A RESOLUTION  STRONGLY REITERATING THE CALL FOR ALL PERSONS, ENTITIES OR ESTABLISHMENTS TO IMPLEMENT THE LEGALLY MANDATED RIGHTS OF SENIOR CITIZENS AND PERSONS WITH DISABILITIES UNDER REPUBLIC ACT NO. 7432 AS AMENDED BY REPUBLIC ACT NOS. 9257 AND 9994 WHICH INCLUDE ESTABLISHMENT OF A PREFERENTIAL OR SPECIAL LANE

WHEREAS, in a long line of legislation since the year 1996, the city has passed Ordinances and Resolutions which promote the rights of Senior Citizens, particularly: City Ordinance No. 3, Series of 1996, “An Ordinance making it punishable for any establishment, service utility and private or public institution who refuses to grant the privileges and benefits due senior citizens as provided for under Republic Act 7432”, City Council Resolution No. 60, Series of 1999, “A Resolution establishing a preferential or express lane for senior citizens and persons with disabilities in paying stations of government and non-government agencies providing utilization of services for a fee (electric, water, transportation, cinemas, banking facilities and etc.)”; City Ordinance No. 23, Series of 2000, “An Ordinance mandating all public utility transport vehicles within the jurisdiction of the City of Olongapo to comply with the provisions of RA #7432 specifically granting twenty (20%) discount to senior citizens and posting of that information in the vehicles”: City Ordinance No. 25, Series of 2000, “An Ordinance mandating each barangay to appoint an OSCA (Office of Senior Citizen Affairs) Chairman for Senior Citizens to be selected from among barangay council members”; City Council Resolution No. 36, Series of 2001, “A Resolution authorizing the Federation of Senior Citizens Association of the Philippines (FSCAP) Olongapo chapter to occupy portion of Lot 5, TS-308, located at Barangay West Bajac-Bajac, this city”; City Council Resolution No. 100, Series of 2001,” A Resolution authorizing the Federation of Senior Citizens Association of the Philippines (FSCAP) Olongapo City Chapter, to use the old DSWD office at the City Engineering Compound, West Bajac-Bajac, this city as their new office and authorizing the City Mayor to enter into a Memorandum of Agreement relative thereto”; City Council Resolution No.41, Series of 2006, “A Resolution strongly supporting the strict compliance with the provisions of Republic Act 9257 otherwise known as the Expanded Senior Citizens Act of 2003”; City Council Resolution No. 103, Series of 2006, “A Resolution strongly endorsing the swift passage into law of Senate Bill No. 2206 giving Senior Citizens discount beyond death, and other additional privileges, authored by Sen. Edgardo Angara”; City Council Resolution No. 140, Series of 2007, “A Resolution accrediting the Federation of Senior Citizens Association of the Philippines (FSCAP) Olongapo City Chapter, a people’s organization for membership purposes in local special bodies in Olongapo City pursuant to the provisions of Republic Act No. 7160 otherwise known as the Local Government Code of 1991”; City Council Resolution No. 21, Series of 2009, “A Resolution supporting Senate Bill No. 3061 which seeks to amend Republic Act No. 9257 or the Senior Citizens Act of 2003 by exempting senior citizens from the twelve percent Value Added Tax on Medicines”; City Council Resolution No. 64, Series of 2010, “A Resolution adopting Republic Act No. 9994 otherwise known as the Expanded Senior Citizens Act of 2010 or An Act granting additional benefits and privileges to senior citizens, further amending Republic Act 7432 as amended, otherwise known as An act to maximize the contribution of senior citizens to nation building, grant benefits and special privileges and for other purposes and enjoining all concerned establishments and offices on its implementation” ;

WHEREAS, recent reports show that there remain persons, entities or establishments which do not comply with the legally mandated rights of Senior Citizens or Persons with Disabilities under national and local legislation's  thus the need to  strongly reiterate the city’s consistent stance favoring and promoting their rights;

NOW, THEREFORE, on motion of City Councilors Edna A. Elane and Elena C. Dabu with the unanimous accord of the Members of the Sangguniang Panlungsod present;

 RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to Strongly Reiterate the Call for all Persons, Entities or Establishments to Implement the Legally Mandated Rights of Senior Citizens and Persons with Disabilities under Republic Act No. 7432 as amended by Republic Act Nos. 9257 and 9994 which include establishment of a Preferential or Special Lane.

