A RESOLUTION REPEALING CITY COUNCIL RESOLUTION NO. 114, SERIES OF 2009, TO SECURE THE BEST POSSIBLE TERMS FOR, AND OPTIMUM BENEFITS FROM, THE LONG-TERM LEASE OF CITY MALL

WHEREAS, the Hon. City Mayor James Gordon, Jr. has been duly authorized in previous City Council resolutions such as Resolution No. 54, Series of 2008, and Resolution No. 79, Series of 2009, to negotiate, enter into and sign a long-term lease agreement relative to the City Mall and to prepare the terms of reference (TOR) regarding any such lease agreement;

WHEREAS, in relation to the previous authority granted to the City Mayor, the TOR for the long-term lease of City Mall was adopted through, and embodied in, City Council Resolution No. 114, Series of 2009;

WHEREAS, to constantly ensure that only the best possible terms and conditions would be secured for the greater good and welfare of the local community, and in order to maintain flexibility compliant with pertinent laws, there is a need to repeal Resolution No. 114, Series of 2009;

NOW, THEREFORE, on motion of City Councilor Aquilino Y. Cortez, Jr. co-sponsored by City Councilors Gina G. Perez, Rodel S. Cerezo, Angelito W. Baloy, Edwin J. Piano, Anselmo A. Aquino, Elena C. Dabu, Jonathan G. Manalo and Cheenee F. Hoya, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to repeal, as it hereby repeals City Council Resolution No. 114, Series of 2009 without prejudice to the viability of public-private partnership arrangements consistent with the Local Government Code and such other applicable laws.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO SIGN AND ENTER INTO A LONG-TERM LEASE AGREEMENT WITH THE MOST QUALIFIED LESSEE AS REGARDS THE OLONGAPO CITY MALL PURSUANT TO THE RECOMMENDATIONS OF THE SPECIAL BIDS AND AWARDS COMMITTEE CREATED FOR SUCH PURPOSE

WHEREAS, there is a need to optimize the economic potential of the Olongapo City Mall;

WHEREAS, current best practices point to government endeavors that help conserve its resources while generating revenues;

WHEREAS, leasing out the Olongapo City Mall achieves the foregoing purpose;

NOW, THEREFORE, on motion of Councilor Angelito W. Baloy co-sponsored by Councilors John Carlos G. delos Reyes, Rodel S. Cerezo, Edwin J. Piano, Aquilino Y. Cortez, Jr., Anselmo A. Aquino, Elena C. Dabu, Jonathan G. Manalo, Carlito A. Baloy and Cheenee F. Hoya, with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to sign and enter into a Long-term Lease Agreement with the most Qualified Lessee as regards the Olongapo City Mall pursuant to the recommendations of the Special Bids and Awards Committee created for such purpose.

WHEREAS, there is an unnamed body of water adjacent to the Olongapo City Mall separating Olongapo City from the fenced area of Subic Bay Freeport Zone;

WHEREAS, the said body of water consist of a Channel, deep and relatively narrow linking two larger bodies;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 09

AN ORDINANCE NAMING THE BODY OF WATER ADJACENT TO THE OLONGAPO CITY MALL AS “THE CHANNEL” FOR IDENTIFICATION AND RECORD PURPOSES

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. That the body of water adjacent to the Olongapo City Mall that separates the city from the fenced area of Subic Bay Freeport Zone shall be named as “The Channel”.

SECTION 2. With the approval of this Ordinance, Olongapo City Map shall include “The Channel”.

SECTION 3. This Ordinance shall take effect upon its approval.
