RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 85
(Series of 2005)

AN ORDINANCE APPROPRIATING THE AMOUNT OF ONE HUNDRED SEVENTY NINE MILLION PESOS (PHP179,000,000.00) TO THE ITEM COST OF GOODS SOLD UNDER MAINTENANCE AND OTHER OPERATING EXPENSES OF THE PUBLIC UTILITIES DEPARTMENT

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Hundred Seventy Nine Million Pesos (PhP179,000,000.00) is hereby appropriated from the item Cost of Goods Sold under Maintenance and Other Operating Expenses for the payment of power bills to the National Power Corporation (NPC) of the Public Utilities Department (PUD).

SECTION 2. This ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter request of Honorable City Mayor James Gordon, Jr. dated 17 November 2005, letter request dated 17 October 2005 of Engr. Andawi, City Treasurer are hereby made as integral parts of this Ordinance.

ORDINANCE NO. 84
(Series of 2005)

AN ORDINANCE DECLARING MT. APO STREET, ALSO KNOWN AS 1ST STREET, AS ONE WAY STREET FROM CORNER MAGSAYSAY AVENUE TO CORNER FENDLER STREET

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Mt. Apo Street is hereby declared as one way Street from corner Magsaysay Drive to corner Fendler Street.

SECTION 2. No vehicles shall enter from Fendler Street to Magsaysay Drive.

SECTION 3. Right side facing Rizal Avenue, that portion of Mt. Apo from Magsaysay to Fendler Street is also declared as one side parking area only.

SECTION 4. Vehicles parked on the left side shall be towed and so declaring the left side as tow away zone.

SECTION 5. Violation of this Ordinance is penalized under the traffic citation system and subject to all existing rules and Ordinances, and traffic code.

SECTION 6. Any part of existing ordinance which maybe in conflict with the provisions of this Ordinance are hereby amended, repealed and modified accordingly.

ORDINANCE NO. 83
(Series of 2005)

AN ORDINANCE APPROPRIATING THE AMOUNT OF ONE MILLION FIVE HUNDRED THOUSAND PESOS (PHP1,500,000.00) TO BE TAKEN FROM THE PAGCOR FUND TO COVER THE CITY’S COUNTERPART FOR 2,500 INDIGENT FAMILIES OR A TOTAL OF 5,000 INDIGENT FAMILIES WHO WILL BENEFIT FROM THE NATIONAL HEALTH INSURANCE PROGRAM

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Million Five Hundred Thousand Pesos (PhP1,500,000.00) to be taken from the PAGCOR Fund is hereby appropriated to cover the city’s counterpart for 2,500 indigent families or a total of 5,000 indigent families who will benefit from the program.

SECTION 2. This appropriation Ordinance shall be subject to the usual accounting and auditing rules and regulations.

WHEREAS, the Olongapo City Mall Administration assessed that the temporary leasable spaces for exhibit and other purposes at the mall draw significant revenues for the past months;

WHEREAS, the City agrees that with the increase in the influx of requests for it, it is best to increase also the proposed rates thereof to further enhance the mall’s revenue generation;

AN ORDINANCE AMENDING ORDINANCE NO. 15, SERIES OF 2004 ENTITLED “AN ORDINANCE APPROVING THE PROPOSED RATES FOR TEMPORARY LEASE OF SPACES AT THE OLONGAPO CITY MALL”,
REVISING THE EXHIBIT RATES AT THE SAID MALL

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Section 1 of Ordinance No. 15, Series of 2004 entitled “An Ordinance Approving The Proposed Rates For Temporary Lease Of Spaces At The Olongapo City Mall” shall be read as :

All rentable spaces not in anyway covered by previous contracts at the Olongapo City Mall shall have the following lease rates on a period not more than six (6) months, to wit :

WHEREAS, streamers, banners and advertisements are being placed indiscriminately, wherein the city government shoulders the cost of clearing the said streamers, banners and advertisements left arbitrarily in public areas;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

SECTION 1. IMPOSITION OF RATES/FEES FOR STREAMERS

1.1 Minimum fee shall be 500
Additional if in excess of 4 sqm (per sqm) 100

1.2 Fees shall be paid to the City Treasurer’s Office upon submission of application.

SECTION 2. GUIDELINES

2.1 Duration of permit to display shall be One Month;

2.3 All streamers, banners and advertisements shall have date of display duration and permit / receipt number clearly marked.

