RESOLUTION NO. 110

A RESOLUTION REITERATING OLONGAPO CITY’S OBJECTION TO COAL-FIRED POWER PLANTS AS AN ENERGY SOURCE AND URGING THE NATIONAL GOVERNMENT TO CONSIDER SAFER ALTERNATIVE SOURCES OF ENERGY

WHEREAS, Redondo Peninsula Energy Inc., a joint venture between Aboitiz Energy and a Taiwanese company is proposing to put up 2 X 150megawatt coal-fired power plant in Sitio Naglatore, Barangay Cawag, Subic, Zambales;

WHEREAS, the City of Olongapo passed numerous resolutions expressing opposition to the project posing environmental and health hazard and the negative effect to the tourism industry of the city;

WHEREAS, stakeholders opposing to the project filed a Writ of Kalikasan to the Supreme Court and has referred the case to the Court of Appeals;

WHEREAS, the Court of Appeals recognized the overwhelming opposition of the people of Olongapo,  Zambales, and declared  the Lease Development Agreement (LDA) and the Environmental Compliance Certificate (ECC) of the project as invalid;

WHEREAS, while the Court of Appeals  decision halted the project, the proponent was given another chance to re-start the process for them to comply with all the requirements of the law;

WHEREAS, the people of Olongapo fears that the project will push through with the Department of Energy endorsing the project owing  to the perceived power crisis in 2016;

WHEREAS, the people of Olongapo reiterates their opposition to the Coal Power Plant Project, believing that the President will heed to the outcry of the people whom he called his ”BOSS” and allay their fears and consider a more safer alternative sources of energy;

NOW, THEREFORE, on motion of  City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED AS IT HEREBY RESOLVED,  by the Sangguniang Panlungsod in a session assembled  to reiterate, as it hereby reiterates Olongapo City’s Objection to Coal-Fired Power Plant  as an energy source and urging the National Government to consider a Safer Alternative Sources of Energy.

A RESOLUTION REITERATING ALLOCATION OF PAYMENT FOR POWER SECTOR  ASSETS  AND  LIABILITIES  MANAGEMENT  CORPORATION
(PSALM)  AND FOR  THE  PUBLIC  UTILITIES  DEPARTMENT (PUD)
PERSONNEL FROM  THE ASSET PURCHASE AGREEMENT (APA) PROCEEDS

WHEREAS, APA was entered into by and between the City Government and CEPALCO by virtue of City Resolution No. 60, Series of 2010;

WHEREAS, APA and City Resolution No. 60,  Series of 2010 state that portion of the proceeds shall be for payment of National Power Corporation (NAPOCOR) /PSALM and for the compensation of PUD employees subject to official Civil Service Commission approved computation and compensation package;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reiterate, as it  hereby reiterates, allocation of payment for the National Power Corporation (NAPOCOR)/Power Sector Assets and Liabilities Management Corporation (PSALM) and for the Public Utilities Department (PUD) personnel from  the Asset Purchase Agreement (APA) proceeds, in all manners consistent with law.

A RESOLUTION REITERATING OLONGAPO CITY’S REQUEST TO THE SUBIC BAY METROPOLITAN AUTHORITY TO ASSIST BY THE WAY OF ALLOCATING FUNDS OR EQUIPMENT IN THE DREDGING OF CHANNELS AND RIVERS SHARED BY OLONGAPO CITY AND SUBIC BAY FREEPORT AS PER RESOLUTION NO. 47, SERIES OF 2010

WHEREAS, the City Government recognized the danger brought about by clogged and polluted waterways and there is, in fact, an urgent need to dredge and revive Olongapo waterways to prevent massive flooding, polluted beaches, and scarcity of clean water both in the city and Subic Bay Freeport;

WHEREAS, the industrialization and reclamation by the SBMA and its locators contributed in the clogging and pollution of the city’s rivers and bay;

WHEREAS, the city government in its vigorous campaign to protect and maintain its rivers and channels through continuous implementation of dredging operations, sees the need for SBMA, who shared rivers and channels with Olongapo, to assist by way of allocating more or less Thirty Million Pesos (PhP30M) or needed equipment for the immediate de-clogging of rivers and channels shared by Olongapo City and Subic Bay Freeport;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguininag Panlumgsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reiterate, as it is hereby reiterates its request to SBMA to Assist by way of Allocating Funds For equipment in the dredging of channels and rivers shared by Olongapo City and Subic Bay Freeport as per Resolution No. 47 Series of 2010.

Let copies of the Resolution be furnished to SBMA and DPWH for their information and record.