RESOLUTION NO. 56

A RESOLUTION REITERATING OLONGAPO CITY’S REQUEST TO THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO CONSTRUCT A JETTY/BREAKWATER OR OTHER SIMILAR STRUCTURE TO PREVENT CLOGGING AT THE MOUTH OF KALAKLAN RIVER AS PER RESOLUTION NO. 44, SERIES OF 2010

WHEREAS, the Olongapo City Government acquired a dredging machine last year for the de-clogging of Olongapo City waterways and started to dredge the Kalaklan River;

WHEREAS, dredging, desilting, declogging operations have since been undertaken at various waterways of the city;

WHEREAS, the dredging of Kalaklan River is rendered futile because Subic Bay’s natural flow causes the sand to build up at the mouth of Kalaklan River which was aggravated by the reclamation project at Moonbay Marina.

WHEREAS, a study conducted by experts in flood control suggests that a jetty/breakwater or other similar structure must be constructed at both sides of Kalaklan River to prevent clogging at the mouth of Kalaklan River;

WHEREAS, the City Government of Olongapo thru the CDF of Senator Richard Gordon had completed the jetty construction at its side and requested SBMA to construct a similar structure on their side as part of their social responsibility.

WHEREAS, the recent flooding were unprecedented in the history of the city and flood experts conclude that the Moonbay Marina Project which Olongapo strongly opposed, contributed in such massive flooding. Furthermore, such project is devoid of Environmental Compliance Certificate (ECC) and Environmental Impact Statement and has not been approved by DENR, and therefore must implement required mitigating measures;

WHEREAS, the City Government thru the City Council deems it necessary to reiterate that SBMA construct a jetty/breakwater or other similar structure at their side at the mouth of Kalaklan river;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reiterate, as it hereby reiterates Olongapo City’s Request to the Subic Bay Metropolitan Authority (SBMA) to contruct a jetty/breakwater or other similar structure to prevent clogging at the mouth of Kalaklan River as per Resolution no. 44, Series of 2010.

Let copies of this Resolution be furnished to SBMA, DENR, DPWH and Moonbay Marina for their information and record.

RESOLUTION NO. 145

A RESOLUTION STRONGLY REITERATING TO THE FREEPORT SERVICES CORPORATION (FSC) BOARD THAT THE FSC’S NITE BAZAAR ADVERSELY AFFECTS THE ECONOMIC VIABILITY OF BUSINESSES IN OLONGAPO CITY

WHEREAS, the Subic Bay Metropolitan Authority (SBMA) officials push intensive market-driven promotion strategies to sell Subic as a premier tourist destination, focusing on its natural attractions, forest trails and theme parks to add on to the spawning investments in the Freeport brought by multinational companies;

WHEREAS, as the most proximate stakeholder, keeper and protector of the legacy that made SBMA, the world-class Freeport that it is, Olongapo, amongst its neighboring communities, was not only a loyal and enduring partner in this thrust but had equally and jointly hurdled with SBMA the acid tests of its timeline;

WHEREAS, however, it can be recalled that the City bore the brunt of the past administration in deviating from the original zoning master plan of the Freeport by allowing the proliferation of pawnshops, eateries, beauty parlors as well as “tiangges”, and other ventures uncalled for inside the Freeport and within the central business area that are posing unfair competition to the local businesses of Olongapo City that are subject to regular taxes and other mandatory business permit requirements. The City, then, had to weather the turbulence of such market battle;

WHEREAS, the City is perturbed if it will suffer again from the trade festivals they organized that allowed merchandisers from Metro Manila and other places not contiguous to the Freeport Zone to compete directly with local businesses that our entrepreneurs will have to gamble to a seeming bleak economic environment;

WHEREAS, it can be construed now that coordinated efforts in devising a coherent management plan that will benefit the SBMA and the City on this regard had been miserably reneged. For this, the City expresses that this matter be given utmost consideration by the new leadership helm of SBMA and reiterates its position that the Nite Market/Bazaar poses adverse effects in the economies of the City and its neighbors;

WHEREAS, explicitly put, the Local Government Code so provides that national agencies and offices with project implementation functions shall coordinate with one another, and as such shall coordinate with the local government units concerned in the discharge of such duties;

NOW, THEREFORE, on motion of Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to strongly reiterate, as it hereby strongly reiterates to the Freeport Services Corporation (FSC) Board that the FSC’s Nite Bazaar adversely affects the economic viability of businesses in Olongapo City.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be furnished Her Excellency President Gloria Macapagal – Arroyo, Hon. Feliciano Salonga, Chairman, Hon. Armand Arreza, Administrator, Subic Bay Metropolitan Authority (SBMA), Freeport Services Corporation (FSC) Board and the SBMA Board of Directors for their information and action.