2.4 The following shall be designated areas for streamers, banners and advertisements:
· Rizal Triangle Park;
· All Barangay covered courts;
· East Tapinac Sports Complex;
· City parks playgrounds and other duly designated public structures;
· Open and vacant spaces (designated by the Mayor’s office in coordination with the owner).

2.5 The Environmental Sanitation & Management Office (ESMO) and Public Utilities Department (PUD) shall be tasked to monitor the display of streamers and removal of the same.

SECTION 3. EXEMPTION FROM PAYMENT

Personal greeting of public officials and public announcements by accredited NGOs maybe exempted from payment of fees provided they secure a Mayor’s permit and it has no lewd or offensive contents.

SECTION 4. REPEALING CLAUSE

All ordinances, rules and regulations, or part thereof, in conflict with, or inconsistent with any provision of this Ordinance are hereby repealed and modified accordingly.

SECTION 4. This Ordinance shall take effect upon its approval

WHEREAS, the Olongapo City Mall Administrator Mr. Honorio Gomez proposed on his letter dated July 7, 2005 to the Hon. City Mayor James Gordon, Jr. to declare the Boardwalk as part of the Olongapo City Mall, where its areas are to be divided into leasable spaces with corresponding rates;

WHEREAS, the said proposal aims to raise revenues generated by the said Mall to offset the surmounting financing costs due to its operations;

WHEREAS, the said proposal was referred to the City Appraisal Committee for their evaluation and the rates were favorably endorsed for approval;

WHEREAS, the Local Finance Committee has also expressed their recommendation that Mr. Gomez’ proposal be adopted and endorsed to the City Council for legislative action;
NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo and co-sponsored by Hon. Bella P. Asuncion, Hon. Marey Beth D. Marzan, Hon. Angelina B. Andrada, Hon. Brian Patrick H. Gordon, Hon. Anselmo A. Aquino, Hon. Edwin J. Piano, Hon. Gina Perez and Hon. Robine Rose Buenafe with the majority decision of the Members of the Sangguniang Panlungsod present,

AN ORDINANCE DECLARING THE BOARDWALK AT THE CITY MALL AS PART OF THE OLONGAPO CITY MALL WHICH AREAS TO BE DIVIDED INTO LEASABLE SPACES AND APPROVING THEIR CORRESPONDING RATES



BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The Boardwalk at the City Mall is hereby declared as part of the Olongapo City Mall which certain areas are to be divided into leasable spaces and approving their corresponding rates.

SECTION 2. The City Mall Administrator shall be responsible for the management, operation, cleanliness and orderliness of the declared areas and shall ensure that fair business competition will be implemented among the City Mall Tenants.

SECTION 3. The Rental Rates for the Leasable Spaces is hereto attached as Annex “A”.

SECTION 4. The Site Development Plan is likewise attached as Annex “B”.

SECTION 5. This Ordinance shall take effect upon its approval.

WHEREAS, the issue on pornography is extremely complex, and so is the public policy governing it;

WHEREAS, in this intricacy, one issue stands out as particularly pressing and needs immediate action: the claim that pornography, or certain forms of pornography can lead to serious sex crimes, forcible rape in particular;

WHEREAS, the rampant production and publication of pornographic materials cause moral outrage and encourage sexual perversions;

WHEREAS, the number of computer cafés in the City of Olongapo is enormously increasing, making our community prone to pornography;
NOW, THEREFORE, on motion of Councilor Gina Gulanes- Perez with the unanimous accord of the Sangguniang Panlungsod present,
RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to enact the following Ordinance:

ORDINANCE NO. 79

AN ORDINANCE TO DEFINE AND PENALIZE ON-LINE PORNOGRAPHY
IN OLONGAPO CITY

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Definition of terms.

