A RESOLUTION CONFIRMING THE APPOINTMENTS OF CITY COUNCILORS EYRMA YVETTE MARZAN-ESTRELLA, EDUARDO J. PIANO, AND RODEL S. CEREZO AS MEMBERS THE GORDON COLLEGE – BOARD OF TRUSTEES

WHEREAS, pursuant to City Ordinance No. 9, Series of 1999, Olongapo City Colleges, now known as Gordon College, was created with the mandate of providing excellent quality education for the poor and deserving students of Olongapo City;

WHEREAS, this responsibility is carried out mainly by the school’s Board of Trustees, comprised by qualified persons with academic and technical expertise in formulating policies and decisions for the attainment of the institution’s mission and vision;

WHEREAS, pursuant to Section 4 of City Ordinance No. 8, Series of 2010, the Board of Trustees shall be composed of the Chairmen on Education and Labor and Employment, and prominent citizens who have distinguished themselves in education ;

WHEREAS, City Councilor Eyrma Yvette Marzan – Estrella and Eduardo J. Piano hold the chairmanships of Education and Labor and Employment respectively, while Councilor Rodel S. Cerezo is an active educator and a member of the Education Committee;

WHEREAS, in the exigencies of service, City Councilors Eyrma Yvette Marzan-Estrella, Eduardo J. Piano and Rodel S. Cerezo were appointed as interim members of the Board of Trustees pending compliance with pertinent legislative requirements;

WHEREAS, by reason of their vast experience as legislators, they epitomize the values which are worth emulating and were formally nominated for membership on the said board subject to the required confirmation under pertinent laws;

NOW, THEREFORE, on motion of City Councilor Elena C. Dabu, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to confirm, as it is hereby confirms the appointments of City Councilors Eyrma Yvette Marzan-Estrella, Eduardo J. Piano, and Rodel S. Cerezo as Members of the Gordon College – Board of Trustees.

RESOLUTION NO. 23

A RESOLUTION APPROVING THE CONSTRUCTION OF A CONCRETE FOOTBRIDGE AT BLOCK 27, BARANGAY STA. RITA AS ONE OF THE PRIORITY PROJECTS FOR 2010

WHEREAS, residents of Blk. 27, Purok 5D, Balic-Balic, Barangay Sta. Rita requested the City Government for the construction of a footbridge in their area;

WHEREAS, it is necessary that the said project be approved as soon as possible for the general welfare of the constituents;

WHEREAS, the Committee on Public Works and Engineering after thorough and careful deliberation on the matter, approved the said proposal and that the project is deemed worthy of implementation as a priority project of the City;

NOW, THEREFORE, on motion of City Councilor Anselmo A. Aquino, co sponsored by City Councilors Gina G. Perez, Rodel S. Cerezo, Edwin J. Piano, Aquilino Y. Cortez, Jr., Elena C. Dabu, Jonathan G. Manalo and Cheenee F. Hoya, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it is hereby approves the Construction of a Concrete Footbridge at Block 27, Barangay Sta. Rita as one of the Priority Projects for 2010.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED that the Program of Work be made as an integral part of this Resolution.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT (MOA) BY AND BETWEEN JAMES L. GORDON MEMORIAL HOSPITAL (JLGMH) AND THE OLONGAPO CITY POLICE OFFICE (OCPO) REPRESENTED BY THE CITY DIRECTOR PSSUPT OSCAR D. ALBAYALDE, PESE, FOR THE JAMES L. GORDON MEMORIAL HOSPITAL (JLGMH) TO PROVIDE ENHANCED HEALTH SERVICES TO PHILIPPINE NATIONAL POLICE (PNP) PERSONNEL ASSIGNED IN THE OLONGAPO CITY POLICE OFFICE (OCPO)

WHEREAS, the Olongapo City Police Office (OCPO) under the Philippine National Police (PNP) is the country’s primary law enforcement agency tasked to enforce all laws, statutes and ordinances relative to the protection of lives and properties, maintain peace and order and take all necessary steps to ensure public safety, investigate and prevent crimes, effect arrest of criminal offenders, bring them to justice and assist in their prosecution and conduct search and seizure in accordance with the Constitution;

WHEREAS, in furtherance of their duties and responsibilities, the safety, health and well-being of all active PNP personnel, uniformed and non-uniformed alike, are continuously exposed to various imminent perils;

