RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 50
(Series of 2006)

AN ORDINANCE APPROPRIATING THE AMOUNT OF EIGHT HUNDRED THOUSAND SEVEN HUNDRED THIRTY PESOS (PHP800,730.00) FOR
THE DESIGN CONTRACT PROJECT OF THE PROPOSED
PEDESTRIAN BRIDGE AT ULO NG APO ROTONDA

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESION ASSEMBLED, THAT:

SECTION 1. The amount of Eight Hundred Thousand Seven Hundred Thirty Pesos (PhP800,730.00) is hereby appropriated from the Unappropriated Balance of the General Fund not otherwise appropriated and the same is hereby made available for the design contract project of the proposed pedestrian bridge at Ulo ng Apo Rotonda.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The memorandum of Engineer Narciso L. Martinez, Jr. Assistant City Engineer, OIC, dated September 22, 2006, Conceptual Plan of the Proposed Pedestrian Bridge at Ulo ng Apo Rotonda and a Certificate of Availability of Funds dated September 12, 2006 issued by Mr. Marcelino D. Andawi, City Treasurer are hereby made as integral parts of this Ordinance.

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESION ASSEMBLED, THAT:

SECTION 1. The amount of Fifty Thousand Pesos (PhP50,000.00) is hereby appropriated from the Unappropriated Balance of the General Fund not otherwise appropriated and the same is hereby made available to the item IT Equipment and Software under Capital Outlay of the Office of the City Mayor.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter request of Honorable City Mayor James Gordon, Jr., dated 14 September 2006, letter of Honorable Cynthia G. A RESOLUTION AUTHORIZING THE CITY MAYOR TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE 2006 CITY FIESTA EXECUTIVE
COMMITTEE FOR THE CARNIVAL OPERATION IN THE EAST TAPINAC OVAL TRACK AS PART OF THE FUND RAISING CAMPAIGN



WHEREAS, the City Fiesta Executive Committee is the working committee tasked by the City mayor to implement plans and organize this year’s City Fiesta activities;

WHEREAS, the East Tapinac Oval Track was one of the areas identified to be the site for the operation of the carnival, a part of the fiesta activity to generate funds for the projects of the City;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the City Mayor to enter into a Memorandum of Agreement with the 2006 City Fiesta Executive Committee for the carnival operation in the East Tapinac Oval Track as part of the fund raising campaign.

A RESOLUTION REQUESTING THE PRESIDENT OF THE REPUBLIC
OF THE PHILIPPINES FOR ADDITIONAL LOGISTICAL SUPPORT
TO MEET THE NEEDS OF GIANT FIRMS INVESTING IN
SUBIC BAY METROPOLITAN AUTHORITY


WHEREAS, the Office of the President has skillfully attracted foreign businessmen to invest in Subic Bay Metropolitan Authority;

WHEREAS, these foreign investors, HANJIN and COGEN among others, rely on Subic Bay Metropolitan Authority and Olongapo City for the needed manpower for the conduct and operation of its business venture;

WHEREAS, Subic Bay Metropolitan Authority and Olongapo City Government are global partners to address unemployment and underemployment thereby alleviating poverty among residents of Olongapo and ultimately address the needs of the investors;

WHEREAS, the Olongapo City Government has embarked on an ambitious project of skills training of its residents to address the issue of manpower requirement of these gigantic firms in Subic Bay Metropolitan Authority;

WHEREAS, the City Government is in need of additional logistical support to maintain and continue the welding, glass manufacturing and call center training of its residents in addition to the more than one thousand residents it has trained for the said business capitalists.

NOW, THEREFORE, with the unanimous accord of the Members of Sangguniang Panlungsod present;

A RESOLUTION AUTHORIZING THE 2006 OLONGAPO CITY EXECUTIVE
FIESTA COMMITTEE TO USE THE EAST TAPINAC OVAL TRACK AS PART OF THEIR FUND RAISING ACTIVITY


WHEREAS, Olongapo City is once again in the midst of an elaborate preparation for the coming fiesta celebration, where fun-filled activities have been lined up to add glitter to the festive atmosphere. Canvassing nights for the City Fiesta Queen Contest, the coronation night, Mardi Gras, parades and other exciting events are set for the said occasion;

WHEREAS, the City Fiesta Executive Committee endeavors that through the proceeds of its fund raising projects, the people of Olongapo will enjoy the benefits of the development programs identified so by the said committee;

WHEREAS, the Executive Committee deems that the East Tapinac Oval Track is the best venue for the conduct of big events such sports, concerts and other programs. As such it has been chosen for the operation of a carnival for fund raising purposes;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the 2006 Olongapo City Executive Fiesta Committee to use the East Tapinac Oval Track as part of their fund raising activity.

