RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare, as it hereby declares the Annual Budget of Barangay Barretto  for the Fiscal Year 2013 in the amount of  Twelve Million Eighty Thousand Two Hundred Twenty Seven Pesos and 01/100 (PhP12,080,227.01) operative in its entirety considering that the said budget as contained in Barangay Appropriation Ordinance No. 01, Series of 2012 of Barangay Barretto, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations.  PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in her letter dated May 17, 2013 are strictly complied with;

A RESOLUTION APPROVING THE APPLICATION OF DIGITEL TELECOMMUNICATIONS, INC. (SUN CELLULAR) FOR THE INSTALLATION AND OPERATION OF CELLSITE/GSM ANTENNA AT BARANGAY BARETTO, OLONGAPO CITY

WHEREAS, Digitel Mobile Philippines, Inc. (DIGITEL) a corporation duly organized and existing under Philippine Laws, with principal office located at 6th Floor Cyber Gate Tower 2, EDSA corner Pioneer St. Mandaluyong City thru their official Site Acquisition Contractor Ericson/Telequip applied for a permit to allow the construction, installation and operation of a BI-POD Digitel Cellular Antenna located at Santol St. Purok 3, New Cabalan, Olongapo City;

WHEREAS, with Digitel’s well-known capability of providing world-class telecommunication system that produces seamless cellular coverage and accessibility, residents and subscribers of Digitel Telecom/Sun Cellular in the city and adjoining areas will be assured of uninterrupted link to personal and business communications;

WHEREAS, Ericson/Telequip had initially presented necessary documents for them to proceed with their application and have been accomplishing other pertinent requirements for the approval of the same as defined under Sangguniang Panlungsod Resolution No. 13, Series of 2005;

WHEREAS, Barangay Baretto, after public consultation and submission of signed neighbors’ consent, passed Resolution 8, Series of 2010, giving clearance to the said project and placed on record that no objection had been noted for the said construction;

WHEREAS, DIGITEL acknowledges its obligation to settle real property taxes of its existing assets in Olongapo City and assured that its contractor have local Mayor's Permit prior to the start of construction;

WHEREAS, additional implements being installed into the tower, such as but not limited to antenna, satellite or parabolic disc or any device used to transmit or receive for purpose of voice or data especially those that are from other service provider and thus, will be doing so for a fee is not covered by this resolution and therefore, must have prior permission from the city;

NOW, THEREFORE, on motion of City Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod

in session assembled, to approve as it hereby approves the application of Digitel Telecommunications, Inc. (Sun Cellular) for the installation and operation of Cellsite/GSM antenna at Barangay Baretto, Olongapo City;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Barangay Baretto Resolution No. 8, Series of 2010 and a copy of the signed neighbors’ consent as well as other pertinent documents such as declaration of Real Properties shall be made as integral parts of this Resolution.

Let copies of this Resolution be furnished to Ericson/Telequip, Digitel Telecommunications, Inc. (DIGITEL), Barangay Baretto and the National Telecommunications Commission for their information and record.

WHEREAS, HHIC-Phil. is a corporation duly organized and existing under the Philippine Laws, is the owner of a shipyard located at Greenbeach I, Redondo Peninsula, Cawag, Subic, Zambales with more than twenty thousand work force;

WHEREAS, HHIC-Phil. in its desire to uphold the welfare of its workers who are not living in Redondo Peninsula area, sees the need for a reasonable and convenient transportation facilities to and from their work place;

WHEREAS, Subic Bay Metropolitan Authority (SBMA) board passed Resolution No. 09-08-3244 approving the draft tripartite MOA for the construction of a passenger terminal facility;

WHEREAS, the Olongapo City Government believing that the project will be beneficial to its people, concur with the proposed jetty facility project which will be constructed in Barangay Baretto as proposed in the draft Memorandum of Agreement;

WHEREAS, this resolution is adopted without prejudice to any cases pending in courts;

NOW, THEREFORE, on motion of City Councilor Edwin J. Piano, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes Honorable City Mayor James Gordon, Jr. to enter into a Tripartite Agreement with Subic Bay Metropolitan Authority (SBMA) and Hanjin Heavy Industries and Construction – Phil. A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY BARRETTO, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2009

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Barretto, City of Olongapo for the Calendar Year 2009 considering that the budget as contained in Barangay Ordinance No. 1, Series of 2008 of Barangay Barretto dated October 21, 2008 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation.

