A RESOLUTION EXPRESSING OPPOSITIONS TO THE PLAN OF THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO COVERT SUBIC BAY INTERNATIONAL AIRPORT (SBIA) INTO A COMMERCIAL ZONE, INSTEAD, SUPPORTING SBIA’S RETENTION AND FULL UTILIZATION

WHEREAS, the Naval Air Station Cubi Point now known as Subic Bay International Airport (SBIA), was constructed October 2, 1951 and befits all the requirements of the National Historical Commission of the Philippines (NHCP) as a Historical site, symbolizing the lasting friendship and cooperation between the people of the Philippines in general, the Olongapo constituents in particular, and the American People;

WHEREAS, the Subic Bay International Airport (SBIA), which lies strategically at the center of the Asia-Pacific heartland, serves as a secondary and main diversion airport for Ninoy Aquino International Airport (NAIA);

WHEREAS, while NAIA is now over-its-capacity limit and Clark International Airport (CIA) is expected to duffer the same fate as the Manila airports in the next five to ten years, the SBIA is capable of international and domestic flight operations which complements the general aviation requirements of Luzon;

WHEREAS, SBIA, an irreplaceable asset that entails a construction costs worth billions of dollars, can serve as an International General Aviation Hub and can be a backup for Hong Kong, Singapore and Malaysia airports which have reached either its full or nearly full capacity in terms of Aircraft Management, Interior and Painting Facilities and Maintenance and Repair facilities;

WHEREAS, an article by Aviation Industry Newspaper (AIN), published by Aviation Industry 6,000 plus participants in China and 100,000 in the US and Europe, says that Subic Bay is an excellent “alternative to Hong Kong hassles” thereby creating new aviation careers for the Philippines with jobs providing long-term growth and high income potential;

WHEREAS, the Subic Bay Metropolitan Authority has expressed its plan to demolish and destroy SBIA and convert the billion-dollar asset into a commercial zone for future leasable areas for the development of what they termed as an “Integrated Family-Oriented Tourist Destination”;

WHEREAS, the City Government believes that we retain the runway vis-à-vis the plan commercialization of SBMA;

WHEREAS, while the City Government of Olongapo supports the business expansion at the Subic Bay Freeport Zone, it, however, found its proposed plan untenable due to the following reasons:

1)      The planned conversion is ill-advised as it forfeits the use of an international airport and demolish a billion-dollar investment which can be utilized for the benefits of both local and national interest;

2)      Converting and demolishing billions-worth of infrastructure to make way for a 200-hectare leasable area for prospective investors is economically and financially unsound, especially if a 3,000-hectare area at the Redondo Peninsula is available for expansion and development;

3)      The proposal of SBMA to cram in one contiguous area all kinds of projects of various categories is technically and environmentally unsound; and

4)      It shall diminish the viability of the Philippines, in general and Subic Bay, in particular as a Cooperative Security Location (CSL) especially in terms of aerial operations and logistical requirements of allied countries.

WHEREAS, the planned expansion of the SBMA can be established at Redondo Peninsula which has been described in the official portals of the Department of Tourism (www.visitmyphilippines.com) as scenic 3,800-hectare area earmarked for the development of subdivisions, golf courses, resort hotels and restaurants. Part of Redondo Peninsula is being reserved for the Green Beach One Project for both tourism and industrial based developments which may include an eco-village development, a resort, marina and entertainment complex are some of the possible tourism-based projects suitable in the area and ship-building facility, container port, specialized industrial park and institutional research center are some of the industrial-based developments;

WHEREAS, with both the airport and seaport intact, the capability of Subic Bay as Cooperative Security Location (CSL) shall be greatly enhanced and the national government, the Subic Bay Freeport Zone, the City of Olongapo and outlying LGUs shall benefit from the lease-rentals of the two facilities;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby express opposition to the plan of the Subic Bay Metropolitan Authority (SBMA) to convert Subic Bay International Airport (SBIA) into a commercial zone, instead, supporting SBIA’s retention and full utilization.

