WHEREAS, the City of Olongapo owns by virtue of donation by the Bureau of Fisheries and Aquatic Resources a Patrol Boat to be used for the purpose of monitoring illegal fishing, piracy in the seashores and within its territorial boundaries;

WHEREAS, this boat will also be useful to pursue the peace and order campaign of the city at the sea;

WHEREAS, environmental concerns like protecting our water resource from pollution and the pursuit of a clean waterways may also be boosted by the use of this patrol boat;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 47
(Series of 2005)

AN ORDINANCE DECLARING THE FISHPORT AT BARANGAY BANICAIN AND THE DRIFTWOOD BEACH BOARDWALK KNOWN AS “PIER B” AT BARANGAY BARRETTO DOCKING AREAS OF THE CITY’S
PATROL BOAT

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The Fishport at Barangay Banicain and the Driftwood Beach Boardwalk known as “Pier B” at Barangay Barretto, both in this City are hereby declared
as official docking areas of the City’s Patrol Boat.

ORDINANCE NO. 48

AN ORDINANCE APPROVING THE AMOUNT OF TEN THOUSAND PESOS (PHP10,000.00) AS ASSISTANCE TO THE VICTIMS OF DEMOLITON LAST AUGUST 2, 2005 AT PUROK 7, NEW CABALAN , OLONGAPO CITY TO BE TAKEN FROM THE ITEM DONATIONS UNDER MAINTENANCE AND OTHER OPERATING EXPENSES OF THE SANGGUNIANG PANLUNGSOD

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of Ten Thousand Pesos (PhP10,000.00) is hereby approved as assistance to the victims of demolition last August 2, 2005 at Purok 7, New Cabalan, Olongapo City to taken from the Item Donations under Maintenance & Other Operating Expenses of the Office of the Sangguniang Panlungsod.

SECTION 2. The said Fund will be managed by the City Social Welfare and Development Office (CSWDO).

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 49
(Series of 2005)

AN ORDINANCE REPEALING ORDINANCE NO. 57, SERIES OF 2000 AND AMENDING ORDINACE NO. 97, SERIES OF 2001


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The establishment of barangay mini fairs or carnivals can only be had after approval of its formal requests addressed to the City Mayor and the Members of
the Sangguniang Panlungsod. The request should state the specific purpose of the fund raising activity. .

SECTION 2. TERMS AND CONDITIONS.

2.1 The establishment and holding of mini fairs and carnivals by the barangay shall not exceed 7 days preparation and 45 days operation and can only be held once a year for each barangay;

2.2 The venue of the mini fairs and carnivals be at least fifty (50) meters away from the nearest schools, place of worship and residential houses;

2.3 No game of chance where money is involved, which are legally prohibited by the law shall be played in any mini fair or carnival;

2.4 No minors or students shall be allowed entrance to mini fairs or carnivals during school hours, except if accompanied by parents;

2.5 The following curfew hours for minors and students shall be strictly enforced:

(a) No minors or students shall be found in the vicinity of the mini
carnival fair at 9:00 p.m. during weekdays and Sundays; and

(b) No minors or students shall be found in the vicinity of the mini
carnival fair at 10:00 p.m. during Sundays.

2.6 It is the responsibility of the Barangay concerned to maintain peace and order and cleanliness within the vicinity of the mini fairs or carnivals;

2.7 The applying barangay shall be required to execute a Deed of Undertaking with the City Government of Olongapo for strict enforcement of this Ordinance;

2.8 There shall be an outright disapproval and downright closure of mini carnival fairs to barangays which already established such without seeking prior approval from the City;

2.9 The City Mayor may issue/promulgate such other terms and conditions relative hereto as he/she may deem necessary for the effective implementation of the provision of this Ordinance;

2.10 Subject to Paragraph 11 Section 391 of the Local Government Code.


SECTION 3. The owners/operators of carnivals or mini fairs must secure business permit from the City and should comply with the Safety Regulations set by the Office of the City Mayor.