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management (DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999.

Pursuant to Local Budget Circular No. 63 of the Department of Budget & Management dated 22 October 1996, "barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitation on personal services, the honorarium rates of the said barangay officials may be adjusted”: However, such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangays belong.

SG - 14 for the punong barangay
SG - 10 for the Sangguniang barangay members,
barangay secretary and barangay treasurer.

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed "pursuant to the LBC No. 63 of the DBM dated 22 October 1996".

Barangay Tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument provided the total amount shall not exceed the minimum salary rate for salary grade 1.

That the appropriation for compensation of Lupon Tagapamayapa Chairman, in the person of the Barangay Captain, under "General Services" cannot be acted upon pending circular, memorandum, guidelines from the Department of Budget and Management.

That the amount appropriated for Traveling Expenses and Training & Seminar Expenses shall be disbursed in accordance with Executive Order No. 248 dated 29 May 1995 as amended by Executive order Nos. 248-A and 298 dated 14 August 1995 and 23 March 2004, respectively.

That the amount of "POWER BILLS" appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sangguniang Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability, may be properly liquidated/settled.

That item number 2 under Policy Thrusts to support income and revenue shall be subject to City approval and national laws.

That appropriations, in the amount of Ten Million Four Hundred Eighty Thousand Two Hundred Sixty Seven Pesos and 95/100 (PhP10,480,267.95) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

Let Barangay Barretto Ordinance No. 1, Series of 2008 and endorsement from City Budget Office and other pertinent documents related hereto form part of this resolution.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON JR. TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) FOR AND IN BEHALF OF THE CITY GOVERNMENT OF OLONGAPO WITH THE PHILIPPINE NATIONAL POLICE, OLONGAPO CITY POLICE OFFICE REPRESENTED BY ITS CITY DIRECTOR, ABELARDO P. VILLACORTA REGARDING THE UTILIZATION OF TOURIST INFORMATION CENTER IN BARRETTO AS TOURIST POLICE CENTRAL COMMAND POST

WHEREAS, City Government of Olongapo’s primary industry is tourism thus it aims to ensure the safety of foreign and local tourists who wish to explore the beauty of Olongapo;

WHEREAS, the Philippine National Police, Olongapo City Police Office and the City Government have joined forces to organize a group of Tourist Police who shall be identified as protectors of foreign and local tourists in all means;

WHEREAS, Tourism Industry recently launched the newly organized group of Tourist Police to undertake the official function as stated;

WHEREAS, utilization of Tourist Information Center in Barretto as a Tourist Police Central Command Post is ideal due to its strategic location;

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo, co-sponsored by John Carlos G. delos Reyes, Rodel S. Cerezo, Edwin J. Piano, Angelito W. Baloy, Aquilino Y. Cortez, Jr., Anselmo A. Aquino, Elena C. Dabu, Carlito A. Baloy and Cheenee F. Hoya, with the accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to sign and enter into a Memorandum of Agreement (MOA) for and in behalf of the City Government of Olongapo with the Philippine National Police, Olongapo City Police Office represented by its City Director, Abelardo P. A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A LETTER OF UNDERSTANDING BETWEEN THE OLONGAPO CITY GOVERNMENT AND BARANGAY BARRETTO REPRESENTED BY ITS PUNONG BARANGAY HONORABLE CARLITO A. BALOY FOR THE ESTABLISHMENT OF A HEALTH FACILITY PROVIDING BASIC EMERGENCY MATERNAL OBSTETRIC CARE (BEMOC) IN BARANGAY BARRETTO

WHEREAS, Republic Act 7160 otherwise known as the Local Government Code of 1991 enables the Sangguniang Barangay to provide for the construction and maintenance of barangay facilities and other public works chargeable to the general fund of the barangay or such other fund actually available for the purpose;