A RESOLUTION OPPOSING THE RECLAMATION AT MOONBAY MARINA, OCEAN VIEW BEACH RESORT AND ALL AREAS ALONG SUBIC BAY

WHEREAS, the Olongapo City Government has started to dredge its rivers in its effort to revive and maintain its waterways to prevent massive flooding;

WHEREAS, adding to the natural flow of Subic Bay, the reclamation project in Moonbay Marina becomes a major factor in the clogging of Kalaklan River;

WHEREAS, the Department of Environment and Natural Resources (DENR) has not issued an Environmental Clearance Certificate and Environmental Impact Assessment nor a consultation with contiguous area has been made;

WHEREAS, flood experts concluded that the Moonbay Marina Project is contributing in the clogging of the Kalaklan river preventing the free flow of Olongapo waterways to Subic Bay, while the continuous reclamation in Ocean View Beach Resort have uncertain effect in the environment;

WHEREAS, the city government sees the need to impede these reclamations and urge the Subic Bay Metropolitan Authority, Moonbay Marina and Ocean View Beach resort to take the necessary mitigating measures;

NOW, THEREFORE, on motion of City Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled, to oppose as it hereby opposes the reclamation at Moonbay Marina, Ocean View Beach Resort and all areas along Subic Bay.

A RESOLUTION STRONGLY OPPOSING THE PASSAGE OF HOUSE BILL NO. 6303 AND CALLING FOR ITS OUTRIGHT REJECTION

WHEREAS, the City of Olongapo, its officials and its inhabitants abide by the Constitution and the rule of law;

WHEREAS, on November 18, 2008, the Supreme Court in the case of “League of Cities of the Philippines v. COMELEC, et al,” has rendered a decision (the “Decision”) nullifying the cityhood laws of sixteen municipalities for violation of R.A. 9009 and the Constitution;

WHEREAS, the City of Olongapo fully supports and agrees with the Decision for being in accordance with the rule of law and the supremacy of the Constitution;

WHEREAS, the sixteen municipalities have caused the filing of House Bill No. 6303 which attempts by legislation to resurrect the exemption clause that has already been declared null and void by the Supreme Court with finality;

WHEREAS, House Bill No. 6303 is a blatant and contemptuous attempt to thwart and circumvent the ruling of the Supreme Court in the Resolution;

WHEREAS, House Bill No. 6303 has the same defect as the cityhood laws which renders it unconstitutional even if it becomes law;

WHEREAS, House Bill No. 6303 also violates the principle of separation of powers of the legislature and the judiciary by seeking to overturn the Supreme Court’s interpretation of R.A. 9009 and Sections 6 and 10 of Article X of the Constitution;

WHEREAS, House Bill No. 6303 will create havoc in the orderly system of conversion of municipalities into cities by establishing arbitrary and discriminatory standards in the application of the requirements under Section 450 of the Local Government Code;

WHEREAS, House Bill No. 6303 is not in accordance with the Constitution and the rule of law and should therefore be rejected outright;

WHEREAS, the City of Olongapo and its inhabitants have suffered continuous damage and injury due to the implementation of the unconstitutional cityhood laws;

NOW, THEREFORE, with unanimous accord of the Members of the Sangguniang Panlungsod of Olongapo, on behalf of its constituents and residents, hereby resolves to:

1. STRONGLY AND VEHEMENTLY OPPOSE the passage of House Bill No. 6303;
2. CALL for the outright rejection of House Bill No. 6303 for being void and unconstitutional; and
3. URGE the Honorable Members of the 14th Congress to uphold the rule of law and the principles laid down by the Supreme Court in the Decision in League of Cities of the Philippines v. COMELEC.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, by the Sangguniang Panlungsod in session assembled, to oppose, as it hereby opposes the passage of House Bill No. 6303 and calling for its outright rejection.

