A RESOLUTION AUTHORIZING THE CITY MAYOR, HONORABLE ROLEN C. PAULINO TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT WITH HOLISTIC MARKETING SERVICES COMMUNICATIONS FIRM CORPORATION WITH REGARD TO THE LEASE OF A PORTION OF OLONGAPO CITY PUBLIC MARKET

WHEREAS,  Olongapo City endeavors to be an environment where business, tourism  and trade can through our City's  own and unique attractions to draw local and foreign tourists alike to cater to different budgets and levels of comfort.

WHEREAS, along with this thrust are marketing concepts to create  sources of revenues and raise funds for  City projects to benefit the constituents of Olongapo;

WHEREAS, one of the strategies is to lease a portion of Olongapo City Public market for advertisement/marketing /product promotion activities;

WHEREAS, for this venture, the City's leadership deems that a Memorandum of Agreement to be entered into with Holistic Marketing Services Communications Firm Corporation (Holistic) is in order and shall provide the best benefits for the people of Olongapo;

NOW, THEREFORE, on the motion of City Councilor Alreuela M. Bundang-Ortiz, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the SangguniangPanlungsod in session assembled to authorize as it  hereby authorizes the City Mayor, Honorable  Rolen C. Paulino to enter into and sign a Memorandum of Agreement with Holistic Marketing Services Communications Firm Corporation with regard to the lease of a portion of the Olongapo City Public Market.

A RESOLUTION REJECTING ANY MARKET STUDY FROM FINASIA LAND AND REALTY CORPORATION OR ANY OTHER ENTITY THAT SEEKS TO OUST GENUINE STAKEHOLDERS AT THE EAST BAJAC-BAJAC PUBLIC MARKET AND REAFFIRMING THE CITY’S COMMITMENT TO GENERAL WELFARE

WHEREAS, on 15 April 2009, the Sangguniang Panlungsod approved Resolution No. 50, Series of 2009, which primarily sought to redevelop the East Bajac Bajac Public Market (“EBB Market”) for the primary benefit of the people whose livelihood is based and conducted therein;

WHEREAS, on 27 May 2009, the Sangguniang Panlungsod approved Resolution No. 70, Series of 2009, for the purpose of maximizing the livelihood-and-job generating potential of the East Bajac Bajac Public Market (“EBB Market”), but placing emphasis on the need to ensure, to the fullest extent viable, a real and meaningful participation from its authentic stakeholders such as genuine stallholders, salesmen and retailers who must be protected;

WHEREAS, in light of the misinformation perpetuated by unscrupulous non-stakeholders or those who seek to sow disunity in the community, and whose negative disinformation is aimed at stunting the City’s well-meaning initiatives, the Sangguniang Panlungsod deems this measure indispensable to affirm its profound commitment to its constituents;

NOW, THEREFORE, on motion of City Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reject as it is hereby rejects any market study from Finasia Land and Realty Corporation or any other entity that seeks to oust genuine stakeholders at the East Bajac Bajac Public Market and reaffirming the city’s commitment to general welfare.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance.

ORDINANCE NO. 11
(Series of 2009)

AN ORDINANCE REVERTING THE AMOUNT OF ONE HUNDRED THOUSAND PESOS (PHP100,000) FROM THE ITEM CAPITAL OUTLAY- OTHER MACHINERIES AND EQUIPMENT TO THE ITEM PERSONAL SERVICES- VACATION AND SICK LEAVE BENEFITS OF THE OLONGAPO CITY PUBLIC MARKET.

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED THAT:

SECTION 1. The amount of One Hundred Thousand Pesos (PhP100,000.00) is hereby reverted from the item Capital-Outlay Other Machineries and Equipment to the item Personal Services - Vacation and Sick Leave Benefits of the Olongapo City Public Market.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter request of Honorable City Mayor James Gordon, Jr. dated February 18, 2009 and the Memorandum of Mr. Damian P. Delos Santos, Jr. dated February 16, 2009 shall be made as integral parts of this Ordinance.

SECTION 4. This Ordinance shall take effect upon its approval.