WHEREAS, cognizant of the recurrent constraint encountered in providing adequate, timely and appropriate health services to all active personnel, the PNP desires to engage the services of select Department Of Health (DOH) Retained Hospitals manned by highly qualified medical/health staff and equipped with adequate medical facilities;

WHEREAS, the City Government of Olongapo through the James L. Gordon Memorial Hospital (JLGMH) acknowledges such need and agrees to make health care services available to all Philippine National Police (PNP) personnel assigned in the Olongapo City Police Office (OCPO);

NOW, THEREFORE, on motion of City Councilor Aquilino Y. Cortez, Jr., co-sponsored by City Councilor Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter into and sign a Memorandum of Agreement (MOA) by and between James L. Gordon Memorial Hospital (JLGMH) and the Olongapo City Police Office (OCPO) represented by the City Director PSSUPT Oscar D. Albayalde, PESE, for the James L. Gordon Memorial Hospital (JLGMH) to provide enhanced health services to Philippine National Police (PNP) personnel assigned in the Olongapo City Police Office (OCPO).

Let a copy of this Resolution be furnished to Police Director General Jesus A. Verzosa, Chief of the Philippine National Police, Camp Crame, Quezon City, Metro Manila.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance.

ORDINANCE NO. 08
(Series of 2010)

AN ORDINANCE AMENDING THE LEGAL BASIS ON THE CREATION AND OPERATION OF GORDON COLLEGE

SECTION 1. This shall be an amendment to Ordinances pertaining to Gordon College charter:

1. City Ordinance No. 9, series of 1999 created the Olongapo City
Colleges;
2. Resolution No. 42, series of 2002 changed the name of Olongapo City
Colleges (OCC) to Gordon College;
3. Ordinance No. 36, series of 2004, was ratified to adopt revisions on
the legal basis for the creation and operation of the Olongapo City
Colleges now named Gordon College;

SECTION 2. The College shall be envisioned as a premier institution of higher learning committed to the wholistic development of the human person and society. Its mission shall be to produce well-trained, skilled, dynamic, and competitive individuals imbued with values and attitudes, and responsive to the changing needs of the local, national and global communities.

SECTION 3. The governing body of the College shall be the Board of Trustees which shall be composed of 13 members.

SECTION 4. Composition.

The Board shall be composed of the City Mayor as Chairman, the Vice Chairman and the President of the College, who shall be appointed by the City Mayor subject to the confirmation of the City Council, the Chairman on Education and Chairman of Labor and Employment of the City Council, six (6) prominent citizens who have distinguished themselves in Education or in any of the professions or fields of specialization of the College preferably from the business/industry sector and the health profession of the College who will also be appointed by the City Mayor upon the recommendation of the City Council, President of the Faculty Association, President of the duly recognized Student Council and the Commission on Higher Education Regional Director (Region III) or duly authorized representative.

SECTION 5. The following shall be the functions of the Board of Trustees:

1. To receive budget and appropriate funds coming from the City Government of Olongapo and other sources for the purposes specified by law, such sums as may be provided for the support of the College;

2. To provide for the establishment of the necessary graduate and undergraduate courses, programs, institutions, trainings, instructions of the departments in the priority of community needs including certification programs;

3. To confer degrees upon successful candidates for graduation of the College. It may also confer honorary degrees upon persons in recognition of learning, statesmanship or eminence in any fields of the College, or in recognition of public service or achievements in science, technology and literature. Provided that such degree shall not be conferred in consideration of or to reciprocate some personal favor;

4. To provide fellowship for qualified faculty members and scholarships to deserving and qualified students;

5. To authorize the President of the College to award proficiency certificates, diplomas and/or certificates of completion to students who have successfully complied with the requirements set forth in all non-degree courses;

6. To approve the curricula and rules of discipline drawn by the College Council as hereinafter provided;

7. To appoint, upon the recommendation of the President of the College, Deans, Instructors, Heads of Departments, Registrar, Lecturer and other officials and employees of the College, to fix their compensation and salaries, hours of service and such other duties, conditions and incentives subject to the provisions of the revised compensation and classification system and other pertinent laws as it may deem proper; to grant them at its discretion, leaves of absences under such regulations as it may promulgate any provisions of existing law to the contrary notwithstanding, to suspend and remove them for cause in accordance with the requirements of due process of law, to establish chairs in the College and to provide for the maintenance or endowment of such chairs as may be necessary;

8. To provide rules for its own government and to enact for the Government of the College such rules and regulations not contrary to law as may be necessary to carry out the purposes and functions of the College;

