A RESOLUTION ADOPTING THE GORDON COLLEGE BOARD OF TRUSTEES RESOLUTION NO. 9, SERIES OF 2015 ENTITLED: “A RESOLUTION APPROVING THE PROPOSED MEMORANDUM OF AGREEMENT BETWEEN GORDON COLLEGE AND THE DEPARTMENT OF EDUCATION, DIVISION OF CITY SCHOOLS, OLONGAPO CITY FOR USE OF FACILITIES IN THE OLONGAPO CITY NATIONAL HIGH SCHOOL (OCNHS)”

WHEREAS, the Gordon College is lack of classrooms to be used by the students for the Academic Year 2015-2016;

WHEREAS, Gordon College will enter into a Memorandum of Agreement (MOA) with the Department of Education, Division of City Schools, Olongapo City to allow them to use twenty four (24) classrooms at the Olongapo City National High School with conditions stated in the MOA;

WHEREAS, the Sangguniang Panlungsod deems it proper that Resolution No. 9, Series of 2015 endorsed by Gordon College Board of Trustees approved on January 13, 2015 pursuant to City Resolution No. 70, Series of 2012 is necessary for adoption;

NOW, THEREFORE, on motion of City Councilor Benjamin G. Cajudo II co-sponsored by City Councilor Edna A. Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to adopt, as it hereby adopts the Gordon College Board of Trustees Resolution No. 9, Series Of 2015 entitled: “A Resolution Approving The Proposed Memorandum Of Agreement Between Gordon College And The Department Of Education, Division Of City Schools, Olongapo City For Use Of Facilities In The Olongapo City National High School (OCNHS)”.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copy of the Gordon College Board of Trustees Resolution No. 9, Series of 2015 be made as integral parts of this Resolution.

 WHEREAS, the City Government Of Olongapo, with its principal address at the City Hall Complex, Rizal Avenue, West Bajac-Bajac, Olongapo City, is represented herein by its City Mayor Rolen C. Paulino hereinafter  referred to as CGO;

              WHEREAS, the Department Of Education, with its principal address at the City School Division Office, Olongapo City Elementary School, Rizal Avenue, West Bajac-Bajac, Olongapo City, is represented by the City School Superintendent Jessie Ferrer, hereinafter referred  to as DepEd;

              WHEREAS, the SM PRIME HOLDINGS, INC., with its principal address at the Mall of Asia Arena, Annex Building Coral Way Corner J.W. Diokno Boulevard, Mall of Asia Complex, Barangay 76 Zone 10 CBP 1-A, Pasay City, is represented by its President, Hans Sy, hereinafter referred to as SM;

            WHEREAS,  the CGO is the owner of a property located in Barangay East Tapinac, Olongapo City, known as Lot No. 12, TS-308, with an area of  30,397 square meters by virtue of Presidential Proclamation No. 936;

            WHEREAS, the DepEd is the occupant of the portion of the lot known as Lot No. 12, TS-308, which is currently being used as site of the East Tapinac Elementary School;

            WHEREAS, the existing site of the city-owned and city-run Gordon College is covered by the lease agreement between the CGO and SM as such, Gordon College will be relocated on a portion of Lot No. 12, TS-308;

             WHEREAS, in the proposed relocation site of Gordon College, there are existing improvements, particularly the Grandstand and DepEd Buildings A and B;

            WHEREAS, since the proposed relocation site of Gordon College will affect DepEd Buildings A and B, with a total of 12 classrooms, the CGO proposes to build a new, three(3) storey building in lieu of the school buildings that will be affected;

            WHEREAS, as part of the additional condition/commitment of SM to the CGO, SM will fund and build a three-storey, 18-classroom school building in exchange for the DepEd Buildings A and B which will be affected by the construction of the new Gordon College Building;

            WHEREAS, the DepEd and the CGO will not shoulder any cost for the construction of the three-storey, 18-classroom school building, and that the said construction shall comply  with the standard design and requirements as mandated by the DPWH for the construction of schools;

            WHEREAS, upon completion of the construction of the three-storey, 18-classroom school building, there should be an acceptance on the part of DepEd and warranties in case the building will be damaged within a specified period as mandated by the law;

            WHEREAS, to carry out such undertaking, a Memorandum of Agreement (MOA) signed by the parties is deemed necessary;

