RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 12
(Series of 2006)

AN ORDINANCE APPROPRIATING THE AMOUNT OF FOUR HUNDRED EIGHT THOUSAND PESOS (PHP408,000.00) AS SEED MONEY FOR THE OPERATION OF KBG ROLLING STORE CHARGEABLE AGAINST THE PAGCOR FUND

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of Four Hundred Eight Thousand Pesos (PhP408,000.00) is hereby appropriated as seed money for the operation of KBG Rolling Store chargeable against the PAGCOR Fund.

SECTION 2. This appropriation Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter request of Honorable James Gordon, Jr. dated February 06, 2006 and a Certificate of Availability of Funds dated February 15, 2006 issued by Mr. Marcelino D. Andawi, City Treasurer are hereby made as integral parts of this Ordinance.

SECTION 4. This Ordinance shall take effect upon its approval.

WHEREAS, under Republic Act (RA) No. 3456 (Internal Auditing Act of 1962), as amended by RA No. 4177, there shall be created, organized and operated in all government agencies an Internal Audit Service (IAS) which shall assist the management to achieve efficient and effective fiscal administration and performance of agency affairs and functions;

WHEREAS, on March 29, 1989, Administrative Order (AO) No. 119 was issued, mandating government entities to strengthen its internal control systems and/or organize systems and procedures to that effect in coordination with the Department of Budget and Management (DBM);

WHEREAS, on April 14, 2003, AO No. 70 was issued mandating all heads of government agencies, GOCCs, GFIs, SUCs and LGUs to immediately organize an IAS in their respective offices, which shall function in accordance with the policies established by the provisions of RA No. 3456, as amended by RA No. 4177;

WHEREAS, on March 22, 2004, DBM Budget Circular No. 2004-4 was issued providing the guidelines on the organization and staffing of Internal Auditing Units (IAUs);

WHEREAS, the City Government deems that it is in the best interest of the City that a separate Internal Auditing Unit be created to maintain its independence, objectivity and integrity;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 11
(Series of 2006)

AN ORDINANCE CREATING THE CITY INTERNAL AUDITING UNIT


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The City Internal Auditing Unit is hereby created whose functions shall be as follows:

1. Appraisal of procedures and related matters, including expressing an opinion as to the efficiency or adequacy of existing procedures and appraising personnel efficiency;
2. Verification and analysis of financial and operations data to ascertain if attendant management information systems generate data or reports that are complete, accurate and valid;
3. Perform activities to verify the extent of compliance to laws, rules, regulations and standard procedures, such as but not limited to: (a) determining that accounting procedures or other policies are being followed, (b) operating procedures are being properly implemented, (c) governmental regulations are being complied with, (d) performance targets are being achieved, and (e) other contractual obligations are being met;
4. Conduct audits of a protective nature, such as prevention and detection of fraud or dishonesty, review of cases involving misuse of the city government’s properties, and checking of transactions with outside parties; and
5. Carry out other related services, including special investigations and assistance to outside contacts such as the COA.


SECTION 2. The Chief Internal Auditor (CIA), being the head of this office, shall be under and report directly to the City Mayor. The organizational structure of this unit is hereby created as follows:

The Personnel Office shall be responsible in the formulation of the job descriptions of each item in the organizational structure. Their salary grades shall also be determined after further consultations had been finalized.

SECTION 3. For the effective implementation of this ordinance, an amount to be later determined by the City Budget Office shall be appropriated under a Supplemental Budget from the Office of the City Mayor for the calendar year 2006.

SECTION 4. This Ordinance shall take effect upon its approval subject to existing government accounting and auditing rules and procedures.

WHEREAS, Republic Act No. 7160, otherwise known as “The Local Government Code of the Philippines” empowers the City Government to impose supervisory, regulatory, application, processing and monitoring fees to defray the expenses of the government;

WHEREAS, with the steady increase in fuel prices, the city finds it necessary to impose fees for motorcades, defined here as a procession of three or more persons using motor vehicles with intent of attracting public attention thereby creating a situation that may disrupt the normal flow of traffic;

WHEREAS, a public hearing was held last June 28, 2005 at the Sangguniang Panlungsod Session Hall for the said purpose;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 10

AN ORDINANCE PRESCRIBING RATES FOR MOTORCADES FOR COMMERCIAL AND PROMOTION OF PRODUCTS AND SERVICES

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:


SECTION 1. IMPOSITION OF RATES/FEES FOR MOTORCADES

1.1 City proper excluding New Cabalan and Bo. Barretto P250/hour
with minimum of P 500.00

1.2 City proper including New Cabalan and Bo. Barretto P250/hour
with minimum of P 1,000.00

SECTION 2. GUIDELINES

2.1.1 Application must be filed at least one week before the said motorcade
2.1.2 The route and exact start and completion time of the said motorcade must be specified in the application of the permit
2.1.3 Upon payment of fees, the Traffic Management Board must be furnished a copy of the application with specified route for verification and other recommendation/revision that they may find necessary.
2.1.4 The TMB upon receipt of the permit, must submit with-in twenty-four hours their recommendations, revisions, oppositions and/or endorsement to the City Mayor

SECTION 3. EXEMPTION FROM PAYMENT

3.1 Local and National Government Agencies, Private and Public Educational Institutions and accredited NGO’s maybe exempted from payment of fees provided they secure a Mayor’s permit.
3.2 Since the said measure is for commercial purposes, explicitly, funeral corteges, churches and charitable institutions are likewise exempted provided also that they secure Mayor’s Permit.

SECTION 4. PENALTY

Five Thousand Pesos (PhP5,000.00) is prescribed for violators thereof.

SECTION 5. REPEALING CLAUSE

All ordinances, rules and regulations, or part thereof, in conflict with, or inconsistent with any provision of this Ordinance are hereby repealed and modified accordingly.

SECTION 6. This Ordinance shall take effect after posting requirement are complied with.

A RESOLUTION APPROVING THE KALAKAL AT BIGASAN NI GORDON (KBG) AS ONE OF THE PRIORITY PROJECTS OF THE CITY


WHEREAS, these present times, prices of basic household goods soar up that low-income families in depressed areas could hardly afford to buy:

WHEREAS, the plight of those who are living in far-flung barangays are even more difficult since they have limited access or no access at all to avail of basic commodities which are exactly cost-effective;

WHEREAS, on January 11, 2006, the KBG Rolling Store, a program aimed to sell NFA and other cheaper varieties of rice and other basic commodities, was inaugurated. The said store on wheels will reach out depressed communities with basic necessities at a lower cost within the range of a common budget;

WHEREAS, the said project is one of the best ways to address the needs of the Olongapo constituents that are fundamental to the improvement of their living condition;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to approve, as it hereby approves the Kalakal at Bigasan ni Gordon (KBG) as one of the priority projects of the City.

A RESOLUTION EXPRESSING SUPPORT TO THE UNDERTAKINGS
OF HANJIN HEAVY INDUSTRIES AND CONSTRUCTION CO., LTD. (HHICC)

WHEREAS, Hanjin Heavy Industries and Construction Co., LTD. (HHIC) signed a land lease agreement with the Subic Bay Metropolitan Authority (SBMA) for the construction and operation of a shipyard at the Subic Bay Freeport Zone;

WHEREAS, the company also committed to pour in about $1 Billion over the next year in a steel structure fabrication yard at the 230-hectare land covered by the abovesaid lease agreement;

WHEREAS, the said Korean investment is expected to boost economic activity at the country’s premiere freeport zone and generate 30,000 to 40,000 jobs;

WHEREAS, the City is positive that its constituents will the first beneficiaries of such a kind of investor confidence accorded by the Hanjin, to the country in general and the Subic Bay Freeport Zone with its neighbors in particular;

WHEREAS, the City looks forward to the rippling effects of this undertaking, the strengthening of partnerships, wider business opportunities and renewed socio-economic stamina to the further improvement of the quality of lives of the Olongapeños;

NOW, THEREFORE, upon the unanimous accord of the members of Sangguniang Panlungsod present;

RESOLUTION NO. 32

A RESOLUTION REQUESTING THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO REBUILD THE OLONGAPO CITY LIGHTHOUSE (PAROLA) AT BARANGAY KALAKLAN


WHEREAS, the Olongapo Lighthouse (Parola) at Barangay Kalaklan had long stood as a historical landmark and as a silent witness of the City’s developments;

WHEREAS, during the U.S. Naval Base times, the said lighthouse provided light for ships, aircraft carriers and other sea vessels for them to stay their courses and as such mitigated them from the perils of the sea;

WHEREAS, the City endeavors that this permanent structure be rebuilt to restore its historicity and be part of the tourism “come-ons” of both the Subic Bay Freeport Zone as host to the former U.S. Naval Base and the City as well;