(a) Pornography – pertains to anything that depicts erotic, sexual behavior, portraying lewdness. It can be of different media, written or spoken, such as photos, sculptures, drawings, moving images and even animation sounds;
(b) On – line – is being connected to some larger network or system. Any on-line information may be accessible through the internet;
(c) On – line pornography – refers to pornography that is accessible through internet;
(d) Computer Café - is a public place where one can use computer with or without internet access for fee, usually per hour or minute. Sometimes one can have unmetered access with pass for a day or month;
(e) Minor- pertains to a person who has not reached full legal age, or is below 18 years old;
(f) Cyber sex- is a virtual sex encounter by which two or more persons connected remotely via computer network send one another sexually explicit messages describing a sexual experience. It also refers to a role-play in which participants pretend they are having sexual intercourse; and
(g) Telecommunication – is any device associated with the larger system on-line. If it is under the direct control of the system, this covers the use of cell phones as telecommunication equipment with high-tech features.

SECTION 2. Objectives.

(a) To protect children from sexual exploitation;
(b) To strictly forbid all computer cafes from publication of pornographic websites;
(c) To secure children and women from on-line prostitution;
(d) To lessen, if not totally eradicate, the number of reported cases on sex crimes; and
(e) To fully realize and uphold the goal of the City of Olongapo to be a “Child Friendly City”.

SECTION 3. Prohibition. This ordinance prohibits all computer cafés from encouraging and/or tolerating their customers, especially minors, to browse pornographic websites and to use web cam for the purpose of cyber sex. It forbids the use of telecommunication equipment and devices like high-powered cell phones with add-in features such as bluetooth, camera, video-audio, infrared, MMS, etc., for pornographic purposes. Further, this ordinance forbids all computer cafés from putting up enclosed computer cubicles. However, cubicles made of transparent glass, wherein both the user and the computer monitors are visibly seen from the outside, hence, discouraging cybersex and other acts involving on-line pornography, are exempted from the prohibition.

SECTION 4. Pornography Banning Signages. All computer cafés in Olongapo City are required to post at least one (1) legible and visible signage, English or Filipino, inside their café.

SECTION 5. Penalties. Computer cafés that will be caught violating Sections 3 and 4 of this ordinance will be penalized according to the classifications stipulated below:

SECTION 6. All Computer Cafes shall be encouraged to install software that will totally block the pornographic and obscene websites.

SECTION 7. Administration and Authority to Institute Action. The City’s Department of the Interior Local Government and PNP are primarily tasked to inspect all computer cafés in Olongapo City. Moreover, everyone is encouraged to be vigilant and to report violators to the authority. The Local Chief Executive, upon the recommendation of the aforementioned government agencies, is authorized to institute criminal proceedings against the violators of this ordinance.

SECTION 8. Repealing Clause. All existing ordinances, which are inconsistent with this Ordinance, are hereby overturned.

SECTION 9. Separability Clause. If any of the provision or part of this ordinance is declared unconstitutional or invalid, the other provisions or parts hereof not exaggerated thereof, shall continue to be in full force and effect.

SECTION 10. Effectivity. This Ordinance shall take effect thirty- (30) days upon its approval, provided that massive information dissemination thru media announcement is conducted.

SECTION 11. That copies of this Ordinance shall be furnished the City Social Welfare & Development Office (CSWDO), Department of the Interior and Local Government (DILG), Philippine National Police (PNP) and PREDA.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 78
(Series of 2005)

AN ORDINANCE AMENDING CERTAIN SECTIONS OF ORDINANCE NO. 14, SERIES OF 2001, OTHERWISE KNOWN AS “AN ORDINANCE SETTING FORTH RULES AND REGULATIONS TO GOVERN THE OPERATION, LICENSING AND SUPERVISION OF ALL COMPUTER RELATED ESTABLISHMENT/INTERNET STATIONS AND FOR OTHER PURPOSES”

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Section 2 of City Ordinance No. 14, Series of 2001 shall read as follows:

2.1 Shop-Keepers/Operators/Managers/Owners shall not allow minors (17 years old and below) during school hours to enter their facilities except in the following conditions:

v When parents, legal guardian or school officials accompany the minor;

v When the minor presents a valid permit duly authenticated by school principal or truant officers. The permit (in the format prescribed herein) must be properly filled up using ball pen or other non-erasable writing instrument, presented, verified, and notes specifying time of entry clearly written on the permit for inspection purposes. Failure of the Shop-keepers, Operators, Managers/Owners to write the minor's time of entry will be ground for Imposition of Fines, Suspension, Cancellation and or Non-Renewal of License as the case maybe.

