A RESOLUTION AUTHORIZING THE CITY MAYOR TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH KABISIG NG KALAHI AND DEPARTMENT OF SOCIAL WELFARE & DEVELOPMENT AND SUPPLEMENTAL FEEDING GROUP REGARDING THE SUPPLEMENTAL FEEDING PROGRAM

WHEREAS, health maintenance starts with proper and adequate nourishment of the body;

WHEREAS, the inevitable rise in the cost of living, the spread of poverty and the social neglect of many directly affect the rise of malnutrition, particularly in children;

WHEREAS, the City Government of Olongapo recognizes the importance of the health of its human resource particularly the children, and the eradication of malnutrition for economic growth and development;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, co-sponsored by Councilor Angelina B. Andrada with the unanimous accord of the Members of the Sanggunian Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor To Enter Into A Memorandum Of Agreement With Kabisig Ng Kalahi And Department Of Social Welfare & Development And Supplemental Feeding Group Regarding The Supplemental Feeding Program.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF
BARANGAY STA RITA, CITY OF OLONGAPO
FOR CALENDAR YEAR 2005


On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Sta. Rita, City of Olongapo for the Calendar Year 2005 considering that the budget as contained in Barangay Resolution No. 06, Series of 2005 of Barangay Sta. Rita, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of May 16, 2005 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

RESOLUTION NO. 66

A RESOLUTION SUPPORTING AND ADOPTING NAGA CITY COUNCIL RESOLUTION NO. 2005-150, OPPOSING THE PASSAGE OF JOINT HOUSE RESOLUTION NO. 1


WHEREAS, pending before the Senate of the Philippines is House Resolution No. 1 which sought exemption for 23 towns for the new requirements for cityhood, embodied in Republic Act 9009;

WHEREAS, the said law, wisely enacted by Congress is aimed to respond to the advocacy of the League of Cities of the Philippines against unwarranted, runaway conversion that threatens the viability of existing cities;

WHEREAS, it can be noted that through the said conversion, municipalities registered a heftier gain as they receive major Internal Revenue Allotment (IRA) increase while cities lose heavily and bear heavier burdens amidst a deteriorating economy;

WHEREAS, the need for the Senate of the Philippines to hold in abeyance House Resolution No. 1 is imperative as well as the review of the sharing scheme of the IRA under the Local Government Code as a result of the said conversion. For this, Olongapo City urges the Senate to look into this issue with utmost concern;

WHEREAS, the City Government of Olongapo joins the City Government of Naga in expressing strong opposition to House Resolution No. 1 that seeks to convert 23 municipalities into cities without the benefit of applying the new income requirement provided for in Republic Act 9009, which amended section 450 of Republic Act 7160, otherwise known as the Local Government Code of 1991;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to support, as it hereby supports and adopts Naga City Council Resolution No. 2005-150, opposing the passage of Joint House Resolution No. 1.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copy of Naga City Council Resolution No. 2005-150 be made as integral part of this Resolution.

Let copies of this Resolution be furnished the Senate of the Philippines and the House of Representatives for their information and action.

A RESOLUTION RATIFYING THE CONTRACT EXTENDING THE JANITORIAL SERVICES OF SUBIC BAY WORKERS/VOLUNTEERS MULTI-PURPOSE COOPERATIVE, INC. AND THE CITY OF OLONGAPO FROM JUNE 1 TO JULY 31, 2005


WHEREAS, for the City of Olongapo to continuously avail of the services of a competent janitorial service provider for the cleaning and maintenance of the City Hall, James L. Gordon Memorial Hospital, Gordon College, Olongapo City Convention Center, City Mall and City Museum, which is vital to the daily operations of the said structures, the City Government deems it best to extend the contract of the Subic Bay Workers/Volunteers Multi-Purpose Cooperative, Inc. from June 1 to July 31, 2005 while the City conducts public bidding;

NOW, THEREFORE, on motion of Councilor Cytnhia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to ratify, as it hereby ratifies the contract extending the janitorial services of Subic Bay Workers/Volunteers Multi-Purpose Cooperative, Inc. (SBWVMPCI) to the City of Olongapo from June 1 to July 31, 2005.

A RESOLUTION AUTHORIZING LEOPOLDO “MIKE” PUSING TO REPRESENT THE CITY OF OLONGAPO IN THE CIVIL AND CRIMINAL CASES TO BE FILED AGAINST PR LPG COMPANY AND CARLOS JALAJADO


WHEREAS, ON June 5, 2005 at around twelve o’clock (12:00) midnight a vehicular accident happened at the National Highway, Purok I, New Cabalan, Olongapo City ;

WHEREAS, the vehicular accident was caused by a wayward LPG truck with plate number NUW 378, driven by a person named CARLOS JALAJADO and owned by PR LPG COMPANY;

WHEREAS, the vehicular accident, due to the reckless imprudence of the driver and the failure of PR LPG COMPANY to exercise extraordinary diligence in the selection, supervision and discipline of its driver, caused damages to the City of Olongapo and some of its constituents;

WHEREAS, as a consequence and to protect its interest, the City deems it necessary to file civil and criminal cases against PR LPG COMPANY and its driver CARLOS JALAJADO;

WHEREAS, these civil and criminal cases to be filed against PR LPG COMPANY and CARLOS JALAJADO shall require a duly authorized representative from the City;

NOW THEREFORE, with the unanimous accord of the Members of the Sanggunian Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes LEOPOLDO “MIKE” PUSING, to represent the City of Olongapo in all stages/phases of the civil and criminal cases to be filed against PR LPG COMPANY and CARLOS JALAJADO;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that LEOPOLDO “MIKE” PUSING, is hereby authorized to appear for and on behalf of the City of Olongapo during the pre-trial of the pertinent civil case, including the power to enter into the possibility of an amicable settlement or of a submission to alternative modes of dispute resolution; the possibility of obtaining stipulations or admissions of facts and of documents to avoid unnecessary proof; and such other powers as required under Rule 18 of the Revised Rules of Civil Procedure.