            NOW, THEREFORE, on motion of City Councilors Noel Y. Atienza and Benjamin G. Cajudo II,  with the majority decision of the Members of the Sangguniang Panlungsod present,

            RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes Honorable City Mayor Rolen C. Paulino to enter into and sign theMemorandum of  Agreement (MOA) between the City Government of Olongapo, the Department of Education, and the SM Prime Holdings, Inc., with their respective representatives, Olongapo City Mayor Rolen C. Paulino, DepEd City Schools Superintendent Jessie Ferrer, and SM President Hans Sy, on the relocation of Gordon College and construction of a three-storey 18-classroom school building in lieu of DepEd Buildings A and B, and accepts the same, subject to applicable laws, rules and regulations.

PAULINO TO ENTER INTO AND SIGN THE ADDENDUM TO THE MEMORANDUM OF AGREEMENT, FOR AND ON BEHALF OF THE CITY GOVERNMENT OF OLONGAPO WITH THE DEPARTMENT OF EDUCATION –SCHOOLS DIVISION OF OLONGAPO CITY, REPRESENTED BY ITS SCHOOLS DIVISION SUPERINTENDENT, MR. JESSIE D. FERRER AND THE AYALA FOUNDATION INC., REPRESENTED BY ITS PRESIDENT, MARIA LOURDES HERAS- DE LEON RELATIVE TO THE TEXT2TEACH PROGRAM

WHEREAS, the Sangguniang Panlungsod of Olongapo passed Resolution No. 120, Series of 2014 which authorized the City Mayor, Hon. Rolen C. Paulino to enter into and execute a Memorandum of Agreement (MOA) with the Department of Education- Schools Division of Olongapo City and the Ayala Foundation (AFI) in the implementation of the Text2teach Program in the City;

WHEREAS, in the said signed MOA, the program was implemented in ten (10) recipient public schools identified based on the validation by the Text2Teach alliance, in accordance with project’s selection criteria;

WHEREAS, the addendum to the original terms and conditions of Text2Teach Memorandum of Agreement shall include: a.) There shall be twelve (12) recipient public schools in the City of Olongapo and b.) the counterpart-funding requirement for LGU-Olongapo City equivalent to Five Hundred Sixty Six Thousand (566,000.00) from the total fund in the original MOA shall cover the twelve (12) new Text2Teach recipient schools;

                                                

NOW, THEREFORE, on motion of City Councilor Benjamin G. Cajudo II, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor Hon. Rolen C. Paulino to enter into and sign the Addendum to the Memorandum Of Agreement, for and on behalf of the city government of Olongapo with the Department of Education –Schools Division Of Olongapo City, represented by its Schools Division Superintendent, Mr. Jessie D. Ferrer and the Ayala Foundation Inc., represented by its President, Maria Lourdes Heras- De Leon relative to the Text2teach Program.

A RESOLUTION AUTHORIZING THE HON. CITY MAYOR JAMES GORDON, JR. TO ENTER, EXECUTE AND SIGN THE MEMORANDUM OF AGREEMENT WITH THE DEPARTMENT OF EDUCATION AND JOLLIBEE FOUNDATION FOR THE BUSOG LUSOG TALINO (BLT) SCHOOL FEEDING PROGRAM AND THE CORRESPONDING APPLICATION LETTER, IN A MANNER CONSISTENT WITH LAW

WHEREAS, the Department of Education and the City of Olongapo have endeavored to engage in initiatives which promote the well-being, health and nutrition of the youth;

WHEREAS, the Department of Education and the Jollibee Foundation have engaged in a school feeding program, known as the “Busog Lusog Talino (BLT) School Feeding Program” where the City’s participation and contribution is indispensable;

WHEREAS, there is in need to enter into a Memorandum of Agreement to ensure that the project would be complaint with pertinent laws, rules and regulations on nutrition and he guidelines of the Department of Health on feeding programs;

NOW, THEREFORE, on joint motion of City Councilors Eyrma Yvette Marzan-Estrella and                 Edna A. Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungosd in session assembled, to authorize, as it hereby authorizes the Hon. City Mayor James Gordon, Jr. to enter, execute and sign the Memorandum of Agreement with the Department of Education and Jollibee Foundation for the Busog Lusog Talino (BLT) School Feeding Program, and the corresponding application letter, in a manner consistent with law.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, to submit the required BLT site feeding program to Jollibee Foundation and Division of City Schools, Olongapo city.