WHEREAS, in the spate that the SBMA also pursues earnest developments as home to a bustling seaport, a rebuilt lighthouse at Kalaklan will serve as the best reference point since it existed and is recognized in international navigational maps and nautical charts long before;

WHEREAS, with the steadfast partnership between the Subic Bay Metropolitan Authority (SBMA) and the City had shared in various undertakings, the leadership of Olongapo deems it best to request the SBMA to rebuild the said lighthouse for further eco-tourism endeavors ;

WHEREAS, Mr. Ernesto Velasquez Dela Cruz peacefully joined his creator at the age of 71;

WHEREAS, “Kuya Ding” will always be remembered as an energetic individual, who is passionate to his work as a base employee, affectionate and responsible as the head of the family and a concerned brother to his church mates and his community;

WHEREAS, our Brother Ding will surely be missed by his former colleagues for his generosity, cheerful and loving ways that build in them a solid encouraging relationship;

WHEREAS, his high spirits of leadership and service has marked not only to the people he worked with but also with the entities where he has shown his productive skills such as in the Ship Repair Facilities at the former US Naval Base, the Olongapo City Water District, Boy Scouts of the Philippines, in his Church and so many civic activities aimed to reach the needy;

WHEREAS, his wife and children will never forget his profound commitment to prioritize the welfare of his family and those people who need help and care the most;

A RESOLUTION AFFIRMING THE MEMBERSHIP OF DR. RESTITUTO C. ACOSTA ON THE BOARD OF TRUSTEES OF THE GORDON COLLEGE

WHEREAS, Ordinance No. 9, Series of 1999, creating the Gordon College formerly known as Olongapo City Colleges was passed, providing the said institution the mandate to provide total academic quality and excellent education for the people of Olongapo;

WHEREAS, this responsibility is carried out mainly by the School’s Board of Trustees, who comprise the best qualified people with the academic and technical expertise in formulating the best policies and decisions that would lead to the attainment of mission and vision;

WHEREAS, Dr. Restituto C. Acosta was nominated by no less than the City Mayor, Hon. James Gordon, Jr. for membership on the Board of Trustees of the said college;

WHEREAS, Dr. Acosta holds the degree of Doctor of Medicine from Far Eastern University, Manila. He is currently affiliated as a Consultant of the Subic Bay Medical Center in Subic Bay Freeport, Mother and Child, St. Jude and James L. Gordon Memorial Hospitals. He has attended various post-graduate courses as well as international annual congress/conferences. His vast medical experience in the field of Dermatology has made him a sought after lecturer by multi-national pharmaceutical companies;

WHEREAS, his continuing desire for advancement of knowledge through education and practice of profession, further improves his chosen craft and as such is an important asset for his membership in a College’s Board of Trustees;

A RESOLUTION REQUESTING THOROUGH INVESTIGATION FOR THE OPENING OF THE GATES OF THE JAIL AT BARRETTO POLICE STATION BY WENG QUEJADA


WHEREAS, the Olongapo City Government has painstakingly exerted efforts to maintain peace and order over its territorial jurisdiction;

WHEREAS, the Philippine National Police and the Olongapo City Government have been partners and acted in concert to reduce crime rate and enjoy resident-confidence among its constituents;

WHEREAS, the aforementioned arms of government condemn any act or acts tending to abet or condoning criminal activities in its locality and are staunch advocates of good governance, truth, justice, fair play and respect for dignity of each and every citizen;

WHEREAS, it has been established that an alleged drug pusher en route to the province of Zambales has been apprehended and is detained at the Barretto Police Station headed by its station commander P/Insp. Bolina;

WHEREAS, Representative Milagros Magsaysay suddenly barged into the Barretto Police Station last 18 February 2006, where the said drug pushers were detained, hurling clearly unfounded and baseless accusations, invectives and conjectures against P/Insp Bolina and Olongapo City Police Director Florencio Buentipo;

WHEREAS, said congress personality further foments and condones the act of her staff, Weng Quejada, who committed a crime of willfully, intentionally and feloniously opening the gates of the jail at the Barretto Police Station;

WHEREAS, the Subic Bay Metropolitan Authority has goods, materials and equipment stored at the SBMA Warehouse which are deteriorating and will be better off donated to Olongapo City Government for distribution and beneficial use of its residents;
