A RESOLUTION COMMENDING THE QUICK EMERGENCY RESPONSE UNIT OF BARANGAY OLD CABALAN FOR BEING AWARDED AS THE OVER-ALL CHAMPION FOR THE BARANGAY FIRE BRIGADE CATEGORY IN THE RECENTLY CONCLUDED 5^th CENTRAL LUZON FIRE OLYMPICS HELD IN ANGELES CITY, PAMPANGA

WHEREAS, the Bureau of Fire Protection-Regional Office 3 conducts an annual event dubbed as Central Luzon Fire Olympics as part of the Bureau’s continuing campaign towards quick response during fire occurrences;

WHEREAS, this year’s Central Luzon Fire Olympics was held in Salakot, Bayanihan Park, Angeles City, Pampanga on 29 May 2015, and was participated by the Regional emergency response units coming from the Uniformed, Industrial and Barangay Level;

WHEREAS, Barangay Old Cabalan Quick Emergency Response Unit bested other barangay level participants from the Central Luzon Region;

           

WHEREAS, Barangay Old Cabalan Quick Emergency Response Unit won First Place in the Hose Laying and Busted Hose Replacement Event, Second Place in the Bucket Relay Event, Second Place in the Fire Extinguishing Event, Best in Uniform and Most Disciplined Team;

WHEREAS, in view of the citations above stated, Barangay Old Cabalan Quick Emergency Response Unit was awarded as the Over-All Champion in the Barangay Level Category;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

 RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to commend as it hereby commends the Quick Emergency Response Unit of Barangay Old Cabalan for being awarded as the Over-All Champion for the Barangay Fire Brigade Category in the recently concluded 5^th Central Luzon Fire Olympics held in Angeles City, Pampanga. 

Let a copy of this Resolution be furnished to the Barangay Old Cabalan for their information and documentation.

In the interest of public service and on motion of City Councilor Gina Gulanes Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare, as it hereby declares the Annual Budget of Barangay Old Cabalan  for the Fiscal Year 2013 in the amount of Eight Million Nine Hundred Forty-Three Thousand Seven Hundred Twenty-Three Pesos (PhP8,943,723.00) operative in its entirety considering that the said budget as contained in Barangay Appropriation Ordinance No. 002, Series of 2013 of Old Cabalan, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations.  PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in her letter dated April 22, 2013 are strictly complied with;

WHEREAS, Appropriation Ordinance No. 003, Series of 2009 of the Barangay Old Cabalan authorizing its Annual Budget for Fiscal Year 2010, involving an appropriation of Eight Million One Hundred Ninety-four Thousand Eight Hundred Seventy Five & 20/100 Pesos (PhP8,194,875.20), was submitted to the Sangguniang Panlungsod of Olongapo for review pursuant to the provisions of Republic Act No. 7160;

WHEREAS, the subject Appropriation Ordinance reveals substantial compliance with the same law and its Implementing Rules and Regulations;

NOW, THEREFORE, on motion of City Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare, as it hereby declares Appropriation Ordinance No. 003, Series of 2009 of the Barangay Old Cabalan operative in its entirety, effective upon approval subject to the posting requirements under Section 59 of R.A. A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) FOR AND ON BEHALF OF THE LOCAL GOVERNMENT UNIT OF OLONGAPO CITY AND THE DEPARTMENT OF EDUCATION REPRESENTED BY THE SCHOOLS DIVISION SUPERINTENDENT, DR. LIGAYA B. MONATO REGARDING THE CREATION OF THE OLD CABALAN INTEGRATED SCHOOL.

WHEREAS, the creation of the Old Cabalan Integrated School would be beneficial to the residents and nearby constituents of the area as well as to accommodate the growing educational needs and minimize congestion in the city schools;

WHEREAS, the said school will cater to students who belong to low-incoming group;

WHEREAS, The Local government Unit and Department of Education agree as follows:

1. The LGU will provide the following:

a. Funds for the maintenance of the new school for at least one year;

b. Funds for the construction of new buildings and facilities and provide the new

classroom with furniture, equipment and textbooks subject to the availability of fund;

c. Funds for the salaries of new teachers at rates approved by the Local School Board and to be taken from the Local School Board Fund.