9. To fix tuition fees and other necessary college charges such as, but is not, limited to matriculation fees, graduation fees, laboratory fees, related learning experience fees, and miscellaneous fees, as the Board may deem proper to impose. Such fees and charges and other income generated by the College shall constitute special trust funds and shall be deposited in any authorized government depository bank, and all interests that shall accrue thereafter shall form part of the same funds for the use of the college;

10. The income generated by the College may, at the approval of the Board, be disbursed for the professional growth and development, health, welfare and other similar benefits of the faculty members and personnel for extension and student welfare expenses so that the flexibility on use of income shall be focused on faculty, personnel improvement and student welfare activities and for expenses necessary for the operation of the college including the expansion of facilities and buildings for the attainment of its purposes under this ordinance;

11. To receive in trust legacies, gifts, donations of real and personal properties of all kinds, to administer the same for the benefit of the College or a department thereof, or for aid to any student or students in accordance with the directions and instructions of the donor, and in default thereof, in such manner as the Board may, as its discretion determine. All such donations shall be exempted from all taxes and shall be considered as deductible items from the income tax of the donor;

12. To authorize the City Government of Olongapo and the College to undertake construction and/or repair of its buildings, machinery, equipment, and other facilities;

13. To file with the City Mayor and the City Council an annual detailed report setting forth the progress, conditions and needs of the College;

14. To establish research and extension centers where such will promote the development of the College;

15. To develop consortia and other forms of linkages with other institutions and agencies, both public and private, local and foreign, in furtherance of the mission and goals of the College.

16. To do all things, as are not inconsistent with existing laws, it may deem proper for the efficient government of the College.


SECTION 6. The College shall offer graduate, undergraduate and short-term vocational-technical programs within its area of specialization as the Board of Trustees may deem necessary to carry out its mission and goals, particularly in meeting the needs of the City.

SECTION 7. The College shall be self-sustaining, utilizing its income from tuition fee and other school fees for its operation and maintenance which may be collected from the students, as may, from time to time be determined by the Board of Trustees. It shall establish other income-generating activities for additional source of income.

SECTION 8. All other provisions of existing measure not in conflict with this Ordinance are still applicable.

A RESOLUTION ADOPTING THE GORDON COLLEGE’S BOARD OF TRUSTEES RESOLUTION NO. 20, SERIES OF 2006 ENTITLED: “A RESOLUTION ESTABLISHING AN INCOME-GENERATING PROJECT UNIT OF GORDON COLLEGE”

WHEREAS, the tasks of the unit are as follows:

1. Supervision of the Income-generating Projects of the College
2. Preparation of Proposals for other possible source s of income
3. Preparation of guidelines regarding the establishment of income-generating activities in the college;

WHEREAS, the Sangguniang Panlungsod deems that Resolution No. 20, Series of 2006 entitled: “A Resolution Establishing An Income-Generating project Unit of Gordon College” is necessary for adoption for its immediate implementation;

WHEREAS, it is indeed necessary to carry out the purposes and functions of the college;

NOW, THEREFORE, on motion of City Councilor Jonathan G. Manalo, co-sponsored by City Councilors Edwin J. Piano and Rodel S. Cerezo with the unanimous accord of the Members of the Sangguniang Panlungsod present;

WHEREAS, the Sangguniang Panlungsod deems that the following resolutions entitled;

No. 1 - Approving the Candidates for Graduation, AY 2008-2009;

No. 3 - Accepting Atty. Bernardine S. Gantan as Member of the Board of Trustees (BOT) Of Gordon College;

No. 4 - Granting Incentive to Top Ten Examinees of Gordon College in any Licensure
Examination;

No. 6 - Recommending the change of Signatory of the Land Bank Account of Gordon College From Mr. Arvin Esposo to Mr. Marcelino D. Andawi, Olongapo City, Treasurer.

are necessary for adoption for their immediate implementation;.

WHEREAS, Mr. Angelito B. Layug, Executive Officer, CDCC Chief, DMO submitted the Work and Financial Plan of the City Disaster Coordinating Council for the Year 2009;

WHEREAS, said plan will sustain and maintain the resources of the said office to effectively and promptly respond to disasters in the City as well as to allow the enhancement and strengthening the capabilities and abilities of its manpower in delivering emergency rescue and response services;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to approve, as it hereby approves the Work and Financial Plan for Calendar Year 2009 of the Olongapo City Disaster Coordinating Council.

