A RESOLUTION ENJOINING LOCAL GOVERNMENT UNITS (LGUs), SUBIC BAY METROPOLITAN AUTHORITY (SBMA) AND NONGOVERNMENTAL ORGANIZATIONS (NGOs) AROUND SUBIC BAY TO PARTICIPATE IN THE CREATION OF SUBIC BAY WATERWAYS COUNCIL AND SUPPORT THE PROJECTS THERETO.

WHEREAS, Asian Development Bank Research and Water Regulatory Board study showed that generally the country’s water resources and the local bays and waterways are fast deteriorating. In its rate of pollution and deterioration, severe floodings and profound scarcity of clean water will be a serious problem in the near future;

WHEREAS, the devastating effect of massive floodings and other natural calamities that we recently experienced, may again occur, with the possibility of more catastrophic effect;

WHEREAS, with climate change in our midst, the city government sees the need to put our acts together now for the protection, preservation and revival of waterways;

WHEREAS, the daunting task of saving our environment should be everybody’s concern and necessitates a Council to take the lead for a unified action of all the stakeholders;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enjoin, as it hereby enjoins, Local Government Units (LGUs), Subic Bay Metropolitan Authority (SBMA) and NonGovernmental Organizations (NGOs) Around Subic Bay To Participate In The Creation Of Subic Bay Waterways Council And Support The Projects Thereto.

Let copies of this Resolution be furnished the Local Governments of Subic and Morong, the Subic Bay Metropolitan Authority (SBMA) and accredited nongovernmental organizations, for their information and participation.

A RESOLUTION APPROVING AND RATIFYING THE LOAN AGREEMENT, THE CONTINUING DEED OF ASSIGNMENT WITH HOLD-OUT, CHATTEL MORTGAGE (IF APPLICABLE) AND OTHER DOCUMENTS RELATED THERETO SIGNED AND EXECUTED BETWEEN THE CITY OF OLONGAPO (LGU), AND THE DEVELOPMENT BANK OF THE PHILIPPINES (DBP) WITH ALL THE
TERMS AND CONDITIONS THEREOF.

WHEREAS, as duly authorized by the City Council of Olongapo, Hon. James J. Gordon Jr., City Mayor of Olongapo and Marcelino D. Andawi, City Treasurer have entered into a Loan Agreement with the Development Bank Of The Philippines (DBP) in the principal amount of Eighty One Million Pesos (PhP81,000.000.0), hereinafter referred to as the “DBP Loan” to finance acquisition of the dredging system composed of a one (1) unit Versi dredge starwheel drive and a one (1) unit sewer drainage vacuum cleaner and declogging machine for used of the LGU and executed as security therefore, the Loan Agreement dated September 28, 2009, the Continuing Deeds on the applicable portion of the LGU’s Internal Revenue Allotment (IRA)with hold-out provision equivalent to one (1) quarterly amortization under the Loan agreement and other related documents, local taxes and other revenues of the City duly allocated for debt servicing;

WHEREAS, the aforesaid Loan Agreement, Continuing Deeds of Assignment, Chattel Mortgage ( If applicable) are now before the Sanggunian for its perusal, study, ratification and approval;

WHEREAS, the terms and conditions contained in the above loan documents are fair, just, legal and in order.

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod, in the session duly assembled, to ratify, confirm, approve and render effective and of full force and effect the loan under the terms and conditions of the Loan Agreement and the covering collateral and other document/s executed in relation thereto.

For this purpose, the City is hereby authorized as it hereby authorizes the following:

1. The City to maintain with DBP its existing Debt Servicing Account (DSA) and the applicable portion of the LGU’s IRA shall be deposited subject to continuing of assignment with hold-out provision equivalent to one (1) quarterly amortization under the loan agreement and other related documents, in favour of DBP and for the City Mayor to execute the covering Continuing Deed of Assignment with Hold-out.

2. To maintain its 20% allowed Debt Service Ceiling under Section 324 (b) of the Local Government Code of the Philippines.

RESOLVED FURTHER, AS IT HEREBY FURTHER RESOLVED, that the Sanggunian undertakes, as it herby undertakes to appropriate in the LGU’s annual budget for the years 2009 to 2017 an amount sufficient to pay its loan from DBP including interest thereon and other charges.

RESOLVED FINALLY, AS IT HEREBY FINALLY RESOLVED, that this resolution shall remain valid and effective until the Loan with DBP has been fully settled and paid.

Let copies of this Resolution be furnished the Office of the City Mayor, the City Treasurer’s Office, the Auditor’s Office and the concerned Development Council and DBP.

House think-tank pushes stronger taxing powers fro local governments

Local governments must be given stronger taxing powers or at least commensurate to the expenditure functions assigned to them, the Congressional Planning and Budget Department (CPBD), the think-tank of the House Representatives, said in a paper.

In its report entitled “Public Sector Government and Decentralization in the Philippines “authored by executive director Romulo Miral Jr., CPBD said that while major expenditure functions have been devolved to local governments, the National Government continues to have exclusive authority over productive and broad based taxes.

The think-tank noted that local governments have inadequate tax powers, resulting in ineffective decentralization.

“Government resources continue to be centralized; resulting in common pool problems and local governments remain very dependent on National Government transfers and the direct provision of devolved services. This undermines local autonomy and government accountability,” CPBD said.

