In the interest of public service and on motion of City Councilor Gina Gulanes Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare, as it hereby declares the Annual Budget of Barangay Kalaklan  for the Fiscal Year 2013 in the amount of Six Million Nine Hundred Eighty One Thousand Seven Hundred Sixty One  Pesos and 16/100 (PhP6,981,761.16) operative in its entirety considering that the said budget as contained in Barangay Appropriation Ordinance No. 008, Series of 2012 of Barangay Kalaklan, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations.  PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in her letter dated April 26, 2013 are strictly complied with;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Barangay Appropriation Ordinance No. 008, Series of 2012 of  Barangay Kalaklan dated December 28, 2012 and the letter from Ms. Marey Beth D. Marzan, City Budget Officer dated April 26, 2013 be made as integral parts of this Resolution.

A RESOLUTION REITERATING OLONGAPO CITY’S REQUEST TO THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO CONSTRUCT A JETTY/BREAKWATER OR OTHER SIMILAR STRUCTURE TO PREVENT CLOGGING AT THE MOUTH OF KALAKLAN RIVER AS PER RESOLUTION NO. 44, SERIES OF 2010

WHEREAS, the Olongapo City Government acquired a dredging machine last year for the de-clogging of Olongapo City waterways and started to dredge the Kalaklan River;

WHEREAS, dredging, desilting, declogging operations have since been undertaken at various waterways of the city;

WHEREAS, the dredging of Kalaklan River is rendered futile because Subic Bay’s natural flow causes the sand to build up at the mouth of Kalaklan River which was aggravated by the reclamation project at Moonbay Marina.

WHEREAS, a study conducted by experts in flood control suggests that a jetty/breakwater or other similar structure must be constructed at both sides of Kalaklan River to prevent clogging at the mouth of Kalaklan River;

WHEREAS, the City Government of Olongapo thru the CDF of Senator Richard Gordon had completed the jetty construction at its side and requested SBMA to construct a similar structure on their side as part of their social responsibility.

WHEREAS, the recent flooding were unprecedented in the history of the city and flood experts conclude that the Moonbay Marina Project which Olongapo strongly opposed, contributed in such massive flooding. Furthermore, such project is devoid of Environmental Compliance Certificate (ECC) and Environmental Impact Statement and has not been approved by DENR, and therefore must implement required mitigating measures;

WHEREAS, the City Government thru the City Council deems it necessary to reiterate that SBMA construct a jetty/breakwater or other similar structure at their side at the mouth of Kalaklan river;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reiterate, as it hereby reiterates Olongapo City’s Request to the Subic Bay Metropolitan Authority (SBMA) to contruct a jetty/breakwater or other similar structure to prevent clogging at the mouth of Kalaklan River as per Resolution no. 44, Series of 2010.

A RESOLUTION DECLARING THE APPROPRIATION ORDINANCE NO. 4, SERIES OF 2009 OF THE BARANGAY KALAKLAN OPERATIVE IN ITS ENTIRETY SUBJECT TO SOME CONDITIONS

WHEREAS, Appropriation Ordinance No. 4, Series of 2009 of the Barangay Kalaklan authorizing its Annual Budget for Fiscal Year 2010, involving an appropriation of Five Million Four Hundred Sixty-three Thousand One Hundred Eighty & 71/100 Pesos (PhP5,463,180.71), was submitted to Sangguniang Panlungsod of Olongapo for review pursuant to the provisions of Republic Act No. 7160;

WHEREAS, subject Appropriation Ordinance reveals substantial compliances with the same law and its Implementing Rules and Regulations except the following:

1. That the excess in the appropriation for 5% Calamity Fund in the amount of Eleven Thousand Seven Hundred Fourteen & 40/100 Pesos (P11,714.40) shall be reverted to the Unappropriated Balance under the General fund of the barangay;

Computation:

2010 Estimated Regular Fund P 5,233,510.00

5% thereof 261,675.50

2. That the deficit in the appropriation for 2% Discretionary Fund in the amount of One Thousand Three Hundred Seventy-eight & 44/100 Pesos (PhP1,378.44) shall be taken from the Unappropriated Balance under General Fund of the baranagay.

NOW, THEREFORE, on motion of City Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare, as it hereby declares the Appropriation Bill No. 4, Series of 2009 of the Barangay Kalaklan operative in its entirety, effective upon approval subject to the posting requirements under Section 59 of R.A. No. 7160 and subject further to the following conditions:

1. That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation;

2. That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management (DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999;

3. That the appropriation for 5% Calamity Fund shall be utilized solely for relief, rehabilitation, reconstruction and other works or services in connection with calamities which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determined and declared by the Sangguniang Barangay concerned. Likewise, said appropriation may also be utilized for disaster preparedness and other pre-disaster activities as provided under Joint DBM and DILG Memorandum Circular No. 2003-01;

4. Pursuant to Local Budget Circular No. 63 of the Department of Budget & Management dated 22 October 1996, “barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitation on personal services, the honorarium rates of said barangay officials may be adjusted”: However, such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs.