A RESOLUTION APPROVING THE CONTAINER VAN-OFFICE AT THE ENGINEERING COMPOUND AS ONE OF THE PRIORITY PROJECTS FOR THE BUDGET YEAR 2009.

WHEREAS, a Container Van-Office to be included to the City Priority Projects for 2009 was submitted to the Sangguniang Panlungsod amounting to PhP 1,846,802.70;

WHEREAS, it is necessary that the said project be approved as soon as possible for the general welfare of the constituents;

WHEREAS, the Committee of Public Works and Engineering has convened and discussed the inclusion of a container van-office to the Priority Projects for 2009 and after thorough and careful deliberation on the matter, the body approved the said proposal that the project is deemed worthy of implementation;

NOW, THEREFORE, on joint motion of Councilors Anselmo A. Aquino, Edwin J. Piano and Rodel S. Cerezo with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve as it is hereby approves the container van-office at the engineering compound as one of the priority projects for the budget year 2009.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO REPRESENT THE CITY OF OLONGAPO TO ENTER INTO A MEMORANDUM OF AGREEMENT BETWEEN THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS FOR THE IMPLEMENTATION OF THE SPECIAL LOCAL ROAD FUND (SLRF) UNDER REPUBLIC ACT 8794 OR THE MVUC LAW

WHEREAS, Pursuant to Republic Act No. 8794, the Motor Vehicle User’s Charge Law (MVUC Law), under Section 1 which declares that “it is the policy of the State to provide for and ensure the adequate maintenance of national and provincial roads through sufficient funding for the purpose”;

WHEREAS, Section 7 of the said Act, which states that all monies collected under this Act shall be earmarked solely and used exclusively (1) for road maintenance and improvement of road drainage, (2) for the installation of adequate and efficient traffic lights and road safety devices, and (3) for air pollution control”. It further provides that 5% of all monies collected shall be deposited in the National Treasury under the Special Local Road Fund (SLRF), which shall be apportioned to provincial and city governments in accordance with the vehicle population and size of the road network under their respective jurisdiction, and shall be used exclusively for maintenance of local roads, traffic management and road safety devices. It also directs that the Special Fund, the Special Local Road Fund and Special Road Safety Fund shall be under the DPWH;

WHEREAS, pursuant to Sections 3 and 5 of Executive Order No. 124, dated 30 January 1987, the DPWH shall decentralize its responsibilities to the fullest extent possible; and, may delegate to any agency it determines to have adequate technical capability, any of its powers and functions. Consistent with its policy of decentralization, the DPWH shall assist the LGUs in developing the latter’s capabilities by allowing them greater participation in the local road maintenance and safety provisions;

WHEREAS, it is necessary that a Memorandum of Agreement should be entered into for the purpose of delineating responsibilities regarding the implementation of policies, standards and procedures at the LGU level in accordance with the pertinent provisions of the SLRF under MVUC Law and its IRR;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino co-sponsored by Councilors Edwin J. Piano, and Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it is hereby authorizes the Honorable City Mayor James Gordon, Jr. To Represent The City Of Olongapo To Enter Into A Memorandum Of Agreement Between The Department Of Public Works And Highways For The Implementation Of The Special Local Road Fund (SLRF) Under Republic Act 8794 Or The MVUC Law.

A RESOLUTION COMMENDING BARANGAY EAST TAPINAC AS REGIONAL AWARDEE IN THE COMPETITION OF LUPONG TAGAPAMAYAPA INCENTIVE AND ECONOMIC AWARDS (LTIEA) FOR THE PERIOD OF JUNE 2007 TO JULY 2008

WHEREAS, Lupong Tagapamayapa Incentive And Economic Awards (LTIEA), an award being conferred to barangays with exemplary performance in judiciously and expeditiously resolving inter-personal and community conflicts referred to them for amicable settlement, was accorded to Barangay East Tapinac;

WHEREAS, the selection of winners is based on the efficiency of operations, effectiveness in securing the objectives of the program, and creativity and resourcefulness of the mediators;

WHEREAS, the Lupong Tagapamayapa of Barangay East Tapinac resolved cases by coming into a win-win situation agreed by both parties without any legal counsel involved which usually makes cases arbitrary and expensive. The Lupon mediators implore on mutual agreements that may result to the most agreeable settlement by both parties. As such the Katarungang Pambarangay has become “the shoulder to cry on among the residents”;

WHEREAS, the City commends the leadership of Barangay East Tapinac for being of great service to its constituents by instilling justice at all times towards a more peaceful and orderly society;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to commend, as it hereby commends Barangay East Tapinac as Regional Awardee in the competition of the Lupong Tagapamayapa Incentive and Economic Awards (LTIEA) for the period of June 2007 to July 2008.