2.2 Recommended maximum allowable playing time (per day) for MINORS:
v During School days two (2) hours;
v Weekends / Holidays four (4) hours;
v Students conducting research or writing reports/thesis must have such activity written in the permit in order to get exemption from time limits.
v College students needs only a signature of their parents or guardians and a valid school ID

2.3 Operators/Managers/Owners must not allow gambling, cybersex or other form of prostitution, consumption of intoxicating substances and other illegal activities in their establishment.

2.4 Minors must be released by Shop-Keepers/Operators/Manager/Owner thirty (30) minutes before curfew hours, except if parents or legal guardian accompanies the minor.

2.5 Provisions of Ordinance 46, Series of 1995 and Ordinance No.65, series of 2001 which prohibit the sale of liquors to minors and the sale of cigar and cigarettes shall be strictly enforced.

SECTION 2. Section 10 of City Ordinance No. 14, Series of 2001 shall read as follows:

10.1 Managers/Proprietors/Operators of Computer related establishment/Internet Stations are hereby required to execute an “Affidavit of Undertaking” to ensure that they will comply with the provisions, specifically Section 1 of Ordinance No. 78, Series of 2005 which pertains to minors and limitations of business activities set forth during the public hearing held on October 25, 2005 at FMA’s Hall, Olongapo City.

10.2 A modified sample of the Affidavit of Undertaking is hereto attached as an integral part of this Ordinance.

SECTION 3. Section 15 of City Ordinance No. 14, Series of 2001 shall include the following items and shall read as follows:

15.3 Officially designated inspectors from business permit office who fails to submit report after inspection and file appropriate charges to violators will be charged with dereliction of duty.

15.4 Entry of designated inspectors to Internet cafes must be recorded and web-casted by web camera for the Truant and Telecom Board officers to witness the on-going activity.

15.5 A section especially for minors shall be designated in each shop for effective monitoring of the same.

15.6 Under no circumstances shall customers of computer shops be allowed access to private office or secret space within the business establishment. Private rooms and cubicles without provision of glass see-through doors where both the customers and computer monitor is visible will not be tolerated and will subject the business to immediate closure.

15.7 The Office of the City Mayor, DSWD, Business Permit, Truant and/or Telecom Board officers shall have access to view individual internet cafe's web cam immediately upon receiving a report of suspicious or illegal activity. Shop-Keepers/Operators/Manager/Owner who refuses access will subject the business to penalties stipulated in this ordinance. Applicable provisions of Ordinance 33 series of 2002 also known as Truancy Ordinance shall be strictly enforced.

SECTION 4. Section 19 of City Ordinance No. 14, series of 2001 shall read as follows:

The City shall impose fines for violations of this Ordinance in accordance with the following schedules:

a) First offense - P5,000.00
b) Second offence - 1 week suspension of business permit
c) Third offense - 1 month suspension of business permit
d) 4th offense - cancellation of permit and 1-year closure

SECTION 5. Fraudulent or Tampered Permits

Faking and tampering of minor’s permit such as falsifying signature to gain access to internet shops will be penalized in accordance existing laws.

SECTION 6. Creation of Computer and Internet related Grievance and Investigation Committee

A committee composed of representatives from Mayor’s Office, Legal Office, Business Permit, CSWD, Telecom and IT Board, ABC, OCCSA and PTCA shall be created to conduct investigations and give necessary recommendations to the Mayor’s Office and City Council on Computer and Internet related offenses.

SECTION 7. All existing provisions of Ordinance No. 14, Series of 2001 which are not inconsistent with this Ordinance are still deemed valid.

AN ORDINANCE IMPLEMENTING THE MARIKIT PARK
RESTORATION PROJECT

SECTION 1. This project shall be called “Marikit Park Restoration Project”.

SECTION 2. This project is in coordination with the Office of the City Mayor and the Sangguniang Kabataan.