SG – 14 for the punong barangay

SG – 10 for the Sangguniang barangay members,

barangay secretary and barangay treasurer.

5. Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed “pursuant to the LBC No. 63 of the DBM dated 22 October 1996”;

6. That the appropriation of compensation of barangay tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument provided the total amount shall not exceed the minimum salary rate for salary grade 1;

7. That the appropriation for monetization of leave credits shall be disbursed in accordance with Civil Service Commission and DBM Joint Circular No. 1-2004;

8. That the amount appropriated for Traveling Expenses and Training Expenses shall be disbursed in accordance with Executive Order 298 dated 23 March 2004 and National Budget Circular No. 486 dated 26 March 2003;

9. That the purchase of motor vehicles, if any, shall be subject to the provisions of Administrative Order No. 233 dated 01 August 2008;

10. That the amount of “POWER BILLS” appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sangguniang Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability may be properly liquidated/settled.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, to require the Barangay Kalaklan to comply with the herein conditions and notify this body of actions take thereon;

RESOLVED FINALLY, AS IT IS HEREBY FINALLY RESOLVED, that this review action does not authorize any item of appropriation that is specifically prohibited by or inconsistent with the provisions of law and that compliance with all existing laws, rules and regulations shall be the responsibility of Barangay Kalaklan.

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Kalaklan, City of Olongapo for the Calendar Year 2009 considering that the budget as contained in Barangay Ordinance No. 3, Series of 2008 of Barangay Kalaklan dated 10 December 2008 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation.

That the amount appropriated for Traveling Expenses and Training & Seminar Expenses shall be disbursed in accordance with Executive Order No. 248 dated 29 May 1995 as amended by Executive Order Nos. 248-A and 298 dated 14 August 1995 and 23 March 2004, respectively.

That the amount of "POWER BILLS" appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sangguniang Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability, may be properly liquidated/settled.

That item number 2 under Policy Thrusts to support income and revenue shall be subject to City approval and national laws.

That appropriations, in the amount of Four Million Six Hundred Eighty Three Thousand One Hundred Seventy Three Pesos and 07/100 (PhP4,683,173.07) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

Let Barangay Kalaklan Ordinance No. 3, Series of 2008 and endorsement from City Budget Office and other pertinent documents related hereto form part of this resolution.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY KALAKLAN, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2008

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Kalaklan, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolution No. 03, Series of 2007 and Barangay Ordinance No. 01, Series of 2007 of Barangay Kalaklan dated December 28, 2007 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation.

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management

(DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999.That the 5% Calamity Fund shall be utilized solely for relief, rehabilitation, reconstruction, contingencies and other works or services in connection with calamities and which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determined and declared by the Sangguniang Barangay concerned.

Pursuant to Local Budget Circular No. 63 of the Department of Budget and Management (DBM) dated 22 October 1996, barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; The honorarium rates of said barangay officials may be adjusted in accordance with Local Budget Circular No. 86 of the Department of Budget & Management dated 18 July 2007; However such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:

SG-14 For Punong Barangay
SG-10 For the Sanggunianng Barangay Members,
Barangay Secretary and Barangay Treasurer.

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed pursuant to the Local Budget Circular No. 63 of the Department of Budget Management dated 22 October 1999”.

Barangay Tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument provided the total amount shall not exceed the minimum salary rate for salary grade 1.

That the amount appropriated for Training & Seminar Expenses shall be disbursed in accordance with National Budget Circular No. 486 dated 26 March 2003.

That the excess in the appropriation for discretionary fund in the amount of Three Thousand Five Hundred Eighty Six Pesos and Sixty-two centavos (P3,586.62) as required under section 324 (d) of Local Government Code of 1991 shall be reverted to the unappropriated Balance under the General fund of the Barangay.

A RESOLUTION EXPRESSING DEEPEST CONDOLENCES TO THE BEREAVED FAMILY OF COUNCILMAN FEDERICO G. VILLEGAS, JR.OF BARANGAY KALAKLAN

WHEREAS, Hon. Federico G. Villegas, Jr., the number one Kagawad of Barangay Kalaklan for almost nine (9) years, peacefully joined his Creator on April 19, 2007;

WHEREAS, one of the most loved and respected Councilman in the community, Kagawad Villegas served as Barangay Secretary before winning the electoral battle and was known to be the right hand of the Chairman in the performance of his functions and projects;

WHEREAS, Barangay Kalaklan will never forget his keen sense of understanding on significant matters and handling of complaints as well as his wise counsel and concern to his constituents;

WHEREAS, Olongapo acknowledges Kagawad Villegas’ leadership, dedication and devotion to public service and joins his family in the loss of their beacon and a doting Tatay to his grandchildren;

NOW, THEREFORE, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby expresses sorrow over the passing away of Hon. Federico G. Villegas, Jr. and condoles with his bereaved family.