A RESOLUTION CONGRATULATING AND RECOGNIZING THE OLONGAPO CITY DISASTER COORDINATING COUNCIL (OCDCC) FOR WINNING THE NATIONAL GAWAD KALASAG AWARD FOR THE BEST CITY DISASTER COORDINATING COUNCIL IN HIGHLY URBANIZED CITY CATEGORY

WHEREAS, Olongapo City Disaster Coordinating Council (OCDCC) is the recipient of the National Gawad Kalasag for being adjudged as the Best Disaster Coordinating Council in Highly Urbanized City in the entire Philippines;

WHEREAS, OCDCC bested the national finals for the best prepared OCDCC to deal with emergencies and providing assistance to affective communities due to disaster and calamities;

WHEREAS, OCDCC responded to almost all emergency situations within the bounds of the city and other neighboring provinces and cities;

WHEREAS, OCDCC outshined all the Disaster Coordinating Council of other provinces and cities as excellent in disaster management and humanitarian assistance;

WHEREAS, OCDCC takes pride on this National Award, another feather in their cap. The entire country salutes the courage of OCDCC in standing as the frontliner of disasters and emergencies with sheer commitment to save lives, alleviate sufferings and mitigate further destruction of lives and properties;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

(Series of 2008)

A RESOLUTION CONGRATULATING AND RECOGNIZING THE OLONGAPO CITY FIRE – RESCUE TEAM FOR WINNING THE HALL OF FAME AWARD IN THE NATIONAL GAWAD KALASAG FOR BEST GOVERNMENT EMERGENCY RESPONDERS (GOERS)

WHEREAS, the Gawad KALASAG Awards aim to confer distinctive recognition to individuals, groups or institutions who have sacrificed their own lives or safety to be able to save people at risk, and prevent or minimize needless sufferings during the three phases of disasters;

WHEREAS, it also aims to inculcate among the Filipinos the true value of self-sacrifice, bravery and heroism in times of disasters and emergencies as well as foster the spirit of bayanihan, volunteerism and mutual assistance in responding to disasters and emergencies;

WHEREAS, the Gawad Kalasag, a distinction comparable to that of Emergency 911 of the United States of America, was again accorded to the Olongapo City Fire-Rescue Team (OFRT), clinching the Hall of Fame Award this time;

WHEREAS, with a fully equipped emergency response unit, professional and highly-trained personnel with profound dedication for service, the OFRT responded to almost all emergency situations within the bounds of the City as well as its outskirts and neighboring towns and provinces;

WHEREAS, armed with a strong sense of purpose, the OFRT was honored for its high level of readiness, timely deployment in the City and beyond, in the call of emergency;

WHEREAS, for their death defying feats and for racing against time, the OFRT offered springs of hope to the community, replete of the commitment to save lives, alleviate sufferings and mitigate further destruction of lives and properties;

WHEREAS, Olongapo City salutes their extraordinary courage, bravery, selflessness, sacrifice and service in times of disasters, and stands prouder of the accomplishments they had garnered for the City’s pride;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sannguniang Panlungsod in session assembled, to congratulate and recognize, as it hereby congratulates and recognizes the Olongapo City Fire – Rescue Team for winning the Hall of Fame Award in the National Gawad Kalasag For Best Government Emergency Responders (GOERS).

Let a copy of this Resolution be furnished to the Olongapo City Fire – Rescue Team for their information and record.

A RESOLUTION APPROVING THE ADDITIONAL LIST OF PRIORITY PROJECTS FOR CALENDAR YEAR 2008 AMOUNTING TO THIRTEEN MILLION FIVE HUNDRED NINETEEN THOUSAND EIGHTY THREE PESOS AND TWENTY NINE CENTAVOS (PHP13,519,083.29)

WHEREAS, the City puts in place necessary infrastructure and road projects in different barangays of the city to match the needs of the community and serve as frameworks to sustain upcoming programs;

WHEREAS, all projects listed are deemed as worthy of project implementation;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino , co-sponsored by Councilors Edwin J. Piano and Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve as it hereby approves the Additional List Of Priority Projects For Calendar Year 2008 Amounting To Thirteen Million Five Hundred Nineteen Thousand Eighty Three Pesos And Twenty Nine Centavos (PhP13,519,083.29).