SECTION 3. Aims of the Project:

(a) To bring back the beauty and magnificence of “Marikit Park” as a recreational park;
(b) To develop the park as a formative site for the development of talents and skills such as theatrical skills, singing, dancing and sports activities;
(c) To make the park productive by captivating once more the private corporations, companies and tourists to use it for commercial purposes;
(d) To develop it to a more Child Friendly Park through additional playground equipment;
(e) To eradicate the park’s negative connotation by eliminating untoward and indecent activities;
(f) To obtain and uphold the trust of the people concerning the park’s security and invulnerability.

SECTION 4. Scope of the Project:

(a) Additional ornamental plants like rose, gumamela, orchid, bougainvillea, yellow bell, petunia and many others inside and outside the Marikit Park;
(b) Re-painting of the ground, fence, tables, benches, and basketball court;
(c) Additional lights to illuminate the park even in nighttime in line with Section 3, e;
(d) Placing canopies to provide additional shelter for park activities and;
(e) Additional playground equipment in line with Section 3, d as sponsored by SK;
(f) Placing of signage (for cleanliness, vandalism, theft).

SECTION 5.

(a) In line with Section 3,e, the City PNP with the Executive Order coming from the City Mayor with regard to RA 6975, shall designate Police Officer everyday, one in the morning and one in the evening from 8:00 A.M. to 9:00 P.M. to assure safety among the people in the park;
(b) To avoid violence of any forms in the park, there shall be opening and closing time with exemption provided by the adjacent section.

SECTION 6. The “Marikit Park” shall be open from 8:00 A.M. to 9:00 P.M. everyday, except if it will be used for the following purposes:

(a) Commercial Purposes like concerts, organizational activities and all profitable activities;
(b) Religious Purposes like evangelization and any non-profitable activities.
(c) Civic Activities like sports leagues and public service activities.

In the aforementioned activities, a permit shall be secured from the office of the City Mayor, and assistance from the PNP shall be given to assure security.

SECTION 7. There shall be a daily cleaning activity, with exemption on Sundays; three (3) shifts a day; opening time, noon and closing time. This is in accordance with Ordinance No. 21, S. 1997 otherwise known as an “Ordinance Prescribing Rules and Regulations for the Use

and Maintenance of Public Parks, Plazas and Playgrounds in the City of Olongapo and for Other Purposes.”

SECTION 8.. Effectivity. This shall take effect upon its approval.

WHEREAS, sometime September 2004, a public hearing was set to tackle on the impending fare increase for tricycles for hire from Php3.50 to Php5.00;

WHEREAS, during the said hearing the Tricycle For Hire (TFH) owners and operators agreed to pay the fare adjustment fee of Php300.00 per tricycle unit (d of Section 9, Ordinance 29, Series of 1992) to be collected upon the yearly renewal of their franchises;

WHEREAS, however, due to the high cost of gasoline, diesel and petroleum products that impact the very cost of living, it is deemed that fares in tricycles be adjusted once more. This time, from Php5 to Php7.50;

WHEREAS, in the public hearing set for the abovementioned increase, drivers, operators aired their concern regarding the proposed suspension of the fare adjustment fee of Php300.00 for this particular tariff, so that, they, too, as well can cope up with the crisis of the times;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the members of the Sangguniang Panlungsod present,

AS NATIONAL BOOK WEEK IN OLONGAPO CITY

WHEREAS, Proclamation 109 designates the period from November 24-30 as National Book Week;

WHEREAS, the Local Government Code mandates the LGU’s to ensure and support among other things the preservation and enrichment of culture;

WHEREAS, the reading of good books or the printed page is one of the most effective methods of bringing enlightenment within the reach of the largest possible number of people, and or promoting the cause of popular culture with its tremendous social benefits;

WHEREAS, it is desirable that the task of arousing a widespread interest in the reading of good books be recognized highly as a patriotic duty as well as a privilege;

WHEREAS, the City of Olongapo celebrates Book Week from November 24-30, 2005 and includes the following suggested activities;

1. Announcement of National Book Week during the flag ceremony and message from the City Mayor;
2. Mounting of streamers and putting up of pylons to announce the events;

WHEREAS, Olongapo is the home city of Mr. Patrick John Tierro, a 17 year old boy, whose family roots from his grandfather has been a source of pride for the city;