WHEREAS, the Barangay Council of Barretto passed a Resolution authorizing Honorable Carlito A. Baloy, as Punong Barangay, to enter into a Letter of Understanding with Honorable City Mayor James Gordon, Jr. which shall serve as a record of agreement between Barangay Barretto and the City of Olongapo as to the obligations of both parties concerning the establishment of a health facility providing Basic Emergency Maternal Obstetric Care (BEMOC);

WHEREAS, the establishment of such facility as an additional health-related service shall not only benefit nearby residents but shall also aid significantly in the decongestion of the James L. Gordon Memorial Hospital;

WHEREAS, the City Council duly recognizes the extensive merits of the health facility and the need for an agreement;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano on behalf of Councilor Angelito W. Baloy, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon., Jr. to enter into a Letter of Understanding between the Olongapo City Government and Barangay Barretto represented by its Punong Barangay Honorable Carlito A. Baloy for the establishment of a Health Facility providing Basic Emergency Maternal Obstetric Care (BEMOC) in Barangay Barretto.

A RESOLUTION APPROVING THE REQUEST OF BARANGAY BARRETTO TO OPERATE A MINI FAIR WITHIN THEIR JURISDICTION SUBJECT TO THE PRESCRIBED GUIDELINES OF THE SANGGUNIANG PANLUNGSOD


WHEREAS, carnivals and mini fairs established in conjunction with fiestas are good income generating means to fund projects for good causes;

WHEREAS, through Barangay Resolution No. 07, Series of 2007, Barangay Barretto asked permission to operate a mini fair in the said barangay in relation to its merry-making activities and as a means to raise funds for their upcoming barangay fiesta;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Barretto with the condition that the preparation and operation of a mini fair shall be in accordance with the provisions of Ordinance No. 49, Series of 2005 and upon compliance with the recommendations set by the same;

NOW , THEREFORE, on motion of Councilor Angelito W. Baloy with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the request of Barangay Barretto to operate a Mini Fair within their jurisdiction subject to the prescribed guidelines of the Sangguniang Panlungsod.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the Sangguniang Panlungsod recommendations regarding the request and that item nos.1 to 4 shall form part of this Resolution.

RESOLVED FINALLY, AS IT IS HEREBY FINALLY RESOLVED, that a financial statement be submitted to the Sangguniang Panlungsod after the event.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY BARRETTO, CITY OF OLONGAPO FOR THE CALENDAR YEAR 2007

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Barretto, City of Olongapo for the Calendar Year 2007 considering that the budget as contained in Barangay Ordinance No. 1, Series of 2007 of Barangay Barretto, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets following conditions:

The disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Development Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Section 287 of Local Government Code of 1991.

Pursuant to Local Budget Circular No. 63 of the Department of Budget & Management dated 22 October 1996, “Barangay Officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitations on personal services; the honorarium rates of said Barangay Officials may be adjusted”. However, such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangay belongs:

SG-14 For the Punong Barangay
SG-10 For the Sangguniang Barangay Members, Barangay Secretary and Barangay Treasurer.

That the amount of POWER BILLS appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sangguniang Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability, may be properly liquidated/settled:

That appropriations herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

And finally, the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied. PROVIDED, that the City Accountant is enjoined to observe the above conditions.

A RESOLUTION EXPRESSING SYMPATHY TO THE BEREAVED FAMILY OF COUNCILMAN CESAR LORENZANA OF BARANGAY BARRETTO,THIS CITY

WHEREAS, Barangay Councilman Cesar Lorenzana of Barretto, Olongapo City passed away to be with his Creator on January 25, 2007;

WHEREAS, aware of his leadership capabilities as a former Purok Leader and Lupon Tagapamayapa Member, Kagawad Lorenzana was eyed to take the seat as Barangay Councilman, a position he held from June 2006 up to January 2007;

WHEREAS, Kagawad Lorenzana will always be remembered for his invaluable contributions as Manager of the Driftwood Beach and as one of the coordinators of the Sibit-Sibit Festival 2006 held at Barangay Barretto, where the City’s tourism endeavors had been featured in national television;

WHEREAS, though brief as it was, Kagawad Lorenzana had proven himself faithful to the call of duty as a public servant, where many had been benefited through his initiative, perseverance and kindness;

WHEREAS, the City joins the Lorenzana Family in the loss of their beacon and Barangay Barretto for the demise of one of their most loved councilmen;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,
