RESOLUTION NO. 101
(Series of 2005)

A RESOLUTION AUTHORIZING THE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH DKT PHILIPPINES, INC. FOR THE REPRODUCTIVE HEALTH PROJECT OF THE UNITED NATIONS FAMILY PLANNING ACTION (UNFPA)

WHEREAS, the Reproductive Health Project consisting of HIV/AIDS/STD prevention and control, and family planning, form part of the UNFPA-funded Annual Work Plan (AWP) under the 6th Country Programme of Assistance to the Government of the Philippines;

WHEREAS, a Letter of Understanding (LOU) was signed between the City of Olongapo, referred to as the implementing partner, represented by the City Mayor James Gordon, Jr., and The United Nations Population Fund, referred to as UNFPA, for the implementation of the UNFPA-funded AWP;

WHEREAS, UNFPA has a prior agreement with DKT PHILIPPINES, INC., a non-profit, non-governmental organization, to grant the City of Olongapo Twenty-Five Thousand (PhP25,000) Pesos worth of contraceptives, funded by UNFPA, to be used for the implementation of the UNFPA Reproductive Health Projects in the city;

WHEREAS, under the franchise agreement with DKT, said supplies purchased at lower unit cost will be sold by the city at the suggested retail price. Profit will be used as the operational fund for the DKT franchise shop called POP SHOP to be run by the City Government;

WHEREAS, this agreement is in preparation for the eventual phase-out of the Department of Health contraceptives supplies to local government units;

NOW, THEREFORE, on motion of Councilor Angelina B. Andrada, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor James Gordon, Jr. to Enter Into A Memorandum Of Agreement With DKT Philippines, Inc. For The Reproductive Health Project Of The United Nations Family Planning Action (UNFPA)

In the interest of public service and on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to ratify, as it hereby ratifies the Addendum to the Original Contract for Janitorial Services from the period August 1-31, 2005 with Subic Bay Workers/Volunteer Multi-Purpose Cooperative, Inc. (SBWVMPCI).

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the signed contract be made as an integral part of this Resolution.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF
BARANGAY OLD CABALAN, CITY OF OLONGAPO
FOR CALENDAR YEAR 2005


On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Old Cabalan, City of Olongapo for the Calendar Year 2005 considering that the budget as contained in Barangay Resolution No. 4, Series of 2005 of Barangay Old Cabalan, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of August 1, 2005 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

RESOLUTION NO. 98

A RESOLUTION EXPRESSING PROFOUND SYMPATHIES AND CONDOLENCES TO THE BEREAVED FAMILY OF FORMER
BRGY. CAPT. EDGAR S. JOHNSON OF WEST TAPINAC, THIS CITY


WHEREAS, Mr. Edgar Sarmiento Johnson born on September 19, 1939 peacefully joined his creator on August 11, 2005 at the age of 65;

WHEREAS, his family recalls his sunny disposition and how he was adored for his cheerful, loving and caring ways as a responsible family man;

WHEREAS, his brothers in the Mason-Lincoln Lodge # 34 remember him for his distinctive jolly and well-mannered behavior;

WHEREAS, in his early years, he chose to work as a Jyro Instrumental Technician in an Oil Refining Company in Kuwait and Oman to support his family needs specially the education of his 4 children;

WHEREAS, he has been called for public service and successfully earned the respect and trust of his people where he was elected twice as a Barangay Councilor and hit the landslide vote as a Barangay Captain for two consecutive terms;

WHEREAS, in 1999, his health started to deteriorate as he suffered several strokes that kept him bedridden. He was unable to finish his term of office because of this condition;

WHEREAS, in his tenure as a public servant, he notably achieved a lot of accomplishments in his jurisdiction such as the installation of street lights, the concreting of drainages and streets and drew people closer to the services of the government;

WHEREAS, the people of Olongapo hereby recall his steadfast public service to his endeavors and recognize the contributions of the late Brgy. Captain Edgar Sarmiento Johnson which the City Government and its people are grateful of. The City joins his family in this moment of grief;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

WHEREAS, she exemplified a life committed to community service as a Barangay Kagawad, Balikatan President from 1989 to 2002, and one of the thousands of volunteers who helped transform the former U.S. Naval Base into a bustling Freeport;

WHEREAS, the City recognizes the contributions of the late Councilwoman Rieza and joins her family in this moment of grief;

A RESOLUTION APPROVING THE REQUEST OF BARANGAY PAG-ASA FOR A PERMIT TO OPERATE A MINI FAIR FROM
AUGUST 15 UP TO SEPTEMBER 30, 2005 IN CELEBRATION
OF THEIR BARANGAY FIESTA


WHEREAS, carnivals and mini-fairs established in conjunction with fiestas are good income generating means to fund projects of good causes;

WHEREAS, Barangay Pag-asa, one of the barangays that will celebrate their fiesta this month, requested the Sangguniang Panlungsod permission to operate a mini fair in connection with their barangay fiesta as a fund raising activity for various projects;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Pag-asa and deems that the setting up of a mini fair on August 15 up to September 30, 2005 is in accordance with the provisions of Ordinance 49, Series of 2005;

A RESOLUTION APPROVING THE REQUEST OF BARANGAY OLD CABALAN FOR A PERMIT TO OPERATE A MINI FAIR FROM
AUGUST 15 UP TO SEPTEMBER 30, 2005 IN CELEBRATION
OF THEIR BARANGAY FIESTA


WHEREAS, the existence of fiestas draw out the kindred spirit and creativity of Filipinos as they present various fun fare and merry making activities;