WHEREAS, Patrick John Tierro from his younger age has been amassing awards and distinctions as a young athlete in the tennis arena;

WHEREAS, now he is to compete not only in the national games but representing our country, Philippines to the Southeast Asian Games to be held this November to December 2005 in Manila;

WHEREAS, the untiring effort of Patrick John in this field of athletics is a model to be emulated especially by other aspiring youth;

WHEREAS, it is the desire of the city to support this kind of unwavering show of determination and strength and to boost the morale of this young boy as well as his equally supportive parents;

WHEREAS, the Constitution of the Philippines mandates that the state shall take into account regional and sectoral needs and condition and shall encourage local planning in the development of educational policies & programs;

WHEREAS, the curriculum of the higher education program should be attuned with the need of the industry since labor and employment is one of the main goals after graduation;

WHEREAS, Subic Bay Freeport Zone, an economic hub is the biggest industry and main source of employment for the people of Olongapo;

WHEREAS, Colleges in the City of Olongapo accumulatively produced thousand of graduates every year to be unfortunately included in the rosters of unemployed and underemployed not because there are no job opportunities but their educational qualifications do not match with the needs of the companies operating inside Subic Bay Freeport Zone;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to request, as it hereby requests the Subic Bay Metropolitan Authority to present to the City Government of Olongapo and to the Colleges/Universities operating in the said city the projected human resources requirement of the Subic Bay Freeport Zone for the next five to ten years.

A RESOLUTION SUPPORTING THE PASSAGE OF SENATE BILL NO. 2042 OTHERWISE KNOWN AS “AN ACT REQUIRING THE REGISTRATION OF SUBSCRIBER IDENTITY MODULE (SIM) CARDS IN MOBILE PHONES
AND HOUSE BILL NO. 2559 ENTITLED “AN ACT REQUIRING THE REGISTRATION OF PRE-PAID SIM CARD USERS AND MOBILE
PHONE UNITS AND FOR OTHER PURPOSES”.

WHEREAS, Mobile phones are useful and convenient tool of modern life;

WHEREAS, while mobile phones have brought us speed and efficiency in our transactions, unscrupulous individual take advantage of the technology by using it as a tool for their illegal activities to the point where terrorist utilize this device to detonate explosives;

WHEREAS, Senator Richard J. Gordon introduced Senate Bill No. 2042 otherwise known as “An act requiring the registration of Subscriber Identity Module (SIM) cards in mobile phones”, while Congressman Rozzano Rufino B. Biazon authored House Bill No. 2559 entitled “An act requiring the registration of Pre-paid SIM card users and mobile phone units and for other purposes”;

WHEREAS, the proposed act aim to regulate the ownership and use of SIM cards for legitimate purposes, to promote the general welfare and protection of the public and it will also promote responsibility and accountability in the use of SIM cards in mobile phones;

RESOLUTION NO. 153

A RESOLUTION CONVEYING DEEPEST SYMPATHIES TO THE BEREAVED FAMILY OF THE LATE CITY COUNCILOR JULIAN MOLAS BUENAFE, JR.

WHEREAS, Hon. Julian M. Buenafe, elected City Councilor of Olongapo from 1992 to 2001, peacefully joined his creator last November 7, 2005;

WHEREAS, as public servant, he handled the Committee on Police and Public Safety and had passed important legislative agenda that greatly helped the city’s endeavors to fight criminality wherein the city’s peace and order is known for;

WHEREAS, he is one of the most loved and respected Councilors of Olongapo City, who had devoted his life for public service from 1988 to 1992. He was first elected as Barangay Kagawad of Barangay Barretto, Olongapo City and was once an Organic Civilian Agent, DND, GH, AFP, Headquarters Intelligence Service from 1980 to 1991;

WHEREAS, Kagawad “Jun” Buenafe, as he is known, came from a prominent family of pioneer businessmen operating popular beach resort and entertainment business;

WHEREAS, the City Council acknowledges Councilor Julian “Jun” Buenafe’s leadership, dedication and devotion to public service;

WHEREAS , the City Council joins the entire Buenafe family in their moment of pain and grief and prays that God’s love will sustain them;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,
