ORDINANCE NO. 14
(Series of 2005)

AN ORDINANCE APPROPRIATING THE AMOUNT OF FIVE MILLION PESOS (PHP5,000,000.00) FOR THE PURCHASE OF NECESSARY SPORTS EQUIPMENT AND OTHER INCIDENTAL EXPENSES IN CONNECTION WITH THE HOSTING OF 2006 CENTRAL LUZON REGIONAL ATHLETIC ASSOCIATION MEET ON APRIL 1-7, 2006 CHARGEABLE TO THE GENERAL FUND UNDER THE OFFICE OF THE CITY MAYOR


BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of Five Million Pesos (PhP5,000.000.00) is hereby appropriated from the Unappropriated Balance of the General Fund not otherwise appropriated and the same is hereby made available for the purchase of necessary sports equipment and other incidental expenses in connection with the hosting of 2006 Central Luzon Regional Athletic Association Meet on April 1-7, 2006 to wit:

A RESOLUTION EXPRESSING DEEPEST SYMPHATIES AND CONDOLENCES TO THE BEREAVED FAMILY OF THE LATE MILAGROS D. DEVERATURDA

WHEREAS, Ms. Milagros D. Deveraturda, Day Care Worker/Designated Social Welfare Aide in the City Social Welfare and Development Office, this City, died in God’s grace on March 19, 2006 at the age of 51;

WHEREAS, born and raised in the City of Olongapo, “Ate Mila” as she is fondly called, chose to be of service to the needy public where she began working at the City Social Welfare and Development Office in 1992;

WHEREAS, as a Day Care Worker, her motherly touch made her very effective in the performance of her function and as such she carried on the promotion of Children Welfare and Rights through her task. She extended her abilities in interacting with the deprived and depressed and managed to meet their needs. This called her to a higher position as an Acting Social Welfare Assistant and continued to give her best in assisting people who are in the midst of crisis;

WHEREAS, the City Government of Olongapo and the people she served, join the family of the late Ms. Milagros D. Deveraturda in this time of grief and recognizes her invaluable contributions and dedicated service to the community;

NOW THEREFORE, upon the unanimous accord of the Members of the Sangguniang Panlungsod present,

WHEREAS, Elmer Albanel Dineros, Purok Leader, Purok 2, Brgy. Sta. Rita, Olongapo City, died in line of service on March 09, 2006 at the age of 70;

WHEREAS, Purok Dineros will always be remembered as a man who devoted his life for the welfare of Purok 2, Brgy. Sta. Rita, where he spent untarnished years of dedicated service as a barangay servant. He worked with five (5) barangay administrations from 1973 up to the present where he exemplified loyalty and cooperation;

WHEREAS, as Purok Leader he showed a special and meaningful concern for the welfare and interest of the barangay constituents and treat them with utmost gladness;

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay East Tapinac, City of Olongapo for the Calendar Year 2006 considering that the budget as contained in Barangay Resolution No. 33, Series of 2005 of Barangay East Tapinac, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of March 08, 2006 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay West Tapinac, City of Olongapo for the Calendar Year 2006 considering that the budget as contained in Barangay Resolution No. 09, Series of 2005 of Barangay West Tapinac, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of March 08, 2006 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

A RESOLUTION RATIFYING THE DEED OF SALE ENTERED INTO BY AND BETWEEN THE CITY GOVERNMENT OF OLONGAPO REPRESENTED BY CITY MAYOR, HONORABLE JAMES GORDON JR. AND MICROVAN, INC. REPRESENTED BY ITS PRESIDENT, MR. MARIANO SONON REGARDING THE PURCHASE OF ONE (1) BULLDOZER


WHEREAS, on his letter dated 30 September 2005, Mr. Dante Ramos, head of the Environmental Sanitation and Management Office of the City, reiterated the need to address the garbage collection problem in the City, through the procurement of necessary dump trucks and equipment;

WHEREAS, out of the ten compactors, only four remain operational, while three (3) dump trucks, one (1) elf truck and the lone bulldozer have already broken down and are beyond economical repair. The lack of serviceable equipment to provide optimum collection efficiency resulted to the delay of collection of garbage, with the exposure thereof posed serious hazard to the environment;