2. The DepEd will provide the following:

a. Policy guidance and directions to ensure the proper implementation of the integration;

b. Evaluation of teachers applicant;

c. Assistance in the curriculum development.

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, the Sangguniang Panlungsod in session assembled to authorize, as it is hereby authorizes Honorable City Mayor James Gordon Jr. to enter into Memorandum of Agreement (MOA) for and on behalf of the Local Government Unit of Olongapo City and the Department of Education represented by the Schools Division Superintendent, Dr. Ligaya B. Monato regarding the creation of Old Cabalan Integrated School.

That in the event the CY 2008 final Internal Revenue Allotment (IRA) share of the city differs from that of the initial amount earlier informed, a supplemental budget shall be prepared to effect the increase or set aside certain amount as unutilized appropriation.

That disbursement of 20% Development Fund shall be in accordance with the projects/activities embodied in the Annual Investment Plan of the Barangay and an amount equivalent to twenty-percent (20%) of the amount appropriated for such development projects shall be set aside for programs and activities pursuant to Local Budget Circular No. 70 of the Department of Budget and Management (DBM) dated 14 March 2000, implementing Executive Order No. 189 dated 21 December 1999.

That the 5% Calamity Fund shall be utilized solely for relief, rehabilitation, reconstruction and other works or services in connection with calamities and which may occur during the budget year, provided that such fund shall be used only in the area or portion thereof, of the barangay, or other areas affected by disaster or calamity as determined and declared by the Sangguniang Barangay concerned.

Pursuant to Local Budget Circular No. 63 of the Department of Budget & Management dated 22 October 1996, "barangay officials shall be compensated in the form of honorarium and subject to availability of funds and the general limitation on personal services, the honorarium rates of the said barangay officials may be adjusted” However, such adjusted rates shall not exceed the rate equivalent to the first step of the following salary grades in the City where the barangays belong.

SG - 14 for the punong barangay
SG - 10 for the Sangguniang barangay members,
barangay secretary and barangay treasurer.

Positions other than those mandatory (Barangay Officials) may be created in the barangay and may be compensated in the form of salary or honorarium at the discretion of the barangay concerned at the rates not exceeding the minimum of the salary grade allocation prescribed "pursuant to the LBC No. 63 of the DBM dated 22 October 1996".

Barangay Tanods and members of the Lupong Tagapamayapa may be granted honorarium or other emolument provided the total amount shall not exceed the minimum salary rate for salary grade 1.

That the appropriation for compensation of Lupon Tagapamayapa Chairman, in the person of the Barangay Captain, under "General Services" cannot be acted upon pending circular, memorandum, guidelines from the Department of Budget and Management.

That the amount appropriated for Traveling Expenses and Training & Seminar Expenses shall be disbursed in accordance with Executive Order No. 248 dated 29 May 1995 as amended by Executive Order Nos. 248-A and 298 dated 14 August 1995 and 23 March 2004, respectively.

That the amount of “POWER BILLS” appropriated or to be set up for budgetary purposes be mutually agreed upon between that Barangay and the Public Utilities Department (PUD) thru the intercession of the Sangguniang Panlungsod so that outstanding power account and/or current bills of the said Barangay based on its financial capability may be properly liquidated/settled.

That appropriations, in the amount of Six Million Eight Hundred Eighty Three Thousand Seven Hundred Twelve Pesos and 87/100 (PhP6,883,712.87) as herein authorized shall be disbursed strictly in accordance with the purposes for which they were intended subject to existing budgeting, accounting and auditing rules and regulations and compliance thereof shall be the responsibility of the implementing barangay.

Let Barangay Old Cabalan Ordinance No. 4, Series of 2008 and endorsement from City Budget Office and other pertinent documents related hereto form part of this resolution.

