A RESOLUTION ENJOINING ALL TELECOM SERVICE PROVIDERS IN OLONGAPO CITY, SUBIC BAY FREEPORT AND ZAMBALES TO IMMEDIATELY IMPLEMENT THE NATIONAL TELECOMMUNICATIONS COMMISSION MEMORANDUM CIRCULAR NO. 09-07-2007 OTHERWISE KNOWN AS THE INTERCONNECTION OF LOCAL EXCHANGE CARRIERS

WHEREAS, the State recognizes the vital role of telecommunications in nation-building and economic development and in its desire to attain universal access, it shall promote the rapid expansion of telecommunications service in all areas of the Philippines in order to maximize the use of all available telecommunications facilities, and to ensure that every user of the public telecommunications shall have access to such facilities at mandated standards of service and at reasonable costs;

WHEREAS, Section 2 Article II of MC 14-7-2000 defines Local Calling (Service) Areas as “the province within which telecommunications services are furnished subscribers under specific scheduled rates and without toll charges. For purposes of these rules, the present areas forming part of the numbering plan area shall be considered a local calling (service) area of all PTEs presently authorized to provide telecommunications service in any portion of the said area”;

WHEREAS, the National Telecommunications Commission issued Memorandum Circular No. 09-07-2007 defining the rules on the interconnection of local exchange carriers in local calling areas which would result to a more efficient service and lesser cost for the consumers;

WHEREAS, with multiple telecom service providers in our area, the Sanggunian is vouching for the immediate implementation of NTC Memorandum Circular No. 09-07-2007;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to enjoin, as it hereby enjoins, all telecom service providers in Olongapo City, Subic Bay Freeport and Zambales to immediately implement the National Telecommunications Commission Memorandum Circular No. 09-07-2007 otherwise known as the Interconnection of Local Exchange Carriers.

RESOLVED FURTHER, AS IT HEREBY FURTHER RESOLVED, that copies of this resolution be furnished to the National Telecommunications Commission, Globe Innove, PLDT, Digitel, Smart, Subictel, Subic Bay Metropolitan Authority, Subic Bay Chamber of Commerce, Olongapo Business Club, Zambales Provincial Board and Municipalities of Zambales for their appropriate action.

RESOLUTION NO. 32

A RESOLUTION ENJOINING THE SBMA THROUGH THE FSC BOARD TO PRIORITIZE THE ORIGINAL VOLUNTEERS TO BE RETAINED UP TO THE LAST POSSIBLE MOMENT OF ITS EXISTENCE

WHEREAS, the SBMA volunteers breathed life into what was used to be the most strategic US Military Air and Navy Station in the Asian Region, that time left by the Americans due to the military base pull-out. Without the volunteers’ profound concern, skillful hands, resilience and commitment to the vision that Subic will rise again, the said military base may not have captivated its position today;

WHEREAS, the SBMA volunteers, composed of former base workers, balikatan ladies and professionals toiled long and hard for the establishment of the Subic Bay Freeport in Olongapo City. They made what is believed to be the “Subic Miracle”. The concerted efforts they poured and contributed in form part and parcel to what is heralded here and abroad as an outstanding model of military base conversion program replicated in Panama, Vietnam, Iran among others;

WHEREAS, for the sacrifices they had willingly offered, it is but proper that they reap the harvest of what they had sown, by tasting the firstfruits of the SBMA Miracle - the outflow of job opportunities for them, they indeed deserve;

WHEREAS, to date, 200 original volunteers are now fielded in various offices under the Freeport Services Corporation, a subsidiary of the Subic Bay Metropolitan Authority;

WHEREAS, however, the knock of retrenchment from the alleged declaration of bankruptcy by the Freeport Services Corporation caused the volunteers to suffer in fear and agony of being the first to be slashed from the FSC workforce, as announced recently;

WHEREAS, the City deems that such move is not just drastic, but heartless that the present FSC Administration had been reneged to consider upon;

WHEREAS, premises considered, the City Government of Olongapo hereby enjoins the SBMA through the FSC Board to look into the issues and the plight of the original volunteers, all in the spirit of solidarity and patronage;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano co-sponsored by Councilors Gina G. Perez, John Carlos G. delos Reyes, Rodel S. Cerezo, Angelito W. Baloy, Aquilino Y. Cortez, Jr. Anselmo A. Aquino, Elena C. Dabu and Cheene F. Hoya, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled to enjoin, as it hereby enjoins the SBMA through the FSC Board to prioritize the original volunteers to be retained up to the last possible moment of its existence.

Let copies of this Resolution be furnished the SBMA and FSC Boards for their information and appropriate action.

A RESOLUTION ENJOINING THE CITY PLANNING & DEVELOPMENT OFFICE (CPDO) AND THE OFFICE OF TRAFFIC MANAGEMENT & PUBLIC SAFETY (OTMPS) TO MAKE STUDIES AND PLANS TO ESTABLISH BICYCLE LANES IN THE MAJOR THOROUGHFARES OF THE CITY OF OLONGAPO


WHEREAS, the rise in economic activity and rejuvenation of the business climate in the City of Olongapo brought about by influx of local investments in both the city and in Subic Bay Freeport Zone, along with an expanding population, resulted to traffic congestion, as more private and public vehicles use the major thoroughfares as well as the parking areas;

WHEREAS, the rising cost of fuel and maintenance cost of vehicles are added financial burden to both private vehicle owners and operators of public utility vehicles;

WHEREAS, the poor maintenance of vehicles by the owners adds to environmental pollution by reducing the quality of air in the city which is detrimental to the health of the people;

WHEREAS, the use of bicycles shall be an alternative to lessen private vehicle usage which will eventually lead to reduction in vehicle emissions and promote good health;

WHEREAS, during the time of the Subic Naval Base as an American Military Installation, Filipino workers often go to and from work using bicycles;

WHEREAS, the streets and major thoroughfares of Olongapo City particularly the Rizal Avenue and RM Drive are congested due to the increasing number of parked private vehicles and other obstructions thereby compromising safety and increasing the risk to danger of pedestrians and bicycle riders;


NOW, THEREFORE, on motion of Councilor Aquilino Y. Cortez, Jr., with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enjoin, as it hereby enjoins the City Planning & Development Office and the Office of Traffic Management & Public Safety (OTMPS) to make studies and plans to establishment bicycle lanes in the major thoroughfares of the City of Olongapo.

RESOLUTION ENJOINING ALL BARANGAYS IN OLONGAPO CITY TO ALLOCATE FUNDS IN THEIR ANNUAL BUDGETS FOR REGISTRATION AND LICENSING OF PORTABLE, BASE AND MOBILE RADIO COMMUNICATION EQUIPMENT


WHEREAS, pursuant to Republic Act No 3846 as Amended and National Telecommunications Commission (NTC) Memorandum Circular No. 11-21-88, all Radio Communication Equipment and operators must secure permit from the NTC;

WHEREAS, violation of the above law and Circular is punishable by confiscation and forfeiture of the equipment and imposition of fines in addition to such other sanctions provided for by law;

WHEREAS, non-registration of Barangay radio communication equipment had been attributed to the absence of funds allocated for radio equipment registration in the barangay’s annual budget;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enjoin, as it hereby enjoins all Barangays in Olongapo City to allocate funds in their Annual Budgets for Registration and Licensing of Portable, Base and Mobile Radio Communication Equipment.

Let copies of this resolution be furnished to all Barangays in Olongapo City and the National Telecommunications Commission Region III