WHEREAS, the City deems that the procurement of equipment such as dump trucks and bulldozer is indispensable. While the deeds of sale of the dump trucks had been previously ratified, that of the bulldozer had been inadvertently overlooked;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the majority decision of the Members of the Sangguniang Panlungsod present,

A RESOLUTION SUPERSEDING RESOLUTION 134, SERIES OF 2005, “A RESOLUTION AUTHORIZING THE CITY MAYOR TO PURCHASE DUMP TRUCKS FOR THE ENVIRONMENTAL SANITATION AND MANAGEMENT OFFICE (ESMO)” TO INCLUDE THE PURCHASE OF ONE (1) BULLDOZER

WHEREAS, there is a need to procure garbage trucks and bulldozer to replace the compactor trucks and other equipment used in the regular collection of garbage. The said compactor trucks and other equipment have already broken down and were rendered unserviceable;

WHEREAS, in order to maintain the efficiency of the operation and avoid delays in the collection of garbage as well as the maintenance of the landfill area, it is an urgent matter to acquire new dump trucks and one (1) bulldozer for the use of ESMO;

WHEREAS, Resolution No. 134, Series of 2005, authorizes the City Mayor to purchase garbage dump trucks for the ESMO. However, the inclusion of one (1) bulldozer was inadvertently overlooked;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled, to supersede as it hereby supersedes Resolution 134, Series Of 2005, “A Resolution Authorizing The City Mayor To Purchase Dump Trucks For The Environmental Sanitation And Management Office (ESMO)” To Include The Purchase Of One (1) Bulldozer;

A RESOLUTION STRONGLY SUPPORTING THE STRICT COMPLIANCE WITH
THE PROVISIONS OF REPUBLIC ACT 9257 OTHERWISE KNOWN AS “THE EXPANDED SENIOR CITIZENS ACT OF 2003”


WHEREAS, Republic Act 7432 otherwise known as “Act to Maximize the Contributions of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and For Other Purposes enacted in 1994 was an integrated and comprehensive approach to address the needs and concerns of the elderly in our community as stated under our constitution;

WHEREAS, Olongapo City Ordinance No. 3, Series of 1996 entitled,” An Ordinance Making It Punishable For Any Establishment, Service Utility and Private or Public Institution Who Refuses to Grant The Privileges and Benefits Due Senior Citizens as Provided For Under R.A. 7432” was passed to deter non-compliance after several complaints from senior citizens;

WHEREAS, R.A. 9257 otherwise known as “The Expanded Senior Citizens Act of 2003” or “An Act Granting Additional Benefits and Privileges To Senior Citizens Amending For The Purpose R.A. 7432” was enacted in 2003;

WHEREAS, Section 4 of R.A. 9257 states the privileges for senior citizens and its application is under the guidelines on Rule V of the Implementing Rules & Regulations of R.A. 9257 and by the DOH Administrative Order No.177, series of 2004;

WHEREAS, due to the growing number of complaints from senior citizens, there is a need to reiterate strict compliance to R.A. 9257 to those mandated by law;

NOW, THEREFORE, on motion of Councilor Angelina B. Andrada, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

WHEREAS, Ms. Jackie Rice, a 15 year old “Batang Gapo” from Gordon Heights made it with flying colors to the Star Struck – The Nationwide Invasion and won as its The Ultimate Female Survivor in the Final Judgment held on March 12, 2006 at the Marikina Sports Center;

WHEREAS, this multi-talented and brilliant young lady has raised the big flag of Olongapeños and brought pride and prestige to the City by revealing the star potentials of its youth;

WHEREAS, during the live simulcast of its Judgment Day, twenty five thousand (25,000) people personally witnessed how Ms. Rice honored the City by presenting it as the Mardi Gras Capital of the Philippines, thus, promoting the rave spirits of festivity and merrymaking. the City is known for;

WHEREAS, Ms. Rice has shown the best of her star quality in the 3-months competition and successfully gained her throne along with PhP1 Million Cash Prize and PhP2 Million worth of exclusive contract at the GMA 7 Network, a package that will surely pave way to a more blossoming television career;

WHEREAS, Jackie made an astounding difference at her fresh and young age having accomplished the various challenges of the quest with a positive attitude. RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay New Ilalim, City of Olongapo for the Calendar Year 2006 considering that the budget as contained in Barangay Resolution No. 013, Series of 2005 of Barangay New Ilalim, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of March 08, 2006 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