WHEREAS, carnivals and mini-fairs established in conjunction with fiestas are good income generating means to fund various projects;

WHEREAS, Barangay Old Cabalan passed Resolution 6, Series of 2005 which seeks to request a permit to operate a mini fair in connection with their barangay fiesta as well as generate funds for projects to be identified later by the Barangay officialdom;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Old Cabalan and deems that the setting up of a mini fair on August 15 up to September 30, 2005 is in accordance with the provisions of Ordinance 49, Series of 2005;

A RESOLUTION APPROVING THE REQUEST OF BARANGAY ASINAN TO OPERATE A MINI FAIR WITHIN THEIR JURISDICTION FROM
AUGUST 15 UP TO SEPTEMBER 30, 2005


WHEREAS, barangays of the City considers the establishment of mini fairs as potent source of funding for their projects;

WHEREAS, Barangay Asinan passed Resolution 010, Series of 2005 which seeks reconsideration and approval for their request to operate a mini fair in order to generate funds for the repainting of their Barangay Hall as well as the repair of its second floor;

WHEREAS, the Sangguniang Panlungsod hereby grants the request of Barangay Asinan and deems that the setting up of a mini fair on August 15 up to September 30, 2005 is in accordance with the provisions of Ordinance 49, Series of 2005;

A RESOLUTION INDORSING THE PETITION LETTER OF THE EJECTED AND DEMOLISHED RESIDENTS OF PUROK 7, OLD CABALAN,
THIS CITY DATED AUGUST 3, 2005.


WHEREAS, residents of Purok 7, New Cabalan, this city wrote the Hon. Rolen C. Paulino, City Vice Mayor dated August 3, 2005 seeking audience and assistance for their alleged untimely ejectment and demolition of their homes at Purok 7, New Cabalan, Olongapo City on August 2, 2005;

WHEREAS, the same affected people appealed to the Members of the City Council during the Regular Session on August 3, 2005, to air their plea and to ask assistance with regard to their relocation;

WHEREAS, the Sangguniang Panlungsod believes that the law clearly separates the legislative and judiciary powers. However, this event calls for the protection of social rights and immediate assistance to the affected people who are the very constituents the Members of the Sangguniang Panlungsod had sworn to serve;

WHEREAS, Article XIII, Section 10 of the Philippine Constitution as quoted, “Urban and rural people dwellers shall not be evicted nor their dwellings demolished, except in accordance with law and in a just and human manner. No resettlement of urban and rural dwellers shall be undertaken without adequate consultation with them and the communities where they are to be located”.

WHEREAS, the Legislative Body deemed it proper to indorse the said Petition Letter to the Executive Branch for their information and action.

NOW THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

WHEREAS, as the legislative arm of the City, the Sangguniang Panlungsod believes that its bedrock foundation should be fortified with teamwork, camaraderie and cooperation amongst its Members and staff ;

WHEREAS, when these bond of unique individuals discover their designs and respond in accordance to their purposes in the organization, the Sangguniang Panlungsod will attain its optimum growth;

WHEREAS, holding on to this proven postulate, the Sangguniang Panlungsod conducted a Teambuilding Seminar Workshop on June 24 to 26, 2005 at Fontana Resort, Clark Field, Pampanga;

WHEREAS, the event was packed with powerful messages about the core values of the organization, communication levels and human management incorporated with unpredictable and exciting group dynamics and heartwarming choruses. These all were made possible through the skills, humor and creativity of Dr. John James A. Larafoster and Mr. Elmer M. Madriaga, who unselfishly shared unique and lifechanging insights toward building the Sanggunian as a team;

WHEREAS, Dr. Larafoster’s energy, wit and humor made the subject matters delightfully penetrating. He presented important conscious razing precepts, hammered down and drove the behavioral changes we seek to catalyze our development as a team;

WHEREAS, on the other hand, the sessions spearheaded by Mr. Elmer M. Madriaga provided relevant, timely and motivational lessons which led us to deeper introspection and kept us focused and captivated;

WHEREAS, the Sangguniang Panlungsod expresses its profound appreciation and gratitude for their efforts and enthusiasm in leading the said momentous event of bonding. This will indeed remain an experience indelibly etched in the hearts of the SP Members and staff;

RESOLUTION NO. 74
(Series of 2005)

A RESOLUTION REQUESTING THE CITY MAYOR TO GRANT EDUCATIONAL ASSISTANCE FOR THE YEAR 2005 TO THE PERSONNEL OF OLONGAPO CITY GOVERNMENT SUBJECT TO THE LIMITATION PROVIDED UNDER BUDGET CIRCULAR NO. 2005-3


WHEREAS, Administrative Order No. 126 dated June 7, 2005 was issued authorizing the grant of Educational Assistance as a one-time financial aid to government personnel for the FY 2005 in recognition of their contributions in providing quality service despite the government’s austerity measures and to help their families up with the rising cost of education;

WHEREAS, with the recent opening of classes for the year 2005, parents of students had to face the enormous economic hardships due to the incessant increase of prices of basic commodities and necessities such as the sending of children to school;

WHEREAS, due to the high cost of education and with the increase of school tuition, educational supplies and the recent implementation of fare increase of transportation, parents can no longer cope up with the meager income that the family receives;

WHEREAS, with the granting of One Thousand Pesos (PhP1,000.00) educational assistance for government employees, this will serve as a big welcome relief for them to help augment the expenses on the schooling of their children;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the City Mayor to grant Educational Assistance for the year 2005 to the personnel of Olongapo City Government subject to the limitation provided under Budget Circular No. 2005-3.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that Budget Circular No. 2005-3 be attached to this Resolution.