RESOLUTION NO. 176
(Series of 2006)

A RESOLUTION ON THE ESTABLISHMENT OF PHILIPPINE CHARITY SWEEPSTAKES OFFICE (PCSO) OF ITS SMALL TOWN LOTTERY PROJECT IN THE CITY OF OLONGAPO

WHEREAS, the City of Olongapo has been declared as a jueteng free environment due to incessant drive by the authorities against the proliferation of the illegal numbers game;

WHEREAS, as a result of this successful campaign against the illegal numbers game, a large number of residents in each barangay who used to work as “kubradors” and “cabos” have lost their source of income and livelihood;

WHEREAS, these former “kubradors” and “cabos” who were displaced by the successful eradication of the illegal numbers game may be provided with an alternative livelihood such as the Small Town Lottery (STL) which is a numbers game sanctioned by the PCSO;

WHEREAS, the operation of Small Town Lottery will augment the City’s revenue due to a certain percentage accruing the coffers of the local government which can be utilized for the purpose of realizing its various programs and projects;

WHEREAS, the establishment of STL will further enhance peace and order situation as a certain percentage will go directly to the local Philippine National Police;

WHEREAS, the institution of STL will also promote the various programs of the PCSO in its campaign to help alleviate poverty;

WHEREAS, the Liga ng mga Barangay of Olongapo City passed a Resolution requesting the Philippine Charity Sweepstakes Office (PCSO) to establish a small town lottery project in the City of Olongapo bearing in mind the benefits it will provide in the lives of the constituents;

WHEREAS, the Olongapo Business Club also passed a Resolution requesting the Philippine Charity Sweepstakes Office (PCSO) to establish a small town lottery project in the City of Olongapo which will eventually result into peaceful and orderly environs and further translate into an atmosphere conducive for business;

NOW, THEREFORE, on motion of Councilor Brian Patrick H. Gordon, co-sponsored by Councilors Cynthia G. Cajudo, Bella P. Asuncion, Angelina B. Andrada, Anselmo A. Aquino, Edwin J. Piano, Gina G. Perez and Robine Rose C. Buenafe, with the majority decision of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled to establish, as it hereby establishes the Small Town Lottery Project of the PCSO in the City of Olongapo.

RESOLUTION NO. 175
(Series of 2006)

A RESOLUTION REQUESTING THE DEPARTMENT OF THE INTERIOR
AND LOCAL GOVERNMENT (DILG) THRU ITS SECRETARY RONALDO PUNO AND THE CIVIL SERVICE COMMISSION (CSC) TO CONDUCT A LIFESTYLE CHECK ON ALL PUBLIC OFFICIALS WHETHER ELECTIVE OR APPOINTIVE AND EMPLOYEES OF OLONGAPO CITY


WHEREAS, Section 1, Article XI of the 1987 Constitution states: “Public office is a public trust. Public officers and employees must at all times be accountable to the people, serve them with utmost responsibility, integrity, loyalty and efficiency, act with patriotism and justice and lead modest lives”;

WHEREAS, Section 4, Paragraph H of Republic Act No. 6713 entitled “An act establishing a code of conduct and ethical standards for public officials and employees, to uphold the time-honored principle of public office being a public trust, granting incentives and rewards for exemplary service, enumerating prohibited acts and transaction and providing penalties for violations thereof and for other purposes” to wit: Simple living –Public officials and employees and their families shall lead modest lives appropriate to their positions and income. They shall not indulge in extravagant or ostentatious display of wealth in any form”;

WHEREAS, “a public office is a public trust created in the interest and for the benefit of the public. The officers are servants of the people and not their rulers. The trust attached to a public office should be exercised in behalf of the government or the citizens and extends to all matters within the range of the duties pertaining to the office.(22 R.C.L. 378-379);

WHEREAS, in the case of Juntilla vs. Calleja AM P-961225 September 23, 1996 decided by the Supreme Court, it was held that: “Public office is a public trust. All public officers are accountable to the people at all times. Their duties and responsibilities must be strictly performed;

WHEREAS, the Department of the Interior and Local Government is mandated for the supervision and coordination on local government units including its local elective officials and as such is authorized to conduct a lifestyle check on all elective public officials in order to determine unreasonable accumulation of assets real or personal of the same, which are not commensurate with their income derived from government service on the basis of their Statement of Assets and Liabilities;

WHEREAS, insofar as the local appointive officials and employees are concerned, the conduct of a lifestyle should be coursed to the Civil Service Commission who has jurisdiction over all employees in the public service;

WHEREAS, the City of Olongapo has been known as a city of character and dignity whose vision and mission is “fighting for excellence”

WHEREAS, in order to enforce the clear mandate of the Constitution, laws and jurisprudence, a lifestyle check should be conducted on all public officials elective or appointive and employees of the City of Olongapo by the Department of the Interior and Local Government and the Civil Service Commission respectively:

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sanguniang Panglungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the Department Of The Interior And Local Government (DILG) Thru Its Secretary Ronaldo Puno And The Civil Service Commission (CSC) To Conduct A Lifestyle Check On All Public Officials Whether Elective And Appointive And Employees Of Olongapo City.

Let copies of the foregoing resolution be furnished to the Department of Interior and Local Government and the Civil Service Commission