A RESOLUTION LIFTING THE PROHIBITION OF THE OLONGAPO CITY GOVERNMENT EMPLOYEES’ MULTI-PURPOSE COOPERATIVE, INCORPORATED (OCGEMPCI) TO SUBLEASE DRIFTWOOD BEACH SUBJECT TO A MEMORADUM OF AGREEMENT BETWEEN THE COOPERATIVE AND THE CITY MAYOR AND CONFIRMATION OF
A SANGGUNIANG PANLUNGSOD RESOLUTION


WHEREAS, Resolution No. 80, Series of 2002 authorized the Olongapo City Government Employees’ Multi-Purpose Cooperative, Inc. to exclusively manage and operate Driftwood Beach located at Brgy. Barretto, Olongapo City;

WHEREAS, Paragraph 4 of the said Resolution prohibits the said Cooperative to sublease the said Beach to any other person, organization or entity;

WHEREAS, the Driftwood Beach’s potential tourism call can be attributed to its core location that can offer prime sports and leisure activities requiring bigger investments and business ventures to further increase its marketability, promotion and profitability;

WHEREAS, with the limited investment of the Cooperative, it is deemed favorable and advantageous to invite prospective investors and developers to negotiate a sublease/development agreement that will bring further improvements to the said area to increase its viability and enhance its competitiveness in the tourism arena;

WHEREAS, a Memorandum of Agreement pertaining to the Sublease of the Driftwood Beach mutually advantageous to the City Government of Olongapo and the Olongapo City Government Employees’ Multi-Purpose Cooperative, Inc. must be forged and entered into by both parties and be confirmed/ratified by the Members of the City Council to legally bind its provisions;

A RESOLUTION REQUESTING HER EXCELLENCY GLORIA MACAPAGAL-ARROYO, PRESIDENT OF THE REPUBLIC OF THE PHILIPPINES THROUGH THE JUDICIAL AND BAR COUNCIL TO FILL IN THE VACANT POSITION OF PRESIDING JUDGE AT THE MUNICIPAL TRIAL COURT IN CITIES (MTCC) BRANCH 4, OLONGAPO CITY


WHEREAS, Section 9, Article VIII of the 1987 Constitution provides for the process of appointment in the judiciary to wit:

“The members of the Supreme Court and judges of the lower courts shall be appointed by the President from a list of at least three nominees prepared by the Judicial and Bar Council for every vacancy. Such appointments need no confirmation.”

For the lower courts, the President shall issue the appointment within ninety days from submission of the list”;

WHEREAS, there are five (5) branches of Municipal Trial Court in Cities in Olongapo City (MTCC Branch 1 to 5);

WHEREAS, out of the five branches, MTCC Branch IV has no permanent presiding judge to hear, try and decide cases pending before it;

WHEREAS, data will reveal that as early as January 2003 up to December 2005 the total number of cases filed are as follows:

“Criminal Cases 3,344 cases”
“Civil Cases 626 cases”
“MTCC Brgy. Cases 31 cases”;

WHEREAS, the cases of our court litigants pending before MTCC Branch IV Olongapo City has dragged for quite some time for lack of presiding judge or has been rendered moot and academic for delay in the resolution thereof;

WHEREAS, many of the court litigants are detention prioners who are likewise entitled to have speedy, impartial and public trial;

WHEREAS, adherence to the doctrine “justice delay justice deny” shall be recognized taking into account the continuous failure to administer justice;

NOW, THEREFORE, upon motion of Councilor Noel Y. Atienza with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled, to request as it is hereby requests, Her Excellency Gloria Macapagal-Arroyo, President Of The Republic Of The Philippines Through The Judicial And Bar Council To Fill In The Vacant Position Of Presiding Judge At The Municipal Trial Court In Cities (MTCC) Branch 4, Olongapo City.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of the letter of Alexander C. Rimando, Clerk of Court IV, Office of the Clerk of Court, MTCC, Third Judicial Region, Olongapo City dated February 15, 2006 and letter of Atty. Alreuela M. Bundang-Ortiz, President, Integrated Bar of the Philippines, Zambales Chapter dated March 15, 2006 be made as integral parts of this Resolution.

Let copies of the foregoing resolution be furnished the Office of the President, the Judicial and Bar Council and the Supreme Court of the Philippines.