SECTION 4. PENAL PROVISION. Administrative sanctions shall be imposed to erring barangay officials concerned who are in utter disregard of this Ordinance in addition to automatic closure of mini carnival fairs in the said barangay

A RESOLUTION FAVORABLY AND STRONGLY ENDORSING
THE ESTABLISHMENT OF A COMPLETE ELEMENTARY SCHOOL AT
SITIO MAMPUENG, OLONGAPO CITY TO BE NAMED AS
“IRAM RESETTLEMENT SCHOOL ANNEX”

WHEREAS, Sitio Mampueng is a mountainous tribal community of Aetas at Iram Resettlement in Olongapo City;

WHEREAS, children of Aeta families travel long hours going to school everyday by foot for a distance of five (5) kilometers before reaching the Iram Resettlement School to attend their classes. They traverse the same distance going back to their homes at Sitio Mampueng;

WHEREAS, it is the commitment of the City to bring education closer to the community it serves, look after the safety of school children and protect them from the risks of exposing them to the many hazards of the road;

NOW THEREFORE, on joint motion of Councilors Marey Beth D. Marzan Cynthia G. Cajudo and Robine Rose C. Buenafe, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to strongly endorse, as it hereby endorses the establishment of a complete
elementary school at Sitio Mampueng, Olongapo City to be named as “Iram Resettlement School Annex”.

A RESOLUTION APPROVING THE REQUEST OF BARANGAY PAG-ASA FOR A PERMIT TO OPERATE A MINI FAIR FROM AUGUST 15 UP TO SEPTEMBER 30, 2005 IN CELEBRATION OF THEIR BARANGAY FIESTA


WHEREAS, carnivals and mini-fairs established in conjunction with fiestas are good income generating means to fund projects of good causes;

WHEREAS, Barangay Pag-asa, one of the barangays that will celebrate their fiesta this month, requested the Sangguniang Panlungsod permission to operate a mini fair in connection with their barangay fiesta as a fund raising activity for various projects;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Pag-asa and deems that the setting up of a mini fair on August 15 up to September 30, 2005 is in accordance with the provisions of Ordinance 49, Series of 2005;

A RESOLUTION APPROVING THE REQUEST OF BARANGAY OLD CABALAN FOR A PERMIT TO OPERATE A MINI FAIR FROM AUGUST 15 UP TO SEPTEMBER 30, 2005 IN CELEBRATION OF THEIR BARANGAY FIESTA


WHEREAS, the existence of fiestas draw out the kindred spirit and creativity of Filipinos as they present various fun fare and merry making activities;

WHEREAS, carnivals and mini-fairs established in conjunction with fiestas are good income generating means to fund various projects;

WHEREAS, Barangay Old Cabalan passed Resolution 06, Series of 2005 which seeks to request a permit to operate a mini fair in connection with their barangay fiesta as well as generate funds for the payment of PHILHEALTH of indigent barangay constituents and other projects to be identified later by the Barangay officialdom;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Old Cabalan and deems that the setting up of a mini fair on August 15 up to September 30, 2005 is in accordance with the provisions of Ordinance 49, Series of 2005;

A RESOLUTION APPROVING THE REQUEST OF BARANGAY ASINAN TO OPERATE A MINI FAIR WITHIN THEIR JURISDICTION FROM
AUGUST 15 UP TO SEPTEMBER 30, 2005


WHEREAS, barangays of the City considers the establishment of mini fairs as potent source of funding for their projects;

WHEREAS, Barangay Asinan passed Resolution 010, Series of 2005 which seeks reconsideration and approval for their request to operate a mini fair in order to generate funds for the repainting of their Barangay Hall as well as the repair of its second floor;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Asinan and deems that the setting up of a mini fair on August 15 up to September 30, 2005 is in accordance with the provisions of Ordinance 49, Series of 2005;

A RESOLUTION INDORSING THE PETITION LETTER OF THE EJECTED AND DEMOLISHED RESIDENTS OF PUROK 7, OLD CABALAN,
THIS CITY DATED AUGUST 3, 2005.


