RESOLUTION NO. 28
(Series of 2007)

A RESOLUTION AUTHORIZING THE CITY MAYOR TO ENTER INTO A MEMORANDUM OF AGREEMENT FOR AND IN BEHALF OF THE OLONGAPO BUSINESS CLUB INC. (OBC INC.) REPRESENTED BY ITS PRESIDENT MR. SAMUEL DEL ROSARIO FOR THE KALYE KASIYAHAN FESTIVAL 2007


WHEREAS, Olongapo Business Club was successful in organizing Mardigras remixed last October 2006, bringing in around 20,000 tourists in Ramon Magsaysay Drive during the two-day activity;

WHEREAS, The City recognizes the effort of the businessmen in its strong desire for local economic growth through tourism;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez with the unanimous accord of Members of the Sangguniang Panlungsod;

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it is hereby authorizes the City Mayor to enter into a Memorandum of Agreement for and in behalf of the Olongapo Business Club Inc. represented by its President, Mr. Samuel del Rosario for the Kalye Kasiyahan Festival 2007.

Let a copy of the Memorandum of Agreement be attached to this Resolution.

WHEREAS, pursuant to Executive Order No. 292 Series of 1987 as amended by Republic Act No. 9177 Series of 2002, December 30 was made as a regular holiday throughout the country;

WHEREAS, December 30 is also a very special day for Olongapo City and its people as they celebrate it as its yearly fiesta;

WHEREAS, Presidential Proclamation No. 503 declared December 30, 2003 as a regular working day in lieu of a Special non-Working Day on January 2, 2004;

WHEREAS, by tradition, Olongapeños celebrates our City Fiesta on this day and spur domestic tourists from neighboring towns and provinces to come and celebrate with us;

WHEREAS, Section 16 of the Local government Code of 1991 provides provisions for Local Government Unit to exercise powers necessarily appropriate or incidental to its efficient and effective governance and which are essential to the promotion of the general welfare of its people;

WHEREAS, it is also provided in the same section the need to preserve and enrich its jurisdictional culture, improve public morals, enhance economic prosperity and preservation of comfort and convenience of their inhabitants;

WHEREAS, to achieve the above-said provisions, the City of Olongapo deemed it proper to proclaim December 30,2003 in its jurisdictional territory ofOlongapo City as a Special Non Working Day as it celebrates Olongapo City Day likewise completing the joyous essence of its celebration;

NOW THEREFORE, on motion of Councilor Teodoro D. Del Rosario, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 154 (Series of 2003)

AN ORDINANCE DECLARING DECEMBER 30, 2003 AS OLONGAPO CITY DAY AND DECLARING THE SAME AS A SPECIAL NON-WORKING DAY

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. December 30, 2003 is hereby proclaimed as Olongapo City Day and declaring the same as a Special Non-Working Day in the jurisdictional territory of the same;

SECTION 2. That copy of this Resolution be furnished the Office of the President, Department of Interior and Local Government, Department of Labor and Employment and other concerned parties for their information and reference.

SECTION 4. This Ordinanace shall take effect upon its approval.

WHEREAS, the City Government of Olongapo had been informed that there are some Bureau of Fire Protection (BFP) personnel from the City or formerly assigned in the City and other personnel assigned at other city, municipal and provincial offices, who are conducting illegal fire inspection in different households and business establishments within the City without the authorization of the former City Marshall;

WHEREAS, to avert the said illegal trade within the BFP force, the City hereby acknowledges to adopt and implement monitoring measures, pursuant to Section 1.201 of PD. 1185 otherwise known as the Fire Code of the Philippines;

NOW, THEREFORE, on joint motion of Councilors Anselmo A. Aquino and Teodoro D. Del Rosario, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 147 (Series of 2003)

AN ORDINANCE REGULATING THE CONDUCT OF FIRE SAFETY INSPECTION WITHIN THE TERRITORIAL JURISDICTION OF OLONGAPO CITY

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Subject to limitations herein prescribed, fire safety inspections on any business, commercial establishments, including house, departments and other structures shall be conducted only by the authorized inspectors of Olongapo City Fire Station.

a. The inspector is duly armed with a Mission Order issued and duly signed by the City Fire Marshal.

b. The inspector conducting the inspection shall be in the prescribed uniform authorized by the City Fire Marshall.

c. The inspection shall be conducted only during office hours Monday thru Saturday.

SECTION 3. BFP personnel who are not the duly Fire Safety Inspectors of Olongapo City found and caught conducting inspection within the territorial jurisdiction of Olongapo City shall, upon conviction, be punished by a fine of not less than Php500.00 but not more than Php 1,500.00 and imprisonment of not less than thirty (30) days but not more than three (3) months.

SECTION 4. This Ordinance shall take effect upon its approval.
