITY FIESTA NIGHT BAZAAR AND AUTHORIZING CITY MAYOR JAMES GORDON, JR. TO SIGN THE LEASE AGREEMENT WITH FREEPORT SERVICES CORPORATION, SUBIC BAY METROPOLITAN AUTHORITY AND TO ENTER INTO CONTRACTS AND AGREEMENTS WITH OTHER ENTITIES OR
PERSONS RELATED TO THE CONDUCT OF CITY FIESTA NIGHT BAZAAR 2008

WHEREAS, Section 458 of the Republic Act 7160 otherwise known as the Local Government Code of 1991 states that the Sangguniang Panlungsod, as the legislative body of the City shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the City and its inhabitants pursuant to Section 16 and in the proper exercise of the corporate powers of the City as provided for under Section 22;

WHEREAS, the City of Olongapo is positioning itself as a prime tourist destination area as the Subic-Clark- Tarlac has opened to serve as a gateway for additional tourists that will help boost the local economy;

WHEREAS, Olongapenos are anticipating an annual celebration of the City Fiesta with an establishment of a carnival with night bazaar as the main attraction where domestic tourists/ consumers can shop, eat and experience fun and entertainment;

WHEREAS, the carnival and bazaar had long attested itself as a catalyst that pump prime the economic flow of the city and the Subic Bay Freeport Zone during the Christmas season;

WHEREAS, the Sangguniang Panlungsod deems it beneficial for the City to request the FSC and SBMA to utilize the Helipad Area and Liwasang Maharlika surrounding the MCO (H8211) Building, Subic Bay, Freeport Zone as venues to conduct the Night Bazaar this year as those were the exact areas since the start of the famous annual night bazaar in the early 2000’s;

WHEREAS, the City Fiesta Night Bazaar shall at least be for the period starting October 15, 2008 to January 20, 2009 for the local populace and the tourists to have a place to visit during the holiday season;

NOW, THEREFORE, on the motion of Councilor Gina Gulanes-Perez, with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests Freeport Services Corporation (FSC) And Subic Bay Metropolitan Authority (SBMA) To Lease A Portion Of FSC Grounds To Be Utilized As Venue For The 2008 City Fiesta Night Bazaar And Authorizing City Mayor James Gordon, Jr. To Sign The Lease Agreement With Freeport Services Corporation, Subic Bay Metropolitan Authority And To Enter Into Contracts And Agreements With Other Entities Or Persons Related To The Conduct Of City Fiesta Night Bazaar 2008.

Let copies of this Resolution be furnished to FSC, SBMA, City Fiesta 2008 Executive Committee for their consideration and appropriate action.

WHEREAS, the City Government of Olongapo in its thrust to improve the quality of life of its constituents by providing technical and marketing support to would-be entrepreneurs in the City of Olongapo, requested the DOST for “Gabay sa Negosyo” Materials, Vacuum Sealer and Horizontal Band Sealer;

WHEREAS, the DOST-III has committed to assist the City Government of Olongapo in its modernization efforts through its 2008 Regional Grants-In-Aid Program and agreed to jointly undertake the project on Upgrading of the Library and Packaging Capability of the Livelihood and Cooperative Office;

WHEREAS, Olongapo City recognizes the importance of our Aeta brothers who were the first stakeholders of Olongapo and Subic, who painstakingly protected our forests and seas even before the Subic-Olongapo area became a US Naval Base;

WHEREAS, the Aeta community equally face with the Olongapeños the opportunities and developmental challenges of the City as well as the Subic Bay Freeport Zone;

WHEREAS, as “parens patriae” of this indigenous people, Olongapo City through its Mayor, Hon. James Gordon Jr., stands on their behalf for the advancement of their welfare;

WHEREAS, the City deems it necessary to authorize the City Mayor to sign a Memorandum of Agreement/Deed of Donation for and in behalf of our Aeta community with the Subic Bay Metropolitan Authority regarding the donations of scrap and other reusable materials to be used for the livelihood projects of our Aeta brothers.