A RESOLUTION OPPOSING THE COMMISSIONING OF THE MOTH-BALLED BATAAN NUCLEAR POWER PLANT

WHEREAS, the Philippine nuclear program started in 1958 with the creation of the Philippine Atomic Energy Commission (PAEC) under Republic Act 2067.Under a regime of martial law, Philippine President Ferdinand Marcos in July 1973 announced the decision to build a nuclear power plant.This was in response to the 1973 oil crisis, as the Middle East oil embargo had put a heavy strain on the Philippine economy, and Marcos believed nuclear power to be the solution to meeting the country's energy demands and decreasing dependence on imported oil;

WHEREAS, construction on the Bataan Nuclear Power Plant began in 1976 and was completed in 1984 at a cost of $2.3 billion. A Westinghouse light water reactor, it was designed to produce 621 megawatts of electricity;

WHEREAS, following the 1979 Three Mile Island accident in the United Sates, construction on the BNPP was stopped, and a subsequent safety inquiry into the plant revealed over 4,000 defects. It was built near major earthquake fault lines and close to the then dormant Pinatubo volcano;

WHEREAS, between 1993 and 1995, M.E.T.T.S. undertook a study of the options for converting the Bataan Nuclear Power Station to fossil fuel (coal or natural gas) combustion. One aim of the study was to find another market for Philippine and Australian coal or natural gas (LNG);

WHEREAS, the Philippine Government has previously stated that the Philippines will have nuclear power, but that power will come from new plant and not the Bataan reactor. President Ramos announced on the 8th October 1994 that the Reactor would be converted to a 1000MW combined cycle gas plant. (Although an announcement for a specific conversion scheme has been made, it is still considered that there is time for other options to be considered.);

WHEREAS, the BNPP’s tainted history is already a hard lesson on how the pursuit of nuclear power has been a gargantuan and unjust burden on Filipinos. Even now, with moves for its revival heralding what appears to be aggressive plans for a national nuclear program, nuclear power may become the altar upon which this country will bankrupt itself;

WHEREAS, the real solutions to the climate change and energy security is renewable energy and energy efficiency technologies, the cheapest and safest sources of power available, and the least greenhouse gas intensive. The potential for renewable energy in the Philippines is vast and far greater than that of nuclear power or fossil fuels. To re-commission the Bataan Nuclear Power Plant is an unwise proposal given our proven renewable energy potential. The Philippine government already chose the right direction with the Renewable Energy Law. Instead of walking into the nuclear trap, our country should now show commitment as an innovator in the ASEAN region, and act as a pioneer and example to the world;

WHEREAS, renewable energy and energy efficiency have already proven themselves as credible and realistic. Every dollar spent on nuclear power will stand in the way of securing a safe future, thousands of green jobs and energy independence in the Philippines;

NOW, THEREFORE, on motion of Councilor John Carlos de los Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

Around 800 volunteers from Greenpeace and the Network Opposed to BNPP (Bataan Nuclear Power Plant) form a giant ‘human banner’ spelling “No to BNPP” in a campus in Quezon City, as a message of solidarity opposing a House bill to revive the mothballed nuclear plant. Greenpeace is calling on Congress representatives not to support the proposal and to withdraw their signatures from the bill which would effectively lock Filipinos into dependence on the world’s most unsafe and most expensive source of electricity.