Seventeen years after the passage of the Local Government Code of 1991 – the landmark law that decentralized the government, CPBD said government revenues, however remain centralized.

The think-tank attributes this to the exclusive authority of the National Government over major taxes.

These include taxes on income of individuals and corporations, excise taxes, value added tax (VAT), travel tax, motor vehicle tax and international trade taxes.

“The only major taxes assigned to local governments are real property and business license taxes, with allowable rates and exemptions prescribed by the National Internal Revenue Code,” CPBD said.

It also pointed out that local taxes are administered independently by each local government unit and do not coordinate with national tax authorities in practice.

Republic Act 7160 or the Local Government Code of 1991 devolved the responsibilities and powers over certain basic services and regulatory functions to local governments from national authorities.

The law increased the local tax rates and local governments’ share in the internal tax revenues to 40 percent from 11 percent.

To achieve a more effective government decentralization, the CPBD said the national local governments can do joint taxation of major taxes such as individual and corporate income tax.

“To accommodate the additional taxes to be imposed by local governments without increasing the overall burden on taxpayers, National Government tax rates could be commensurately reduced,” it said.

The CPBD also believes that with increased tax powers, local governments will subsequently be made responsible for the provision of local services largely from their own revenues.

A RESOLUTION APPROVING AND RATIFYING THE LOAN AGREEMENT, THE CONTINUING DEEDS OF ASSIGNMENT WITH HOLD-OUT AND OTHER DOCUMENTS RELATED THERETO SIGNED AND EXECUTED BETWEEN THE CITY OF OLONGAPO (LGU), AND THE DEVELOPMENT BANK OF THE PHILIPPINES (DBP) WITH ALL THE TERMS AND CONDITIONS THEREOF.

WHEREAS, as duly authorized by the City Council of Olongapo (the “Sanggunian”), Hon. James J. Gordon, Jr. City Mayor of Olongapo and Marcelino D. Andawi, City Treasurer have entered into a Loan Agreement with the DEVELOPMENT BANK OF THE PHILIPPINES (DBP) in the principal amount of TWENTY FOUR MILLION NINE HUNDRED SIXTY NINE THOUSAND ONE HUNDRED FORTY PESOS (PhP24,969,140.00), hereinafter referred to as the “DBP Loan”, to finance General Funding requirements of the LGU and executed as security therefore, the Loan Agreement dated October 21, 2008, the Continuing Deed of Assignment on the applicable portion of the LGU’s Internal Revenue Allotment (IRA) with hold-out provision equivalent to three (3) monthly regular interest under the Loan Agreement and other related documents; and the Continuing Deed of Assignment with Hold-out of the LGU’s Unreleased Share of IRA differential for CY 2001 and 2004, based on the Notice of Payment Schedule (NPS) duly issued by the Department of Budget and Management (DBM), local taxes and other revenues of the City duly allocated for debt servicing.

WHEREAS, the aforesaid Loan Agreement, Continuing Deeds of Assignment with Hold-out and other related documents are now before the Sanggunian for its perusal, study, ratification and approval;

WHEREAS, the terms and conditions contained in the above loan document are fair, just, legal and in order.

RESOLUTION NO. 31

A RESOLUTION URGING LOCAL GOVERNMENT UNITS (LGUs) TO CALL FOR ADVOCACY TO UPLIFT WOMEN’S RIGHTS AND DIGNITY AND PASS THE ANTI-PROSTITUTION ORDINANCE

WHEREAS, prostitution is generally defined as performing, offering, or agreeing to perform a sexual act for any money, property, token, object, article, or anything of value;
WHEREAS, the City Government of Olongapo is deeply concerned about the fact that prostitution and trafficking are flourishing in all societies worldwide and that increasing numbers of women and children are being made into sexual instruments for men's pleasure;
WHEREAS, it is stated in the Republic Act 9208, to institute policies to eliminate trafficking in persons especially women and children, establishing the necessary institutional mechanisms for the protection and support of trafficked persons, providing penalties for its violations, and for other purposes;

WHEREAS, the City Government of Olongapo is urging its neighboring Local Government Units to join in the advocacy to uplift women’s rights and dignity by passing the Anti-Prostitution Ordinance;

WHEREAS, it is a known fact that the economic state of some cities is strikingly commendable due to prostitution, but what is disconcerting to know is that the economic state is doing well for the wrong cause;

WHEREAS, Prostitution targets the tourism image, disposition of the constituents and primarily the health and well-being of the oppressed;

WHEREAS, the City is COMMITTED to eliminate this disconcerting issue and promote clean tourism to all;

WHEREAS, it is a fact that prostitution is a worldwide economic crisis and is not easy to eliminate, that is why the City of Olongapo is appealing to its contiguous and other LGUs to unite and help eliminate this so-called crisis;

WHEREAS, the City Government calls upon Local Government Units to combat prostitution and trafficking by formulating measures which penalize not only the traffickers and pimps but also the men who buy women performing sexual acts;

WHEREAS, it is advised that this resolution needs instantaneous response and action for all;
NOW, THEREFORE, on motion of Councilor Gina G. Perez co-sponsored by Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges all Local Government Units (LGUs) to call for advocacy to uplift women’s rights and dignity and pass the Anti-Prostitution Ordinance.