A RESOLUTION APPROVING THE REHABILITATION OF ERODED ROAD SHOULDER ALONG LONG ROAD, BETWEEN BLOCK 15TH AND BLOCK16TH OF BARANGAY GORDON HEIGHTS, OLONGAPO CITY

WHEREAS, the City puts in place necessary infrastructure and road projects in different barangays of the city to match the needs of the community and serve as frameworks to sustain upcoming programs, which includes the repair of Long Road, Barangay Gordon Heights in this City;

WHEREAS, with reference to the landslide incident which was reported 21 July 2008 and 20 August 2008 by the Engineering Office, it is endorsed that immediate rehabilitation of the collapsed stone masonry slope protection is urgently necessary;

WHEREAS, the Committee of Public Works and Engineering assessed the said project and is worthy of project implementation;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A DEED OF TRANSFER OF OWNERSHIP AND ACCEPTANCE WITH THE DEPARTMENT OF SCIENCE AND TECHNOLOGY (DOST) – REGION III REPRESENTED BY CONRADO J. OLIVEROS, REGIONAL DIRECTOR FOR THE MULTI-PURPOSE DRYER

WHEREAS, the City Government of Olongapo in its thrust to improve the quality of life of its constituents by providing technical and marketing support to would-be entrepreneurs in the City of Olongapo, requested the DOST for a Multi-purpose Dryer;

WHEREAS, DOST-III is committed to provide assistance to the City Government thru its Grants-In-Aid Project entitled “Technology-based Enterprise for the Disabled in Region III”;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter into a Deed Of Transfer of Ownership and Acceptance with the Department of Science and Technology (DOST) – Region III represented by Conrado J. A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A CONTRACT OF AGREEMENT WITH NEW RAPRAP TRUCKING SERVICES FOR THE EMERGENCY LEASE OF WATER TRUCKS

WHEREAS, due to the mountainous terrain and proximity to pumping stations of a portion of the population of the City, the water pressure provided by Subicwater is not enough to reach the said areas;

WHEREAS, inadequate supply of potable water posted danger to the health of the affected constituents which later on would be shouldered by the City Government;

WHEREAS, the City Government with its desire to address the problem in the supply of clean water sees the need to lease Water Trucks to supply potable water to water kiosks in the affected communities;

WHEREAS, a Notice of Emergency Procurement was posted 25 March 2008, and the bidding conducted 8 April 2008 where New RapRap Trucking Services was declared as winning bidder;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor James Gordon Jr., to enter into a Contact of Agreement with New RAPRAP Trucking Services for the emergency lease of Water Trucks.

FOR THE IMPLEMENTATION OF THE FEEDING HOPE PROGRAM AT THE IRAM RESETTLEMENT AREA IN BARANGAY NEW CABALAN, OLONGAPO CITY

WHEREAS, the City of Olongapo has consistently played a major part in worthwhile affiliations for the benefit of the City specifically the underprivileged;

WHEREAS, the City is spearheading a supplemental feeding project entitled: “Feeding Hope Program” which shall accommodate sixty (60) malnourished children from the Iram Resettlement Area in Barangay New Cabalan commencing on August 11, 2008 until March 23, 2009;

WHEREAS, the project aims to improve the nutrition and health of underweight children from ages three (3) to six (6) years old and impart to them and their family the value of establishing and sustaining good health and proper nutrition;

WHEREAS, the opportunity to serve the nutritional needs of the said constituents shall be made possible primarily through the alliance of interests between the City Government of Olongapo and the Rotary Club of Makati;

WHEREAS, the Rotary Club of Makati agrees to contribute the amount of Sixty Thousand Pesos (PHP 60,000.00) for the realization of the project;

WHEREAS, the project shall be a welcome relief to the beneficiaries especially in these very trying times;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter into a Memorandum of Agreement (MOA) by and between the City Government of Olongapo and the Rotary Club of Makati represented by Federico S. SECTION 1. Section 3 Amendment - The pertinent letter-request of the Honorable City Mayor James Gordon Jr., dated 11 August 2008, Memoranda from Ms. Marey Beth D. Marzan dated 04 August 2008 and 04 September 2008 and Certificate of Availability of Funds from the City Treasurer Marcelino Andawi dated 20 August 2008 shall be made as integral parts of this Ordinance.

SECTION 2. Section 4 - This Ordinance shall take effect retroactive July 01, 2008.