WHEREAS, residents of Purok 7, New Cabalan, this city wrote the Hon. Rolen C. Paulino, City Vice Mayor dated August 3, 2005 seeking audience and assistance for their alleged untimely ejectment and demolition of their homes at Purok 7, New Cabalan, Olongapo City on August 2, 2005;

WHEREAS, the same affected people appealed to the Members of the City Council during the Regular Session on August 3, 2005, to air their plea and to ask assistance with regard to their relocation;

WHEREAS, the Sangguniang Panlungsod believes that the law clearly separates the legislative and judiciary powers. However, this event calls for the protection of social rights and immediate assistance to the affected people who are the very constituents the Members of the Sangguniang Panlungsod had sworn to serve;

WHEREAS, Article XIII, Section 10 of the Philippine Constitution as quoted, “Urban and rural people dwellers shall not be evicted nor their dwellings demolished, except in accordance with law and in a just and human manner. No resettlement of urban and rural dwellers shall be undertaken without adequate consultation with them and the communities where they are to be located”.

WHEREAS, the Legislative Body deemed it proper to indorse the said Petition Letter to the Executive Branch for their information and action.

NOW THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

THE ESTABLISHMENT OF A COMPLETE ELEMENTARY SCHOOL AT
SITIO MAMPUENG, OLONGAPO CITY TO BE NAMED AS
“IRAM RESETTLEMENT SCHOOL ANNEX”

WHEREAS, Sitio Mampueng is a mountainous tribal community of Aetas at Iram Resettlement in Olongapo City;

WHEREAS, children of Aeta families travel long hours going to school everyday by foot for a distance of five (5) kilometers before reaching the Iram Resettlement School to attend their classes. They traverse the same distance going back to their homes at Sitio Mampueng;

WHEREAS, it is the commitment of the City to bring education closer to the community it serves, look after the safety of school children and protect them from the risks of exposing them to the many hazards of the road;

NOW THEREFORE, on joint motion of Councilors Marey Beth D. Marzan Cynthia G. Cajudo and Robine Rose C. Buenafe, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to strongly endorse, as it hereby endorses the establishment of a complete

WHEREAS, the City believes that a healthy partnership with educational institutions will help establish benchmarks to improve its governance;

WHEREAS, awareness regarding resolutions and ordinances passed by the Sanggunian Panlungsod as well as their implementation can be reinforced through classroom discussions and information dissemination spearheaded by schools;

WHEREAS, the City recommends school authorities to include pertinent ordinances and resolutions in their curricula specifically those which will directly and effectively address the needs of the school/college itself, the students and their families. Copies of which will be furnished by the Sanggunian Panlungsod’s Committee on Education;

WHEREAS, Olongapo City likewise encourages schools/colleges in the City to visit the site www.sangunian.blogspot.com periodically for further information;

WHEREAS, awareness regarding resolutions and ordinances passed by the Sanggunian Panlungsod as well as their implementation can be reinforced through classroom discussions and information dissemination spearheaded by schools;

WHEREAS, the City recommends school authorities to include pertinent ordinances and resolutions in their curricula specifically those which will directly and effectively address the needs of the sector itself, the students and their families. Copies of which will be furnished by the Sanggunian Panlungsod’s Committee on Education;

WHEREAS, Olongapo City likewise encourages the DepEd and the CHED to visit the site http://www.sanggunian.com.ph/ periodically for further information;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the Department of Education (DepEd) and the Commission on Higher Education (CHED) to indorse the inclusion of pertinent City ordinances and resolutions in the curricula of the schools or colleges within their regulatory power in the City of Olongapo

Let copies of this Resolution be furnished the Department of Education (DepEd) and the Commission on Higher Education (CHED) for their information and action.