A RESOLUTION OPPOSING THE APPLICATION OF VANGUARD RADIO NETWORK COMPANY, INC. FOR THE ISSUANCE OF A CERTIFICATE OF PUBLIC CONVENIENCE TO INSTALL, OPERATE AND MAINTAIN A 5 KW UHF TV STATION IN OLONGAPO CITY

WHEREAS, there are three (3) FM Radio Stations (DWOK, DWSL, DWSB) operating in Olongapo City and there are also three (3) registered AM Radio Stations (DWGO), DWHL, with DZOR-inactive) and one Cable TV Service Provider. Moreover, AM and FM signals from other parts of the country including those from TV Stations are spilling over to Olongapo City;

WHEREAS, with the application of Vanguard Radio Network Company to operate and maintain a 5 kw UHF TV station in the city, filed at the National Telecommunication Commission, another media station will compete with the existing media facilities servicing the city, that are now suffering from economic pinch due to global financial crisis, high cost of operation, maintenance and the meager advertising market to depend on;

WHEREAS, while the city appreciates the good intention of Vanguard Radio Network Company to set up a UHF TV station in the city, the City Government of Olongapo is constrained to oppose the application at this time due to its financial viability which would negatively affect even the existing radio stations. However, this does not prevent them from submitting another application in the future when the over-all state of businesses situation becomes conducive to accepting additional media stations in the city and all required documents are ready for presentations;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to oppose, as it hereby opposes the application of Vanguard Radio Network Company, Inc. for the issuance of a Certificate of Public Convenience to Install, Operate and Maintain a 5 kw UHF TV Station in Olongapo City.

RESOLUTION NO. 16

A RESOLUTION OPPOSING THE CREATION OF 16 NEW CITIES AS IT IS INIMICAL TO PUBLIC GOOD AND ULTIMATELY TO THE GENERAL WELFARE OF THE FILIPINO PEOPLE


WHEREAS, the League of Cities of the Philippines (LCP) staged its protest against the undue conversion of 16 municipalities into cities. According to the Local Government Code, amended by RA 9009, in order to be converted into a city, a municipality should have a minimum locally generated income of P100M and 150,000 population, and/or 100 sq. km. land area. Yet, these 16 municipalities were converted into cities in 2007 without meeting these requirements mandated by law which Congress itself enacted;

WHEREAS, the LCP is also in quandary of the integrity and principle behind the passage of Republic Act Nos. 9389,9390,9391,9392,9394 and 9398, otherwise known as the Cityhood bills which lapsed into law after the President failed to sign them 30 days after they were submitted to Malacañang. Despite failing to meet the requirements of Republic Act 9009, these were still passed by Congress;

WHEREAS, the League also expresses that the grant of unconscionable special treatment to the said municipalities violates the Constitution’s equal protection clause providing that all persons shall be treated equally in law;

WHEREAS, Olongapo City, as one with the LCP, agrees that the said move is not only UNCONSTITUTIONAL and inconsistent with the principles of Cityhood, it is also grossly UNFAIR to those municipalities who took pains to meet the criteria set by law;

WHEREAS, the City joins the LCP in its vehement opposition to the said unlawful conversion since existing cities, like Olongapo, had to suffer an alarming consequence. Instead of getting 14.3% additional Internal Revenue Allocation (IRA) for 2008, they will only get 4.7%. This substantial reduction of P4B means the delivery of basic services will be adversely affected;
WHEREAS, considering the high demand of services in cities, due to higher population growth as well as urban migration, cities also serve as regional and provincial centers of education, health, employment, commerce, transportation and recreation. They cater to a large transient population needing services. The enormous IRA reduction, the outright consequence of the said conversion, will ultimately have a negative impact on the provision and quality of services our people so deserve;

WHEREAS, Olongapo City believes that this kind of gross violation of the law itself as well as its teeming impartiality should be stopped. The City also urges our legislators to arrive at a more rationale basis for Cityhood so that our cities can truly serve as engines of growth of our country;
NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled, to oppose, as it hereby opposes, the creation of 16 new cities as it is inimical to public good and ultimately to the general welfare of the Filipino people.

RESOLVED FURTHER AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be furnished the Office of the President, the Senate of the Philippines, House of Representatives, League of Cities, Union of Local Authorities of the Philippines (ULAP), League of Governors, Vice-Mayors League of the Philippines and the Philippines Councilors League for their information and appropriate action.