A RESOLUTION APPROVING THE APPLICATION OF DIGITEL TELECOMMUNICATIONS, INC. (SUN CELLULAR) FOR THE INSTALLATION AND OPERATION OF CELLSITE/GSM ANTENNA AT BARANGAY OLD CABALAN, OLONGAPO CITY

WHEREAS, Digitel Mobile Philippines, Inc. (DIGITEL) a corporation duly organized and existing under Philippine Laws, with principal office located at 40th Floor, Robinsons Equitable Tower ADB Avenue corner Poveda Street Ortigas Center, Pasig City thru their official Site Acquisition Contractor Samwoo Construction/JAGS Management applied for a permit to allow the construction, installation and operation of a Digitel Cellular Antenna located at ARPN AB-00017-00845 National Highway, Old Cabalan, Olongapo City;

WHEREAS, with Digitel’s well-known capability of providing world class telecommunication system that produces seamless cellular coverage and accessibility, residents and subscribers of Digitel Telecom in the City and adjoining areas will be assured of uninterrupted link to personal and business communications;

WHEREAS, the Olongapo Telecom and IT Board was created under City Ordinance No. 24, Series of 2004 and Executive Order No. 84-A, Series of 2005 where its duties and functions to implement Guidelines, Rules and Regulations are defined under Sangguniang Panlungsod Resolution No. 13, Series of 2005;

WHEREAS, Samwoo Construction/JAGS Management had presented to the Olongapo Telecom and IT Board the necessary documents that warrant the approval of the Board for them to proceed with their application and had accomplished other pertinent requirements for the approval of the same;

WHEREAS, Barangay Old Cabalan, after public consultation and submission of signed neighbors’ consent, passed Resolution 14, Series of 2008, giving clearance to the said project and placed on record that no objection had been noted for the said construction;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve as it hereby approves the application of Digitel Telecommunications, Inc. (Sun Cellular) for the installation and operation of Cellsite/GSM antenna at Barangay Old Cabalan, Olongapo City;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Barangay Old CAbalan Resolution No. 14, Series of 2008 and a copy of the signed neighbors’ consent as well as other pertinent documents be made as integral parts of this Resolution.

A RESOLUTION ESTABLISHING OLD CABALAN INTEGRATED SCHOOL

WHEREAS, the Parents Teachers Association of Old Cabalan Elementary School passed a resolution establishing a Public High School at Barangay Old Cabalan, Olongapo City and will be named as Old Cabalan Integrated School;

WHEREAS, the Sangguniang Barangay of Old Cabalan, Olongapo City approved a resolution for the establishment of a Public Secondary School at Old Cabalan Elementary School and named as Old Cabalan Integrated School;

WHEREAS, the establishment of a Public High School at Old Cabalan Elementary School will lessen the influx of enrollment at the thickly populated public high schools in the city proper;

WHEREAS, the approval of this resolution establishing of Public Secondary School will insure the efficiency and effective delivery of basic services and facilities to the constituents of Old Cabalan as provided for under section 17 of the Local Government Code;

WHEREAS, the establishment of Old Cabalan Integrated School is deemed necessary to the constituents of the Barangay who belong to the low income families to have the opportunity to send their children to high school;

WHEREAS, with the increasing number of enrollees every year will reduce the teacher-student ratio in Public Schools in the City proper;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo and with the unanimous accord of all the Members of the Sangguniang Panlungsod present;


RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled to establish as it hereby establishes Old Cabalan Integrated School.

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Old Cabalan, City of Olongapo for the Calendar Year 2008 considering that the budget as contained in Barangay Resolution No. 001, Series of 2008 of Barangay Old Cabalan dated January 4, 2008 upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets with the following conditions:

A RESOLUTION AUTHORIZING HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A CONTRACT OF AGREEMENT FOR THE LEASE OF THE MULTI-PURPOSE COMPLEX (FORMERLY NDC) OWNED BY THE CITY GOVERNMENT LOCATED IN OLD CABALAN, OLONGAPO CITY


WHEREAS, the City Council passed City Resolution No. 120, Series of 2007 converting the TransCon lot into a multi-purpose complex;

WHEREAS, the Office of the City Assessor thru the City Appraisal Committee Resolution No. 1, Series of 2008, assessed a portion of the lot equivalent to 1,534 square meters with a floor lease rate of Eleven Thousand Nine Hundred Pesos (PHP 11,900.00) per month;

WHEREAS, the portion of lot shall be offered at a lease rate of Eighteen Thousand Pesos (PHP 18,000.00) per month which is more than fifty percent (50%) of its recommended floor lease rate;

WHEREAS, this authority shall be subject to the City Council’s ratification in accordance with pertinent laws, rules and regulations;

NOW, THEREFORE, upon the joint motion of Councilors Angelito W. Baloy and Edwin J. Piano, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize as it hereby authorizes Honorable City Mayor James Gordon, Jr. to enter into a Contract of Agreement for the lease of the Multi-Purpose Complex (Formerly NDC) owned by the City Government located in Old Cabalan, Olongapo City.

In the interest of public service and on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 55
(Series of 2007)

AN ORDINANCE APPROPRIATING THE AMOUNT OF ONE MILLION TWO HUNDRED NINETEEN THOUSAND THREE HUNDRED SEVENTY FIVE PESOS AND 50/100 (PHP1,219,375.50) AS PAYMENT FOR THE 5TH AND FINAL PAYMENT OF THE 6,524 SQM PIECE OF LAND LOCATED AT OLD CABALAN (TRANSCON) TO BE TAKEN FROM TRUST FUND (LOT SALES)

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Million Two Hundred Nineteen Thousand Three Hundred Seventy Five Pesos and 50/100 (PhP1,219,375.50) is hereby appropriated from Trust Fund (Lot Sales) as payment for the 5th and Final Payment of the 6,524 Sq M. piece of land located at Old Cabalan (Transcon).

SECTION 2. This ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter from the National Development Company and a Certificate of Availability of Funds issued by Mr. Marcelino D. Andawi, City Treasurer are hereby made as integral parts of this Ordinance.


SECTION 4. This Ordinance shall take effect upon its approval.

RESOLUTION NO. 111
(Series of 2007)

A RESOLUTION APPROVING THE REQUEST OF BARANGAY OLD CABALAN TO OPERATE A MINI FAIR WITHIN THEIR JURISDICTION SUBJECT TO THE PRESCRIBED GUIDELINES OF THE SANGGUNIANG PANLUNGSOD

WHEREAS, carnivals and mini fairs established in conjunction with fiestas are good income generating means to fund projects for good causes;

WHEREAS, Barangay Old Cabalan requested through Barangay Resolution No. 6, Series of 2007, permission to operate a mini fair in the said Barangay in order to raise funds for various barangay projects;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Old Cabalan with the condition that the preparation and operation of a mini fair shall be in accordance with the provisions of Ordinance No. 49, Series of 2005 and upon compliance with the recommendations set by the same;

NOW, THEREFORE, on motion of Councilor Angelito W. Baloy, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the request of Barangay Old Cabalan to operate a Mini Fair within their jurisdiction subject to the prescribed guidelines of the Sangguniang Panlungsod.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the Sangguniang Panlungsod recommendations regarding the request and that item nos.1 to 4 shall form part of this Resolution.


RESOLVED FINALLY, AS IT IS HEREBY FINALLY RESOLVED, that a financial statement be submitted to the Sangguniang Panlungsod after the event.

A RESOLUTION RECOGNIZING THE INVALUABLE CONTRIBUTIONS OF MRS. EDITHA GO-NG FOR HER DONATION OF A TWO-CLASSROOM SCHOOL BUILDING TO OLD CABALAN ELEMENTARY SCHOOL


WHEREAS, Mrs. Editha Go-Ng, the mother of Mrs. Mary Ng who also donated a school building to another school, showed compassion and concern for the youth of Olongapo by donating a school building which was a very timely solution to the classroom needs of Old Cabalan;

WHEREAS, the donated building will truly add to the well-being of the students and teachers, as well as the improvement of Old Cabalan Elementary School condition;

WHEREAS, the City Government of Olongapo and the recipient school, recognize the invaluable contributions of the generous and benevolent Mrs. Editha Go-Ng in the field of education;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to recognize, as it hereby recognizes the invaluable contributions of Mrs. Editha Go-Ng for her donation of a Two-Classroom School Building to Old Cabalan Elementary School.
